1. Resolution Declaring an Emergency for the Glenwood Drive Slide Pursuant to Public Contract Code §1102 and Authorizing the City Manager to Cause the Repair of the Slide Pursuant to Public Contract Code §§22035 and 22050.

City Manager LaGoe presented this item and responded to questions from the Council. Senior Civil Engineer Dat Nguyen was also in attendance to answer questions. City Manager LaGoe explained on November 12, 2025, the City experienced a significant storm associated with an atmospheric river, producing nearly three inches of rainfall in 24 hours which caused debris accumulation and blockage of roadside inlets, which impeded stormwater flow. The uncontrolled stormwater along the east edge of Upper Glenwood Drive combined with sheet runoff, saturated the soil and caused a mudslide affecting approximately 30 linear feet of the roadway, undermining the pavement, and creating hazardous conditions. In addition, the bike lane was undermined by approximately two feet, requiring closure and forcing bicyclists to share the roadway with vehicles and a water main became exposed creating a risk of catastrophic failure that could disrupt water service to nearby neighborhoods. These conditions pose an immediate threat to public health, safety, and property, necessitating rapid emergency action to stabilize the site, assess hazards, and implement temporary and permanent repairs.

She explained that declaring this emergency will allow for the solicitation of a bid without the typical delay experienced from the competitive bid process, and she reiterated that this action is necessary for a timely response to the emergency.

M/S: Lind/Clark
To adopt Resolution No. 2076, a resolution of the City Council of the City of Scotts Valley declaring an emergency for the Glenwood Drive slide pursuant to the Public Contract Code §1102 and authorizing the City Manager to cause the repair of the slide pursuant to Public Contract Code §§22035 and 22050.
