SUBJECT: Homeland Security Grant Program Agreement for Transfer or Purchase of Equipment and Services for Reimbursement of Operation Costs for Fiscal Year 2022 Operation
Stonegarden
________________________________________________________________ SUMMARY OF REQUEST:
That the City Council adopt Resolution 7463:
1. Authorizing the Chief of Police to execute an agreement on the City’s behalf for transfer or purchase of equipment and services for reimbursement of operating costs for FY 2022; and,
2. Authorizing any further actions necessary for the purpose of obtaining federal financial assistance provided by the Department of Homeland Security – Federal Emergency Management Agency (FEMA) and subgranted through the Riverside Sheriff’s Department in connection with the Operation Stonegarden (OPSG) Homeland Security Grant Program.
BACKGROUND AND ANALYSIS:
The Department of Homeland Security (DHS), via the Homeland Security Grant Program, has allocated funds for use by local governments to increase coordination and enforcement capabilities in support of DHS goals, including those outlined in the Border Patrol National Strategy. As law enforcement partnerships between federal, state, and local entities are critical to improving operational control of the border, the City of Seal Beach is eligible to receive financial assistance in the form of reimbursement for equipment purchases, maintenance costs, overtime, and management and administration costs incurred, through the Riverside Sheriff’s Department sub-grants from the State of California.
During the most recent OPSG grant cycle, Seal Beach Police Department applied for and was awarded funding to provide increased law enforcement patrols and special operations throughout the 1.5 miles of coastline, coastal access points, and flood control access points in the jurisdiction of Seal Beach, in an effort to reduce
smuggling and marine interdiction related crimes. Additionally, funding was awarded to purchase Automated License Plate Reader (ALPR) cameras to be placed at high traffic areas along the coastline. The special operations and ALPR cameras will show high levels of law enforcement presence and serve as a criminal deterrent to help maintain coastal borders, and can lead to drug and vehicle seizures, as well as arrests. In addition, a portion of the funding will go towards the purchase of a new black and white patrol vehicle to be used during these operations.
ENVIRONMENTAL IMPACT:
There is no environmental impact related to this item.
LEGAL ANALYSIS:
The City Attorney has reviewed and approved as to form.
FINANCIAL IMPACT:
The City of Seal Beach may receive OPSG grant funds in the form of training, equipment, or support. The designated funding for Seal Beach Police Department from the current OPSG cycle is $145,570, to be used as follows:

SUBJECT: Resolution to Deny General Plan Amendment (GPA) 19-1 That Would Have Changed the Land Use Category of the
Property at 328 13th Street from Residential High-Density to General Commercial and to Deny Zone Change (ZC) 19-1 That Would Have Changed the Zone of the Property Located at 328 13th Street from RHD-20 to GC and the Zone of the Property Located at 324 13th Street from RHD-20 to RHD-33 ________________________________________________________________ SUMMARY OF REQUEST:
That the City Council Approve Resolution 7464 to Deny GPA 19-1 That Would Have Changed the Land Use Category of the Property at 328 13th Street from Residential High-Density to General Commercial, and to Deny ZC 19-1 That Would Have Changed the Zone of the Property Located at 328 13th Street from RHD-20 to GC and the Zone of the Property Located at 324 13th Street from RHD-20 to RHD-33.
BACKGROUND AND ANALYSIS:
A public hearing was held before the City Council on October 23, 2023 to consider GPA 19-1 and ZC 19-1, which were part of a development application (Project) for 1300 Pacific Coast Highway and 328 13th Street. The proposed Project was heard before the Planning Commission on May 15, 2023 and September 5, 2023, with the Planning Commission conditionally approving Conditional Use Permit (CUP) 19-7 and Variance 22-1 to allow the reconstruction of the existing gas station and addition of a 1,200 square foot convenience store.
At the same meeting, the Planning Commission recommended that the City Council approve General Plan Amendment (GPA) 19-1 and Zone Change (ZC) 19-1, which were necessary to facilitate the proposed Project. Specifically, the parking lot at 328 13th Street, currently with a land use and zoning designation of residential, would need to be rezoned for commercial use to be incorporated into the proposed Project. The adjacent residential lot at 324 13th Street was also proposed to be rezoned to a higher density zoning to accommodate the loss of the one residential parcel in keeping with State laws to not reduce residential
development capacity. The Planning Commission’s approval of CUP 19-7 and Variance 22-1 was conditioned upon the City Council’s approval of GPA 19-1 and ZC 19-1.
At the October 23, 2023 City Council meeting, by a 4-1 vote the City Council determined that the GPA and Zone Changes would not be in the best interest of the City because, among other reasons, they would result in a commercial use— a convenience store—encroaching further into a residential neighborhood with narrow streets. In addition, eliminating the Residential High-Density Designation and Zoning on the property at 328 13th Street would limit the opportunity for housing development on that parcel.
Tonight’s action is the adoption of Resolution 7464, memorializing the City Council’s decision and formally denying the Project’s GPA and Zone Changes.
The Council has already made a determination on the Project, and Resolution 7464 formalizes it for the record. The Project’s CUP and Variance will be void and have no effect as a result of this action.
ENVIRONMENTAL IMPACT:
In compliance with the California Environmental Quality Act, Cal. Pub. Res. Code § 21000 et seq. (“CEQA”) and the State CEQA Guidelines 14 C.C.R. § 15000 et seq., a Negative Declaration was prepared for GPA 19-1 and ZC 19-1. The Negative Declaration found that proposed GPA and Zone Change would not have a significant effect on the environment. RESOLUTION 7464
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH TO DENY GENERAL PLAN AMENDMENT 19-
1 THAT WOULD HAVE CHANGED THE LAND USE
CATEGORY OF 328 13TH STREET FROM RESIDENTIAL
HIGH-DENSITY TO GENERAL COMMERCIAL AND TO DENY
ZONE CHANGE 19-1 THAT WOULD HAVE CHANGED THE
ZONE OF THE PROPERTY LOCATED AT 328 13TH STREET
FROM RHD-20 TO GC AND THE ZONE OF THE PROPERTY
AT 324 13TH STREET FROM RHD-20 TO RHD-33
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY FIND AND RESOLVE AS FOLLOWS:
Section 1. A duly noticed public hearing was held before the City Council on October 23, 2023 to consider the proposed Negative Declaration (including Initial Study and related Appendices) and the application for: (1) GPA 19-1, a request to amend the Land Use Map of the City’s General Plan to change the land use designation of the property located at 328 13th Street from Residential High Density to General Commercial; and (2) Zone Change 19-1, which would amend the City’s Zoning Map to change the zoning designation of the property located at 328 13th Street from RHD-20 (Residential High Density – 20 units per acre) to GC (General Commercial) and to change the zoning designation of the property located at 324 13th Street from RHD-20 (Residential High Density – 20 units per acre) to RHD-33 (Residential High Density – 33 units per acre).
Section 2. At the aforementioned hearing, all interested parties, including the applicant, were given the opportunity to be heard and to present evidence. The City Council received and considered all evidence presented, both written and oral, regarding the subject application.
Section 3. GPA 19-1 and Zone Change 19-1 are part of a development application (Project) that was heard before the Planning Commission on May 15, 2023 and September 5, 2023, for which the Commission conditionally approved Conditional Use Permit 19-7 and Variance 22-1 to allow the reconstruction of the gas station at 1300 PCH and 328 13th Street, with the addition of a 1,200 square foot convenience store; and for which the Commission recommended that the City Council approve GPA 19-1 and Zone Change 19-1. The Planning Commission’s approval of Conditional Use Permit 19-7 and Variance 22-1 was conditioned upon the City Council’s approval of GPA 19-1 and Zone Change 19-1.
Section 4. No findings are required for legislative acts such as a General Plan Amendment and a Zone Change. However, the City Council finds that the GPA and Zone Change to change the land use category and zoning of the property at 328 13th Street to General Commercial would not be in the best interest of the City because it would result in a commercial use—a convenience store—encroaching further into a residential neighborhood with narrow streets. In addition, eliminating the Residential High-Density Designation and Zoning on the property would limit the opportunity for housing development on a vacant parcel at 328 13th Street.
Section 5. In compliance with the California Environmental Quality Act, Cal. Pub.
Res. Code § 21000 et seq. (“CEQA”) and the State CEQA Guidelines 14 C.C.R. § 15000 et seq., a Negative Declaration was prepared for GPA 19-1 and Zone Change 19-1. The Negative Declaration found that proposed GPA and Zone Change would not have a significant effect on the environment. However, pursuant to Guidelines Section 15061(b)(4), a project that is denied or rejected by the City is exempt from the requirements of CEQA.
Section 6. The Seal Beach City Council hereby denies GPA 19-1 and Zone Change 19-1.
Section 7. As a result of the City Council’s denial of GPA 19-1 and Zone Change 19-1, the Planning Commission’s conditional approval of Conditional Use Permit 19-7 and Variance 22-1 is hereby void and of no force or effect.
Section 8. The documents, staff reports, technical studies, appendices, plans, specifications, and other materials that constitute the record of proceedings upon which this Resolution is based are on file for public examination during normal business hours at the Community Development Department, City of Seal Beach City Hall, 211 8th Street, Seal Beach, CA 90740.

7. Authorizing the City Manager to execute Amendment No. 1.
BACKGROUND AND ANALYSIS:
On August 24, 2023, the Public Works Department was notified of a water break at the intersection of Seal Beach Boulevard and Marlin Avenue. Staff responded and were unsuccessful in establishing a secure shutdown without significantly affecting water service to the surrounding community, including McGaugh Elementary School. Due to the location of the break and the unworkable configuration of the water system in the immediate area, the Director of Public Works declared an emergency on the basis of immediate preservation of life, health, and property of the City. Staff mobilized Valverde Construction, Inc. (Valverde), one of the City’s existing on-call contractors, for this emergency work.
The work started on August 24, 2023 and was substantially completed within nine days. The construction included the installation of five line stops and three water valves at two locations along Seal Beach Boulevard, and the relocation of a conflicting hydrant service line at the intersection of Seal Beach Boulevard and Bolsa Avenue. Repaving and striping commenced approximately two weeks later.
Valverde’s total cost to complete this emergency work was $256,456.15, which exceeds the Public Works Department Director’s signing authority limit of $40,232.
Therefore, staff is requesting authorization to issue a purchase order in the amount of $256,456.15 for the work completed based on the emergency declaration as an exception to the competitive bidding process.
On March 8, 2021, the City Council adopted Resolution 7117 awarding a professional maintenance agreement to Valverde to provide on-call emergency and unexpected task utility maintenance and repair services for a three-year term.
Due to the amount of the emergency repair, the Agreement’s $300,000 compensation limit being fully encumbered, and in anticipation of unforeseen maintenance and repair services, an increase to the Agreement’s compensation limit is recommended. As such, Amendment No. 1 to the professional maintenance agreement would increase the Agreement’s not-to-exceed limit to $750,000.
ENVIRONMENTAL IMPACT:
This project complies with all requirements of the California Environmental Quality Act (CEQA) and is categorically exempt under Section 15301 Class 1 subsection (b) of the CEQA Guidelines.
LEGAL ANALYSIS:
The City Attorney has approved the agreement and resolution as to form.
