The implementation assistance will include legislative research, compliance tracking/reporting, and providing general solid waste, recycling, and organics liaison assistance.
The City has an exclusive franchise agreement with Republic Services to provide solid waste and recycling services. Over the past several years, the City undertook numerous efforts to comply with current state unfunded mandates such as Assembly Bill (“AB”) 341 (Mandatory Commercial Recycling), AB 1826 (Mandatory Organic Commercial Recycling) and AB 1594 (Green Material used as Alternative Daily Cover). The City’s franchise agreement was amended to codify these regulations and the resulting rate changes, where applicable. On January 24, 2022, the City Council adopted Ordinance 1692 adding Chapter 6.25 (Mandatory Organic Waste Disposal Reduction) to Title 6 of the Seal Beach Municipal Code to implement the requirements of Senate Bill 1383.
In September 2016, Governor Brown signed SB 1383, which established methane emissions reduction targets for short-lived climate-pollutants (SLCP) in various sectors of California’s economy. SB 1383 establishes a target to achieve a 50 percent reduction in statewide disposal of organic waste from 2014 levels by 2020 and a 75 percent reduction by 2025. The law grants CalRecycle the regulatory authority to achieve the organic disposal reduction targets. In 2020, CalRecycle adopted regulations requiring organic waste recycling from every waste generator, which includes residences, businesses, and government entities, and established an additional target that not less than 20 percent of currently disposable edible food is recovered for human consumption by 2025.
Local jurisdictions, including the City of Seal Beach, must implement SB 1383, which will require extensive coordination with multiple stakeholders. The requirements include:
1. Providing organic collection services to all residents and businesses.
2. Establishing a food recovery program to recover edible food that hasn’t gone to waste.
3. Conducting education and outreach efforts to all affected parties including residents, city departments, waste generators, businesses, haulers, solid waste facilities, local food banks, and other edible food recovery organizations.
4. Evaluating the City’s readiness to implement SB 1383 and conducting capacity planning related to collection and recycling.
5. Procuring recycled organic waste products.
6. Maintaining accurate records and submitting reports to the State.
7. Ensuring compliance with SB 1383 through enforcement.
The City is also in negotiations with Republic Services to update the solid waste and recycling franchise agreement which was last updated in 1997. As part of this agreement, HF&H will develop an updated franchise agreement to reflect the negotiated terms with Republic.
Staff recommends awarding a contract to HF&H Consultants, LLC, based on its experience and expertise in the solid waste industry, as well as its familiarity with Seal Beach derived from the work performed for the City regarding AB 1594 and AB 1826.
ENVIRONMENTAL IMPACT:
This item is not subject to the California Environmental Quality Act (“CEQA”) under Section 15061(b)(3) of the state CEQA Guidelines because it can be seen with certainty that approval of a Professional Services Agreement with HF&H Consultants for SB 1383 Contracting Assistance will not have a significant effect on the environment.
Environmental impacts related to adoption of a new or amended franchise agreement or other implementation efforts will be assessed under separate efforts.
LEGAL ANALYSIS:
The City Attorney has reviewed the agreement and approved the resolution as to form.
FINANCIAL IMPACT:
The total amount of the agreement is $115,000. The City was awarded two (2) grants from the State of California through the SB 1383 Local Assistance Grant Program. The first grant (OWR2) amounts to $33,074 and the second grant (OWR4) amounts to $75,000 for a total amount of grant funds of $108,074. The remaining balance of $6,926 is currently budgeted in fund 104-110-0011-51280.

AGENDA STAFF REPORT
DATE: June 10, 2024
TO: Honorable Mayor and City Council
THRU: Jill R. Ingram, City Manager
FROM: Michael Henderson, Chief of Police
SUBJECT: Seal Beach Police Department Renewal Purchase of Axon Body Worn Camera System, Patrol Vehicle Camera System,
and Integrated TASER 10 System
________________________________________________________________ SUMMARY OF REQUEST:
That the City Council adopt Resolution 7531:
1. Approving an agreement between the City of Seal Beach and Axon Enterprise, Inc. for the purchase of Body Worn Cameras, in-dash camera system, TASER 10s, accessories and associated programs; and,
2. Authorizing the City Manager to execute the agreements and any necessary documents, amendments, and extensions on behalf of the City of Seal Beach.
BACKGROUND AND ANALYSIS:
On July 20, 2020, the City Council approved Resolution 7059, approving the purchase of Axon Body Worn Cameras (“BWCs”), a patrol vehicle camera system, and an Integrated TASER 7 System. The approved agreement under Resolution has a term of five (5) years, with an end date of July 20, 2025.
In February 2024, staff began working with Axon on a quote for the 2025 renewal.
During the process, the City negotiated a discounted 10-year term with Axon that would absorb the final year of the current contract and ensure set pricing and savings. Due to rising costs, several other cities have chosen the 10-year term option, as it provides more stability and allows cities to lock in rates at the current price point.
The 10-year agreement (“Agreement”) provides updated hardware for BWCs, patrol vehicle cameras, TASERs, and for the associated accessories at the onset of the Agreement as well as during preset “refresh” periods throughout the term to ensure against failures related to aging technology or devices.
Fleet Cameras
The new contract includes an upgrade of fleet cameras for all twelve patrol vehicles. The currently installed fleet cameras have a forward and rear facing camera. The new fleet camera system includes upgraded panoramic cameras with dual view of recording video and Infrared Radiation (IR) for better visibility in darkness. These new fleet systems also include Automated License Plate Reader (ALPR) camera technology, integrating 4K ALPR cameras that cover three (3) traffic lanes and provide officers with real-time awareness. The installation cost for these new fleet cameras for twelve patrol vehicles is included in the contract pricing.
Body Worn Cameras
As part of the July 20, 2020, contract, the City purchased 50 Axon Body 3 BWCs, the necessary accessories, and software licenses. Subsequently, the City purchased two additional Body 3 BWCs and licenses to ensure all personnel were equipped with the technology. The new contract includes 52 BWCs of Axon’s newest technology, the Body 4 model, and all necessary accessories for operation.
The Body 4 model includes a larger battery for longer battery life, an upgraded 5MP camera sensor, increased visibility with a 4:3 aspect ratio and increased 160- degree field of view.
Taser Technology
The 2020 contract upgraded department staff to the Axon Taser 7, a non-lethal taser device that integrated with the Axon software systems. The proposed contract includes 50 Taser 10 devices, the newest taser model offered by Axon.
The Taser 10 has a maximum range of 45 feet, an increase in range over the Taser 7 by almost double the distance, which provides officers with more time and space to de-escalate and resolve conflicts. Should de-escalation fail, the Taser 10 can deploy up to 10 individually charged targeted probes without the need to reload and includes advancements in accuracy and effectiveness, including a more visible green laser to improve daylight scenarios. Lastly, the Taser 10 is certified to operate after being fully submerged in up to 1 meter of water for up to 30 minutes, ensuring its effectiveness against all elements.
During the four (4) years since the City has acquired this technology, it has improved officer safety, reduced agency liability, reduced and resolved citizen complaints, increased evidence quality (assisting in prosecution of cases), improved agency accountability and officer professionalism, worked to improve community perceptions, significantly simplified critical incident review processes, improved training opportunities, reduced use of force incidents, and illustrated the City’s efforts at transparency.
ENVIRONMENTAL IMPACT:
There is no environmental impact related to this item.
LEGAL ANALYSIS:
The City Attorney has reviewed and approved as to form.
FINANCIAL IMPACT:
The purchase of Axon products is presented as a 10-year plan, which includes the cost of equipment, unlimited cloud based storage, warranty replacements, and maintenance. The 10-year fixed costs are as follows:
Subtotal Per Year Total Per Year
Estimated w/Tax
Year 1 $ 130,000.00 $ 135,868.76
Year 2 $ 172,424.96 $ 179,103.56
Year 3 $ 172,424.96 $ 179,103.56
Year 4 $ 172,424.96 $ 179,103.56
Year 5 $ 172,424.96 $ 179,103.56
Year 6 $ 172,424.96 $ 179,103.56
Year 7 $ 172,424.96 $ 179,103.56
Year 8 $ 172,424.96 $ 179,103.56
Year 9 $ 172,424.96 $ 179,103.56
Year 10 $ 172,424.96 $ 179,103.56
$1,681,824.64 $1,747,800.77
The total cost of the program for the 10-year term is $1,747,800.77, which includes annual ongoing costs of $179,103.56 per year for Year 2 thru 10.
The FY 2024-2025 Proposed Budget includes funding for Year 1 costs, which is estimated to be less than the July 20, 2020 contract agreement Year 5 cost of $142,981 due to staff negotiated contract costs through budget implementation.
Additional costs are spread across Years 2 through 10 and equate to an annual estimated fixed increase of $36,122.56 per year compared to current contract costs, which represents costs of service but includes a significant discount to the city for early renegotiation and fixed pricing.
The City was able to secure a 10-year contract with no increase to the annual maintenance costs per year. Therefore, the remaining contract balance will be budgeted in future years. Additionally, staff recommends the costs in Years 2 through 10 continue to be reallocated to the City’s Information Technology Operating Budget under the Police Department, as this is an annual reoccurring costs and a new contract will be necessary when the current proposed agreement expires. If the proposed agreement is approved, Years 2 through 10 will be
budgeted in the City’s Information Technology Police Department Operating Budget in the General Fund in future years.
Currently only two of the twelve patrol fleet vehicles are equipped with ALPR technology. The cost to outfit each patrol vehicle, independent of Axon, is $8,000 with additional recurring fees each year per vehicle for licensing. The new Axon fleet cameras installed under this contract will fully equip all patrol vehicles with ALPR technology, a cost savings of over $80,000 compared to independently equipping vehicles, and this amount is included in the proposed agreement.
Additionally, there is the potential for cost savings from the reduction of claims and claims costs, which is a factor in reducing the City’s contribution premium.
Although there is no direct contribution reduction for the implementation of risk management measures, i.e., the use of the cameras, if the cameras assist with the reduction of frequency and severity of liability claims, which in turn, reduces the overall claims and claims costs, this could reduce the City’s overall contribution.
STRATEGIC PLAN:
This item is not applicable to the Strategic Plan.

AGENDA STAFF REPORT
DATE: June 10, 2024
TO: Honorable Mayor and City Council
THRU: Jill R. Ingram, City Manager
FROM: Michael Henderson, Chief of Police
SUBJECT: Seeking City Council Approval of the Use of Data Ticket Inc., for the Processing of Administrative Citations for the City of Seal Beach and Consideration of an Agreement with Data Ticket Inc. for this Purpose
________________________________________________________________ SUMMARY OF REQUEST:
That the City Council adopt Resolution 7532:
1. Approving the agreement with Data Ticket Inc., for the processing of Administrative Citations for the City of Seal Beach; and,
2. Authorizing the City Manager to execute this agreement on the City’s behalf.
BACKGROUND AND ANALYSIS:
The City of Seal Beach would benefit from the use of Data Ticket Inc. to process Administrative Citations issued by authorized city staff. Any violation of the Municipal Code may be prosecuted through the administrative citation procedure, if it is not prosecuted as a misdemeanor or infraction.
In accordance with Sections 1.15.010 and 1.15.015 of the Seal Beach Municipal Code, code enforcement officers are authorized to issue administrative citations, which includes city personnel designated by the City Manager to issue administrative penalties for provisions of the Municipal Code that they are authorized to enforce. Depending on the type of code violation, this would include police officers, lifeguards, and designated code enforcement officers.
The administrative citation process requires service of the citation upon the responsible party and the opportunity for the responsible party to challenge the imposition of the citation through an administrative hearing process. This process can be time consuming and burdensome for City staff.
With the assistance of Data Ticket Inc., the administrative citation process will become more streamlined, without the added work for current Seal Beach Police Department or City Hall staff.
Administrative Citations will assist the Seal Beach Police Department achieve the following goals: To protect the public health, safety and welfare of the citizens of the City; To gain compliance with the Seal Beach Municipal Code, ordinances, agreements, and regulations of the City; To provide for an administrative process to appeal the imposition of administrative citations and fines; To provide a method to hold parties responsible when they fail or refuse to comply with the provisions of the Seal Beach Municipal Code, ordinances, agreements, or terms and conditions of entitlements or permits enacted or approved pursuant to the police power; To avoid or minimize the expense and delay of enforcement in the civil or criminal justice system.
Administrative Citations are issued by designated personnel primarily to gain compliance with the Seal Beach Municipal Code, ordinances and regulations in a timely and efficient manner, as well as to protect the public health, safety and welfare of its citizens. Typically, an Administrative Citation program is established as an alternative enforcement tool to address certain Municipal Code violations.
As an alternative to criminal prosecution in specified circumstances, use of the Administrative Citation could include open alcoholic beverages on public beaches, beach curfew, dog at large, or other public nuisance violations. It is also regularly used for violations of zoning regulations and the building codes.
This program provides a method to hold parties responsible when they fail or refuse to comply with these provisions and minimize the expense and delay where otherwise the sole remedy would be to pursue the responsible party in the civil or criminal justice system. They also allow the City to partially recover its costs to bring the responsible party into compliance. Repeat offenders are also subject to increased fines and possible misdemeanor charges. Administrative penalties shall be set forth in a penalty schedule established by City Council resolution and shall be payable directly to the City.
Data Ticket would assist the City with processing administrative citations, collection of applicable penalties by authorized means, and, if necessary, assisting with the conduct of administrative hearings for persons who desire to challenge the issuance of an administrative citation.
