CITY OF SEASIDE

STAFF REPORT
Item No.: 8.B.

TO: City Council
FROM: Jaime M. Fontes, City Manager
BY: Dan Meewis, Recreation Director
DATE: March 16, 2023
SUBJECT: ADOPT A RESOLUTION AUTHORIZING THE CLOSURE OF

BROADWAY AVENUE TO THROUGH TRAFFIC FROM FREMONT

BOULEVARD TO DEL MONTE AVENUE, AND ASSOCIATED SIDE

STREETS AS WELL AS THE WEST BOUND LANES OF FREMONT

BOULEVARD FROM CLEMENTINA AVENUE TO AMADOR STREET,
FOR THE EXOTICS ON BROADWAY EVENT ON AUGUST 19,
2023

RECOMMENDATION
Adopt a resolution permitting the closure of Broadway Avenue to through traffic from Fremont Boulevard to Del Monte Boulevard, and associated side streets, as well as the west bound lanes of Fremont Boulevard from Clementina Avenue to Amador Street to ensure public safety during the Exotics on Broadway event on Saturday, August 19, 2023.

BACKGROUND
Exotics on Cannery Row, LLC, has submitted an application to hold an Exotics on Broadway Event on Broadway Avenue on Saturday, August 19, 2023 from 1:00 p.m. to 6:00 p.m., with setup and clean up hours as 5:00 a.m. to 12:00 a.m. They are requesting the closure of Broadway Avenue from Fremont Boulevard to Del Monte Boulevard and associated side streets, including Calaveras Street, Alhambra Street, Hillsdale Street and Contra Costa Street from the alleyways, both north and south of Broadway, towards Broadway Avenue, as well as the west-bound lanes of Fremont Boulevard from Clementina Avenue to Amador Street for their display of exotic cars.

The closure of Broadway Avenue from Fremont Boulevard to Del Monte Boulevard, as well as the west-bound lanes of Fremont from Broadway Avenue to Amador Street will allow 200-300 exotic cars to be shown, as well as amenities to complement the event, like a stage, bands, vendors, porta-potties, etc.

Packet Page 15

Item No. 8.B. Page 2 of 3
In 2018, Exotics on Cannery Row outgrew its former location, with crowds estimated in the thousands. However, in 2019, Exotics on Cannery Row LLC held their first annual Exotics on Broadway in Seaside with great success. In 2020 Exotics on Broadway, was poised to come back to Seaside. However, that was at the height of the pandemic, and the show was canceled. Exotics on Broadway made their return to Seaside in 2022, and that show saw some of the largest crowds out of any of the shows during car week, and it featured an extension that utilized the west bound lanes of Fremont Avenue. It is expected that the 2023 show will exceed the attendance of 2022, as it is known as the best free car show on the peninsula.

Typically, during Car Week, Seaside has been a low-key destination for tourists. Exotics on Broadway now offers an opportunity for a free high quality show, which is very popular with locals and tourists, and it has made Seaside a premier destination during Car Week. This event would enhance exposure of Broadway and other Seaside businesses to generate revenue, particularly from food and beverage sales. Several Broadway businesses have mentioned support of this type of event.

The approval of this request for Exotics on Broadway will support the City Council Strategic Priorities of:
• Diverse and Inclusive Community
• Community Safety & Quality of Life

FISCAL IMPACT
Cost Estimate for staff time and resources:

Medical Standby - Three personnel $2,882.88
Police Department - Three Officers
Assigned to Event
$2,089.50
Public Works
Labor & Vehicles, Rental of City Traffic
control, UBER.Bus sign
$6,300.00
TOTAL $11,272.38

RECOMMENDATION
If the City Council approves the request for closure of Broadway Avenue from Fremont Boulevard to Del Monte Boulevard, and associated side streets, as well as the westbound lanes of Fremont Boulevard from Clemintina Avenue to Amador Street on Saturday, August 19, 2023 between the hours of 5:00 a.m. to 12:00 a.m. staff recommends the following conditions be met:

RECOMMENDATION
Adopt a resolution authorizing an amendment to the professional services agreement with La Neta Murals for an amount not to exceed $3,000.00

BACKGROUND
At the January 5, 2023 Regular City Council Meeting, the proposed conceptual design of the fire station mural was presented for the first time. On January 11, 2023, La Neta Murals met with City Staff to discuss changes to the conceptual design. The Fire Department made additional recommendations based on the relevancy of apparatus style, personnel, and types of incidents. A depiction of Martin Luther King Jr. was also included in the recommendations. On February 13, 2023, the Fire Department and City Staff met a second time with La Neta to review the recommended changes and modifications to what was presented to City Council on January 5, 2023.

BY: City Manager

DATE: March 16, 2023
SUBJECT: ADOPT RESOLUTION RATIFYING DECLARATION OF LOCAL

EMERGENCY DUE TO THE PINEAPPLE EXPRESS ATMOSPHERIC

RIVER STORMS

RECOMMENDATION
Adopt a resolution ratifying a declaration of Local Emergency.

BACKGROUND
When a local emergency is proclaimed by the Director of Emergency Services, the City Code requires that it be submitted to the City Council for ratification at the earliest possible time. City staff will return to the Council on a timely basis to request any necessary extensions of the proclaimed local emergency. This item request Council approval to ratify the local state of emergency as a result of damages (known and unknown) to roads and other City property from the December 2022 and January 2023 Atmospheric River Storm events that have occurred and are ongoing.

While the City of Seaside generally has weathered the storms well, our Storm drainage system was inundated and sink-holes in our streets and roads were increased in size due to the inundation of rain. In addition, in pursuit of protection of the health and safety of our residents, the City expended staff time and overtime in storm-related preparations and made acquisitions of additional equipment and supplies, such as sand and pumps to address storm-related impacts. The City also required our contractors who were already performing emergency repairs to our storm drain system to bring in additional pumps and man power to monitor flooding conditions. There may very likely be additional costs associated with those activities. The extent of those additional costs has not yet been tabulated.

Packet Page 75

Item No. 8.F. Page 2 of 2
On or about March 8, 2023, the Governor of the State declared a state-wide emergency due ot the 2022-2023 Atmospheric River storm systems battering California.

Additionallly, on March 10, 2023, the President of the United States declared a federal emergency in California due to the Atmospheric River Storm systems. The City needs to declare a local emergency to be eligible to seek state and federal disaster funds and assistance. Typically, only a portion of damage totals are recoverable from state and federal governmental sources.

FISCAL IMPACT
To be determined.

BACKGROUND
The City of Seaside has co-sponsored and funded the Gold Coast Rods classic car show on lower Broadway since 1998. The original car shows were fully funded for six events a year, which occurred on the last Friday of each month from May to October. Funding was completely eliminated in the 2009-10 budget cuts and the organization eventually discontinued their event in the City of Seaside.

In 2014, the City reestablished their co-sponsorship of the Gold Coast Rods events, and they have continued since. The 2022 events were approved for co-sponsorship and fee waivers for costs associated with public works services, and the Fee Waiver & Special Event applications were approved to close Broadway Avenue between Calaveras and Contra Costa and detour traffic during each of the five events.

Gold Coast Rods has submitted a Special Event Application and is requesting all fees be waived for this year’s events that will be held on June 23, 2023, July 28, 2023, August 25, 2023, and September 22, 2023. Gold Coast Rods will provide the insurance coverage.

CITY OF SEASIDE

STAFF REPORT
Item No.: 9.A.

TO: City Council
FROM: Jaime M. Fontes, City Manager
BY: Kirstin van Gend, Administrative Analyst II
Nisha Patel, Public Works Director/City Engineer
DATE: March 16, 2023
SUBJECT: ADOPT A RESOLUTION AUTHORIZING AN AMENDMENT TO THE

AGREEMENT FOR CONTRACTOR SERVICES WITH DISASTER

KLEENUP SPECIALISTS FOR ON-CALL PROPERTY CLEAN-UP
SERVICES FOR AN AMOUNT NOT TO EXCEED $100,000.00

RECOMMENDATION
Adopt a resolution authorizing the City Manager to execute an Amendment to the Agreement for Contractor Services with Disaster Kleenup Specialists to perform on-call property clean-up services for an amount not to exceed $100,000.00.

BACKGROUND
In May 2019, the City issued a Request for Proposals for On-Call Property Clean-up Services for a qualified and responsible company or contractor available to provide oncall clean-up services to remove personal property stored on public property including homeless encampments, alley ways, and other public property as needed. Disaster Kleenup Specialists (DKS) was selected for this contract by the selection committee based on their competitive pricing, staff availability, and experience.

On July 18, 2019, the City Council awarded an Agreement for Contractor Services with Disaster Kleenup Specialists (DKS) in the amount of $100,000.00. Amendments to the agreement were issued on July 28, 2020, June 25, 2021, and May 5, 2022, each extending the agreement by a year and increasing the agreement's value. Since the execution of their contract, DKS has completed over 80 assignments which resulted in the disposal of many tons of waste and over hundreds of hours of specialized labor.

Many of these on-call clean-up assignments consist of potential biohazards, which DKS is capable of disposing of properly.

Packet Page 121

Item No. 9.A. Page 2 of 2
The total amount spent on work completed by DKS thus far is about $199,840.00, leaving an amount of approximately $140.00 of budget remaining in their contract. On average, DKS performs between 3-4 clean ups per month for the City, and the average charge for one clean-up is between $2,500 to $3,500, depending on the size of the location and quantity of items for pick-up. Examples of larger homeless encampment clean-up locations include homeless encampments at Laguna Grande Park, Christian Memorial Tabernacle, and 1st and Lightfighter, as well as blight removal at 335 and 355 Sonoma Avenue. These larger clean-ups can cost between $8,000 to over $20,000 for one job, although the blight removal costs may be reimbursable by special tax assessment through the process outlined in Municipal Code sections 17.36.170 or

8.30.110. The average amount billed by DKS per month ranges from $8,000 to $11,000.

With the proposed Amendment, DKS will continue to support the City with on-call cleanup work including the removal and disposal of items such as furniture, shopping carts, mattresses and other waste. They will no longer survey the City for large dumping of litter, which includes weekly checks of the City known hot-spots. For DKS to continue to support the City with large litter and hazardous waste clean-up through July 31, 2023, staff has determined an additional $100,000.00 is required for the Agreement for Contractor Services with DKS. In addition, authorization for the City Manager to approve additional amendments up to $50,000.00 for large blight removal pick-ups is required so that unforeseeable large clean-ups can be made as quickly as necessary.

FISCAL IMPACT
The cost of increasing the contract was approved by the City Council at the mid-year budget review. The additional funds will be paid by the City's general fund.
