CITY OF SEBASTOPOL
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEBASTOPOL ADOPTING A FRANCHISE FEE OF TEN PERCENT (to%l oF THE GROSS REVENUES RECETVED By SONOMA COUNTY RESOURCE RECOVERY FOR SERVICES PROVIDED
PURUSANT TO THE SOLID WASTE COLLECTION AGREEMENT
WHEREAS, on January 7,2025, City Council approved the execution of the Solid Waste Collection Agreement (Agreement) for garbage, recyclable materials, and organic waste collection services with Sonoma County Resource Recovery (SCRR); and
WHEREAS, Section 4.05,1 states that the Franchise Fee payable by SCRR to the City, to fund the City's costs of providing solid waste-related services, including the City's management and administration of the Agreement, as well as charges for the reasonable value of the use of City property, including streets, for the provision of solid waste services, is to be set by resolution of the City Council; and WHEREAS, the maximum service rates included in the Agreement contemplate that the City's Franchise Fee will be tO% of SCRR's gross revenues, as was required by the City's competitive request for proposals (RFP)for Solid Waste Collection Agreement; and
WHEREAS, the recommended 10% Franchise Fee is the same as the franchise fee included in the City's current solid waste collection agreement, which expires June 30,2025; and WHEREAS, the City finds that the Franchise Fee does not exceed the City's reasonable costs for management and administration of the Agreement, as well as charges for the reasonable value of the use of City property, including streets, for the provision of solid waste services.
NOW, THEREFORE, BE lT RESOLVED by the City Council of the City of Sebastopol that the Franchise Fee payable by SCRR to the City per Section 4.05.1 of the Agreement shall be !O% of SCRR's gross revenues from services provided in the City per the Agreement.
The above and foregoing Resolution was duly passed, approved, and adopted at a meeting by the City Council on the 21-'t day of january, 2025 by the following vote:
