CITY MANAGER’S/STAFF’S REPORT
COUNCIL MEETING DATE: October 21, 2024
__________________________________________________________________________ ITEM NO: B.
SUBJECT: Consideration of a Resolution Accepting Amendment No. 1 to Professional Service Agreement with Yamabe and Horn Engineering for Clarkson Lift Station Improvement Project
______________________________________________________________________________ BACKGROUND: During a Special Council Meeting held on February 9, 2022, Council directed staff to allocate American Rescue Plan Act (“ARPA”) Funds for the improvements to the Clarkson Lift Station.
The Clarkson Lift Station is located approximately 3.5 miles south of the city limits on McCall Avenue. The existing Lift Station currently sends sanitary sewer from a gravity main to the Selma – Kingsburg – Fowler Sanitation District (“SKF”) facility east of McCall Avenue and north of Clarkson Avenue. The Clarkson Lift Station Improvement Project (“Project”) includes the expansion of the existing Clarkson Lift Station site to include upgrading the existing pumps, a new wet well with additional pumps, site improvements, electrical enclosure, effluent vault, and discharge piping.
On February 5, 2024 the City awarded the construction for the Project to HPS Mechanical, Inc. The contract amount of $2,631,300.00 was awarded by Council with funding allocated from the ARPA Fund. As described in the Staff Report for the same meeting, the estimated cost for Construction Management services for the project was estimated at $395,000.
The Professional Service Agreement (“PSA”) between the City of Selma and Yamabe & Horn Engineering dated July 1, 2023 includes inspection and general supervision of Public Works Construction Projects. These services are provided on a Time and Material basis for each project.
DISCUSSION: The State of California Treasury Department issued the Obligation Interim Final Rule in November 2023. The Interim Final Rule (“IFR”) provided clarification as to the requirement for obligating ARPA Funds. The IFR stated that ARPA funds must be obligated by contract prior to December 31, 2024.
Staff consulted with the City Attorney’s office for direction on necessary steps to adequately obligate the remaining ARPA Funds available to the City. It was the opinion of the City Attorney that the Agreement between the City of Selma and HPS Mechanical, Inc. executed on February 26, 2024 adequately obligated the contract amount of $2,631,300.
Based on reports provided by the Finance Department, as of September 25, 2024, there is $230,400 of ARPA Funds that have not been expended or obligated.
At the direction of the City Attorney’s office an amendment to the PSA with Yamabe & Horn Engineering to include the cost for Construction Management of the Project would October 21, 2024 Council Packet Page 5
adequately obligate the remaining ARPA Funds. An amendment has been provided by the City Attorney for the Council’s consideration.
FISCAL IMPACT:
The estimated cost for construction management, inspection, testing, and administration of the Project is $395,000.00.
The funding for this project will be the American Rescue Plan Act (“ARPA”) funds available to the City. The current balance of unobligated ARPA funds is $230,400. The remaining cost will be funded with Measure C Funds.
______________________________________________________________________________ RECOMMENDATION: Approve Resolution accepting the First Amendment to Professional Service Agreement with Yamabe & Horn Engineering, Inc. specifically for Construction Management services for the Clarkson Lift Station Improvement Project for the amount not to exceed $395,000; and authorize the City Manager and City Attorney to sign on behalf of the City.

CITY MANAGER’S/STAFF’S REPORT
COUNCIL MEETING DATE: October 21, 2024
______________________________________________________________________________ ITEM NO: C.
SUBJECT: Consideration of a Resolution Approving a Maintenance Agreement and MOU with the Office of the Fresno County District Attorney for Electronic Laboratory Services and Access to the Fresno County Regional Electronic Laboratory (FCREL)
______________________________________________________________________________ BACKGROUND: The Selma Police Department is leveraging modern technology to support criminal investigations and depends on devices to extract digital contents from devices such as cellular phones, tablets, computers and other electronic devices that are seized for evidence during criminal investigations. Investigators recover and analyze content from these devices to help ensure that the Fresno County District Attorney has the necessary evidence to establish proof beyond a reasonable doubt for prosecution.
The devices used for digital extraction are understandably costly to purchase and maintain.
Additionally, the specialized training required to operate these devices can be expensive. The Fresno County District Attorney’s Office operates a Regional Electronic Laboratory that is staffed by two full-time sworn District Attorney Investigators and one Crime Analyst. The lab specializes in the forensic extraction of digital content from electronic devices for various police agencies in the Fresno County area, except for the Clovis Police Department. Among the agencies that submit devices, the Fresno Police Department, the Fresno County Sheriff’s Office and the Selma Police Department are the top three contributors to this program. This high level of submission of devices indicates the significant role digital evidence plays in the investigations and prosecutions within the county.
DISCUSSION: Currently, the Office of the Fresno County District Attorney incurs an estimated annual cost of $227,702.09 for the equipment and repairs necessary to maintain the digital forensic equipment. This fee doesn’t include the salaries for the three employees who operate the lab. To effectively utilize the Fresno County Regional Electronic Laboratory, the Selma Police Department is being asked to pay a fee of $25,000.00 for the 2024/2025 fiscal year. This fee covers the costs associated with operating the digital forensic lab. This MOU also includes that the Selma Police Department will provide one of its employees to assist in the extraction of digital devices, indicating a collaborative effort in utilizing the lab’s services.
This employee will be deployed on a part-time basis and will allow for the training of digital extraction for said employee, which we feel is crucial for future Selma Police Department digital forensic investigations. This contribution also gains priority access to the digital forensic equipment which is crucial during investigations that require immediate attention.
FISCAL IMPACT: The adopted Fiscal Year 2024-2025 Budget includes a $50,000 allocation for this service, thus there is expected to be a net savings to the General Fund due to the actual cost being $25,000.
______________________________________________________________________________ RECOMMENDATION: Adopt the attached Resolution approving a maintenance agreement with Fresno County Regional Electronic Laboratory (Office of the Fresno County District Attorney) and authorize the City Manager or designee to execute the agreement.

Each Investigator, Officer, Deputy or Civilian assigned to the FCREL will abide by their departmental policy and procedure as it relates to their job and job assignment. The Fresno County District Attorney’s Office is not responsible for any other departmental agency personnel.
COSTS
The authorized signor below recognizes the substantial costs for forensic cyber equipment, training and software that goes into a forensic lab. The cost of a cyber forensic laboratory is significant for an agency to carry the entire cost of a regional laboratory. With this in mind, we respectfully request each agency financially commit to the overall costs of the laboratory. The resources needed would include equipment, training, software and personnel to make a regional lab successful. At this time, we have found that an annual cost of the FCREL would be approximately $250,000 per year (these costs will go up and down depending on the different software, hardware, and training needed each year. We are also building into the cost of the FCREL budget projections on the cost to replace antiquated equipment in future years so as not to make huge deviations in the FCREL budget year to year.).
The cost per agency will depend on several factors. For example, how much an agency uses the lab, what equipment needs to be bought or replaced, etc. The cost per agency will be agreed upon by the signors and or their designees. Once the annual cost of the FCREL is agreed upon by each agency, the agency shall be responsible for that agreed upon amount. Costs should be worked out at least for the first year – DA x amount, FPD x amount, FSO x amount..
If an agency/department wishes to terminate their association to the FCREL, the annual cost will not be refunded or terminated. The agency/department shall pay the cost agreed upon for that calendar year.
MODIFICATION
Any matters of this MOU may be modified from time to time by the written consent of all parties without, in any way, affecting the remainder.

CITY MANAGER’S/STAFF’S REPORT
COUNCIL MEETING DATE: October 21, 2024
_____________________________________________________________________________ ITEM NO: 1.
SUBJECT: Consideration of a Resolution Adopting the Downtown Business Improvement District Logo
______________________________________________________________________________ BACKGROUND: The Downtown Business Improvement District (BID) aims to develop a new downtown logo that will serve as a visual identity to promote community pride, attract visitors, and create a cohesive image.
After several rounds of revisions, the Downtown BID presented a logo for City Council consideration at the February 5, 2024, meeting. However, the Council postponed adoption, requesting further revisions. A revised logo was presented on May 6, 2024, but the Council again tabled its adoption, requesting additional changes.
On July 1, 2024, the Downtown BID requested the formation of an ad-hoc logo subcommittee with two Council members to help expedite the logo development process. The Council agreed to appoint two members, Councilmember Sarah Guerra and Councilmember Blanca Mendoza Navarro, to collaborate with the BID Board in finalizing the logo.
The first meeting of this subcommittee took place on July 24, 2024. Using feedback from the discussion the BID Board prepared three final logo options for City Council consideration, incorporating feedback about adding more color, detail, and prioritizing cohesion.
DISCUSSION: The Downtown BID Advisory Board has updated the logo based on Council input. Parminder Singh, a BID Board member, will present the following logo options to the City Council:

FISCAL IMPACT: The BID Board budgeted for the logo and has exhausted all revisions in the current contract, if further logo revisions are recorded this would impose an expense between $500- $1,000 for the BID.
_________________________________________________________________________ RECOMMENDATION: The City Council can choose to adopt the logo as it is by adopting the draft resolution or offer further recommendations. _________________________________________________________________________ ________/s/_______________________________ 10/21/24

CITY MANAGER’S/STAFF’S REPORT
COUNCIL MEETING DATE: October 21, 2024
__________________________________________________________________________ ITEM NO: 2.
SUBJECT: Public Hearing and Waiver of the Second Reading of the Special Event Ordinance Amendment Adding the March For Jesus Event and Removing the Tejano Festival
______________________________________________________________________________ BACKGROUND:
During the July 15, 2024 Council Meeting, the City Council provided consensus to discuss the addition of the “March for Jesus” event to the Legacy Events list. During the August 19, 2024 Council Meeting, the City Council provided consensus to discuss removing the Tejano Festival from the Legacy Events list.
On September 3, 2024, the City Council provided direction to City staff to propose revisions to the Fee Waiver and Reduction Policy (“Waiver Policy”) portion of the Special Event Permit Ordinance regarding the addition of the March for Jesus event and the removal of the Tejano Festival from the Legacy Events list.
A first reading of the ordinance occurred at the October 7, 2024 City Council meeting. The City Council approved the first reading of the ordinance and set the public hearing and second reading for the October 21, 2024 meeting. If Council approves the second reading of the ordinance, it will take effect in thirty (30) days from the date of approval.
DISCUSSION:
Legacy Events are defined within the Selma Municipal Code, Chapter 5-7-19: Special Events Ordinance (Attachment A) and demonstrate consistent benefit to the local community.
Special events are designated as Legacy Events at the City Council’s discretion through the Municipal Code.
Legacy events are required to meet the standards established in SMC Chapter 5-7-19: Special Events. Apart from being recognized for their historical contributions to Selma, Legacy Events receive a waiver of special event application fees. Legacy Events are still required to submit permit applications within the required timelines in order to be approved for operation. Nothing in the above-mentioned ordinance entitles Legacy Events to be exempt from the application process, or any other requirements in the policy.
FISCAL IMPACT: With the addition of one event and the removal of another, there is no net impact to the General Fund.
