The funds will cover eight (8) CPR classes and 15 hours of public education events for calendar year 2025. The CPR classes are taught by Selma Fire Department Personnel and are limited to nine (9) citizens each class due to American Heart Association regulations. The classes are offered on a first come, first served basis and require a $20.00 deposit at time of registration that will be returned at the conclusion of the class.

CITY COUNCIL STAFF REPORT
Meeting Date: March 18, 2025
SUBJECT: Consideration of Resolution 2025-3CEC Approving and Authorizing Execution of Grant Agreement between Selma Community
Enhancement Corp and Selma Healthcare District; and Authorizing Purchase of LUCAS Devices and Equipment through Sourcewell Contract with Selma Community Enhancement Corp funds.

SUBMITTED: Jordan Webster, Fire Chief
APPROVED: Fernando Santillan, City Manager
RECOMMENDATION:

Adopt Resolution 2025-3CEC approving and Authorizing Execution of Agreement between Selma Community Enhancement Corp and Selma Healthcare District; and Authorizing the Purchase of LUCAS Devices and Equipment through Sourcewell Contract with Selma Enhancement Corp Funds.

DISCUSSION:

Selma Healthcare District was formed to improve the quality of health care in the communities it serves. The District has adopted a grant program to invest in organizations and agencies whose activities and programs improve the health and well-being of District residents consistent with the provisions contained in the Health & Safety Code section 32000.

The City of Selma Fire Department received a grant award for the purchase of three (3) LUCAS Device chest compression systems, Three (3) Desk-Top Battery Chargers, Three (3) LUCAS External Power Supply systems, Three (3) Rechargeable LiPo Batteries, Three (3) Disposable Suction Cup 12 packs. The purchase of this equipment will be procured through a Sourcewell contract meeting requirements of City of Selma’s Purchasing policy. The total cost of the equipment listed is $69,645.08.

These devices are utilized for mechanical chest compressions during Cardio Pulmonary Resuscitation (CPR). The benefit of these devices include: consistent and adequate chest compressions critical to the chain of survival during cardiac arrest, freeing up personnel from performing chest compressions during cardiac arrest events to perform other critical life saving treatments such as the placement of advanced airways and medicine administration.

The Lucas Devices will be placed on the three (3) front line fire apparatus to ensure the readiness and availability to the citizens of Selma. Maintenance and consumables will be included in the operations budget of the Ambulance Fund in future fiscal years.

Once the equipment is purchased by the Selma Community Enhancement Corp, the equipment will become the property of the City of Selma Fire Department.

FISCAL IMPACT:
32 An increase in revenues of $69,645.08 and an offsetting expenditure of $69,645.08 will be reflected in Selma Enhancement Corps financial statements.

CITY COUNCIL STAFF REPORT
Meeting Date: March 18, 2025
SUBJECT: Second Reading and Approval of Ordinance 2025-01 Amending Selma Municipal Code Section 5-7-19 of Chapter 7 of Title V Adding the Tejano Festival and Dia de Los Muertos to the List of Legacy Events and Waive the One-Day Business License Requirement for Vendors Associated with Legacy Events
SUBMITTED: Jerome Keene, Deputy City Manager
APPROVED: Fernando Santillan, City Manager
RECOMMENDATION:

Approval of Second Reading and Adoption of Ordinance 2025-01 amending Selma Municipal Code Section 5-7-19 of Chapter 7 of Title V, adding the Tejano Festival and Dia de Los Muertos to the list of Legacy Events and waive the One-Day Business License requirement for vendors associated with Legacy Events.

DISCUSSION:

At the February 3, 2025, Council meeting, it was requested that Selma Municipal Code Section 5-7-19: Special Event Fee Reduction and Waiver Regulations be revised to add the Tejano Festival and the Dia de Los Muertos Celebration. Additionally, it was also requested that vendors associated with Legacy Events be exempt from obtaining a One-Day Business License.

Pursuant to the request, on February 18, 2025, a first reading of the draft ordinance was conducted at the February 18, 2025, City Council meeting to add both events to Legacy Events within the Municipal Code.

The ordinance also includes an added subsection that clearly identifies that vendors that are associated with a Legacy Event and have obtained other appropriate permitting approvals are exempt from the One-Day Business License requirement.

FISCAL IMPACT:

As presented previously, if fees are waived and the City sponsors portions of these events while also waiving fees, there will be a decline in revenue to the General Fund.

CITY COUNCIL STAFF REPORT
Meeting Date: March 18, 2025
SUBJECT: Second Reading and Adoption of Ordinance 2025-02 Amending Subdivision (A) of Section 1-5-1 of the Selma Municipal Code (SMC) Changing the Date of Regular Meetings of the City Council from the First and Third Monday of Each Month to the First and Third Tuesday of Each Month
SUBMITTED: Neal Costanzo, City Attorney
APPROVED: Fernando Santillan, City Manager
RECOMMENDATION:

Approval of Second Reading and Adoption of Ordinance 2025-02 Amending SMC Section 1-5-1, changing the regular meeting date of the City Council from the first and third Monday to the first and third Tuesday of each month after public hearing.

DISCUSSION:

The City Council wishes to change the date of its regular meetings, which is specified by ordinance, specifically SMC Section 1-5-1 (Subdivision A). The appropriate amendment to that section accompanies this Staff Report and if adopted it would effectively change the date and time of the City’s regular meetings from the first and third Monday of each month to the first and third Tuesday of each month and the meeting time would be specified by ordinance, as 6:00 p.m.

As written and as amended, the ordinance which specifies the date and time for City Council meetings can be overridden by resolution, so long as that resolution is adopted at a regular meeting. The Council has adopted a resolution at the regular meeting of February 18, 2025, moving its meetings to Tuesdays instead of Mondays. The ordinance if adopted will not be effective until 30 days after the date of this meeting, but the resolution adopted on February 18, makes the change to Tuesdays immediately effective.

A first reading of the ordinance was conducted at the February 18, 2025, City Council meeting.

FISCAL IMPACT: None.

Amending Municipal Code Section
11-2-3(D) of the Selma Municipal Code
Adding Development Regulations for
Housing Development Projects listed

51 ITEM NO: 3-3

CITY COUNCIL STAFF REPORT
Meeting Date: March 18, 2025
SUBJECT: First Reading of Ordinance 2025-03 Amending Municipal Code Section 11-2-3(D) of the Selma Municipal Code Adding Development Regulations for Housing Development Projects Listed under Priority Housing Sites to Fulfill Housing Element Program 7 Objectives.

SUBMITTED: Kamara Biawogi, City Planner
Jerome Keene, Deputy City Manager
APPROVED: Fernando Santillan, City Manager
RECOMMENDATION:

Conduct the first reading during the public hearing and set the second reading of Ordinance 2025-03 to amend Municipal Code Section 11-2-3(D) (Table 2-6) of the Selma Municipal Code, by adding development regulations for housing development projects listed under Priority Housing Sites, to fulfill Housing Element, Program 7 objectives.

DISCUSSION:

The Housing Element is a State-mandated eight-year policy document that is a component of the Selma General Plan. The overall purpose of the Housing Element Update is to identify current and projected housing needs, show locations where housing can be built, and set goals, policies, and programs to meet the community's housing needs.

The City prepared its Housing Element as part of a Multi-Jurisdictional Housing Element regional effort in collaboration with the Fresno County Council of Governments, Fresno County, and thirteen other cities in Fresno County. The Fresno County Council of Governments contracted with PlaceWorks and team members Ascent, Provost & Pritchard, and the California Coalition of Rural Housing to assist Fresno County and the cities with the Multi-Jurisdiction Housing Element Update.

Prior to adopting the Housing Element, State law requires the State Department of Housing and Community Development (HCD) to administer the law by reviewing draft housing elements for compliance with State law and by reporting its written findings to the local jurisdiction. The City submitted its initial draft to HCD on December 28, 2023. HCD provided a letter with findings dated March 26, 2024. The City revised the draft in response to the letter and resubmitted it to HCD on July 24, 2024. The City received a letter of Conditional Compliance from HCD on September 20, 2024, stating the City had achieved conditional compliance with State Housing Element Law (Gov. Code, § 65580 et seq).

The City Council adopted the 2023-2031 Housing Element on November 18, 2024. On December 4, 2024, the adopted draft was submitted to HCD for a final certification review.

The City received a response letter from HCD on January 29, 2025, identifying conditional certification Housing Element. However, HCD mandated certain zoning text amendments be adopted before final certification of the document, which are identified in this report. 52 Program 7 under the 6th cycle Housing Element commits the City to allow housing developments by right on sites consistent with Government Code Section 65583.2(C) in which at least 20 percent of the units meet affordability thresholds for lower-income households. Staff is presenting a zoning ordinance text amendment to fulfill HCD’s mandate to meet all statutory requirements pursuant to Government Code Section 65583.2. This item is the last remaining revision to obtain certification of the City’s housing element for the current planning period.

The attached Ordinance is being introduced to City Council at this public hearing. The Council will need to conduct a second reading and formally adopt the Ordinance at the next regular meeting, after which, the Ordinance will be approved and will be effective 30 days following the second reading.

Item 4-1
Action Item – Introduction and First
Reading of Ordinance 2025-04 Amending
Selma Municipal Code Section 6-21-6
Relating to Graffiti Removal
59 ITEM NO: 4-1

CITY COUNCIL STAFF REPORT
Meeting Date: March 18, 2025
SUBJECT: Introduction and First Reading of Ordinance No. 2025-04 Amending Section 6-21-6 of the Selma Municipal Code (SMC) Relating to the Removal of Graffiti
SUBMITTED: Neal E. Costanzo, City Attorney
APPROVED: Fernando Santillan, City Manager
RECOMMENDATION:

Introduce and Waive First Reading of Ordinance 2025-04 Amending Section 6-21-6 of the Selma Municipal Code Relating to Removal of Graffiti.

DISCUSSION:

The current version of Section 6-21-6 provides that the property owner is required upon receiving notice that graffiti is present on his or her property must within 72 hours remove the graffiti and that if he fails to do so, that is deemed consent for the City to enter his or her property and remove the graffiti through its own forces and then assess the cost of doing that against the property.

The City cannot enact an ordinance that deems a property owner has consented to the City entering his property because he failed to remove graffiti within 72 hours of receiving notice of the need to do so. The Fourth Amendment of the United States Constitution does not allow a city to assume somebody has consented to it making entry onto his or her property by the failure to take action in response to a notice. The current ordinance is unenforceable. Property owners receiving notice of graffiti on their property typically ignore the notices. There is nothing the City can do to gain entry to their property without their express consent.

To encourage people to allow the City to enter and remove graffiti from their property the amended ordinance establishes a different procedure. When a notice of the presence of graffiti is given to the property owner, the property owner would be given a form to consent to the City entering his or her property for the purpose of removing graffiti along with a general release of liability for any injury caused in connection with taking that action. Rather than deem the person to have consented to an entry to his or her real property, this method gives the City express consent which is what is required under the Fourth Amendment.

In the event the property owner refuses to sign the consent and release the City is authorized under the amended ordinance to assess a fine against the occupant or owner in the amount of $100 per day for each day the graffiti remains on the property. The ordinance provides, further, that the City Attorney is authorized to initiate a civil action once the fines or penalties have reached $1,500. The amended ordinance also authorizes the City Attorney to seek an order requiring the property owner to remove the graffiti, or to allow the City to do it without the property owner’s consent.
60 FISCAL IMPACT:

Dependent upon number of homes or businesses given notice, which is unpredictable.

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SELMA
AMENDING SELMA MUNICIPAL CODE SECTION 6-21-6 RELATING TO A PROPERTY OWNER’S RESPONSIBILITY FOR REMOVAL OF GRAFFITI WHEREAS, Selma Municipal Code (SMC) 6-21-6 currently provides that a property owner is required to remove graffiti on his or her property within 72 hours of service of a notice by the City to remove the graffiti and provides that upon the failure of the property owner to do so, the City may enter the property owner’s property and remove the graffiti itself; and
WHEREAS, to encourage property owners to quickly remove graffiti on their property the amended ordinance provides that the City will remove the graffiti for the property owner at no cost if the property owner simply consents to and waives liability for the City entering upon the property owner’s property and painting, repairing or otherwise taking actions to remove the graffiti; and
WHEREAS, the amended ordinance further specifies that a property owner who fails to either remove or allow for the removal of graffiti from his or her property by the City within 72 hours of receiving notice of the need to do so shall be responsible for daily penalties and subject to civil action requiring the removal of graffiti and the payment of any penalties assessed in addition to the cost to the City of removing the graffiti in the event the City is ultimately allowed by a court to remove the graffiti from the property owner’s property.

CITY COUNCIL STAFF REPORT
Meeting Date: March 18, 2025
SUBJECT: Storefront Improvement Grant Application Requirements SUBMITTED: Alicia Aguirre, Economic Development Manager Jerome Keene, Deputy City Manager
APPROVED: Fernando Santillan, City Manager
RECOMMENDATION:

Council direct staff to review the provisions and make adjustments appropriate to increase applications submittals, such as, but not limited to, qualifying improvements and eligible applicants.

DISCUSSION:

In 2024, the City Council approved the Downtown Business Improvement District’s (BID) Storefront Improvement Grant Program. The program established qualifying projects for which tenants and property owners could apply for a match grant of up to $10,000. The eligible improvements include:

1. Removal of unnecessary visual distractions, such as taking down window decals.

2. Removal of non-compliant signage but excluding primary signage of the business.

3. Removal and/or replacement of damaged or outdated door.

4. Repairing damaged or outdated window.

5. Code deficiencies including ADA compliance upgrades for store entrance (excluding sidewalk)

6. Exterior entryway flooring or pavement as part of ingress/egress to building. (excluding city sidewalks)

7. Installation of permanent lighting attached to your business storefront Recently, there have been discussions and comments from both the BID and City Council regarding applicant eligibility requirements as well as the qualifying improvements being too narrow, which has led to no applications being submitted for the program.

With regard to the list of eligible improvements, Staff agrees that expanding the list is a viable option to increase interest. However, with the design standards for downtown currently being developed, allowing paint, awnings, and other items that have not been adopted to be improved using grant funds would simply lead to these improvements needing to be corrected if they are not consistent with the design guidelines ultimately adopted.

Furthermore, the eligibility of property owners and property managers of sitting BID members and City Council has also been a point of discussion. The prior City Attorney previously commented on this matter and provided an opinion that Government Code section 87100 disallows a government official, which includes appointed members of the BID and the City Council, from participating in or making a decision in which they have a financial interest, as shown on Page 5 of the Application Guidelines. 66 A financial interest can include property ownership, income, and business investments, such as receiving income from managing the property. Apart from obvious benefits to property owners, the reason that a property manager would be excluded would be because of the potential financial interest would be that the improvements made to the building through the grant program could allow for increased rent or more lucrative tenants, which could then increase the fee that the property manager would get from the rent.

Additionally, the grant program could be viewed as a contractual agreement with the applicants, for which City officials, such as appointed and elected officials, cannot directly benefit. A grant qualifies as a financial transaction, so a city official applying for funding may violate Government Code Section 1090, unless an exception applies.

Therefore, unless otherwise directed, Staff recommends that the applicant provisions for the grant remain unchanged and exclude BID members as well as the City Council members to continue to maintain that a conflict of interest or favoritism does not exist with regard to the Storefront Improvement Grant program and the issuance of public funds to improve private property within the downtown area.

FISCAL IMPACT:

No new fiscal impact. Funds have been allocated for the Storefront Improvement Grant in the amount of $100,000 for Fiscal Year 24/25.

68 Downtown Selma Storefront Improvement Grant Program
Framework and Eligibility Criteria
Overview:

The Downtown Business Storefront Improvement Grant Program in the City of Selma is a strategic initiative aimed at revitalizing downtown businesses by providing financial support for exterior enhancements. Unlike traditional grant programs, this unique initiative distinguishes itself by excluding improvements subject to upcoming design guidelines. Recognizing the ongoing development of these guidelines, the program focuses on eligible enhancements that align with community preferences but do not fall within the parameters of the forthcoming design restrictions. This intentional exclusion is designed to ensure that the grant program not only complements the City's vision for immediately providing resources for improving aesthetics, but also serves as a prelude to include physical façade improvement that will seamlessly integrate with the established design guidelines. Through this phased approach, Selma aims to empower downtown businesses, enhance community aesthetics, and lay the groundwork for a cohesive and visually appealing downtown.

SB 975: Prevailing Wage Legislation
In the last year, the California Department of Industrial Relations ("DIR") has issued a number of new determinations of prevailing wage applicability in various publicly 72 assisted projects. In almost all of those determinations, the DIR found that public agency assistance to the projects triggered prevailing wage requirements. The prevailing wage requirements were changed even further by the Legislature’s adoption of SB 975, which dramatically expanded the coverage of prevailing wage requirements to projects involving almost any sort of public subsidy. Under current law, prevailing wages are required to be paid on any public works project in excess of $1,000 (Labor Code Sections 1770 – 1774). A public works project is defined as a work of "construction, alteration, demolition or repair work done under contract and paid for in whole or in part out of public funds" (Labor Code Section 1720).

Types of Assistance Requiring Prevailing Wages Under SB 975. o SB 975 defines "paid for in whole or in part out of public funds" as any of the following:
o The payment of money or the equivalent of money by a state or political subdivision directly to or on behalf of the public works contractor, subcontractor, or developer.
o Performance of construction work by the state or political subdivision in execution of the project.
o Transfer of an asset of value for less than fair market price. o Fees, costs, rents, insurance or bond premiums, loans, interest rates, or other obligations that would normally be required in the execution of the contract, which are paid, reduced, charged at less than fair market value, waived or forgiven.
o Money to be repaid on a contingent basis. o Credits applied against repayment obligations.

Exceptions to Prevailing Wages Under SB 975.
o SB 975 contains certain exemptions, the most important of which are as follows:
o Private residential projects are built on private property, if the project is not built pursuant to an agreement with a state agency, redevelopment agency, or local public housing authority.
o Public agency contribution of funds for public works if the public agency "maintains no proprietary interest in the overall project" (but prevailing wages must be paid on the public works project).
o Public agency reimbursement of costs "that would normally be borne by the public."
o Public subsidy to a project that is "de minimis in the context of the project." o Affordable housing projects where the only public subsidy is redevelopment low- and moderate-income housing funds.
73 o Affordable apartment projects financed with multifamily mortgage revenue bonds (for bonds allocated before December 31, 2003).
o Single family housing projects financed with single family revenue bonds (for bonds allocated before December 31, 2003).
o Affordable apartment projects which receive federal or state low-income housing tax credits (for tax credits allocated before December 31, 2003). o While there is no "grandfather clause" contained in the text of SB 975 itself, the DIR has sent out a notice that SB 975 will not be applied against "public works projects advertised for bids" prior to January 1, 2002.

District Design Guidelines Update
79 ITEM NO: 4-3

CITY COUNCIL STAFF REPORT
Meeting Date: March 17, 2025
SUBJECT: Downtown CBD District Design Guidelines Update SUBMITTED: Jerome Keene, Deputy City Manager
APPROVED: Fernando Santillan, City Manager
RECOMMENDATION:

Schedule a Downtown Design Guidelines Workshop during the second week of May as a joint meeting with the Selma City Council, Planning Commission, and Downtown Business Improvement District. Proposed dates are May 13 or May 15 at 4:30 PM.

DISCUSSION:

As part of the ongoing development of design guidelines for the downtown district, staff has begun preliminary discussions with the Downtown Business Improvement District (BID) regarding façade materials and color schemes. While this is just one component of the broader design guideline framework, the initial conversation focused on the role of color requirements in achieving a cohesive downtown aesthetic while balancing flexibility for property owners and developers.

During the BID’s regular meeting on March 10, 2025, members discussed the benefits and challenges of strict color guidelines. Key considerations included maintaining visual consistency versus allowing flexibility to minimize financial burdens and preserve creative and branding opportunities for businesses. The discussion also explored how these guidelines could reinforce the vision for Downtown Selma as a Cultural Arts District.

Board members reviewed approaches used by other cities and examined popular color palettes. A strong preference emerged for prioritizing brick as a primary façade material due to its historic and widespread use throughout downtown, contributing to the district’s character. Additionally, two preferred color schemes were identified:
• Terracotta-inspired palette: Featuring sand, ochre, and deeper green tones. • Neutral palette: Incorporating whites, charcoal, and natural wood accents.

Today’s discussion will summarize these initial takeaways and provide an opportunity for City Council to share input in preparation for a more comprehensive workshop on design guidelines, to be scheduled in May.

FISCAL IMPACT:

None at this time however depending on the guidelines developed, future costs may arise from enforcement, incentives for compliance, or updates to zoning codes and permitting processes.

Discussion Item – Selma Community
Ministries (Selma COM) located on
Whitson and 1st Street Update
83 ITEM NO: 4-4

CITY COUNCIL STAFF REPORT
Meeting Date: March 18, 2025
SUBJECT: Selma Community Ministries (Selma COM) located on Whitson and 1st Street Update
SUBMITTED: Jerome Keene, Deputy City Manager
APPROVED: Fernando Santillan, City Manager
RECOMMENDATION:

Discussion Only.

DISCUSSION:

In December 2022, Selma Community Ministries (Selma COM) applied for a business license and building permit to operate a church at 2001 Whitson Avenue. Staff approved both applications and completed inspections for the project.

However, over time, numerous violations have been identified on site that illegal improvements and activities are being conducted on site that do not comply with the Municipal Code or California Building Code requirements.

Most recently, a Code Enforcement case was opened on December 20, 2024, due to a trailer being parked on site and connected to the City’s sewer system. The use of a trailer for habitation is not permitted under the Municipal Code nor is connecting a facility to the sewer system without appropriate approval by the City and the Selma-Kingsburg-Fowler (SKF) Sanitation District. Additionally, the activities being conducted were not included within the original business license application materials submitted by Selma COM and likely would have triggered additional review by City Departments.

The Code Enforcement case closed on January 21, 2025, after a site inspection confirmed that the trailer had been disconnected from City facilities and was not being used.

Lastly, it was discovered that the approval and initial inspection of the operation may have been done incorrectly. The property is currently zoned C-2 which requires a church only through the approval of a conditional use permit, which Selma COM did not obtain.

Furthermore, the building permit which was issued should have included a change of occupancy of the building from the bar (A-2 occupancy) to the church (A-3 occupancy). While both A-2 and A-3 fall under assembly occupancy, a formal change of occupancy review is typically required to assess:

1. Occupant load calculations and egress adequacy.

2. Fire protection & sprinkler requirements.

3. Structural considerations.

4. Plumbing and accessibility compliance.
84 As shown in the building permit that was issued, the work completed was listed as painting, drywall, glass replacement and installation of door. Staff did not recover any plans submitted with this permit as well. Therefore, it is assumed that these items were simply inspected in the field by prior staff. Therefore, it is likely the appropriate assessment for the change of occupancy was not conducted.

Therefore, Community Development will work with the property owner to achieve proper entitlement permitting to ensure the required occupancy improvements are completed within a specific timeframe to ensure compliance with the California Fire and Building Code as well as the Selma Municipal Code.
