ITEM NO: 1-1

CITY COUNCIL STAFF REPORT
Meeting Date: October 7, 2025
SUBJECT: Informational Item: Safe Routes to School Update SUBMITTED: Jerome Keene, Deputy City Manager
APPROVED: John Kunkel, Interim City Manager
DISCUSSION:

Earlier this year, the City Council and City staff discussed options for the upcoming Safe Routes to School funding cycle being sponsored by the Fresno Council of Governments (Fresno COG). At that time, projects and improvements were discussed to allow staff to begin developing scopes of work to prepare for the release of the request for applications and application submittal deadline on October 14, 2025.

City staff worked to develop four (4) scopes of work with varying improvements throughout the City. General descriptions of each scope of work is as follows:

1. Scope of Work #1 (Woodrow Wilson Elementary)
a. Install a crosswalk with MUTSD stop sign at Brelinger Park at Woodrow Wilson Elementary
b. Improve crosswalks at Locust Street and Olive Street on Rose Avenue c. Install missing segments of sidewalk along Locust Street and Olive Street, south of Rose Avenue

2. Scope of Work #2 (Abraham Lincoln Middle School)
a. Install curb bulb-outs at crosswalks to shorten walking distance at Barbara Street and Orange Avenue at Abraham Lincoln Middle School b. Install curb bulb-outs at crosswalks to shorten walking distance at Lewis Street and Orange Avenue at Abraham Lincoln Middle School
c. Install Rectangular Rapid Flashing Beacons on crossing signs at both locations for visibility.

3. Scope of Work #3 (Heartland High School)
a. Install missing segments of sidewalk along Rose Avenue, between Mitchell Avenue and Thompson Avenue under Highway 99.
b. Install Rectangular Rapid Flashing Beacons on crossing signs and improve crosswalk visibility at the irregular intersection of Rose Avenue, Thompson Avenue, and Young Street.
c. Install missing segments of sidewalks near and around Heartland High School.

4. Scope of Work #4 (All Schools)
a. Update 37 crosswalks with high visibility improvements city-wide to benefit all schools within the City of Selma.
7 City staff met with the Selma Unified School District Superintendent and staff to discuss these scopes of work. The District stated that a letter of support for all scopes of work would be provided, as these enhancements are necessary for the pedestrian network to support students.

Staff is preparing the final grant applications for submittal prior to the October 14, 2025, deadline. Fresno COG will convene a scoring committee on October 28, 2025, to review applications received from all eligible agencies. The City plans to include consultation with the Selma Unified School District, supporting data from the Tactical Urbanism Grant pilot projects, and the Local Road Safety Plan findings within the grant application in order to show how these improvements have already been identified as a need for residents.

ITEM NO: 2-1

CITY COUNCIL STAFF REPORT
Meeting Date: October 7, 2025
SUBJECT: Second Reading and Adoption of Ordinances 2025-12 and 2025-13 (Selma North Annexation Pre-Zoning)
SUBMITTED: Jerome Keene, Deputy City Manager
APPROVED: John Kunkel, City Manager
BACKGROUND:

On September 2, 2025, the City Council conducted the first reading of Ordinance Nos. 2025- 12 and 2025-13, introduced by title only, in compliance with Government Code §§ 36931– 36934.
• Ordinance No. 2025-12 pre-zones approximately 150 acres consisting of 20 parcels within the Selma North Annexation Area, consistent with the 2035 Selma General Plan.
• Ordinance No. 2025-13 pre-zones approximately 20 acres located at 9791 S. McCall Avenue (APN 358-120-35), requested by property owner Allison Ying Bauer for inclusion in the Selma North Annexation.

Pre-zoning is required prior to annexation under Government Code § 56375(a). Adoption of the ordinances will establish the zoning framework but will not take effect until the annexation is approved by the Fresno County Local Agency Formation Commission (LAFCo) and a Certificate of Completion is recorded.

DISCUSSION:

At the first reading, the City Council also adopted Resolution Nos. 2025-85R and 2025-86R, approving the annexation proposals and adopting findings under CEQA Guidelines §15183 (Projects Consistent with a Community Plan or Zoning).

The ordinances are now before the Council for second reading and adoption. Following adoption, staff will forward the annexation package to Fresno County LAFCo, including:
• Certified resolutions and ordinances,
• Legal descriptions and boundary maps,
• CEQA documentation.

No building permits or development rights are authorized through adoption of these ordinances. Any future entitlements will require separate approval by the City. 31 FISCAL IMPACT:

No direct fiscal impact results from the adoption of the ordinances. Fiscal neutrality will be addressed through annexation agreements or LAFCo conditions as required.

RECOMMENDATION:

Staff recommends that the City Council waive the second reading in full and adopt Ordinance No. 2025-12 (Pre-Zoning of the Selma North Annexation Area – 150 acres) and Ordinance No. 2025-13 (Pre-Zoning of Additional Parcel – 20 acres, APN 358-120-35), as attached.

CITY COUNCIL STAFF REPORT
Meeting Date: October 7, 2025
SUBJECT: Consideration and Necessary Action on Resolution 2025-95R Approving and Authorizing Execution of Revised Interim City Manager Employment Agreement
SUBMITTED: Neal E. Costanzo, City Attorney
APPROVED: John Kunkel, Interim City Manager
RECOMMENDATION:

Adopt Resolution 2025-95R Approving Revised Interim City Manager Employment Agreement.

DISCUSSION:

A Revised Interim City Manager Employment Agreement is attached. You previously entered into an Interim City Manager Employment Agreement with John Kunkel on May 6, 2025. We normally do not include an indemnification provision for employees because the city is statutorily required to indemnify its employees for everything that they do in the performance of their duties. John Kunkel, however, is a retired Cal PERS Annuitant and there are some questions as to whether the city’s statutory indemnification obligation for employees is applicable to him. Accordingly, he has asked, and staff prepared a new Interim City Manager Employment Agreement which more closely follows the statutory provisions relating to the employment of a retired Cal PERS Annuitant and includes an indemnification provision requiring the city to defend and indemnify Mr. Kunkel for any claim or alleged liability arising out of the performance of his duties as your Interim City Manager.

FISCAL IMPACT:

None.

APPROVING AND AUTHORIZING EXECUTION OF A REVISED INTERIM CITY

MANAGER EMPLOYMENT AGREEMENT
WHEREAS, John Kunkel has been employed, subject to requirements of the Cal PERS Laws as Interim City Manager since May 6, 2025; and WHEREAS, the city has a statutory obligation to defend and indemnify all employees, but that statutory obligation arguably may not apply to a retired Cal PERS Annuitant; and WHEREAS, John Kunkel has requested his employment agreement be revised to include a specific indemnification agreement.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

1. The foregoing recitals are true and correct.

2. The City Council has reviewed and approves the Revised Interim City Manager Employment Agreement with John Kunkel and the Mayor is authorized to execute the same on behalf of the City.

THEREFORE, in consideration of the above recitals and of the mutual promises and conditions in this AGREEMENT, it is agreed as follows:

1. TERM OF EMPLOYMENT - Subject to early termination as provided for in this AGREEMENT, Kunkel shall be appointed for a term beginning May 6, 2025 and ending with the appointment and start of the permanent City Manager, unless the City terminates this AGREEMENT earlier. 2. DUTIES – Kunkel is being appointed to perform the duties of the City Manager

3. REASONABLE TIME AND EFFORT - During the period of appointment, Kunkel shall devote such time, interest, and effort to the performance of his duties under this AGREEMENT as may be fairly and reasonably necessary. In no event shall Kunkel work more than 960 hours for the City and any other CaIPERS contracting agency combined in a fiscal year (July I to June 30).

4. HOURLY PAY RATE - During the term of this AGREEMENT, the City agrees to pay Kunkel for the work he performs at $116.88 per hour, payable on a bi-weekly basis and subject to all applicable withholdings and deductions unless Kunkel chooses to be paid through a non-payroll method such as AP and then Kunkel acknowledges that he is responsible to pay all taxes. This salary is within the hourly salary range for the City's classification of City Manager at the time of appointment.

To the same extent, the City will pay and advance all expenses, including reasonable attorneys ‘fees and costs of courtapproved settlements, actually and necessarily incurred by the City in connection with the defense of any civil action, suit, or proceeding in connection with any civil appeal, which has been brought against Kunkel by reason of his performance of services in the course and scope of his employment with the City.

7. TERMINATION OF AGREEMENT - The City may terminate this AGREEMENT with or without cause at any time by providing written notice of such action to Kunkel. In such event, Kunkel has no right to appeal the termination of this AGREEMENT or his employment, in any forum. Kunkel also has the right to terminate this AGREEMENT and his employment at any time by providing written notice of such action to the City.

8. IMPACT UPON CALPERS BENEFITS - At the time that this AGREEMENT is entered into, Government Code sections 2122I(h) and 7522.56 allow a CaIPERS retiree to perform work not to exceed a total of 960 hours in any fiscal year for all CaIPERS contracting employers without being reinstated from retirement, and without loss or interruption of CaIPERS retirement benefits, under certain circumstances. However, it is agreed and acknowledged by the Parties that in making this AGREEMENT, Kunkel will hold the City, its elected officials, officers, employees, agents, attorneys and assigns harmless in the event CaIPERS or any other person or entity in any way challenges this AGREEMENT, including but not limited to, challenges to Kunkel's entitlement to CaIPERS benefits or seeks Kunkel's reinstatement into active CaIPERS membership and or recovery of retirement benefits already paid. Kunkel shall indemnify and defend the City for the payment of any employee and employer contributions to CaIPERS related to Kunkel's post-retirement earnings, as well as for the payment of any administrative or other penalties and interest on such contributions, which would otherwise be the responsibility of the City. CITY COUNCIL STAFF REPORT
Meeting Date: October 7, 2025
SUBJECT: Consideration of Resolution 2025-96R Adopting an Environmentally Preferable Purchasing Policy and Consideration of Resolution 2025-97R Authorizing the Application Submittal for the CalRecycle Rubberized Pavement Grant Program (FY 2025–26).

SUBMITTED: David Horn, City Engineer
APPROVED: Jerome Keene, Deputy City Manager
RECOMMENDATION:

A. Adopt the attached resolution 2025-96R approving an Environmentally Preferable Purchasing (EPP) Policy to guide municipal procurement and operational decisions.

B. Adopt the attached resolution 2025-97R authorizing the submittal of an application to the California Department of Resources Recycling and Recovery (CalRecycle) Rubberized Pavement Grant Program for Fiscal Year 2025–26 for the amount of $44,000.

BACKGROUND:

City of Selma has demonstrated its commitment to environmental stewardship through various initiatives, such as recycling paper waste, working with the contract waste hauler for disposal of recyclable materials, and installing solar powered lights. The proposed EPP Policy represents the next step in formalizing this commitment by integrating environmental considerations into the city’s procurement process, a major area of influence for the local government.

City Staff from Public Works, Finance, Community Development, and Engineering researched best practices and drafted a policy tailored to the city's needs. The draft policy incorporates elements from other successful municipal programs.

The California Department of Resources Recycling and Recovery (CalRecycle) administers the Rubberized Pavement Grant Program to promote the use of recycled waste tire rubber in roadway improvement projects. The program provides funding for cities and counties to offset the costs of using rubberized asphalt concrete in street resurfacing and repair.

DISCUSSION:

The proposed EPP Policy provides City staff with practical guidance to make purchasing decisions that reduce waste and pollution, conserve natural resources, and improve community health and safety. The policy establishes common-sense defaults for office supplies, janitorial products, equipment, fleet, and construction materials that align with state and federal best practices, while allowing reasonable exceptions where cost, performance, or availability are issues. Implementation relies on existing purchasing processes with minimal added administration efforts and only requires a simple summary of notable environmentally preferable purchases when needed for grants or reporting. Adoption of this policy demonstrates the City’s commitment to sustainability, fiscal responsibility through life-cycle 83 cost savings, and leadership in supporting local and regional markets for recycled and safer products.

The City of Selma has several roadway segments in need of rehabilitation due to wear, cracking, and surface deterioration. The use of rubberized pavement will not only improve driving conditions but will also extend roadway life, reduce maintenance costs, and divert thousands of waste tires from landfills.

The application for the CalRecycle grant will include improvements at various locations throughout the City, including but not limited to the following street segments: Area #1: Merlot St, Berry St, Sierra Madre Ct, Pine St (Cleveland St to end), Cleveland St, Evergreen St (Cleveland St to Mitchell Ave), Berry St, Peach St (Berry St to end), Sequoia St, Peach St (Sequioa St to end), Mill St, Evergreen St (Sequoia St to end), Pine St (Shaft St to end), and Shaft St. Area #2: Walnut St, Olive St, Plum St, and Orchard St. Area #3: Northview St, Willow St, Sierra View St, and Wright St.

FISCAL IMPACT:

No impact to Adopt the EPP Policy. No impact to submit the CalRecycle Application.

Environmentally Preferable Purchasing
(EPP) Policy
City of Selma • 1710 Tucker St., Selma, CA 93662 • (559) 891-2200 Adopted by City Council on: October 7, 2025

1. Purpose
This Policy guides City purchasing to: (a) reduce waste and pollution; (b) conserve energy, water, and natural resources; (c) support markets for recycled and responsibly produced goods; and (d) improve health and safety for workers and the community.

2. Scope
This Policy applies to all City departments and divisions when purchasing goods, equipment, supplies, and services (including construction and maintenance). Contractors and vendors are encouraged—and, where feasible, required by bid specifications—to provide products consistent with this Policy.

3. Key Definitions
• Environmentally Preferable Product (EPP): A product with a reduced impact on human health and the environment over its life cycle compared to alternatives. • Practicable: Meets performance needs, is available in a reasonable timeframe, and is competitively priced.
• Recycled Content: The proportion of a product made from recovered materials, including post-consumer materials used by end users and diverted from disposal.

4. Policy—What We Prefer to Buy
When practicable, departments will give preference to products and services that, as applicable:
• Contain recycled content, with emphasis on post-consumer content. • Are durable, repairable, reusable, or refillable and have minimal packaging. • Are energy- and water-efficient (e.g., ENERGY STAR®, WaterSense). • Reduce greenhouse gas emissions and air pollutants during use. • Are low-toxicity/low-VOC and safer for workers and the public. • Are available from local or regional suppliers when feasible to reduce transport impacts.

5. Practical Category Standards (Simple Defaults)
Departments should use these defaults unless a non-EPP is justified under Section 7.

Office & Janitorial
• Office paper and envelopes: ≥ 30% post-consumer recycled content; duplex printing by default. 87 CITY OF SELMA

(EPP) Policy
City of Selma • 1710 Tucker St., Selma, CA 93662 • (559) 891-2200 • Janitorial paper (towels, tissue): meets EPA Comprehensive Procurement Guidelines (CPG) or equivalent. • Toner/ink: remanufactured cartridges where compatible.

Electronics & Appliances
• Computers, monitors, printers, copiers, and major appliances: ENERGY STAR® (or EPEAT-registered where applicable).

Cleaning & Maintenance
• General cleaners, floor care, and hand soaps: products certified by U.S. EPA Safer Choice, Green Seal, or equivalent.
• Paints, coatings, adhesives, and sealants used in occupied spaces: low- or zero-VOC.

Fleet, Streets & Construction
• Motor oils and lubricants: re-refined products meeting applicable performance specs. • New on-road vehicles and off-road equipment: acquire the lowest feasible emission or zero-emission option suited to the task; prioritize EVs and hybrid equipment when practicable. • Construction materials: use recycled aggregate, reclaimed base, rubberized/asphalt concrete, recycledcontent signs/cones/stops, and compost/mulch for landscaping when practicable per project specs.

6. Waste Prevention & Recycling (Light-Touch)
• Use duplex printing as default and avoid unnecessary single-use items in City meetings and facilities when alternatives are readily available.
• Provide convenient recycling for paper, cardboard, bottles/cans, and proper handling of universal waste (e.g., batteries, fluorescent lamps) in City facilities.

7. Exceptions (Common-Sense Safeguards)
The City is not required to procure an EPP if any of the following apply:
• The product does not meet performance or safety needs. • The product is not available in time or in sufficient quantity. • The price is unreasonably higher than a non-EPP alternative after considering total cost of ownership (e.g., energy, maintenance, lifespan).
• Purchase would conflict with law, grant/contract conditions, or emergency needs.

When an exception is used, the requisition or purchase record should briefly note the reason (one sentence is sufficient).

8. Responsibilities (Minimal Administration)
• City Manager (or designee): Designates an EPP point of contact (e.g., Finance/Purchasing or Public Works) to answer quick staff questions and maintain this Policy. • Purchasing: Incorporates EPP preference language in solicitations and standard terms; uses sample specifications from state/federal programs when convenient. • Departments: Consider EPP options during requisition and use the defaults in Section 5 unless an exception applies.

9. Reporting (Keep It Simple)
Upon request for grants or annually if needed, the EPP point of contact compiles a one-page summary of notable EPP purchases (e.g., recycled paper, ENERGY STAR equipment, re-refined oil, recycled aggregate). No routine detailed tracking is required unless needed for funding.

10. Effective Date & Review
This Policy is effective upon Council adoption and will be reviewed every three (3) years or sooner if required to maintain grant eligibility or to reflect updated best practices. 89 90
