Council returned to discussion of Item 2-1:

Fire Department: Chief Webster provided details of the estimated $1.2 million cost for a new fire engine; he mentioned this expense is not in the operating budget. Chief Webster agreed to review the feasibility of using the Senator Hurtado grant money (Fund 459) for the fire truck. Chief Webster confirmed the requested $115,000 for a new Command Vehicle will be purchased locally.

Chief Webster provided explanation as to significant overtime. He explained significant portion of overtime ($585,000 budgeted) is due to EMS staff being classified differently than suppression staff, requiring 16 hours of mandatory overtime per week as part of their 56-hour work schedule, making it a planned expense.

Public Comment: Joyce Cason, community member, questioned Chief Webster regarding Phase 1 of Fire Campus, the EMS housing facility. Concern of project phasing and allocation of property during such phasing is expressed.

Community Development / Public Works / Capital Improvements: Deputy City Manager Keene addressed property in SW for Fire Campus. He added there was $1.3 million dollars in grant money pending. The request for an additional $100,000 for the Downtown BID Storefront Improvement Grant is pending a formal request and will be on the next BID agenda. Council Member Avalos and Mayor Robertson directed staff to include a placeholder of $1 million in the budget for the construction/replacement of downtown light posts (or Schaefer Park lights). He directed staff to work internally to find an appropriate fund source (e.g. Fund Balance, which will reduce it to $3 million if a full $1 million is budgeted). Council requested a comparison between Musco and non-Musco light options and related structural costs for the Schaefer Park lighting project. Council requested a workshop ASAP on the design plans for the Second Street grant project, including potential signage (arch sign) and downtown features. Mayor Robertson requested prioritizing the submission of the Request for Authorization (RFA) to Caltrans for construction funding before June 2026, once the right-of-way acquisition is complete. Mayor Robertson sparked discussion regarding full-time City Engineer versus use of contracted. David Horn, contracted City Engineer, provided budget details on Capital Improvement Projects.

Community Services: Staff were directed to increase funding to the 4100 Recreation budget to support additional events like "Selma Live". Council Member Avalos requested, and staff agreed to increase the Senior Activity general fund budget by $10,000 to allow for additional trips and activities, including potentially subsidizing one free excursion per year. Cultural Arts Center Coordinator Nicolette Andersen requested to convert her part-time employee into full-time, to better support grant writing, sponsorships, and daily theater operations. 18 Special Revenue / Enterprise / Debt Service: Finance Director Moreno detailed the Measure S Special Revenue Fund, Grants and Impact Fees with highlights of committed expenditures.

Director Moreno agreed to consult with an advisor on the feasibility of combining various debt measures (bonds) to secure a potentially lower interest rate. Finance Director Moreno agreed to provide a document detailing the aggregate monthly and annual debt service payments at the next Council meeting.

SIDE LETTER OF AGREEMENT
Between the International Association of Fire Fighters (IAFF) Local 3716, Fire Middle Management Employees and The City of Selma.

RECITALS
This Side Letter of Agreement (“Agreement”) is entered into by and between the City of Selma (“City”), the International Association of Fire Fighters, Local 3716 (“Union”), and the Fire Middle Management Employees (“Management Group”), collectively referred to as the “Parties.”

1. On June 30, 2024, the salary schedule in effect for classifications represented by IAFF Local 3716 and the Fire Middle Management Employees was used as the basis for calculating salary adjustments effective July 1, 2024.

2. A miscalculation occurred in applying the adjustments, resulting in under compensation of employees between July 1, 2024, and the present.

3. On October 21, 2025, the City will adopt a corrected salary schedule that reflects the intended salary adjustments.

4. The Parties desire to resolve the matter of under compensation through a one-time non-pensionable corrective payment, without altering the terms of the current Memoranda of Understanding (“MOUs”).

AGREEMENT

1. One-Time Corrective Payment
o The City shall provide a one-time, non-pensionable corrective payment to all active members of IAFF Local 3716 and the Fire Middle Management Employees.
o The payment for each eligible employee shall be calculated as one percent (1%) of the employee’s monthly base salary, multiplied by the number of months elapsed from July 1, 2024, through October 31, 2025. Employees hired after July 1, 2024, shall have their payment calculated using the number of months from their date of hire through October 31, 2025.
o For the purposes of this calculation, “monthly base salary” shall mean the employee’s current step monthly rate within their classification’s salary range, as 33 reflected in the Master Salary Schedule adopted by the City Council on October 21, 2025.

2. Timing of Payment
o The corrective payment shall be issued during the pay period beginning on November 1, 2025.
o Adjustment for Delayed Payment: In the event the payment is not processed during the November 1, 2025 pay period, the amount owed to each employee shall increase proportionally by continuing to apply the same methodology described above (1% of monthly base salary per month) for each additional month that elapses beyond October 31, 2025, until payment is made.

3. Purpose
a. This payment is provided solely to make employees whole for the period of July 1, 2024, through October 31, 2025, due to the miscalculation of salary increases.
b. The Parties expressly agree that this payment is non-pensionable and shall not be reported to CalPERS as pensionable compensation.

4. No Modification of MOUs
a. This Agreement shall not amend, modify, or otherwise affect the terms and conditions of the current MOUs between the City and the bargaining groups.

5. Entire Agreement
a. This Agreement constitutes the entire understanding of the Parties with respect to the matters addressed herein.

CITY COUNCIL STAFF REPORT

MEETING
DATE:

October 21, 2025
SUBJECT: Consideration of Resolution 2025-103R adopting changes to the Master Salary Schedule for the positions represented by the International Association of Fire Fighters (IAFF) Local 3716, Fire Middle Management Employees, Senior Accountant and Accountant
SUBMITTED: Margee Fallert, Interim Administrative Services Director APPROVED: John Kunkel, Interim City Manager
RECOMMENDATION:

Adopt Resolution 2025-103R approving changes to the Master Salary Schedule for the positions represented by the International Association of Fire Fighters (IAFF) Local 3716, Fire Middle Management Employees, Senior Accountant and Accountant.

DISCUSSION:

In the Fall of 2024, the Fire Union had identified issues with the salary chart for the positions that they represented in both the percentage implemented into the chart and the five percent steps between classifications. Changes were not made at the time and had a compounding effect on increases that were implemented in 2025.

The attached salary chart corrects the issues including not allowing rounding between the five percent steps in the chart. In addition, the Human Resources department is implementing a non-shift hourly rate for any ranks within the department that are normally on a 112-wage schedule. With the addition of this rate, it allows more flexibility to the department when employees are not on a shift schedule for extended periods of time due to injury etc.

In addition to the above, there was a minor error in the calculation of the Senior Accountant and inadvertently the vacant/unfunded Accountant position was overlooked, when increasing the salary by the COLA of three (3%) percent in July 2024 and two (2%) percent in July 2025. It is a practice to update all classification, even if vacant, so they remain current to market.

Section 36506 of the California Government Code provides that the City Council shall fix the compensation of all appointive officers and employees by resolution or ordinance.

Additionally, Section 570.5 of Title 2 of the California Code of Regulations requires that pay rates be approved and adopted by the City Council and included in a publicly available salary schedule. This schedule must list the position title, pay rate (whether a single amount or within a range), and the applicable time base (hourly, daily, bi-weekly, monthly, bi-monthly, or annually).
37 The California Public Employees’ Retirement System (CalPERS), pursuant to its interpretation of Title 2 CCR § 570.5, recommends that all CalPERS employers maintain compensation levels in a single, publicly available document that is approved and adopted by the governing body and meets all regulatory requirements. While CalPERS has indicated that it may revisit its interpretation, no formal revisions have been issued to date.

To maintain compliance with CalPERS' current recommended interpretation and with Title 2 CCR § 570.5, the City continues to maintain and adopt a unified Master Salary Schedule.

FISCAL IMPACT:

The impact of the COLA increases was included in the budget and a mid-year budget adjustment will be brought to Council to account for the equity adjustments.

CITY COUNCIL STAFF REPORT
Meeting Date: October 21, 2025
SUBJECT: Consideration and Necessary Action on Resolution 2025-99R Approving and Authorizing Execution of First Amended Fire Chief Employment Agreement.

SUBMITTED: Neal E. Costanzo, City Attorney
APPROVED: John Kunkel, Interim City Manager
RECOMMENDATION:

Adopt Resolution 2025-99R Approving and Authorizing Execution of First Amendment to Fire Chief Employment Agreement.

DISCUSSION:

The Fire Chief previously entered into a new contract on July 1, 2025, for employment as such. At the time, that contract was entered into the council determined that there should be a rough parity between the agreements employing the Fire Chief and the Chief of Police. The First Amendment to the Fire Chief Employment Agreement simply changes the rate of contributions made into the Fire Chief’s IRC § 457 (b) deferred compensation plan, to be equivalent to that paid by the city into the Chief of Police’s deferred compensation plan.

FISCAL IMPACT:
$1,250.00 per month, approximately, the difference between the amount previously paid into a deferred retirement account and the amount provided for by the First Amendment to the Fire Chief’s Agreement.

A RESOLUTION OF THE CITY COUNCIL OF SELMA APPROVING AND

AUTHORIZING EXECUTION OF FIRST AMENDEMENT TO FIRE CHIEF

EMPLOYMENT AGREEMENT
WHEREAS, the City Council previously determined to achieve parity, to the extent practicable, between the terms of employment of the Chief of Police and the Fire Chief and the Fire Chief has requested an additional approximately $416 to be deposited to his deferred compensation account for retirement to be equal to that deposited by the city for the Chief of Police under his Employment Agreement. The first amended Fire Chief Employment Agreement makes that change.

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

1. The foregoing recitals are true and correct.

2. The City Council has reviewed and approves the First Amended Fire Chief Employment Agreement, and the Mayor is authorized to sign the same on behalf of the City.

64 FIRST AMENDED FIRE CHIEF EMPLOYMENT AGREEMENT
The Fire Chief Employment Agreement (Agreement) was entered into as of July 1, 2025, and fully supersedes the Fire Chief Employment Agreement entered into on August 28, 2023, between the City of Selma (“City”) and Jordan Webster (“Employee”).

This First Amended Fire Chief Employment Agreement changes only the provisions relating to City and Employee contributions to a tax deferred account selected by employee appearing in Section (4) (B) (40 below and the change is effective beginning on October 1, 2025. .

RECITALS
A. Employee was appointed Fire Chief on August 28, 2023, and both Employee and City desire that Employee continue his employment as Fire Chief of the City of Selma according to substantially the same terms and conditions provided for by the former Fire Chief Employment Agreement of August 28, 2023, which this Agreement fully supersedes.

AGREEMENT
NOW, THEREFORE, in consideration of the mutual promises and agreements set forth below, City and Employee agree as follows:

1. Position and Duties. Employee shall serve as Fire Chief of the City.

Employee shall have those powers and duties set forth for the position of Fire Chief in the City’s Municipal Code, the Government Code of the State of California and any other applicable law of the State of California and as are customarily performed by one holding the position of Fire Chief in a California city. The City Council shall have the power to determine such other specific duties and responsibilities Employee must perform, but only to the extent that such duties conform to statute and are of a nature customarily performed by the person holding the position of Fire Chief in a California city. The City Council may act on the recommendation of the City Manager.

2. Term. The term of this Agreement shall commence July 1, 2025, and it shall be in full force and effect for a period of five (5) years and will remain in full force and effect until June 30, 2030, or until sooner terminated by Employer or Employee as provided in this Agreement.

3. At-Will Employment Status, Exemption From Personnel System, and Termination. Employees' employment is at will. Thus, Employee's employment is at the mutual consent of Employee and City and either Employee or City may terminate the employment at-will. City may terminate Employee at any time, with or without good cause, for any reason whatsoever that does not violate any law or public policy of the State of California. Termination shall be by at least three (3) affirmative votes of the City 65 Council. Employee may terminate his employment at any time, with or without good cause, for any reason whatsoever. Employee is exempt from the City's Personnel System and holds no property right in his employment. Employee agrees that no representative of City has made or can make any promises, statements, or representations which state or imply that Employee is hired or retained under any terms other than at-will and with exemption from City's Personnel System, as set forth above. Employee agrees that no agreement can impliedly arise that Employee is employed under any terms other than atwill and with exemption from City's Personnel System, as set forth above. Employee's status as at-will and exempt from City's Personnel System may only be changed, revoked, amended, or superseded by a written document, signed by Employee and the Mayor following approval by the City Council.

4. Compensation and Benefits. Employee shall receive the following compensation.

A. Salary/Hourly Rate. Employee will receive an annual salary of two hundred one thousand two hundred twenty five dollars and sixty two cents ($201,225.62). The City Manager may adjust the salary annually by virtue of an annual performance evaluation in an amount permitted by the terms of this Agreement and any applicable salary schedule within the range established by the Selma City Council for Employee’s position. In the event the Fire MidManagement bargaining group receives a percentage increase in the base pay, or Cost of Living adjustments (COLA) for any fiscal or calendar year according to the terms of a memorandum of understanding Employee shall receive an equivalent percentage increase or adjustments to base pay.

B. Benefits. In addition to the salary provided in paragraph 4A herein above, Employee shall receive the following vacation.
(1) Vacation Leave. Employee shall accrue vacation leave with pay during each 12-month period during which this Agreement is in effect at the rate of 7.3846 hours per pay period; 192 hours per year, and shall accrue vacation leave with pay up to the maximum accrual rate of 480 hours. Employee shall be entitled to accrue vacation leave with pay that is not used from year to year up to the maximum amount of 480 hours at which point, Employee will cease to accrue vacation with pay until and to the extent vacation is used and accrued vacation leave falls below 480 hours. In the event Employee is terminated or resigns, Employee shall be compensated for all accrued and unused vacation leave up to the maximum amount of 480 hours.
(2) Management and Holiday Leave. Employee shall be
allowed ninety-six 96 hours of management leave annually and such other 66 time as the City Manager may approve as management leave with full compensation. Employee shall accrue management leave at the rate of ninety-six (96) hours for each year of service. Management leave not used each year shall continue to accrue from year to year up to a maximum of 240 hours, at which point, Employee shall cease to accrue management leave until and to the extent the accrued leave is used and falls below 240 hours. Accrued management leave is not deferred compensation and if not used prior to when Employee resigns or is terminated, the Employee shall not receive any monetary compensation for any accrued or unused management leave. Employee is entitled to all holiday leaves or privileges as now or may hereafter be provided to regular employees of the City. (3) Sick Leave. Employee shall accrue and have credited to his personal account sick leave at the rate of 1 workday each month or

Accrued and unused sick leave is not paid to Employee and Employee shall not be compensated for such leave in the event of termination or resignation. (4) Retirement. Employee is considered a “classic” safety member of CalPERS pursuant to Public Employee’s Pension Reform Act (PEPRA), and the City shall provide Employee with a CalPERS safety two percent (2%) at fifty (50) retirement plan. The Employee’s share of the contribution shall be fully vested in each Employee’s name in accordance with CalPERS policies. Classic employees contribute the full 9% of compensation earnable member contribution, and 3% compensation earnable of the required employer contribution as cost sharing in accordance with Government Code §20516(f) for a total employee CalPERS contribution of 12%.

Further, City agrees to deposit $833.06 per month to a tax deferred retirement account voluntarily established by the Employee in the Employee’s name in one of the City’s 457 tax deferred compensation plans that the Employee elects. In addition, City will match Employee’s contribution of up to $833.06 per month.
(5) Disability, Health and Life Insurance. Employee shall select and have provided for him and his eligible dependents the health benefits provided for all eligible employees of City including health, dental, and vision care services. City pays 90% of the premium for such health, dental, and vision care services and Employee is responsible for and consents to a payroll reduction of 10% of the cost of such premiums. In addition, Employee shall have provided for him at City’s cost, group life 67 insurance and accidental death and dismemberment insurance in the amount of $100,000 payable to a beneficiary designated by Employee. (6) Dues and Subscriptions. City agrees to budget and to pay for the professional dues and subscriptions of Employee necessary for his continuation of and full participation in national, regional, state and local associations and organizations necessary and desirable for his continued professional participation, growth and advancement which shall be considered a benefit to the City, as approved by the City Manager. (7) Professional Development/Automobile. Once completed, City Staff will be able to include additional sidewalk and curb ramp improvements to be constructed with the current project.

SUBMITTED: David Horn, City Engineer
APPROVED: Jerome Keene, Deputy City Manager
RECOMMENDATION:

Berry Jr., Inc. for the Selma Sidewalk Connectivity Phase III Project (CDBG 24651) in the amount of $56,249.00; approve a 10% construction contingency for potential change orders in the amount of $5,600 for this project; and authorize the City Manager to sign contract documents on behalf of the City.

BACKGROUND:

The County of Fresno receives an annual allocation of Community Development Block Grant (CDBG) grant funds from the federal government Department of Housing and Urban Development (HUD). The County makes a portion of these grant funds available to each of its participating cities based on the same HUD formula by which the County receives its funding. Each City participating in the County’s CDBG program is invited to submit activity proposals for its portion of CDBG grant funds. The five participating cities include the cities of Fowler, Kerman, Kingsburg, Reedley and Selma.

On September 10, 2024, the Community Development Division of the Fresno County Department of Public Works and Planning and the City entered into Agreement 24-496 (“Agreement”) for the Sidewalk Connectivity Project #24651. The Agreement included $232,796 of funds from the County for the project. On July 8, 2025, the County and the City entered into Amendment I to the Agreement to include an additional $68,461 in CDBG funds available to the Project. The County has proposed an Amendment II to the Agreement to include an additional $229,303 in CDBG funds for this project. The total amount of CDBG funds available to the City is $530,560 for design, construction, contingencies, and construction management costs.

The proposed Project included concrete improvements in the public right-of-way to provide continuous sidewalk and accessible access as depicted in the City of Selma Active Transportation Plan for Prioritized Sidewalk and Intersection Improvements. The various areas of work are within the area bounded by Yerba Street to the south, Thompson Avenue to the west, Second Street to the north, and Sheridan Street to the east. 97 On October 2, 2025, the City held a public bid opening for the Selma Sidewalk Connectivity Phase III, CDBG #24651 (“Project”). The Engineers Estimate for the Project Base Bid was $208,000. The City received and opened bids from seven contractors. The low bid for this project shall be the lowest bid price on the construction base bid contract without consideration of the additive alternate costs. The amount of the bids were as follows:

1. Employment. City agrees to employ Employee to render services as City Manager of City on the terms and conditions set forth in this Agreement and Employee accepts such employment on the terms and conditions set forth in this Agreement.

2. Term. The term of Employee's employment shall be three (3) years, commencing on November 17, 2025, and ending on the earliest of:

A. November 17, 2028, or
B. The date of termination of Employee's employment in accordance with paragraph 4 below.

3. Position and Duties. Employee shall serve as City Manager of City. Employee shall have those powers and duties set forth in City's Municipal Code. The City Council of the City ("City Council") shall have the power to determine such other specific duties and responsibilities which Employee must perform, and the means and manner by which Employee must perform those duties and responsibilities. The City Council has previously established the following as duties and responsibilities of the City Manager:

A. The City Manager position is designated as a “on-site” role. Employee is encouraged to perform all duties and responsibilities insofar as practicable at the City’s designated work location, Selma City Hall, or within the boundaries of the City of Selma. City recognizes that City Manager must be at other locations outside of the city boundaries in order to effectively perform his job duties and under no circumstances shall employee be required to be on site at City Hall any specific number of hours per week. The provisions of this sub-paragraph are only intended to discourage the practice of working from home remotely on a consistent, long-term basis.

B. The City Manager is encouraged to actively participate, to the extent practicable in community events, public relations activities, outreach programs and other events as directed by City. These events may occur outside of standard business hours, including evenings and weekends; attendance, when available, shall be considered encouraged. City does not expect Employee to discontinue or limit his presence for personal or family events or activities, only to encourage Employee’s presence at 114
community events when he is available. City Manager will necessarily work in excess of forty (40) hours per week on average and city recognizes that Employee will exercise his best judgement in adjusting his presence at City Hall or at community events or adjust the number of hours worked per week to accommodate his own personal or family obligations. Employee is not to be penalized in any evaluation or otherwise, for adjusting his presence at City Hall or at city events or other functions as he in his sole judgement determines is necessary.

Employee should otherwise devote his working time and efforts to his function and duties as City Manager and shall not have any outside work in the capacity of an independent contractor or employee.

C. The City Manager is required to prepare and submit to City Council weekly written reports summarizing key administrative activities, departmental updates, on-going projects and any issues requiring Council attention. Such Reports shall be submitted to the City Council by email each week, unless otherwise directed by the City Council.

D. In addition to written reports, the City Manager shall maintain on-going transparent communication with the City Council; attend all regular and special City Council meetings, unless excused; provide timely verbal briefings, recommendations and analyses as requested by the City Council; ensure council members are informed of significant developments affecting city operations, finances, personnel or public relations; respond promptly and professionally to council inquires and requests for information. These communications and reporting responsibilities are considered essential job duties for the position of City Manager.

4. At-Will Employment Status, Exemption from Personnel System, and Termination. Employee's employment is at-will. Thus, Employee's employment is at the mutual consent of Employee and City and either Employee or City may terminate this Agreement at-will. City may terminate Employee at any time, with or without good cause, for any reason whatsoever that does not violate a public policy of the State of California.

Termination shall be by at least three (3) affirmative votes of the City Council. Employee may terminate his employment at any time, with or without good cause, for any reason whatsoever, subject to the notice requirement set forth in paragraph 8 below. Employee is exempt from City's Personnel System and holds no property right in his employment.

Employee agrees that no representative of City has made or can make any promises, statements, or representations which state or imply that Employee is hired or retained under any terms other than at-will and with exemption from City's Personnel System, as set forth above. Employee agrees that no agreement can impliedly arise that Employee is employed under any terms other than at-will and with exemption from City's Personnel System, as set forth above.
115
Employee's status as at-will and exemption from City's Personnel System may only be changed, revoked, amended, or superseded by a written document, signed by Employee and the Mayor following approval by the City Council.

In addition, City agrees to deposit five thousand dollars ($5,000) annually or two hundred eight dollars and thirty-three ($208.33) per pay period into a deferred retirement account voluntarily established by Employee in the Employee’s name in one of the City’s IRSC § 457 taxdeferred compensation plans that Employee elects.
