Pre-Zoning/Re-Zoning for the

ITEM NO: 2-3
CITY COUNCIL STAFF REPORT
Meeting Date: January 6, 2026
SUBJECT: Second Reading and Adoption – Ordinance No. 2025-16 PreZoning/Re-Zoning for the Selma Casitas Project (Application No. 2022- 030)
SUBMITTED: Lupe Macias, Associate Planner
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:
Staff recommends the City Council adopt Ordinance 2025-16 approving the prezone of property to R-4 and C-3 for the Casitas Project (Application 2022-030) and waive the second reading.
BACKGROUND:
On December 16, 2025, the City Council conducted a public hearing and approved Ordinance 2025-16 to prezone property to R-4 and C-3, along with Resolutions 2025-135R and Resolution 2025-136R for approvals associated with the Casitas project. A second reading of the ordinance for the prezoning of the project is required before it becomes effective.
River Park Properties II filed Application No. 2022-0030 requesting approval of a large-scale mixed-use development known as the Selma Casitas Project, consisting of:
• 600 multifamily apartment units;
• 40,000 sq. ft. of commercial retail/food service uses; • A 100-key hotel;
• A public park;
• A Vesting Tentative Subdivision Map to create 17 lots and 3 outlots for building pads, parking lots, apartment development, and a public park; • Annexation of approximately 75.3 acres into the City of Selma.
FISCAL IMPACT:
Future revenues from the project could include property taxes, sales taxes, transient occupancy taxes, and developer impact fees. Furthermore, the project would be required to annex to the Community Facilities District for its proportional share of city services, such as road maintenance, park maintenance, police, fire protection, and sewer maintenance.

PROJECT)
WHEREAS, River Park Properties II (“Applicant”) filed Application No. 2022-0030 requesting approval of the Selma Casitas Project, a mixed-use development consisting of approximately 600 multi-family units, 40,000 square feet of commercial retail/food service, a 100-key hotel, a public park, a Vesting Tentative Subdivision Map, and annexation of approximately 75.3 acres to the City of Selma; and
WHEREAS, the City Council has adopted Resolution No. 2025-135R certifying the Final Environmental Impact Report (SCH No. 2024070105), adopting the Findings of Fact, the Statement of Overriding Considerations, and the Mitigation Monitoring and Reporting Program (MMRP) for the Selma Casitas Project; and
WHEREAS, the City Council has adopted Resolution No. 2025-135R approving the General Plan Amendment, Vesting Tentative Subdivision Map, and Site Plan Review for the project; and
WHEREAS, the proposed pre-zoning to R-4 (High Density Residential) and C-3 (Commercial Service) is consistent with the City of Selma General Plan, supports development of a horizontal mixed-use project, and is required for the annexation to be processed by the Fresno County Local Agency Formation Commission (LAFCo); and WHEREAS, pursuant to Government Code Sections 56375 and 65859, pre-zoning becomes effective only upon completion of the annexation; and

THE CITY COUNCIL OF THE CITY OF SELMA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council hereby adopts the pre-zoning of the property included in Application No. 2022-0030 to the following zoning districts, consistent with the approved General Plan Amendment.
• R-4 (High Density Residential) for the multifamily residential portion of the project; and
• C-3 (Commercial Service) for the commercial and hotel portions of the project.
These zoning classifications shall become effective solely upon the successful completion of annexation proceedings by Fresno LAFCo.
31 SECTION 2. The City Council finds that the pre-zoning to R-4 and C-3 is consistent with the General Plan designations approved under Resolution No. 2025-135R and complies with all applicable General Plan policies.
SECTION 3. The City Council relies on the Final Environmental Impact Report (SCH No. 2024070105) certified under Resolution No. 2025-135R and incorporates that resolution by reference as the CEQA document for this ordinance.
No further environmental review is required pursuant to CEQA Guidelines §§ 15162 and 15168.
SECTION 4. City staff is directed to transmit this Ordinance and all required supporting materials to the Fresno County Local Agency Formation Commission (LAFCo) for inclusion in the annexation application and processing of the reorganization.
SECTION 5. If any section, subsection, clause, or phrase of this Ordinance is declared invalid or unconstitutional, such decision shall not affect the remaining portions of the Ordinance.
SECTION 6. This Ordinance shall take effect 30 days after adoption, except that prezoning classifications shall not become operative until the effective date of the annexation approved by Fresno LAFCo.

Public Hearing –
Consideration of a
Resolution to Approve the
Annexation of Tract 6244
(Amberwood, Phase 1) to
Community Facilities District
2006-01 and Establish Zone
of Benefit B

ITEM NO: 4-1
CITY COUNCIL STAFF REPORT
Meeting Date: January 6, 2026
SUBJECT: Consideration of Resolution 2026-02R to Approve the Annexation of Tract 6244 (Amberwood, Phase 1) to Community Facilities District 2006- 01 and Establish Zone of Benefit B
SUBMITTED: David Horn, City Engineer
APPROVED: Jason Roger, City Manager
RECOMMENDATION:
Staff recommends the City Council:
1. Adopt Resolution 2026-02R to Approve the Annexation of Lots 1 through 297 of Tract 6244 (Amberwood, Phase 1) to Community Facilities District 2006-01 and Establish Zone of Benefit B.
BACKGROUND:
The Final Map and Subdivision Agreement for Tract 6244, Phase 1 of the Amberwood Specific Plan, was approved by the Selma City Council on November 18, 2025. At that time, the Council also adopted a rate to be levied by Community Facilities District (CFD) 2006-01 to fund maintenance of associated amenities such as police, fire, landscaping, street lighting, parks (on and off-site), streets (on and off-site), and storm drainage (on and off-site) for future residents of the projects.
The proposed special tax for the subdivision is as follows:
Service Cost per Lot Annual Total
Admin Costs* $25.24 $7,495.56
Community Park Facilities $7.16 $2,127.20
Fire $381.98 $113,448.90
Landscaping $83.50 $24,798.76
Park Maintenance $111.44 $33,099.01
Police $400.82 $119,042.06
Road Maintenance (off site) $66.10 $19,630.47
Road Maintenance (on site) $308.87 $91,735.20
Storm Drain (on-site) $15.63 $4,642.11
Storm Drain (off-site) $2.01 $596.47
Streetlight $7.74 $2,297.33
Total Special Tax Levied $1,410.48 $418,913.08
35 DISCUSSION:
As part of the establishment of the rate, the Council adopted a resolution giving a 45-day notice of the intent to annex the entirety of Tract 6244 to CFD 2006-01 and create Zone of Benefit B. The separate Zone of Benefit is needed to levy the property at the rates adopted, which is different than prior rates established for the other portion of CFD 2006-01 that covers Vineyard Estates (Tract 5217, Phases 1, 2, and 3).
The public hearing is to be conducted to allow for any protests, written or oral, by any party that owns real property within the proposed annexation area. The current annex area is owned by a single entity, Lennar Homes, which is the developer for this subdivision. As of the date of this report, no written or oral protest has been filed with City staff.
Similar special tax levies will be required for future phases of the Amberwood Specific Plan development area to reduce reliance on service and maintenance from the General Fund and earmarked allocation funds. Additional Zones of Benefit for future phases of the Amberwood will also be needed for projects based on the amenities constructed, as different projects may have different proposed components that may require different levels and costs for maintenance.
FISCAL IMPACT:
The CFD would allow for the fair share contribution of revenue to support the services and ongoing maintenance of the infrastructure for the proposed project without support from the General Fund. Furthermore, the development of the project would generate both property tax and sales tax, which would increase revenues to the General Fund.

SUBJECT: Discussion and Direction Regarding High Street Downtown Planters SUBMITTED: Michael Honn Public Worlcs Director
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:
Staff requests Council's direction on a design for the "Downtown District" High Street planters.
DISCUSSION:
Consensus is needed for the final design of the new planters that were installed along High Street between First and Second Streets in late October of 2025. While we discuss the options that are before you tonight, it is important to look at the long-term goal for the appearance that the BID committee and City Council are trying to achieve for the Downtown District.
Final approval for a design will be incorporated into the new city standards that will be included in the second phase of the standard revision. Drought resistant plants, hardscapes and other easily maintained items are preferred by Public Works for sustainability and ease of maintenance.
FISCAL IMPACT:
$8,000.00 Low end basic weed barrier and mid-sized rock. $ 35,000.00 High end with steel boarder with DG and weed barrier with mid-sized rock and drought resistant plants (2 to 3 each).

SUBMITTED: Jordan Webster, Fire Chief
APPROVED: Jason Rogers, City Manager
RECOMMENDATION;
Staff recommends the City Council adopt resolution approving the purchase of a modular building to be utilized as the EMS Division living quarters, Phase 1 of the New Fire Station Campus located at Thompson and Huntsman and authorize the City Manager or designee to execute all necessary documents.
DISCUSSION:
The City of Selma Fire Department's Emergency Medical Services (EMS) Division currently operates three Advanced Life Support (ALS) ambulances 24/7, 365 days a year, with plans to add a fourth part-time unit. The existing EMS Post 3 facility at 1231 Rose Ave. is leased, inadequate in terms of space, privacy, and safety for staff, necessitating the expedited development of a new facility as part of a larger, multi-phase campus project. The city has prioritized the EMS facility as Phase 1 of the Fire Station Campus development, with subsequent phases to follow as funding and planning allow.
The proposed modular building will be located at the Fire Station Campus located on the Northwest corner of Thompson and Huntsman in Selma, California. It is designed to accommodate three ALS ambulance crews operating 24/7, providing living quarters for up to six personnel. The facility will include:
• Six individual barracks/bedrooms
• Two restroom/ shower facilities
• Aday room
• A kitchen area
• An EMS supply/restock room
The modular building is a 48' x 44' complex, totaling approximately 2,112 square feet, and is designed to meet the operational needs of EMS staff who work extended shifts (48-96 hours).
The facility will provide improved privacy, safety, and comfort, addressing the shortcom of the current leased facility. The modular approach allows for rapid deployment and cost savings compared to traditional construction, and the building is designed to be repurposed or integrated into future campus phases as needed.

The policy must include contractual liability that has not been amended. Any endorsement restricting standard ISO “insured contract” language will not be accepted.

Any policy inception date, continuity date, or retroactive date must be before the effective date of this agreement and Consultant agrees to maintain continuous coverage through a period no less than three years after completion of the services required by this agreement.
Consultant shall submit to City, along with the certificate of insurance, a Waiver of Subrogation endorsement in favor of the City, its officers, agents, employees and volunteers.
Proof of insurance. Consultant shall provide certificates of insurance to City as evidence of the insurance coverage required herein, along with a waiver of subrogation endorsement for workers’ compensation. Insurance certificates and endorsement must be approved by City’s Risk Manager prior to commencement of performance. Current certification of insurance shall be kept on file with City at all times during the term of this contract. City reserves the right to require complete, certified copies of all required insurance policies, at any time.
Duration of coverage. Consultant shall procure and maintain for the duration of the contract insurance against claims for injuries to persons or damages to property, which may arise from or in connection with the performance of the Services hereunder by Consultant, his agents, representatives, employees or subconsultants.
Primary/noncontributing. Coverage provided by Consultant shall be primary and any insurance or self-insurance procured or maintained by City shall not be required to 81 contribute with it. The limits of insurance required herein may be satisfied by a combination of primary and umbrella or excess insurance. Any umbrella or excess insurance shall contain or be endorsed to contain a provision that such coverage shall also apply on a primary and non-contributory basis for the benefit of City before the City’s own insurance or self-insurance shall be called upon to protect it as a named insured.
City’s rights of enforcement. In the event any policy of insurance required under this Agreement does not comply with these specifications or is canceled and not replaced, City has the right but not the duty to obtain the insurance it deems necessary and any premium paid by City will be promptly reimbursed by Consultant, or City will withhold amounts sufficient to pay premium from Consultant payments. Waiver of subrogation. All insurance coverage maintained or procured pursuant to this agreement shall be endorsed to waive subrogation against City, its elected or appointed officers, agents, officials, employees and volunteers or shall specifically allow Consultant or others providing insurance evidence in compliance with these specifications to waive their right of recovery prior to a loss. Consultant hereby waives its own right of recovery against City, and shall require similar written express waivers and insurance clauses from each of its subconsultants.
Enforcement of contract provisions (non estoppel). Consultant acknowledges and agrees that any actual or alleged failure on the part of the City to inform Consultant of noncompliance with any requirement imposes no additional obligations on the City nor does it waive any rights hereunder.
Requirements not limiting. Requirements of specific coverage features or limits contained in this Section are not intended as a limitation on coverage, limits or other requirements, or a waiver of any coverage normally provided by any insurance. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type. If the Consultant maintains higher limits than the minimums shown above, the City requires and shall be entitled to coverage for the higher limits maintained by the Consultant. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the City.
Notice of cancellation. Consultant agrees to oblige its insurance agent or broker and insurers to provide to City with a thirty (30) day notice of cancellation (except for nonpayment for which a ten (10) day notice is required) or nonrenewal of coverage for each required coverage.
82 Additional insured status. General liability policies shall provide or be endorsed to provide that City and its officers, officials, employees, and agents, and volunteers shall be additional insureds under such policies. This provision shall also apply to any excess liability policies.
Prohibition of undisclosed coverage limitations. None of the coverages required herein will be in compliance with these requirements if they include any limiting endorsement of any kind that has not been first submitted to City and approved of in writing.
Separation of Insureds. A severability of interests provision must apply for all additional insureds ensuring that Consultant’s insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the insurer’s limits of liability.
The policy(ies) shall not contain any cross-liability exclusions.
Pass Through Clause. Consultant agrees to ensure that its subconsultants, subcontractors, and any other party involved with the project who is brought onto or involved in the project by Consultant, provide the same minimum insurance coverage and endorsements required of Consultant. Consultant agrees to monitor and review all such coverage and assumes all responsibility for ensuring that such coverage is provided in conformity with the requirements of this section. Consultant agrees that upon request, all agreements with consultants, subcontractors, and others engaged in the project will be submitted to City for review.
City’s right to revise specifications. The City reserves the right at any time during the term of the contract to change the amounts and types of insurance required by giving the Consultant ninety (90) days advance written notice of such change. If such change results in substantial additional cost to the Consultant, the City and Consultant may renegotiate Consultant’s compensation.
Self-insured retentions. Any self-insured retentions must be declared to and approved by the City. The City reserves the right to require that self-insured retentions be eliminated, lowered, or replaced by a deductible. Self-insurance will not be considered to comply with these specifications unless approved by the City.
Timely notice of claims. Consultant shall give the City prompt and timely notice of claims made or suits instituted that arise out of or result from Consultant’s performance under this Agreement, and that involve or may involve coverage under any of the required liability policies.
Additional insurance. Consultant shall also procure and maintain, at its own cost and expense, any additional kinds of insurance, which in its own judgment may be necessary for its proper protection and prosecution of the work.

Mobile Modular shall pass on all manufacturer’s component warranties that may be available. This warranty is limited to "Normal" usage and exposure. The following are excluded by the definition of "Normal" and therefore from this warranty if such conditions exist: (a) failure to provide drainage of water from all surfaces on or around the buildings, (b) improper maintenance, (c) installation in an area subject to heavy snow, fall out of corrosive chemicals, ash or fumes from chemical plants, foundries, plating works, kilns, fertilizing manufacturers, paper plants and the like, (d) Acts of God, vandalism, falling objects, external forces, explosion, fire, riots, acts of war and radiation, and (e) modifications or alterations performed by Customer that affect code compliance or the structural integrity of the buildings or their components.

Customer will be solely responsible, at its cost, for preparation of the site on which the equipment is to be used, including any required structural or grade alterations and identification of utility lines. Customer will provide firm and level ground on no more than a six-inch (6”) slope from one end to the other for safe and unobstructed installation of the equipment. Site selection is the sole responsibility of the Customer.
The Customer warrants that he owns, or has the right to construct buildings on, the property upon which the equipment as described herein is to be delivered, constructed, or other work performed, and will designate to Mobile Modular the location of the corner stakes of the property and will furnish the plot plan showing the boundary dimensions and angles of the property, and the proposed location of the site of the building or other work to be performed, together with all necessary information concerning contours, grades, soil conditions, tree locations, utility service lines, rights of way, easements and restrictions, dimensions and other relevant data pertaining to existing structures on the premises. Mobile Modular shall not be responsible for encroachments of any type. The Customer warrants that the said construction will not violate zoning restrictions or other laws, and the Customer agrees to indemnify and hold Mobile Modular harmless from all loss or damage or liability which may result by reason of the construction of the said building or other work done, or from any lack or defect of title in the Customer, or by reason of said construction violating any zoning restrictions or other laws.
The Customer agrees not to interfere with the progress of the work, and not to occupy any portion of the building until all terms and conditions herein are fulfilled by both parties. Customer further agrees not to permit any workmen other than those of Mobile Modular to work at or in the immediate vicinity of the building without Mobile Modular’s written consent until Mobile Modular’s work on the building is completed. The Customer agrees to pay Mobile Modular for any damage that may be caused by anyone other than workmen or subcontractors of Mobile Modular, by reason of disturbing or damaging concrete forms, grade finishing or any construction work in process whatsoever.
Mobile Modular’s price and schedule are based on the assumption that the site is environmentally clean and has no subsurface conditions. If any are found, the Customer will be responsible for the remediation of pre-existing environmental conditions and the removal/displacement of subsurface conditions found at the project site.
Risk of loss shall transfer to the Customer upon delivery of the Equipment to the Site. Substantial Completion shall be achieved when the work is completed in accordance with Mobile Modular’s proposal and is ready for its intended use and operation, except for punch list items of work by Mobile Modular. Title to the equipment will be furnished to the Customer within thirty (30) days of Mobile Modular’s receipt of payment in full from the Customer.
This Agreement is strictly by and between Mobile Modular and Customer and Mobile Modular is not responsible for the terms and conditions of any prime contract between Customer and Owner.
This transaction is subject to Mobile Modular Corporate Credit and Risk Management approval.
Customer is hereby advised of the following: Due to the extreme volatility in the materials market Mobile Modular retains the right to apply an equitable adjustment in the amount of any or all of the charges set forth in this Sale Agreement to account for any increases in material costs which may occur between the "Date Printed" shown on this Sale Agreement to the date that the Scope of Work is performed by Mobile Modular, to the extent that such increases are not the result of any fault or negligence on the part of Mobile Modular.
