3-REGULAR BUSINESS
3-1 Consideration and Necessary Action on Resolution 2026-20R, Adopting Interim Downtown Exterior Color Standards
Moreno
Discussion on Regular Business Item 3-1: Council considered resolution 2026-20R, adopting an interim exterior color standard for the downtown district. Based on the feedback from City Council, BID and Planning Commissions during 2025 meetings, a refined Historic Terracotta Color Palette had been chosen as the standard; that color palette was provided by Communications Director Moreno as an exhibit, for reference. The purpose of Resolution 2026-20R is to maintain aesthetic cohesion while a more comprehensive Downtown guideline is finalized. Concerns of implementation and compliance were raised.

Public Comment:
• Mayor Robertson expressed concern over the ability to enforce the standards, as a permit is not required for painting projects.
• City Manager Rogers responded, providing clarification that the color palette is simply a “guideline”, with property owner’s having the opportunity request a deviation from the color palette; the Council would consider the requests on a case-by-case basis. • Mayor Pro Tem Guerra questioned the painting of historic brick. • Director Moreno responds, stating the intent is to ensure historical brick is not covered completely or plastered over.
• Mayor Robertson questioned the ability to make the standards retroactive. • City Manager Rogers and City Attorney Costanzo responded to that question; noting in agreement a color change cannot be forced, unless the work is subsidized by City of Selma funds.
• Council Member Oceguera mentioned the paint at the Selma Arts Center; noting the Art Center needs some attention and refurbishment.
15 4
• City Manager agreed to consider this by first reviewing the budget. • Council Member Trujillo speaks in support of the Exterior Color Standards, however expressed concern about the ability to gain compliance, specifically mentioning instances where the property owner is not the tenant. He noted the need for a structured plan. • Theresa Salas questioned the ability to enforce.
• City Manager Rogers reiterates that the goal is to gain compliance through offering the grant, noting the City will encourage property owners to apply for the grant, which will require compliance with the color standard.
• Rose Robertson suggested consideration of a City Hall façade update and expressed support for the cohesive color scheme.
• Council Member Avalos spoke in support of the Terracotta color scheme. • Bryan Ramirez expressed his support for adopting a cohesive color standard.

CITY COUNCIL STAFF REPORT
Meeting Date: March 17, 2026
SUBJECT: Approval - Informational Update – City Wide Sign Replacement Program SUBMITTED: Michael Honn, Public Works Director
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

No recommendation as this is an informational report only regarding staff replacing signage throughout the city limits which include but are not limited to street name signs, speed limit signs, traffic cautionary signs, and truck route signs.

DISCUSSION:

In December of 2024, Public Works purchased a sign printing machine to utilize for the replacement of all signage throughout the city. The purchase of the printer finalized the needed equipment to give the Public Works Department the ability to be a fully functional sign making shop. Staff identified 10 service areas for sign replacement throughout the City.

Since we started this replacement program in late 2024, staff have moved through 5 areas and are currently working on area #6. After completion of area #6, we will continue to work through the remaining 4 areas. Once the street signage has been completed in the ten areas, staff will then begin working on caution type placards such as stop signs, speed limit signs and truck route signage.

FISCAL IMPACT:

Each phase consists of approximately 130 street name signs.

Each sign costs approximately $175 to manufacture and install.

Each phase costs approximately $22,750.00 to install new street name signage.

CITY COUNCIL STAFF REPORT
Meeting Date: March 17th, 2026
SUBJECT: Consideration of Resolution 2026-22R Approving Correction of Resolution 2022-96, regarding Surplus of Assets. Correction to Remove Vehicle Unit #196 (Reported in Error) and Amend to Include Unit #186, the Correct Number Assigned to the Totaled Vehicle
SUBMITTED: Michael Honn, Public Works Director
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

Staff is recommending that a revision be approved, as stated in Resolution 2026-22R, to remove unit #196 from the approved Resolution 2022-96 and add unit #186 in its place, to correct the previously approved Surplus List.

DISCUSSION:

On February 7th, 2022, the City Council approved Res. No. 2022-96 that allowed for the surplus of several city assets. The list that was approved included a police interceptor with a unit number of #196. Staff has since realized that unit #196 is still in service and that the actual unit to be on the surplus list was unit #186 which was totaled in an accident. The surplus list that was approved by way of Res. No. 2022-96 needs to be modified to remove unit #196 and add unit #186.

CITY COUNCIL STAFF REPORT
Meeting Date: March 17, 2026
SUBJECT: Consideration of Resolution 2026-23R Approving the Emergency Dispatch Services Agreement with Fresno County Fire Protection District and Authorizing the City Manager to Execute All Necessary Documents SUBMITTED: Jordan Webster, Fire Chief
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

Staff recommend that the City Council adopt Resolution 2026-23R approving the Emergency Dispatch Services Agreement with the Fresno County Fire Protection District and authorize the City Manager to execute all necessary documents.

DISCUSSION:

The City of Selma currently contracts with Fresno County Fire Protection District (the “District”) for the provision of emergency dispatch services. The proposed Agreement is effective from July 1, 2025, through June 30, 2027, and formalizes the terms for dispatching City personnel to medical, fire, vehicle accidents, mutual aid, and life-threatening emergencies within City boundaries. The Agreement allows for a one-year extension through June 30, 2028, unless either party provides notice of non-renewal.

Fresno County Fire Protection District has continued to provide dispatch services outside the terms of their original agreement and has requested to back date to July 1, 2025, for continuity of services.

Approval of this Agreement will ensure the City’s continued access to professional emergency dispatch services, supporting public safety and effective emergency response.

FISCAL IMPACT:

Expenses for the services provided by Fresno County Fire Protection District are $57,301.55 for FY 2025/26. This is an increase of $13,801.55 of what was appropriated for this fiscal year. The adjustment will be included in the third quarter budget amendment presented by the Finance Department.

CITY COUNCIL STAFF REPORT
Meeting Date: March 17, 2026
SUBJECT: Consideration of a Resolution 2026-24R Approving the Purchase of a 2026 Chevrolet Silverado 2500HD LT Command Vehicle for the Fire Department from Liberty Chevrolet in an Amount Not to Exceed $74,447.74 and Authorization for the City Manager or Designee to Execute All Necessary Associated Documents
SUBMITTED: Jordan Webster, Fire Chief
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

Staff recommends the City Council adopt Resolution 2026-24R approving the purchase of a 2026 Chevrolet Silverado 2500HD LT from Liberty Chevrolet for use as a Fire Department command vehicle, in an amount not to exceed $74,447.74, and authorize the City Manager or designee to execute all necessary associated documents.

DISCUSSION:

The Selma Fire Department utilizes command vehicles to provide Chief Officers with the necessary transportation and equipment to respond to fire, emergency medical, and other incidents throughout the City's service area. Command vehicles serve a critical operational role, enabling Chief Officers to carry protective equipment, command supplies, and take advantage of technological advancements in firefighting and emergency medical services capabilities.

The Fire Department currently operates three battalion chief vehicles that were purchased from Liberty Chevrolet in 2022. As part of ongoing fleet management and operational readiness, staff identified the need for an additional command vehicle during the FY 25/26 budget process. This vehicle will replace one of the department's existing two-wheel drive battalion chief vehicles with a four-wheel drive model, providing improved accessibility and response capability to incidents across varied terrain. The replaced two-wheel drive vehicle will be repurposed as a utility vehicle for logistical operations within the City and for singleresource deployment on statewide mutual aid assignments.

Standardizing the battalion chief fleet to all four-wheel drive vehicles ensures consistent operational capability across all command staff, regardless of incident location or conditions.

A not to exceed approval is requested as the vehicle will be ordered from the vendor to ensure specification requirements are adhered to and to maximize cost efficiency.

Procurement Process
In alignment with the City of Selma's Purchasing Policy, three (3) bids were solicited for this purchase. The City's purchasing policy requires that competitive bids be secured for all contracts for goods or services greater than $5,000 to ensure that goods and services are acquired at the lowest cost to the taxpayers. For purchases of $25,000 or more, City Council 85 approval is the approving authority; however, as this purchase falls within the appropriate threshold, staff have followed the applicable competitive process to ensure fiscal responsibility and transparency.

Liberty Chevrolet, a local Selma business, submitted the lowest quote of the three bids received. The quote from Liberty Chevrolet for one (1) 2026 Chevrolet Silverado 2500HD LT totals $74,447.74.

Supporting Local Business
Most importantly, this purchase aligns with the City Council's high priority of keeping tax dollars local and supporting local businesses. Liberty Chevrolet is a dealership located within the City of Selma and has a demonstrated history of serving the City's fleet needs, including the purchase of three Chevrolet pickups for the Fire Department in 2022. By awarding this purchase to a local dealer, the City reinvests public dollars into the local economy, supports local employment, and recycles sales tax revenue back into the community. The City's purchasing policy for staff vehicles specifically prioritizes negotiations with local car dealers, stating that only in the case of non-availability of suitable vehicles from local dealers may the purchase be made from a dealer located outside of the City of Selma city limits.

Upfitting
Once the vehicle is received, it will undergo upfitting to include the necessary equipment for Fire Department command use. This will include emergency lighting, radios, a hard-shell cover for the bed, and a storage area in the bed for command and firefighting equipment, consistent with the department's current command vehicle specifications. Additional equipment such as a mobile data terminal (iPad-based MDT system) compatible with the Fresno County Emergency Communications Center will also be installed. The cost of upfitting will be addressed separately from this vehicle purchase.

FISCAL IMPACT:

The total cost for the 2026 Chevrolet Silverado 2500HD LT, including all fees and taxes, is not to exceed $74,447.74. This purchase was included as an appropriation in the FY 25/26 adopted budget and is funded through the fleet replacement account (111 account), which is a non-general fund item. No budget amendment is necessary Attachments:

Meeting Date: March 17, 2026
SUBJECT: Consideration and Adoption of a Resolution 2026-25R Approving the LAUNCH Program Industry Partner Agreement with Foundation for California Community Colleges and Authorizing the City Manager or Designee to Execute All Associated Documents
SUBMITTED: Jordan Webster, Fire Chief
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

Staff recommend that the City Council adopt the attached Resolution 2026-25R approving the LAUNCH Program Industry Partner Agreement with the Foundation for California Community Colleges (FCCC) and authorize the City Manager or designee to execute all necessary documents associated with this agreement.

DISCUSSION:

LAUNCH Apprenticeship Network is a fiscally sponsored program of the Foundation for California Community Colleges, which serves as a registered Workforce Intermediary Apprenticeship Sponsor. LAUNCH provides a structure for registered apprenticeship programs newly created through K-14 and university partners and offers a streamlined agreement for businesses offering paid registered apprenticeships that wish to partner with multiple education partners within the sponsor's network.

The LAUNCH Apprenticeship Network establishes an innovative approach for individuals to pursue education and career development, and for employers to develop talent.

Apprentices complete a structured program that includes on-the-job learning and technical instruction. Participants who complete LAUNCH Apprenticeship programs receive certificates of completion from the Division of Apprenticeship Standards and Department of Labor, and may also receive college credit, certificates, and degrees based on components of the program.

The development of LAUNCH Apprenticeship Programs is led by Regional Apprenticeship Industry Committees, which are categorized by industry sectors. The role of the Committee is to provide industry leadership to the apprenticeship network by considering and making recommendations to LAUNCH and connected education partners regarding the creation, implementation, and sustainability of apprenticeship programs.

Committee membership comprises companies employing apprentices within the program's jurisdiction, and labor unions representing apprentices and/or apprentice supervisors, with a signed LAUNCH Apprenticeship Agreement to Train Apprentices. Each member company and labor union is entitled to one vote per meeting, with decisions made by majority vote of members present.
99 As an Industry Partner, the City will fulfill two primary requirements of registered apprenticeship:

1. Provide paid on-the-job learning to apprentices: Apprentices shall be paid at or above an increasing schedule of wages based on a percentage or dollar amount of the Industry Partner's current professional worker wage rates.

2. Provide evaluative feedback on apprentice progress: Industry Partners agree to provide evaluations of apprentices' progress through identified professional and occupational competencies. At minimum, apprentices should receive evaluations from supervisors or Human Resources personnel twice per year.

The agreement clarifies that nothing shall impact the at-will employment status of apprentices with Industry Partners.

The City will subscribe to the provisions of the Apprenticeship Standards formulated and registered by LAUNCH and agree to carry out the intent and purpose of said standards. The Industry Partner is assured that apprentices will receive qualified training personnel and adequate supervision during their apprenticeship.

The Industry Partner Agreement will remain in effect until canceled voluntarily or revoked by LAUNCH, the Industry Partner, or the Office of Apprenticeship. 1 The City agrees to comply with Apprenticeship Standards which may be updated or modified from time to time, including current LAUNCH requirements and standards set forth by the Department of Labor or Division of Apprenticeship Standards.

The City will be responsible for completing the California Division of Apprenticeship Standard form "DAS-752 Employer Agreement," which identifies the specific Industry Committee(s) selected by the Industry Partner.

This partnership will provide the City with access to a structured workforce development program that:
• Supports career technical education and workforce readiness • Provides opportunities for community members to access registered apprenticeship programs
• Connects the City with a network of education and training partners • Ensure compliance with state and federal apprenticeship regulations FISCAL IMPACT:

There is no direct fiscal impact to the General Fund associated with this agreement. The City's participation as an Industry Partner is voluntary, and any costs associated with apprentice wages and training will be determined by the City's participation level and workforce development needs.

Agreement No. 0000XXXX

1. Background
LAUNCH is a fiscally sponsored program of the Foundation for California Community Colleges (“FoundationCCC”), which is the auxiliary 501(c)(3) of the California Community College Chancellor’s Office that has received funding through state and federal grants, regionally allocated Strong Workforce Program project funding, and philanthropic grants for the purposes of managing and growing apprenticeship programs that leverage robust partnerships with high schools, community colleges, universities and workforce agency partners.

This Industry Partner Agreement (“Agreement”) is made between City of Selma Fire Department, a public entity (“Industry Partner”) and FoundationCCC on behalf of LAUNCH Apprenticeship Network (“LAUNCH”). LAUNCH is a registered Workforce Intermediary Apprenticeship Sponsor, which is defined by the Department of Labor as an organization that can help broker local, regional, and national workforce solutions, by convening employers and community partners to determine workforce trends, and assisting in blending customized services and seed funding to grow the demand for new apprenticeship programs.

LAUNCH provides (1) a structure for registered apprenticeship programs newly created through K-14 and university partners and (2) a streamlined agreement for businesses offering paid registered apprenticeships that wish to partner with multiple education partners within the SPONSOR’s network. The parties hereby agree to the following:

2. Basis of Agreement
The LAUNCH Apprenticeship Network establishes an innovative way for individuals to approach education and career, and for companies to develop talent. Apprentices complete a structured program that 105
Foundation for California Community Colleges
Agreement No. 0000XXXX
includes on-the-job learning and technical instruction. Participants that complete LAUNCH Apprenticeship programs receive certificates of completion from the Division of Apprenticeship Standards and Department of Labor, and may also receive college credit, certificates and degrees based on components of the program.

Industry Partners signatory to this Agreement elect to train apprentices, which may include incumbent workers and/or new hires, in cooperation with LAUNCH.

3. Apprenticeship Industry Committees
The development of LAUNCH Apprenticeship Programs are led by Regional Apprenticeship Industry Committees, which are categorized by industry sectors. The role of the Committee is to provide industry leadership to the apprenticeship network, by considering and making recommendations to LAUNCH and the connected education partners, regarding the creation, implementation, and sustainability of apprenticeship programs.

The Committee membership is comprised of companies employing apprentices within the program’s jurisdiction, and labor unions representing apprentices and/or apprentice supervisors within the program’s jurisdiction, with a signed LAUNCH Apprenticeship Agreement to Train Apprentices. Representatives of member companies and labor unions may attend meetings and participate in discussions and decisionmaking. Each member company and each labor union is entitled to one vote per meeting. Committee decisions are made by a majority of the members present and voting.

Program staff and affiliated education and workforce partners serve as advisors. Program staff will provide the Committee with reports on all apprentices, which includes progress and advancements, cancellations, and completions. In addition, changes to Apprenticeship Program Standards and opportunities for program improvement and expansion are subject to the Committee's review.

4. Industry Partner Responsibilities
Industry Partners fulfill two primary requirements of registered apprenticeship: (1) Provide paid on-the- job learning to apprentices and (2) provide evaluative feedback on apprentices' progress through applicable identified professional competencies.

Wages of Apprentices During On-the-Job Learning: Apprentices shall be paid at, or above, an increasing schedule of wages based on a percentage or a dollar amount of the Industry Partner's current professional worker wage rates.

While actively training apprentices, employers agree to provide non-confidential salary and benefits data to help program staff acquire information on the effectiveness of the program in increasing overall productivity and wages of participants.

Evaluative Feedback of Apprentice Progress: Industry Partners agree to provide evaluations of apprentices' progress through identified professional and occupational competencies. At a minimum, apprentices should receive evaluations from supervisors or Human Resources personnel twice per year. LAUNCH will provide Industry Partners with digital and/or printed formats for completing the evaluations and Industry Partners will have access to view apprentice progress updates. LAUNCH will accommodate the individual needs of Industry Partners requesting to customize the evaluation process based on whether the suggested process complies with registered apprenticeship requirements and does not place undue administrative burdens on program staff.

Nothing in this Agreement shall impact the at-will employment of apprentices with Industry Partners. 106
Foundation for California Community Colleges
Agreement No. 0000XXXX

5. Apprentice Responsibilities
Apprentices are responsible for completing the identified on-the-job learning and related education components of their apprenticeship. Program staff will provide apprentices with a program outline at the time of registration. As per the apprentice agreement, apprentices permit program staff and employing Industry Partners to share information regarding on-the-job learning and related education progress. If apprentices discontinue the related education and/or on-the-job learning components, program staff will cancel the apprentice agreement and send notice to the apprentice.

Apprentices are responsible for all documents and processes related to their status as a registered apprentice, which may include completing state and federal apprentice agreements, complying with program rules and regulations, worksite evaluations, related education enrollment, and completion of any forms or processes related to changes to the original apprentice agreement or program outline. Program Sponsorship Acknowledgment for Employers with Collective Bargaining Agreement Basis of Acknowledgment:

LAUNCH serves as an Intermediary Program Sponsor on behalf of affiliated college and K-12 partners that establish cooperative learning agreements with businesses. LAUNCH pursues and maintains registration with the Division of Apprenticeship Standards and the Department of Labor for sponsored programs and operates in compliance with the laws and regulations of registered apprenticeship. Included in the California Code of Regulations (CCR), Title 8, Chapter 2, Subchapter 1, Article 4, CCR 212.2 states that where a collective bargaining agreement exists, a program shall be jointly sponsored unless either party to the agreement waives its right to representation in writing. The development of LAUNCH Apprenticeship Programs are led by Regional Apprenticeship Industry Committees, which are categorized by industry sectors. The Committee membership is comprised of companies with a signed LAUNCH Apprenticeship Agreement to Train Apprentices. Representatives of member companies may attend meetings and participate in discussion and decision-making.

Disposition & Limitations of LAUNCH as a Program Sponsor:

LAUNCH encourages the development and registration of Joint Labor-Management Apprenticeship Committees, and is also pleased to serve as a program sponsor where employers and unions agree the services provided by LAUNCH will be useful. LAUNCH also acknowledges that its services may be used in an initial phase of program development to decrease the cost and administrative burden of all parties involved, with the understanding that the long-term plan for the program would include a transition to a jointly-sponsored Labor-Management Apprenticeship Committee.

As expressed in the Industry Partner Agreement to Train Apprentices, there are standards of participation employer partners must follow. This includes paying apprentices at, or above, the committee’s approved minimum wage progression and ensuring apprentices are supervised by professionals in their trade while performing work- processes applicable to their apprenticeship. However, LAUNCH committees do not bargain or participate in negotiation on behalf of any employees in relation to wages or working conditions and all portions of collective bargaining agreements supersede LAUNCH committees in matters of employment relations.

Acknowledgment and Waiver:

The undersigned employer and authorized union representative hereby waive the right to jointly-sponsor the intended apprenticeship program and authorize LAUNCH to serve as an intermediary program sponsor and administrate the program.

CITY COUNCIL STAFF REPORT
Meeting Date: March 17, 2026
SUBJECT: Second Reading and Adoption of Ordinance 2026-02 Amending Selma Municipal Code § 5-7-3 Relating to Special Event Permit Processing Timelines
SUBMITTED: Jason Rogers, City Manager
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

Conduct second reading and adopt Ordinance 2026-02 amending Selma Municipal Code § 5- 7-3 to establish an expedited application pathway for minor, low-impact special events.

DISCUSSION:

On February 17, 2026, the City Council introduced and waived the first reading of Ordinance 2026-02 amending Selma Municipal Code § 5-7-3 to establish an expedited processing pathway for minor, low-impact special events.

As presented at first reading, the amendment:
• Retains the existing ninety (90) day application requirement for major events; • Preserves the current forty-five (45) day discretionary acceptance provision; • Establishes a defined expedited pathway for minor special events submitted at least twenty-one (21) calendar days prior to the event; and
• Clarifies City Manager discretion to accept or deny applications submitted fewer than twenty-one (21) days prior when sufficient time exists to ensure public safety and regulatory compliance.

The ordinance does not create an entitlement to expedited approval. The City Manager retains discretion to require additional review time or deny expedited processing if operational, staffing, or public safety concerns are identified.

No substantive changes have been made to the Ordinance since its introduction on February 17, 2026. As a result, staff recommend adoption.

FISCAL IMPACT:

There is no direct fiscal impact associated with the proposed ordinance amendment.

Clarifying permit timelines and procedures is anticipated to reduce staff inefficiencies related to case-by-case exception requests and last-minute coordination.

1 ORDINANCE NO. 2026-02

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SELMA,
CALIFORNIA, AMENDING SELMA MUNICIPAL CODE § 5-7-3, RELATING TO

SPECIAL EVENT PERMIT PROCESSING TIMELINES
WHEREAS, Selma Municipal Code (“SMC”) Chapter 5-7 establishes regulations governing special events within the City of Selma, including application requirements, review timelines, and public safety considerations, and;
WHEREAS, SMC § 5-7-3 currently requires special event permit applications to be submitted at least ninety (90) days prior to an event, with limited discretion for the City Manager to accept applications submitted at least forty-five (45) days in advance when specified conditions are met, and;
WHEREAS, The City Council has requested consideration of an expedited review pathway for minor, low-impact events that do not involve street closures, significant public safety impacts, or diversion of City resources, and;
WHEREAS, The City Council finds that establishing a limited expedited application process for minor special events will improve clarity, consistency, and administrative efficiency, while preserving appropriate review timelines and safeguards for larger or more complex events;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SELMA DOES HEREBY ORDAIN AS FOLLOWS:

Section 1. Title Five, Chapter Seven, Section Three, Part A of the Selma Municipal Code (§ 5- 7-3A) is hereby amended to read as follows:
5-7-3: SPECIAL EVENT PERMIT – APPLICATION – INFORMATION REQUIRED – TIMING
(A) An application for a special event permit shall be made at least ninety (90) days prior to the special event. The City Manager or designee may authorize acceptance of an application for a special event permit submitted at least forty-five (45) days prior to the special event if the event does not require closure of a public right-of-way, will not require diversion of regularly assigned public safety personnel, and does not negatively impact emergency access, parking, or traffic in the surrounding area.

1. If determined by the Police Chief that a road closure impacts public safety, the closure must be approved by the City Council prior to the event.

2. Expedited Minor Special Events. Notwithstanding the foregoing, the City Manager or designee may accept and process an application for a minor special event permit submitted no fewer than twenty-one (21) calendar days prior to the event, provided the City Manager or designee determines that the proposed event is minor in nature and low-impact. In making this determination, consideration shall include, but not be limited to, the following:
119
2 a. The event does not require closure of any public right-of-way; b. The event does not require diversion of regularly assigned police, fire, or public works personnel; and
c. The event does not negatively impact emergency access, parking availability, or traffic circulation.
d. Whether the event requires permits or approvals from third-party or outside agencies, including but not limited to the Fresno County Department of Public Health, Alcoholic Beverage Control, or Fire Authority, and whether sufficient time exists to obtain such approvals prior to the event.

3. Applications Submitted Fewer Than Twenty-One (21) Days Prior to the Event.

Notwithstanding subsection (A)(2), the City Manager or designee may, in his or her discretion, accept, process, condition, or deny an application submitted fewer than twenty-one (21) days prior to the proposed event, upon a determination that sufficient time exists to ensure public safety and regulatory compliance.

Nothing in this subsection shall be construed to require approval of an expedited minor special event application. The City Manager or designee may require additional review time or deny expedited processing if operational, staffing, or public safety concerns are identified.

Section 2. Effect. This Ordinance shall take effect and be in force and effect thirty (30) days from and after the date of its final passage.

Section 3. Publication of Summary. The City Clerk is authorized and directed to cause this Ordinance or a summary thereof to be published once in a newspaper of general circulation published and circulated in the County of Fresno within fifteen (15) days after its adoption.

The City Clerk shall cause a summary of the proposed ordinance to be published and a certified copy of the full text of the proposed ordinance to be on file in the office of the City Clerk. The summary shall be approved by the City Attorney.

Section 4. No Preemption. It is the intent of the City Council of the City of Selma to supplement applicable state and federal law and not to duplicate or contradict such laws, and this ordinance shall be construed consistently with that intention.

Section 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unenforceable by a court of competent jurisdiction, the remaining portions of this Ordinance shall nevertheless remain in full force and effect. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more portions may be declared invalid or unenforceable.

CITY COUNCIL STAFF REPORT
Meeting Date: March 17, 2026
SUBJECT: Adoption of Resolution 2026-26R Electing to Become Subject to the California Uniform Public Construction Cost Accounting Act (CUPCCAA) and Adoption of Resolution 2026-27R Amending the City’s Purchasing and Contract Procedures Policy to Conform to Public Contract Code §22032
SUBMITTED: Jason Rogers, City Manager
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

1. Adopt Resolution No. 2026-26R electing to become subject to the California Uniform Public Construction Cost Accounting Act (Public Contract Code §22000 et seq.); and

2. Adopt Resolution No. 2026-27R amending the City’s Purchasing and Contract Procedures Policy to conform to Public Contract Code §22032, as amended from time to time.

DISCUSSION:

The California Uniform Public Construction Cost Accounting Act (CUPCCAA), codified in Public Contract Code §22000 et seq., establishes uniform cost accounting standards and alternative bidding procedures for public works projects.

For purposes of CUPCCAA, public works projects include construction, reconstruction, repair, or maintenance of City infrastructure and facilities, such as streets, sewer and water systems, storm drainage improvements, park construction, and building renovations.

CUPCCAA does not apply to professional services, consultant agreements, equipment purchases, or general goods procurement.

Public Contract Code §22030 authorizes a public agency to elect, by resolution, to become subject to CUPCCAA and requires notification to the California State Controller’s Office.

Participation in CUPCCAA allows the City to utilize statutory bidding thresholds for public works projects, currently:
• $75,000 or less – May be performed by City forces, negotiated contract, or purchase order;
• $75,001 to $220,000 – Informal bidding procedures;
• Over $220,000 – Formal bidding procedures.

These thresholds are established by Public Contract Code §22032 and may be adjusted by the Legislature from time to time.
125
The City’s Purchasing and Contract Procedures Policy (Adopted July 1, 2025) references CUPCCAA participation and includes public works bidding thresholds. To ensure full compliance and consistency with state law, staff recommend:

1. Adoption of a resolution formally electing to become subject to CUPCCAA and authorizing notification to the State Controller; and

2. Adoption of a companion resolution amending the Purchasing Policy to reference Public Contract Code §22032 “as amended from time to time,” thereby ensuring that future statutory adjustments automatically apply without requiring additional Council action.

These actions will align City policy with state law, provide administrative efficiency for public works delivery, and eliminate potential ambiguity regarding bidding authority.

Following adoption, staff will:
• Notify the State Controller’s Office;
• Maintain an annual informal list of qualified contractors as required by Public Contract Code §22034;
• Update the Purchasing Policy, if necessary, to reference Public Contract Code §22032 “as amended from time to time” to ensure consistency with state law.

This action will align City policy and practice with statutory requirements and provide administrative efficiency in delivering public works projects.

FISCAL IMPACT:

There is no direct fiscal impact associated with adoption of these Resolutions. Participation in CUPCCAA provides procedural flexibility and may reduce administrative costs associated with smaller public works projects. Updating the Purchasing Policy ensures compliance and operational clarity.

CITY COUNCIL STAFF REPORT
Meeting Date: March 17, 2026
SUBJECT: Adopt a Resolution 2026-28R Accepting the Clean California Community Cleanup and Employment Pathway (CCEP) Grant, Authorizing Execution of the Restricted Grant Agreement with the California Department of Transportation, and Amending the FY 2025-2026 Budget SUBMITTED: David Horn, City Engineer
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

Adopt a Resolution that:

1. Adopt Resolution No. 2026-28R accepting the Clean California Community Cleanup and Employment Pathway (CCEP) Grant in the amount of $300,000.

2. Authorize the City Manager to execute the Restricted Grant Agreement (RGA) and all related documents with the California Department of Transportation (Caltrans).

3. Amend the FY 2025-2026 Budget to recognize $300,000 in grant revenue and $600,000 in total project expenditures, including the required local match.

DISCUSSION:

The California Department of Transportation (Caltrans) administers the Clean California Community Cleanup and Employment Pathway (CCEP) Grant Program, which provides funding to local agencies to support litter abatement, beautification of public spaces, workforce development, and community engagement initiatives.

The City of Selma was awarded $300,000 in Clean California grant funding for the Clean Selma Second Street and Downtown Arts Corridor Revitalization Project. The project will support community cleanup activities, beautification improvements, and volunteer engagement within the downtown corridor.

The grant agreement establishes a performance period beginning April 1, 2026, or upon approval by Caltrans and issuance of a Notice to Proceed, and ending November 1, 2027.

The CCEP program requires a local match equal to the grant amount, resulting in a total project budget of $600,000.

The required match will be satisfied through in-kind contributions consistent with the approved grant application, including:
• Existing City cleanup and beautification work occurring in the downtown corridor under current Clean California program activities.
• Volunteer participation in community cleanup and beautification efforts. • Consulting and professional services supporting project administration and implementation.
133
Volunteer labor associated with community cleanup activities will be valued at $30 per hour, and professional consulting services may also be contributed as in-kind support. Because the match is provided through existing work activities and in-kind services, acceptance of the grant does not require additional General Fund appropriations.

The grant agreement also includes administrative funding that may be used to support grant management and reporting requirements.

Acceptance of the grant requires City Council authorization to execute the Restricted Grant Agreement and amend the FY 2025-2026 budget to recognize the grant revenue and project expenditures.

FISCAL IMPACT:

The total project cost is $600,000, consisting of:

Funding Source Amount
Clean California CCEP Grant (Caltrans) $300,000
City of Selma Local Match (In-kind) $300,000
Total Project Budget $600,000
The FY 2025-2026 Budget will be amended to:
• Recognize $300,000 in grant revenue, and
• Appropriate $600,000 in total project expenditures.

The required local match will be satisfied through in-kind services and volunteer contributions, and therefore no additional General Fund appropriation is required.

Fletcher, Community Services Director APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

Due to the increasing cost of fireworks each year, the Selma Chamber of Commerce is seeking assistance to help cover half of the cost of this year’s fireworks show. Additionally, the Chamber will not receive revenue from parking fees this year, resulting in a loss of anticipated funding.

Planning Commission from
Office

1 ITEM NO: 5-4

CITY COUNCIL STAFF REPORT
Meeting Date: March 17, 2026
SUBJECT: Consideration and Necessary Action on Resolution 2026-30R; Removing Member of the Selma City Planning Commission from Office SUBMITTED: Neal E. Costanzo, City Attorney
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

Adopt Resolution No. 2026-30R removing Planning Commissioner Louis Franco from that office for reasons detailed in the accompanying Resolution and below.

BACKGROUND:

More detailed facts are supplied in the accompanying Resolution. Without repeating what is there, attached are two sets of documents as follows:
(1) The complete written correspondence between your City Attorney and the California State Bar relating to a complaint filed by “Lauren Edkins”, between February 28, 2025, and September 30, 2025; and
(2) The complete correspondence between your City Attorney and the California State Bar from January 16, 2026, to February 23, 2026, relating to a complaint filed by Louis Franco.

Lauren Edkins, the first person submitting a complaint to the State Bar concerning your City Attorney’s activities on behalf of this city, is Louis Franco’s daughter. The State Bar ceased its improper investigation but did not notify your City Attorney for more than eight months later. The complaint by Louis Franco is still open, although it is obviously facially false, invalid, and void. The complaint is false because it is Louis Franco’s allegation that your City Attorney failed to disclose to the City Council a conflict of interest, something that would necessarily occur in a closed session.

It is a misdemeanor to file a complaint or register a report of Professional Misconduct by an Attorney with the State Bar that is false and malicious. (Business and Professions Code § 6043.5). Your City Attorney is among the City Staff assigned by Ordinance to facilitate, support and consult with, and advice your Planning Commission. By filing these false complaints Louis Franco displays a propensity to dishonesty. He also demonstrates an extreme animosity towards and willingness to injure maliciously your City Attorney. These actions constitute an unacceptable appearance or probability of bias, conflict of interest, personal embroilment or animosity. Given the City Attorney’s function of advising the Planning Commission, these actions can easily spill over into an appearance of partiality, bias, and conflicts of interest affecting a matter being considered by the Planning Commission.
167
2 The Council receives recommendations from the Planning Commission, and the Council necessarily reposes trust in and relies on a Planning Commission Member’s honesty and impartiality.

It seems futile to speculate over Mr. Franco’s intentions in filing these false serial complaints. The complaints are malicious because one necessarily intends the natural consequences of his or her act. Anyone filing a report with the State Bar against an attorney naturally intends it to result in some form of adverse action against the attorney or his license. For whatever reason, Louis Franco has committed a series of criminal acts as to which your City Attorney is the victim and the conduct involved demonstrates dishonesty, inability to accept advice from the person assigned by Ordinance to provide that advice to the Planning Commission and very likely creates a bias against any approval of any proposed action by the Planning Commission recommended by or with the participation of your City Attorney. Mr. Franco simply has a conflict between his own interests in attacking your City Attorney and the City’s interest in having a functioning Planning Commission that acts as an honest impartial arbitrator of matters coming before it.

FISCAL IMPACT:

None.

WHEREAS, the duties of a Planning Commissioner involve conducting public hearings on development, land use or planning applications and to either decide the application subject to an appeal to this City Council, or to recommend to this City Council approval or disapproval of applications which requires Planning Commissions to be acting at all times as impartial, honest arbitrators of often hotly contested matters affecting the physical development of the city who are free of any conflict of interest or potential for conflict of interest arising from personal bias, or otherwise; and
WHEREAS, Planning Commissioners who engage in conduct, even outside their normal function as commission members, which create an unacceptable appearance or probability of bias, conflict of interest, personal embroilment or animosity may preclude them from serving as a reasonably impartial, non-involved reviewer. A perception of lack of partiality often leads to multiple consequences for the Planning Commission including, but not limited to, the disqualification of the member exhibiting an appearance of bias, pre-judgement or conflict of interest or if the member participates in a matter decided by the planning commission the reversal of that action. (Gai v. City of Selma (1998) 68 Cal. App. 4th 213, 219, 233; Nasha v. City of Los Angeles (2004) 125 Cal. App. 4th 470, 483-484); and, WHEREAS, the Planning Commission does not have a separate staff. SMC § 2-1-2 provides specifically that the Community Development Director of the City shall provide technical assistance and serve as secretary to the commission, and that the City Attorney, City Manager, and City Engineer shall all be available for consultation and technical support as needed. For the Planning Commission to effectively perform its function, individual Planning Commission Members are expected to cooperate with the City Personnel who are assigned to assist the Planning Commission so that when a Planning Commissioner demonstrates by their actions a disdain for, or some form of irreconcilable difference with a member of the city staff assigned by ordinance to provide support and consultation to the Planning Commission whether as a result of personal animosity, or otherwise, that member is not properly functioning in the position of Planning Commissioner. The situation creates a circumstance that may warrant the Planning Commissioner’s disqualification from any 219
2 particular matter or matters pending before the Planning Commission. Participation in such matters by the Planning Commission member who displays such personal animosity or embroilment in a dispute with a member of the City Staff assigned to provide consultation and support can result in the reversal of an action taken by the Planning Commission; and WHEREAS, Louis Franco (“Franco”) is a City of Selma Planning Commission Member; and,
WHEREAS, as appointing authority for all City Commissions, the City Council also has authority to remove any commission member, including any Planning Commission Member, for any or no reason at all, without notice or any hearing. (Kimura v. Roberts (1979) 89 Cal. App. 3rd 871 (Mayor and City Council findings that actual or implied conflict of interest existed warranted removal of Planning Commissioner); and WHEREAS, on February 28, 2025, the City Attorney was notified by the State Bar of the State of California that a complaint had been filed against him by one “Lauren Edkins”, Louis Franco’s daughter, vaguely alleging a variety of misconduct purportedly in violation of the Professional Rules of Conduct and/or the State Bar Act allegedly arising from (1) the illegality of a meeting conducted by the City Council on December 12, 2024; (2) the City Attorney’s appearance, after having been appointed as City Attorney at an open and closed session at a City Council meeting on December 19, 2024; (3) the City Attorney representation of an entity involved in an active lawsuit against the city, which the City Attorney never represented; and (4) the City Attorney’s actions in 2018 when he was the City Attorney for the City of Parlier and actions representing Councilman Jim Avalos in 2020 in an election contest proceeding at a point in time when he was not serving as the City Attorney of the City of Selma; and
WHEREAS, the City Attorney responded to the accusations made by Edkins on March 14, 2025, demonstrating the complaint was baseless and false; but, the State Bar did not send the City Attorney notice that it had “completed the investigation of the allegations of Professional Misconduct reported by Lauren Edkins and determined that [the] matter does not warrant further action” and, was therefore, “closed”, until September 30, 2025; and WHEREAS, on January 16, 2026, the State Bar notified the City Attorney that it had “received a complaint from Louis Franco” alleging that a “conflict of interest was not disclosed to the Selma City Council”; and
WHEREAS, the complaint or report by Franco to the State Bar alleging that a conflict of interest was not disclosed to the Selma City Council is false because Louis Franco does not serve on the City Council and has no personal knowledge of anything that was or was not disclosed to this City Council which would necessarily be in closed session so that the complaint appears to be both malicious and false. Business and Professions Code § 6043.5 makes it a misdemeanor for any person to report to the State Bar or who causes a complaint to be filed with the State Bar that an attorney has engaged in Professional Misconduct when that person knows the report or complaint to be false and malicious. (Business and Professions Code B & P, 6043.5); and

3 WHEREAS, this City Council has retained an attorney other than the City Attorney to represent it in Fresno County Superior Court Case No. 25CECG00503, Highland Rose LP. v. City of Selma, the case which gave rise to a conflict of interest, and someone other than the City Attorney is representing Highland Rose LP in that litigation so that it is clear Franco’s allegation that a conflict of interest involving this suit was not disclosed to this City Council is false.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SELMA DOES HEREBY RESOLVE AS FOLLOWS:

1. The City Council finds and determines that the above recitals are true and correct and are incorporated herein by reference.

2. As appointing Authority for all Planning Commission Members, this City Council hereby directs that Louis Franco be removed from office as a Member of the Planning Commission effective immediately.

3. Although the Council is not required to have reasons to remove a Planning Commission Member, Louis Franco’s actions in causing the filing of two separate false and malicious complaints with the California State Bar against the City Attorney gives rise to a disqualifying conflict of interest or the appearance of a conflict of interest in that Louis Franco appears to be engaged in a course of conduct involving the leveling of serial malicious and false attacks on the City Attorney whom he is required to cooperate with and receive consultation and advice from as needed. Louis Franco has displayed personal animosity towards the City Attorney and there appears to exist a personal embroilment in a dispute that Franco created between himself and the City Attorney. Further, the filing of serial false complaints is a violation of law and a criminal act which demonstrates dishonesty and creates an intolerable probability of actual bias for a City of Selma Planning Commissioner.

4. The City Attorney’s written exchanges with the California State Bar relative to the serial complaints by Louis Franco are attached to the accompanying Staff Report. Those non-privileged communications are now public records within the meaning of the Public Records Act.
