ITEM NO: 5-5

CITY COUNCIL STAFF REPORT
Meeting Date: August 18, 2026
SUBJECT: Selection of Kosmont Companies to Provide Infrastructure Financing Advisory Services and Authorization for the City Manager to Execute a Professional Services Agreement
SUBMITTED: Jason Rogers, City Manager
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:

It is recommended that the City Council:

1. Accept the results of the City's Informal Request for Proposals (RFP) for Infrastructure Financing Advisory Services;

2. Select Kosmont Companies as the most qualified firm to provide Infrastructure Financing Advisory Services; and

3. Adopt Resolution No. 2026-87 authorizing the City Manager to execute the documents necessary to effectuate the services, including a Professional Services Agreement with Kosmont Companies in an amount not to exceed $68,500, subject to approval as to form by the City Attorney.

DISCUSSION:

The City of Selma continues to experience residential, commercial, and industrial growth requiring significant public infrastructure investment. To assist with evaluating and implementing financing mechanisms that support these improvements, the City issued an Informal Request for Proposals (RFP) for Infrastructure Financing Advisory Services in accordance with the City's Purchasing Policy.

The requested services include evaluation of financing mechanisms such as Enhanced Infrastructure Financing Districts (EIFDs), Community Facilities Districts (CFDs), and other available public financing tools, along with preparation of supporting financial analyses and implementation assistance.

The City received proposals from the following qualified firms:
• Keyser Marston Associates/NBS
• Kosmont Companies
• NHA Advisors
• Willdan Financial Services
Proposals were evaluated based on the criteria established in the RFP, including relevant experience and qualifications, project approach, project team, cost, and references. 209
Based on the evaluation, Kosmont Companies was determined to be the most qualified firm.

Kosmont demonstrated extensive experience in infrastructure financing and the formation of Enhanced Infrastructure Financing Districts (EIFDs) throughout California, including successful projects within the Central Valley. Their proposed scope of services closely aligns with the City's immediate objective of evaluating and implementing an infrastructure financing strategy to support future economic development projects.

Accordingly, staff recommends selecting Kosmont Companies and authorizing the City Manager to execute the documents necessary to effectuate the services.

FISCAL IMPACT:

The proposed Professional Services Agreement is in an amount not to exceed $68,500.

Funding is available within the FY 2026-27 Budget.

Consultant will control the manner and means of the services to be performed by its employees and 213
subconsultants. All of Consultant's staff will be qualified by training and experience to perform their assigned tasks. 7 PROJECT UNDERSTANDING
Kosmont understands that the City is considering potential implementation of a special purpose Tax Increment Financing (“TIF”) district, such as an EIFD or a Climate Resilience District (“CRD”), to help fund critical infrastructure serving the City. We understand that the City is actively planning for continued residential, commercial, industrial, and mixed-use development. Several significant projects are anticipated over the coming years that will require major investmentsin public infrastructure, including, but not limited to • Transportation improvements
• Sewer and water infrastructure
• Storm drainage facilities
• Parks and recreation facilities
• Public facilities
• Utility improvements
• Streetscape enhancements
The City desires to establish a long-term financing strategy that leverages public and private investment while minimizing impacts on the General Fund. The selected consultant will evaluate available financing tools and assist the City in implementing the most appropriate financing strategy.

Approach to Tasks: The prospective assignment and consulting services that Kosmont will provide will be of a relatively limited scope and duration, and advisory in nature. Kosmont will be making recommendations only, which advise the Client and jurisdictions, including its elected officials, appointed officials and staff, which they can accept or reject. None of Kosmont's staff will act in a capacity as an elected official, nor appointed official, nor as staff, nor as serving in a "designated" position.

Task 1: Financing Strategy Assessment
Kosmont will review existing City planning documents, capital improvement needs, development activity, and previously completed financial analyses. Kosmont will then convene an introductory briefing with City staff to discuss and confirm City objectives, infrastructure priorities, and available financing tools. Kosmont will be prepared to discuss requirements and guidelines for the relevant financing tool statutes, including precedent in other jurisdictions. Kosmont will identify and evaluate potential boundary alternatives for one or more TIF districts within the City. Kosmont will analyze key strategic implementation considerations, including:
• Property ownership
• Planned / proposed future development
• Infrastructure needs and estimated costs
• Potential public and private sector partners (e.g., County of Fresno, other affected taxing entities, developers / property owners)
• Overlap with former Redevelopment Agency Project Area boundaries and status of redevelopment dissolution.

Task 1 summary findings will include a discussion of:
• Appropriate financing mechanism(s)
• Implementation strategy
• Anticipated revenues
• Infrastructure priorities
• Implementation schedule
• Risks and opportunities
Task 2: Updated Financial Analysis
Kosmont will prepare updated financial analyses to support a recommended financing strategy, including a tax increment revenue analysis that reflects potential future development and potential public and private sector partners. The analysis will identify:
• Potential assessed value increase from future development in the district • Property tax increment funding capacity at select annual benchmarks and cumulatively over the estimated district lifetime(s)
• Different levels of tax increment revenue allocation by taxing entity (e.g., 25%, 50%) • Initial estimates of potential bonding capacity to be provided by Kosmont Financial Services, registered Municipal Advisor
• Complementary economic development tools and funding resources (e.g., community facilities district [CFD] financing, grants, leverage of City-owned real estate assets, outstanding debt refinancing strategies, zoning incentive programs)
• As related to potential overlap of proposed district boundaries with former redevelopment agency project areas, analysis of corresponding relevant outstanding enforceable obligations and implications on available revenues
• Fiscal impact analysis.

Kosmont will evaluate and summarize feasible governance and implementation alternatives, including district governing board composition, voting / approval procedures, district formation milestones, debt issuance procedures, and estimated timing, in order to provide potential public and private sector stakeholders with an illustrative “roadmap” for implementation.

Task 3: Financing District Formation
Kosmont will work with City staff and the City Attorney’s office with the preparation of requisite documentation for the Resolution of Intention (“ROI”) to form the financing district, including appropriate designation of the governing Public Financing Authority (“PFA”) board members. Kosmont will assist with coordination and presentation at the required meeting of the City Council to adopt the ROI and will assist with required noticing of the ROI following the City Council action. Kosmont anticipates one City Council meeting as part of this task (in-person or virtual as deemed mutually appropriate by the City and Kosmont).

Kosmont will collaborate with City staff and appropriate third-party consultants (e.g., special counsel, engineering / surveying consultants) on the preparation of the required Infrastructure Financing Plan (“IFP”) and related appendices. The IFP must include a legal description of district boundaries, public improvementsto be implemented, 233

location, timing, and costs of development and financial assistance, finalized tax increment projections, intention to incur debt (e.g., bonds), district termination date, taxing entity fiscal impact analysis, and replacement housing obligations.

Kosmont will assist City staff (e.g., Clerk’s office) in the required distribution of the IFP to property owners within the financing district and to affected taxing entities. Kosmont will assist in drafting and coordinating the required noticing (e.g., website, mailing, newspaper notices) of the PFA meeting and hearings for IFP approval and financing district formation.

Kosmont will assist in coordination, preparation, and presentation of required materials at the required City Council meeting and PFA meetings and hearings to approve the IFP and form the EIFD. While Kosmont is not an attorney, we will provide draft content for required resolutions for review by the City Attorney and/or special counsel. Kosmont anticipates two PFA public meetings, two PFA public hearings, and one City Council meeting as part of this task (inperson or virtual as deemed mutually appropriate by the City and Kosmont).

Following adoption of the IFP at the second PFA public hearing, Kosmont will assist City staff in completing the required filing for Change of Jurisdictional Boundaries with the State Board of Equalization.

Overview of Thrift
and Resale Store Regulations
in the City of Selma
245
ITEM NO: 5-6

CITY COUNCIL STAFF REPORT
MEETING DATE:

SUBJECT:

SUBMITTED:

APPROVED:

August 18th, 2026
Overview of Thrift and Resale Store Regulations in the City of Selma Bonique Emerson
Jason Rogers, City Manager
RECOMMENDATION:

Receive and file the report providing an overview of the City’s historical and current land use regulations applicable to thrift and resale stores.

DISCUSSION:

Background and Regulatory History
The City’s regulation of thrift stores has changed substantially since the original zoning provisions were adopted in 1976. Under the former ordinance, thrift stores were permitted only when operated by nonprofit organizations and approved through a Conditional Use Permit. For-profit thrift stores and other businesses primarily engaged in the sale of used goods were not permitted in commercial zones. Despite those restrictions, three thrift stores were identified as operating without Conditional Use Permits (Third Times a Charm, High Street Boutique & Bison Exchange). In 2020, another thrift store prepared to open, bringing outdated and inconsistently enforced provisions to the City Council’s attention. The 2020 staff report acknowledged that the existing code effectively prohibited thrift stores unless they were operated by nonprofit corporations with approved CUPs and that the provisions had not been consistently enforced.

On November 2, 2020, the City Council considered several possible regulatory approaches, including allowing thrift stores by right, requiring administrative approval, or requiring a full Conditional Use Permit. The Council directed staff to return with an interim urgency ordinance while permanent regulations were studied.

On November 9, 2020, the City Council adopted an urgency ordinance temporarily eliminating the nonprofit ownership restriction and CUP requirement for thrift stores, antique stores, consignment stores, and similar businesses dealing in used goods. The interim ordinance was initially effective for 45 days.

On December 7, 2020, the City Council adopted an amended and extended urgency ordinance for an additional 10 months and 15 days. The amended ordinance temporarily allowed thrift stores, antique stores, and other businesses engaged in the wholesale or retail sale of used goods in commercial zones.

The amended urgency ordinance also established the following limitations:
• Used goods and donations were required to be received on the business premises; and
246
• Donations could not be accepted outside the primary structure; and • A used-goods business could not be located within 300 feet of another used-goods business; and
• No commercial zone could contain more than two such businesses unless a Conditional Use Permit was approved.

The staff report stated that a permanent ordinance was anticipated for consideration in mid2021. However, the records reviewed do not confirm that a permanent ordinance was adopted during that period. The 300-foot separation requirement and the limit of two usedgoods businesses per commercial zone therefore appear to have operated only as temporary standards under the interim urgency ordinance.
2024 Zoning Code Update

In August 2024, the City Council adopted Ordinance No. 2024-6 as part of the comprehensive Zoning Code Update. The updated code established the City’s current permanent regulatory framework for thrift and resale stores.

Under Selma Municipal Code Section 11-2.4(C), thrift and resale stores require approval of a Conditional Use Permit when located in a commercial zoning district. Ordinance No. 2024-6 permanently eliminated the former requirement that thrift stores be operated only by nonprofit organizations. The 2024 Zoning Code did not carry forward the 300-foot separation requirement or the limit of two thrift or used-goods businesses per commercial zone that appeared in the 2020 interim urgency ordinance. Accordingly, the current code does not establish a numerical cap or minimum separation requirement for thrift stores.

Each proposed thrift or resale store is instead evaluated individually through the CUP process.

Recent Thrift and Resale Businesses Approved Under the Current Code • Lovely Little Things, 2025 High Street (Central Business District Zone District — CUP Plan 25-10, approved in 2025.
• My Vintage & Thrift, 1971 High Street (Central Business District Zone District — CUP Plan 25-21, approved in 2025.

Other Existing Thrift and Resale Businesses Identified
• Third Times a Charm, 2033 Second Street (Central Business District Zone District) — No CUP record located; business license was issued in 2024. • High Street Boutique, 1965 High Street (Central Business District Zone District) — No CUP record located; business license was issued in 2021. • Bison Exchange, 2017 2nd Street (Central Business District Zone District) — No CUP record located; business license was issued in 2025. • Extending Hands Thrift Store, 1701 Whitson Street (Community Commercial Zone District) — CUP No. 2016-50; business license was issued in 2016. 247
Conclusion

This report is provided for the City Council's information regarding the historical development of the City's regulation of thrift and resale stores and the current requirements of the Selma Municipal Code. Under the current zoning regulations, thrift and resale stores require approval of a Conditional Use Permit in commercial zoning districts, and the Municipal Code does not establish minimum separation distances or numerical limits on such businesses. Existing thrift and resale operations without a CUP on file may require further review to determine their entitlement status under current and prior regulations, particularly if future expansion, remodeling, or significant operational changes are proposed.
