Adopt Resolution 2026-88
Regarding Peace Officers Workers
Compensation while out of State
24 ITEM NO: 2-3
CITY COUNCIL STAFF REPORT
MEETING DATE: September 1, 2026
SUBJECT: Adopt Resolution 2026-88 authorizing Workers Compensation Coverage for Off-Duty Peace Officers Injured Out of State SUBMITTED: Margee Fallert, Deputy City Manager
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:
Staff recommends that the City Council adopt Resolution 2026-88 authorizing the City of Selma to accept liability for workers’ compensation benefits for qualifying peace officers who sustain an injury or illness while outside the State of California under the circumstances authorized by California Labor Code Section 3600.2.
DISCUSSION:
Peace officers may encounter circumstances outside California in which their training and duties as peace officers lead them to intervene in situations involving the protection of life or property, preservation of the peace, or the apprehension or attempted apprehension of law violators or suspected law violators.
Although an officer may be off duty and outside the immediate direction of the City when such an incident occurs, the officer's actions may nevertheless be consistent with the publicsafety responsibilities and expectations associated with the officer's status as a peace officer.
The proposed resolution establishes the City's policy of accepting workers’ compensation liability for qualifying injuries and illnesses occurring under these circumstances. Adoption of the resolution also satisfies the prerequisite identified by LAWCX for coverage under its amended Memorandum of Coverage.
The resolution is intentionally limited. It does not create blanket workers’ compensation coverage for all injuries sustained by an officer while outside California or while off duty.
Coverage is limited to circumstances falling within Labor Code Section 3600.2 and the City's adopted resolution.
In addition, the resolution provides that coverage does not apply when the peace officer is suspended from peace officer duty or is otherwise not in good standing as a peace officer at the time of the occurrence. The resolution further limits eligibility to a peace officer as defined by Government Code Section 50920.
Staff finds that accepting this liability serves a legitimate public purpose by providing an appropriate workers’ compensation benefit to qualifying peace officers who, while outside California and not under the City's immediate direction, take action to protect life or property, preserve the peace, or apprehend or attempt to apprehend law violators or suspected law violators.
25 Providing this protection supports public safety and recognizes the circumstances in which peace officers may act in response to emergencies or public-safety concerns regardless of their location.
California Labor Code Section 3600.2 permits a peace officer's employer to accept workers’ compensation liability for certain injuries or illnesses sustained by an officer while outside California, even when the officer is not acting under the immediate direction of the employer.
The statute applies when the peace officer is engaged in the apprehension or attempted apprehension of law violators or suspected law violators, the protection or preservation of life or property, or the preservation of the peace.
The statute further provides that an employer may accept such liability when the employer determines that providing workers’ compensation benefits under these circumstances serves the public purposes of the employer.
The City's workers’ compensation coverage through the Local Agency Workers’ Compensation Excess Joint Powers Authority (LAWCX) has been amended to provide coverage for qualifying out-of-state injuries or occupational illnesses, provided that the governing body of the covered member adopts a resolution accepting liability under California workers’ compensation law prior to the occurrence.
The proposed resolution satisfies that requirement and establishes the City's acceptance of liability for qualifying occurrences beginning September 1, 2026. The resolution also limits coverage to peace officers who meet the statutory definition under Government Code Section 50920 and who are not suspended from peace officer duty or otherwise not in good standing at the time of the occurrence.
FISCAL IMPACT:
Qualifying claims would be administered through the City's existing workers’ compensation program and subject to the terms, conditions, limitations, and coverage provisions applicable under the City's LAWCX Memorandum of Coverage and California workers’ compensation.

Adopt Resolution 2026-89
Authorizing a Side Letter Agreement

Regarding Educational Incentive Pay

30 ITEM NO: 2-4
CITY COUNCIL STAFF REPORT
MEETING DATE: September 1, 2026
SUBJECT: Adopt Resolution 2026-89 Authorizing a Side Letter Agreement between the City of Selma and the Selma Police Officers Association Regarding Educational Incentive Pay language changes
SUBMITTED: Margee Fallert, Deputy City Manager
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:
Staff recommends that the City Council adopt Resolution 2026-89 authorizing a side letter agreement between the City of Selma and the Selma Police Officers Association regarding Educational Incentive Pay Language
DISCUSSION:
The City of Selma and the Selma Police Officers Association (“SPOA”) are parties to a Memorandum of Understanding (“MOU”) governing wages, hours, and other terms and conditions of employment for employees represented by SPOA.
The MOU contains provisions governing Educational Incentive Pay for eligible employees.
The City has been notified by the California Public Employees’ Retirement System (“CalPERS”) that the existing language pertaining to Educational Incentive Pay is not compliant with CalPERS requirements governing reportable special compensation.
CalPERS has advised the City that, in order for Educational Incentive Pay to qualify as reportable special compensation, the compensation must be available to all members of the bargaining unit who meet the established criteria and may not exclude employees based solely upon probationary status.
The City and SPOA have therefore negotiated a Side Letter of Agreement to address the eligibility language in Article 27 – Education Incentive. The Side Letter removes the term “probationary” from the language establishing eligibility for the incentive pay. The purpose of the amendment is to ensure that otherwise-qualified bargaining-unit employees are not excluded from the incentive solely because of their probationary status.
The Side Letter does not otherwise alter the Educational Incentive Pay benefits, qualification standards, approval requirements, or other terms contained in Article 27 of the MOU.
The proposed Side Letter is intended to bring the Educational Incentive Pay provision into compliance with the requirements identified by CalPERS while preserving the existing benefit negotiated between the City and SPOA.
Specifically, the amendment removes the reference to probationary status as a basis for exclusion from Educational Incentive Pay. As a result, an employee who satisfies the applicable educational, certification, training, documentation, and approval requirements will not be denied the incentive solely because the employee is probationary. 31 All other eligibility criteria and limitations applicable to Educational Incentive Pay remain unchanged.
Approval of the Side Letter will authorize the City to execute the agreement with SPOA and incorporate the agreed-upon modification into the parties’ MOU.
FISCAL IMPACT:
Fiscal impact if any is minor and will be absorbed through the budget.

Awarding a contract to Dave Christian
Construction Co., Inc. for the MercedStillman-Tulare Alley Improvements and authorize the City Manager to

45 ITEM NO: 2-6
CITY COUNCIL STAFF REPORT
MEETING DATE: September 1, 2026
SUBJECT: Consideration of Resolution 2026-91 awarding a contract to Dave Christian Construction Co., Inc. for the Merced-Stillman-Tulare Alley Improvements and authorize the City Manager to execute the contract documents.
SUBMITTED: David Horn, City Engineer
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:
Approve Resolution 2026-91 awarding a construction contract to Dave Christian Construction Co., Inc. for the Merced-Stillman-Tulare Alley Improvements in the amount of $560,591.15; approving a 10% construction contingency for potential change orders in the amount of $56,100; and authorizing the City Manager to execute the contract documents on behalf of the City.
BACKGROUND:
The Merced-Stillman-Tulare Alley Improvements ("Project") was developed to improve existing alley pavement conditions and associated drainage and concrete improvements within the Merced, Stillman, and Tulare alley areas. The Project is funded through funded Congestion Mitigation and Air Quality (CMAQ) funding and identified as Federal Project No. CML-5096(044).
Plans, specifications, and cost estimates for the Project were prepared by Yamabe & Horn Engineering. In accordance with the City's purchasing policies and applicable public contracting requirements, the Project was publicly advertised for bids.
On August 13, 2026, the City conducted a public bid opening for the Project. Eight sealed bids were received and publicly opened. The bid results are summarized below:
Contractor Base Bid__
Dave Christian Construction Co., Inc. $560,591.15
MAC General Engineering, Inc $591,493.27
Seal Right Paving $659,963.65
Central Valley Asphalt $687,662.00
Terra West Construction, Inc. $689,167.69
R.J. Berry Jr., Inc. $710,556.20
Avison Construction, Inc. $720,021.00
Kroeker, Inc. $734,442.46
DISCUSSION:
46 The Project generally consists of roadway excavation; hot mix asphalt paving; aggregate base; fog seal and trench resurfacing; concrete alley approaches, gutters, sidewalk, and curb and gutter; storm drain manhole, pipe, other appurtenant work necessary to complete the alley improvements.
The Engineer's Estimate for construction was $660,000. The apparent low bid of $560,591.15 is $99,408.85, or approximately 15.1 percent, below the Engineer's Estimate.
Staff and the City Engineer reviewed the bid proposal and determined that Dave Christian Construction Co., Inc. submitted the apparent lowest responsive bid. The bid review also confirmed the contractor's required licensing and registration information and the submitted bid documents.
Based upon the bid review and recommendation of the City Engineer, staff recommends awarding the construction contract to Dave Christian Construction Co., Inc. in the amount of $560,591.15.
With the recommended 10% construction contingency of $56,100, the total authorized construction amount would be $616,691.15.
FISCAL IMPACT:
The proposed construction contract amount is $560,591.15. Staff also recommends approval of a 10% construction contingency in the amount of $56,100, and the Construction Management and Inspection services in the amount of $67,000 bringing the total authorized construction amount to $683,691.15.
The Merced-Stillman-Tulare Alley Improvements is a federally funded CMAQ project (Federal Project No. CML-5096(044)) with the applicable local match. Project costs will be charged to the funding programmed and appropriated for this project.

SUBJECT: Consideration of Resolution 2026-92 Adopting a User Fee Schedule for American Heart Association Emergency Cardiovascular Care Training Courses Offered by the Selma Fire Department and Authorizing the City Manager or Designee to Execute All Necessary Associated Documents
SUBMITTED: Jordan Webster, Fire Chief
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:
Staff recommends the City Council adopt Resolution 2026-92 establishing a user fee schedule for American Heart Association (AHA) Emergency Cardiovascular Care (ECC) training courses offered by the Selma Fire Department, and authorizing the City Manager or designee to execute all necessary associated documents.
DISCUSSION:
The Selma Fire Department offers AHA-certified Emergency Cardiovascular Care training courses to community members, healthcare providers, and local organizations. These courses include AHA Basic Life Support (BLS), AHA Heartsaver, AHA ACLS Renewal Only, and AHA PALS Renewal Only, taught by Selma Fire Department personnel. Course fees include instruction, AHA course materials, and issuance of an AHA course completion card upon successful completion of all course requirements.
The City has a prior history of charging user fees for CPR-related training. The 2018 User Fee schedule (Resolution 2018-67) included a CPR Class Fee (Ref. FI-021) of $65 per professional and $45 for all others, with no recommended change at that time. However, the 2021 comprehensive User Fee Study conducted by Revenue and Cost Specialists (RCS), adopted by the City Council as Resolution 2021-66 on November 1, 2021, recommended the removal of the CPR Class Fee (Ref. FI-021), citing that the service was "no longer provided." The Selma Fire Department has since resumed offering AHA-certified CPR and cardiac emergency training, and the proposed fee schedule formalizes cost recovery for these courses, consistent with the City's established policy of recovering the full costs reasonably borne for providing special services of a voluntary and limited nature.
The AHA training courses offered by the Selma Fire Department provide meaningful and measurable benefits to the Selma community. The AHA BLS course equips healthcare providers and other personnel with high-quality CPR skills for adults, children, and infants, including AED use and relief of choking, skills that are directly applicable in both professional and community settings. The AHA Heartsaver course is specifically designed for individuals with little or no medical training, enabling community members, employees, and volunteers to respond effectively to cardiac, breathing, and first aid emergencies. The AHA ACLS and PALS Renewal courses ensure that local healthcare providers maintain current, up-to-date skills in the recognition and management of cardiac arrest, acute dysrhythmias, stroke, and 52 pediatric cardiopulmonary emergencies — directly benefiting the quality of care available to Selma residents.
The importance of CPR training to community outcomes has been demonstrated locally. The Selma Fire Department has documented that the cardiac arrest survival rate (return of spontaneous circulation) in the field increased from approximately 6% to 18% following the deployment of advanced resuscitation equipment, underscoring the life-saving impact of highquality CPR technique and training. The gold standard for CPR response in cardiac arrest is within six minutes of the heart stopping, and bystander CPR training is a critical component of improving outcomes in the time before emergency responders arrive. The Selma Fire Department's Prevention Division has a history of community outreach through CPR education, including school tours and community events, reflecting the Department's commitment to building a more cardiac-emergency-ready community.
Providing AHA-certified training through the Selma Fire Department also supports local healthcare providers, businesses, and organizations that require AHA course completion cards for job, regulatory, or licensing requirements, reducing the need for Selma residents and employers to seek these services outside the community. 1 The Fiscal Year 2026-2027 Ambulance Services objectives include providing ACLS and PALS training as a service to the community, reflecting the Department's strategic commitment to expanding ECC training as a core community service.
Fees are due at the time of registration and are non-refundable, and are subject to change at the discretion of the Selma Fire Department.
FISCAL IMPACT:
Fees collected for AHA ECC training courses will be deposited into the Ambulance Fund. 7 No General Fund impact is anticipated. 1 Revenue will vary based on course demand and enrollment.

Adopt Resolution 2026-93
Authorizing Acceptance of a
California Office of Traffic
Safety (OTS) Grant
59 ITEM NO: 2-8
CITY COUNCIL STAFF REPORT
MEETING DATE: September 1, 2026
SUBJECT: Consideration of a Resolution 2026-93 Authorizing Acceptance of a California Office of Traffic Safety (OTS) Grant in the Amount of $53,500.00 for the Purchase of Fire Department Auto Extrication Equipment; Approving the OTS Grant Agreement No. EM27020; Amending the Fiscal Year 2026/2027 Budget; Authorizing Payment of $1,605.00 to Granted Solutions for Grant Writing Services; and Authorizing the City Manager or Designee to Execute All Necessary Associated Documents
SUBMITTED: Jordan Webster, Fire Chief
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:
Staff recommends the City Council adopt Resolution 2026-93 authorizing acceptance of a California Office of Traffic Safety (OTS) Grant (Grant No. EM27020) in the amount of $53,500.00 for the purchase of a fully equipped auto extrication system for the Selma Fire Department; approving the OTS Grant Agreement No. EM27020 between the City of Selma and the California Office of Traffic Safety; amending the Fiscal Year 2026/2027 budget by increasing Revenue GL 1002-3210-42100 (Equipment Replacement Grant Revenue) by $53,500.00 and increasing Expense GL 1002-3210-710000 (Fire Administration, Capital Outlay, Equipment) by $53,500.00; authorizing payment of $1,605.00 to Granted Solutions for grant writing services to be accrued to GL 1000-5110-600000 (Professional Services); and authorizing the City Manager or designee to execute all necessary associated documents.
DISCUSSION:
The California Office of Traffic Safety (OTS) is a state agency with a mission to effectively and efficiently administer traffic safety grant funds to reduce traffic deaths, injuries, and economic losses throughout California. The OTS Regional Crash Response and Extrication Improvement Program under which this grant is awarded is specifically designed to address one of the most time-critical and life-threatening scenarios first responders face: extricating victims trapped in motor vehicle crashes. The grant program provides funding for fire departments that either lack extrication equipment entirely or possess aging equipment that has reached the end of its usable lifespan and is in need of replacement.
The City of Selma is uniquely situated at the intersection of two major transportation corridors, State Route 99 and State Route 43, which carry significant volumes of commuter, commercial, and agricultural traffic through the heart of the community. The freeway system running directly through the middle of town creates particularly dangerous conditions, especially during the winter fog season, when the risk of serious traffic collisions increases dramatically. Having modern, reliable extrication equipment, commonly known as the "jaws of life", immediately accessible to field personnel is critical to the safety of travelers passing through Selma as well as the City's own residents.
60 The Selma Fire Department (SFD) serves not only the City of Selma but also surrounding communities including Fowler, Kingsburg, and Parlier, as well as adjacent unincorporated areas of Fresno County, through automatic and mutual-aid agreements. The department's annual call volume reflects the significant demand placed on its resources, with Rescue and Emergency Medical Service incidents accounting for the majority of total responses and a consistent year-over-year increase in EMS calls for service. Auto extrication is a core competency of the SFD, with department members receiving annual training in extrication techniques as part of their ongoing professional development.
The grant was developed in close collaboration between Granted Solutions, the City's grant writing and management consultant, and Battalion Chief Kutka, reflecting a coordinated effort to align the application with both OTS program priorities and the department's operational needs. The City of Selma is grateful for this award opportunity and staff looks forward to putting this critical equipment into service for the benefit of the entire community.
FISCAL IMPACT:
Acceptance of this grant will result in the following budget amendments to the Fiscal Year 2026/2027 budget:
Action GL Account Description Amount
Revenue Increase 1002-3210-42100 Equipment Replacement Grant Revenue $53,500.00 Expense Increase 1002-3210-710000 Fire Admin, Capital Outlay, Equipment $53,500.00 Expense Accrual 1000-5110-600000 Professional Services (Granted Solutions) $1,605.00 There is no net General Fund impact from the grant award itself, as the revenue and expenditure amendments are offsetting. The $1,605.00 payment to Granted Solutions for grant writing services will be accrued to the Professional Services account and is consistent with the City's ongoing grant management consulting arrangement.

Adopt Resolution 2026-94
for Award of On-Call Grant

Services Agreements
86 ITEM NO: 5-1
CITY COUNCIL STAFF REPORT
MEETNG DATE: September 1, 2026
SUBJECT: Adopt Resolution 2026-94 for Award of On-Call Grant Writing and Procurement Services Agreements to Townsend Public Affairs, Inc., Blais & Associates, LLC (B&A Grant Services), and Interwest Consulting Group, Inc.
SUBMITTED: Jason Rogers, City Manager
APPROVED: Jason Rogers, City Manager
RECOMMENDATION:
Adopt resolution 2026-94 approving the selection of Townsend Public Affairs, Inc., Blais & Associates, LLC (B&A Grant Services), and Interwest Consulting Group, Inc. for the City’s on-call list for Grant Writing and Procurement Services; designate Townsend Public Affairs as the City’s primary grant services consultant at a monthly retainer of $5,500; and authorize the City Manager to negotiate and execute professional services agreements with the selected firms, subject to review and approval by the City Attorney as to form.
DISCUSSION:
The City issued a Request for Qualifications (RFQ) for On-Call Grant Writing and Procurement Services to establish a qualified on-call list of up to three firms to assist City departments on an as-needed basis. The requested services include funding needs and feasibility assessment, identification of grant resources and matching opportunities, grant application preparation and submittal, legislative and regulatory monitoring, and grant reporting and management.
The City received 12 proposals in response to the RFQ. An evaluation team comprised of the City Manager, Deputy City Manager, Finance Director, and Fire Chief independently reviewed and scored the proposals using the evaluation criteria established in the RFQ:
Qualifications (25 points), Approach (25 points), Price Proposal (25 points), Innovation/Creative Approach (10 points), and References (15 points), for a total of 100 possible points.
Following tabulation of the evaluation team's scores, the three highest-ranked firms were:
Rank Firm Average Score
1 Townsend Public Affairs, Inc. 90.25
2 Blais & Associates, LLC (B&A Grant Services) 89.00
3 Interwest Consulting Group, Inc. 84.25
Based on the evaluation results, staff recommends establishing the City’s on-call list with the three highest-ranked firms. The firms provide complementary capabilities, with Townsend offering comprehensive grant development and state and federal funding strategy, B&A 87 specializing in municipal grant research, writing, and management, and Interwest providing grant services supported by in-house engineering and other technical expertise.
Staff further recommends Townsend as the City’s primary grant services consultant under its $5,500 monthly retainer ($66,000 annually), which includes ongoing grant identification, competitive grant pursuits, and state and federal funding support.
B&A and Interwest would serve as supplemental on-call consultants with no guaranteed minimum work. B&A proposes grant services at $150 per hour, while Interwest proposes $160 per hour for Grant Writer services and $170 per hour for Grant Manager services.
Assignments would be made as needed based on expertise, availability, cost, and available funding.
This three-firm structure provides the City with additional capacity and flexibility to pursue multiple and specialized funding opportunities as they arise.
FISCAL IMPACT:
Funding for Grant Writing Services is included in the adopted FY 2026/27 Budget.
Townsend Public Affairs proposed an all-inclusive monthly retainer of $5,500, for an annual cost of $66,000, which will be funded from the existing budget appropriation.
B&A and Interwest will be retained on an as-needed basis with no guaranteed minimum compensation. B&A's proposed rate is $150 per hour, and Interwest's proposed rates are $160 per hour for Grant Writer services and $170 per hour for Grant Manager services.
Any services assigned to B&A or Interwest will be authorized only within available departmental, project, grant, or other approved budget authority.
