SFIAFTER COUNCIL AGENDA REPORT
Meeting Date: September 12,2022
FROM: Gabriel A. Gonzalez,City Manager
Prepared By: Kevin Zimmermann, Chief of Police

SUBJECT PURCHASE OF FOUR FORD POLICE UTILITY VEHICLES WITH

OUTFITTED EMERGENCY EQUIPMENT AND GRAPHICS

RECOMMENDATION
Council approve the purchase of four (4) 2023 Ford Police Utility vehicles from Jim Burke Ford with outfitted emergency equipment and graphics for a total cost of $75 ,164.02 per vehicle.

EXECUTIVE SUMMARY
The Shafter Police Department has historically replaced two patrol units annually to help offset the predictable wear-and-tear associated with police vehicles. The City Council also recently approved two additional officer assignments that included a dedicated officer assigned to the Gossamer Grove residential development and a second position as a School Resource Officer (SRO) assigned to the Richland School District. These two new positions require the outfitting of two new patrol units.

Staff received quotes from Jim Burke Ford, National Auto Group, and Future Ford of Clovis. The police department currently contracts with American Emergency Products (A.E.P) who have supplied the outfitting of emergency equipment and outfitting maintenance to the department's fleet since 2003. The police department has previously retained Finish Line Signs to apply the needed emergency graphics to the police vehicles. The required design fees for the department's graphics have already been paid and it would not be cost effective to seek other quotes as new design fees would be accrued. The mobile radios required to be outfitted in the patrol vehicles must be purchased through Motorola as they are the only entity that is able to provide public safety radios. The department is required to outfit new patrol units with AES encryption to be in compliance with DOJ/CJIS encryption protocols.

BACKGROUND
The Shafter Police Department provides patrol units to each officer. Cunently, the department has 31 assigned vehicles to staff members (4 Administrative vehicles, 29 patrol vehicles and 2 Animal Control vehicles) with I spare K-9 Unit. Historically, the department will outfit two new patrol units each year.

Provide patrol personnel with newer patrol units that are less likely to fail in the field and prevent high maintenance costs due to the excessive mileage of two patrol units. Additionally, provide the Gossamer Groves residential development and School Resource Officer assigned personnel with patrol vehicles approved by the City Council.

ALTERNATIVES
Approve the purchase of four (4) 2023 Ford Police Utilities through Jim Burke Ford that will be outfitted by A.E.P, installed Motorola mobile radio with program fees, doors painted by Shafter Auto Body, and graphics created and applied by Finish Line Signs for a total cost of $75,164.02 per unit. Recommended.

Retain the department's current fleet inventory and repair the older units in the fleet as necessary.

Not Recommended.

FISCAL IMPACT/FUNDING SOURCE
The purchase of these four vehicles is included in the 2022-2023 Operating Budget under account 570100 and 570200. No budget action is required with the approval of this acquisition.

CONCLUSION
Staff recommends Council approve the purchase of four outfitted patrol units.

It is essential to replace four patrol units to the Shafter Police Departments current fleet inventory to provide patrol personnel with newer patrol units that are more reliable and outfitted with newer more efficient emergency equipment that is less likely to fail in the field. This recommendation also includes the two patrol units for the Gossamer Groves residential development and School Resource Officer positions.

SI-TAFTER COUNCIL AGENDA REPORT
Meeting Date
FROM:

SUBJECT:

September 12,2022
Gabriel A. Gonzalez,City Manager
Prepared By: Dennis Fidler, Building Official

CONTRACT FOR OUTSIDE CODE ENFORCEMENT SERVICES

RECOMMENDATION
Council authorize the City Manager to execute a professional services agreement with Willdan Engineering, for code enforcement services in an amount not to exceed $80,000, for the fiscal year 2022-2023.

BACKGROUND
The City's building department activity continues to experience a significant amount of growth over the past decade with a recent steady influx of construction activity over the past six years.

While community development has shown steady signs of increase, staff expects this growth to hold steady in the coming years which includes an elevated demand on the code enforcement division. The City uses code enforcement officers to help maintain service levels during high demands. Staff recommends that the City Council approve a contract with Willdan Engineering for such services in a not-to-exceed amount of $80,000. This amount is for budget purposes only and will be utilized as needed for code enforcement services until the code enforcement position is filled and has some overlap to assist with necessary training of the future code enforcement officer.

The Code Enforcement Officer recruitment is an open until filled and has been opened for the past nine months. There has not been an opportunity to permanently fill this position, however, we interviewed several candidates on September 1, 2022, and have the top candidate preparing for a final interview with the City Manager and several other candidates on an eligible list. During these most recent interviews we lessened the specific code enforcement requirements to achieve a greater pool of candidates with less code enforcement experience to help find someone that City staff could train and retain with both contractual assistance and existing current staff.

FISCAL IMPACT
Total expenditures for the contract with Willdan Engineering are not expected to exceed $80,000.

The professional services account, account # 0100-10-405-27-00-510400, currently has sufficient unencumbered balance to cover the requested expense. Therefore, no budget action is required to fund the recommended outside code enforcement services.

CONSENT CALENDAR 2
l.

2. Contract for Outside Inspection Services for Assistance with Code Enforcement

ALTERNATIVES
The Council can reject the recommended action and use the current staffing for all necessary code enforcement activity while all open recruitments are filled. However, the City would have to significantly reduce service levels to keep up with the demands. STAFF DOES NOT RECOMMEND THIS OPTION.

SFIAFTER COUNCIL AGENDA REPORT
Meeting Date:

FROM:

SUBJECT
September 12,2022
Gabriel A. Gonzalez, City Manager
Prepared By: Michael James, Public Works Director

LERDO HIGHWAY MEDIAN LANDSCAPING

SERVICES AWARD

MAINTENANCE

RECOMMENDATION
Council find the requested action is exempt from the Califomia Environmental Quality Act; approve a proposal submitted by R&R Commercial Lawn Maint., Inc. for median maintenance services at Lerdo Highway in the amount of $12,000; and authoize the Public Works Director to award said services.

BACKGROUND
Recently, Staff shortages in the Streets and Parks Divisions of Public Works have resulted in the street median landscaping at Lerdo Highway between Beech Avenue and Mannel Avenue not being adequately maintained. Therefore, the department had R&R Commercial Lawn Maintenance ("R&R") submit a proposal for providing the necessary maintenance work on an interim basis. Their proposed service fee is $1,990 per month, which includes weed control and routine pruning of shrubs. R&R is currently performing similar work at numerous public facilities and streetscapes directly for the City. By the end of this year, City crews can likely resume this work with the backfilling of unfilled positions that are currently budgeted.

Staff has processed a purchase order for R&R to start the median maintenance services. The estimated funding to cover the services for up to six months is approximately $12,000, which requires authorization by the Council to award.

FISCAL IMPACT
The Public Works Streets Division has adequate funding for the estimated $12,000 to cover the median landscape services work. No budget action is necessary.

CEQA ANALYSIS
The proposed action is not subject to the California Environmental Quality Act (CEQA) because it is not defined as a "Project" pursuant to Section 15378(bX5) of the CEQA Guidelines.

CONSENT CALENDAR 5
I
2 Lerdo Highway Median Landscaping Maintenance Services Award

ALTERNATIVES
The Council can reject the recommendation and direct staff to keep using City crews as available for the median maintenance work. While this would preserve operational funding for other improvements or services, the appearance of the median would likely suffer because available crews are focused on pavement maintenance. Also, backfilling budgeted positions to support median maintenance, along with proper training, will likely take at least three months. Staff does not recommend alternative action because this particular stretch of Lerdo Highway serves as a high-profile and impressionable gateway for the Core City.

Meeting Date: September 12,2022

Prepared By: Michael James, Public Works Director

MANNEL PARK SHADE STRUCTURE RELEASE FOR FORMAL

BIDDING
SUBJECT:

RECOMMENDATION
Council find the requested action is exempt from the California Environmental Quality Act; and authorize the release of construction plans and specifications for the Mannel Park Shade Structure project for formal bid purposes, subject to final review and approval by the City Engineer.

BACKGROUND
The City was allocated State park grant funds to be used with local matching funds for improvements at Mannel Park, focusing on a new inigation system, one new shade structure, and u d-og park area subject to fund availability. The Land and Water Conservation Fund (LWCF) speci-fically awarded the grant. A grant funding agreement for this project was recently fully executed by the City and State. Per the agreement, the City's project costs will be reimbursed at agrantrate of 50%vp to approximately $230,000.

The City Engineer has prepared construction plans and specifications for the new shade structure, located immidiately adjacent to Mannel Avenue. Staff picked the site because it is the most popular reservation space without a shade structure and intends to match the style and color layout ^of
an existing shade itructure at the park. The estimated value of the project is $150,000, which, per the Cityi bidding and procurement policies, requires formal bid procedures. Bid results and an award recommendation will be brought before the Council at a future meeting.

F'ISCAL IMPACT
Capital Improvement Program Project #PK00004 was programmed this fiscal year to fully fund the State LWCF grant project with local matching requirements. No budget action is required.

CEQA ANALYSIS
The proposed activity is not subjectto the CaliforniaEnvironmental Quality Act (CEQA) pursuant to Siction 15301(cj of the CEQA guidelines in that the City proposes minor alterations and additions to Mannel Park.

CONSENT CALENDAR I0
Mannel Park Shade Structure Release for Formal Bidding
I
2 ALTERNATIVES
The Council can reject the recommended action in favor of focusing on an alternative site for the shade structure or postponing the project to preserve the local funds required to construct the project. However, the grant funding agreement does limit the amount of time the City has to fulflll to complete the improvements. Further, the project would enhance park use and recreation, which has consistently been a priority for the Council and City residents. Therefore, alternative action is not recommended.

SHAFTER COUNCIL AGENDA REPORT
Meeting Date: September 12,2022
FROM: Gabriel A. Gonzalez,City Manager
Prepared By: Michael James, Public Works Director

AMENDED EASEMENT AGREEMENT WITH TARGET CORPORATION

FOR PUBLIC LANDSCAPING IMPROVEMENTS AT SEVENTH

STANDARD ROAD
SUBJECT:

RECOMMENDATION
Council find the requested action is exempt from the California Environmental Quality Act; accept a dedication of an easement for public landscaping for APN 091-262-09; approve a Landscape Easement Agreement with Target Corporation subject to any non-substantive changes further negotiated by the Public Works Director and City Attorney; authorize the City Manager to execute said agreement; and authorize the recordation said agreement.

BACKGROUND
At its April 5, 2022 meeting, the Council approved the acceptance of an easement from Target Corporaiion for the City to install and maintain public landscaping along the north side of Seventh Standard Road immediately in front of Target's warehouse and distribution facility. The area within the easement dedication had mostly been private landscaping, mainly consisting of ornamental grass, maintained by Target.

In 2018, the City accepted a grant of a sewer easement from Target Corporation (Target), which enabled the City to extend its sewer collection system as far east as Gossamer Grove. However, they agreed to have the City convert a landscaping strip of grass along Seventh Standard Road to a drought-tolerant altemative rather than accepting payment for the easement. The arrangement negotiated by Target and City staff consists of Target granting the City an easement to construct, opirate, and maintain the new landscaping. There is currently funding through the City's Capital Improvement Program (CIP) to construct the landscaping improvements. In addition, an existing landscape and lighting district can fund ongoing operations and maintenance for the upgrades.

Since the Council's approval to accept the public landscaping easement and approve the easement agreement, both Target and City staff have recommended some non-substantive changes to the agreement. Previous versions of neither agreement nor grant of easement have been fullyexecuted. Upon Council approval of these changes, the agreement and easement document will be executed, allowing the City to proceed with the engineering and construction of the landscaping improvements.

CONSENT CALENDAR 1
Amended Easement Agreement between City of Shafter and Target Corporation - Seventh Standard Road

F'ISCAL IMPACT
Costs to prepare and Landscape Easement Agreement can be covered with existing CIP or operational accounts. Fiscal impacts for the construction and maintenance of the proposed landscaping improvements will be brought before the Council at a later date. No budget action is required at this time.

CEQA ANALYSIS
The proposed activity is not subject to the California Environmental Quality Act (CEQA) because it is not defined as a "Project" pursuant to Section 1537S(bX5) of the CEQA Guidelines. The action is organization or administrative activities of governments that does not result in direct or indirect physical changes to the environment.

ALTERNATIVES
The Council can reject the recommended action to preserve CIP funding for other street or landscaping projects. However, as previously stated, the City accepted a sewer easement from Target to extend sewer service to Gossamer Grove and future development areas. The estimated value of the easement is at least $100,000. Rather than accept payment for the easement, Target agreed to invest that funding into improving landscaping at a high-profile traffic corridor, which benefits Target and the City. The planned improvements will result in a modernized look that is easier to maintain and uses significantly less water. In addition, target and the other industries at the Wonderful Industrial Park will participate in funding operations and maintenance through a special services district. Therefore, alternative action is not recommended.

ATTN: Brynn Anderson
1000 Nicollet Mall, TPN 1202
Minneapolis, MN 55403
Dear Ms. Anderson:

The City of Shafter has received a grant of a sewer easement from Target that provldes the City access for constructlon plus ongolng operations and maintenance of a sanitary sewer main on Target property along the north side of Seventh Standard Road. The purpose of this notice is to provide Target with future construction schedullng projections and commltments on what the Clty will do with respect to landscaping lmprovements within or immediately adjacent to the sewer easement.

The construction of the new sewer main is scheduled to take place by July of next year. Work within the new easement granted by Target is one of several project phases, so the exact timing is somewhat dependent upon the City acquiring additional easements and coordlnating with project partners that will be fundlng portions of the project. Regardless of when the Target phase takes place, there should be no disruption to the daily flow of employee or truck traffic because existing roadways and access points will not be impacted. City staff will contact local Target officials once a more precise construction schedule is available.

The goal of the future landscaping work is to either restore or enhance existing improvements after the sewer main construction takes place. One specific goal, previously endorsed by Target, is the removal of the existing grass turf along Seventh Standard Road in favor of new plantings that are more drought tolerant and less expensive to maintain. The City started the design of this landscaping work but is also explo1ng a joint project with Wonderful Real Estate, the master developer of the surrounding industrial park. Regardless if this is a City or partnered project, all proposed landscaping additions and improvements on Target property shall be approved by Target officials before any work can commence.

The City anticipates that the work will start as early as late summer or early fall of next year. The funding available to the City should allow for these improvements to be provided at no cost to Target.

The City appreciates Target's cooperation and support with this project, lf there are any questions or issues regarding the project or this notice, please feel free to contact me.

Sincerely,
MichaelJames

S}TAFTER COUNCIL AGENDA REPORT
Meeting Date: September 12,2022
FROM: Gabriel A. Gonzalez,City Manager
Prepared By: Kevin Harmon, City Engineer
SUBJECT: ACCEPTANCE OF DEDICATION OF EASEMENT FOR STREET &

PUBLIC UTILITY FROM PENTECOSTAL CHURCH OF GOD OF

SHAFTER, INCORPORATED

RECOMMENDATION
Council findthe requested action is exempt fromthe CaliforniaEnvironmental Quality Act; accept the dedication of easement for street and public utility purposes at APN 026-182-08, 09, and 10 from Pentecostal Church of God of Shafter, Inc.; and authorize the City Engineer to record said document.

BACKGROUND
The Pentecostal Church of God is located on the west side of Shafter Avenue between West Orange Avenue and West Ash Avenue. They are performing site improvements, including sidewalk and drive approach construction within the public right-of-way. City staff informed church officials that there are no official records of a right-of-way dedication at the west side of Shafter Avenue that is typically in place for curbs, gutters, and sidewalks. They have since agreed to provide the required dedication via public street and public utility easement. This type of dedication requires Council acceptance and recordation upon being fully executed.

F'ISCAL IMPACT
The street and public utility easement dedication was provided at no cost to the City. Existing operational budget accounts can cover the costs of preparing the easement document. Therefore, no budget action is required.

CEQA ANALYSIS
The requested action is exempt from the California Environmental Quality Act (CEQA). In this case, improvements within the proposed easement dedication do not expand or significantly alter street or utility operations.

ALTERNATIVES
There is no altemative to the recommended action. Right-of-way dedications that give the City access to build, operate, and maintain public improvements require Council approval for acceptance.

SFIAFTER COUNCIL AGENDA REPORT
Meeting Date: September 12,2022
FROM: Gabriel A. Gonzalez, City Manager
Prepared By: Michael James, Public Works Director
SUBJECT: WELL NO. 21 SITE DEVELOPMENT PROJECT RELEASE FOR FORMAL

BIDDING

RECOMMENDATION
Council find the requested action is exempt from the California Environmental Quality Act; approve the construction plans and specifications for the Well No. 21 Site Development Project, located at the Wonderful Industrial Park; and authorize the Public Works Director to approve and release said plans and specifications for formal bid purposes.

BACKGROUND
Last year, the Council authorized the purchase of a parcel within the Wonderful Industrial Park (WP) containing one groundwater well used for agricultural pu{poses. Before the acquisition, City staff had the groundwater analyzedto ensure the water quality meets required drinking water quality standards. Staff now intends to use the well for municipal uses as the primary water source for the WIP, which would significantly reduce the demands on wells operating within the Core City. The well is now referred to as Well No. 21.

Construction plans and specifications for the Well No. 2l Site Development Project, prepared by Dee Jaspar and Associates, are ready to be released for formal bidding purposes. The project includes equipping the well with a new pump and motor, piping to connect the well to the existing distribution system, and miscellaneous electrical controls. The preliminary estimate for the project is approximately $2,000,000 to $2,500,000.

FISCAL IMPACT
Capital Improvement Program Project No. WA000l5 was programmed this fiscal year with $1,300,000 in funding for Well 21. Although this funding is adequate to conduct bid procedures, budget action will likely be required once bidding is complete, given the previously reported estimate. Staff will present bid results and budget action recommendations at a future Council meeting.

CEQA ANALYSIS
The requested action is exempt from the California Environmental Quality Act (CEQA) because it covers only bid procedures. However, CEQA certification by the Council will eventually be 4 CONSENT CALENDAR
Bidding of Well No.21 Site Development Project
covered so the groundwater well can be permitted by the State of Califomia for municipal purposes. This certification will be requested at a future meeting.

ALTERNATIVES
The Council can reject the requested action in favor of the following alternatives:
l. Explore other sites for a future well.

2. Preserve Capital Improvement Program funds for other water projects.

While these alternatives are viable, the current recommendation allows the City to move forward with improving the sustainability of water production and deliveries to all residents and businesses.

Further, the City acquired the site containing the existing groundwater well previously used for agricultural purposes for a future City well site. Therefore, altemative action is not recommended.
