MANAGEMENT REPORT
CITY OF SHAFTER
CITY COUNCIL REPORT
MEETING DATE: January 17, 2023
FROM: Gabriel A. Gonzalez, City Manager
PREPARED BY: Alex Gonzalez, Associate Engineer
SUBJECT: AWARD CONTRACT TO LANDSCAPE DEVELOPMENT, INC. IN THE AMOUNT OF $336,648.50 FOR THE KIRSCHENMANN PARK
IRRIGATION SYSTEM IMPROVEMENTS
RECOMMENDATION
1. Council find the requested action is exempt from the California Environmental Quality Act;
2. Accept the bids received for the Kirschenmann Park Irrigation System Improvements [PK00002-1]; and,
3. Authorize the Public Works Director to issue a Notice of Award and Notice to Proceed to Landscape Development, Inc. in the amount of $336,648.50 on behalf of the City.
BACKGROUND
The Council previously authorized formal bidding of a project that would replace the irrigation system at Kirschenmann Park, plus develop a second field for baseball or softball use. Additionally, the project includes grass reseeding that will leave a turf better-suited for recreational use and planting 20 new trees.
Seven bids were received and opened on December 22, 2022. The following is a bid summary:

Sazama Construction $500,637.52
D.L. Brown
Construction Inc.
$568,028.53
Nish-ko, Inc. $600,103.87
ANALYSIS
The lowest responsive bid was submitted by Landscape Development, Inc., a company based in Valencia. While they have yet to contract with the City for a project, they have completed projects working under Lennar at Gossamer Grove, which include parks and public landscape development.
A recommended project budget, based on the confirmed low bid amount and recommended contingencies of 20%, a suggested budget to fully fund the project is $400,000. The contingency factor is more significant than a typical project, partly because of the park's age. In addition, there are limited files covering the park's past construction, suggesting there may be work scope additions and adjustments to address unforeseen issues or conflicts.
FISCAL IMPACT
No budget action by the Council is required. The Council previously authorized $400,000 in American Rescue Plan Act (ARPA) funds for field improvements at Kirschenmann Park. This amount was programmed into Capital Improvement Program Project No. as Project #PK00002.
CEQA ANALYSIS
Per Section 15302 of the CEQA Guidelines, the action is exempt from CEQA in that the improvements consist of the replacement of the existing irrigation system with a new system that has substantially the same purpose.
APPROVED BY THE CITY ATTORNEY

ALTERNATIVES
Awarding the proposed irrigation system and field improvements at Kirschenmann Park follows the Council's past direction to complete recreation enhancements with ARPA funds. The Council can amend the ARPA funding strategy in favor of other projects. However, Kirschenmann Park was specifically prioritized for ARPA funding because there is a continuous demand for baseball and softball fields without a source of local funding to meet this demand. Additionally, there will be adequate funding for future operations and maintenance of the proposed park upgrades and amenities, provided field use agreements with local sports organizations are in place. Therefore, alternative action is not recommended.
AWARD CONTRACT TO LANDSCAPE DEVELOPMENT, INC. IN THE AMOUNT OF $336,648.50
FOR THE KIRSCHENMANN PARK IRRIGATION SYSTEM IMPROVEMENTS - 3 -
NEXT STEPS
Upon approval of the recommended action, staff will issue a contract award to Landscape Development, Inc. After the contract is fully executed, a Notice to Proceed will be issued, allowing the ordering of materials and construction to start. Once construction commences, Landscape Development, Inc. will have approximately three months to complete the project.

MANAGEMENT REPORT
CITY OF SHAFTER
CITY COUNCIL REPORT
MEETING DATE: January 17, 2023
FROM: Gabriel A. Gonzalez, City Manager
PREPARED BY: Michael James, Public Works Director
SUBJECT: ADOPTION OF RESOLUTION 2902, A RESOLUTION OF THE
CITY COUNCIL OF THE CITY OF SHAFTER AUTHORIZING THE
CANCELLATION OF COMMUNITY DEVELOPMENT (CD)
ACTIVITY 18.19.1
RECOMMENDATION
Council adopt Resolution 2902, a Resolution of the City Council of the City of Shafter Authorizing the Cancellation of Community Development (CD) Activity 18.19.1.
BACKGROUND
The City of Shafter participates with the County of Kern in a cooperative partnership to utilize Federal Community Development Block Grant (CDBG) and Home Investment Partnerships (HOME) program funding. Through the partnership, the County distributes CDBG funding to all participatory agencies under a “fair-share” allocation based on population.
Four years of City CDBG funding had previously been authorized by the Council for improvements at Veterans Park. However, staff later determined that additional Federal funds made possible by the American Rescue Plan Act (ARPA) could be more readily used for constructing improvements than CDBG funds. This development led to the Council authorizing ARPA funds for soccer field lighting at Veterans Park, a highpriority project. Unlike Veterans Park, the improvements at Rodriguez Park can accommodate the additional time needed to proceed with a CDBG-funded project. Therefore, on July 19, 2022, the Council also adopted Resolution 2882, formally authorizing the cancelation of a funding agreement for one annual CDBG allocation ("CD Activity 18.18.1") and the reallocation of four annual CDBG funding allocations towards future improvements at Rodriguez Park.
After receiving Resolution 2882, County staff notified the Public Works Director that additional Council action is required to proceed with CDBG-funded Rodriguez Park improvements. Specifically, a separate resolution must formally cancel "CD Activity
18.19.1", a funding agreement number previously established by the County for one of the annual CDBG allocations to construct park improvements that will now be constructed using ARPA funds.
ANALYSIS
ADOPTION OF RESOLUTION 2902, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SHAFTER AUTHORIZING THE CANCELLATION OF COMMUNITY DEVELOPMENT (CD) ACTIVITY 18.19.1
- 2 -
For Council consideration, Resolution 2902 has been prepared to complete the necessary steps for reprogramming four funding cycles of CDBG funding for improvements at Rodriguez Park. A preliminary estimate of this funding is $400,000.
FISCAL IMPACT
No budget action is required at this time. However, staff plans to present budget action recommendations at a future meeting after the County approves the requested CDBG funding reallocations.
CEQA ANALYSIS
The action is exempt from the California Environmental Quality Act (CEQA) because it is not defined as a "project" per Section 15378(b)(4) of the CEQA Guidelines. The action is a government fiscal activity that does not involve any commitment to any specific project that may result in a potentially significant impact on the environment.
APPROVED BY THE CITY ATTORNEY
Yes
ALTERNATIVES
Adopting Resolution 2902 completes a process required of the City that the Council has already initiated to reallocate funding from one project to another, as previously described. If the Council wishes to proceed with the funding reallocation, there is no alternative action.
NEXT STEPS
Upon adoption, Resolution 2902 will be submitted to County staff, which should enable them to prepare a funding agreement for future Council consideration. Funding for the recommended Rodriguez Park project will likely be programmed in the draft Capital Improvement Program for Fiscal Year 2023-2024.

SUBJECT: APPROVAL OF FISCAL YEAR 2022-2023 BUDGET AMENDMENT TO REALLOCATE $75,000 OF AMERICAN RESCUE PLAN ACT
(ARPA) FUNDS FOR THE MANNEL PARK SHADE STRUCTURE
PROJECT
RECOMMENDATION
Council approve a budget appropriation of $75,000 of American Rescue Plan Act (ARPA) funding to Capital Improvement Program Project No. PK00004.
BACKGROUND
In 2020, the Council adopted Resolution 2702, authorizing staff to submit multiple park project grant applications through the Land and Water Conservation Fund (LWCF), which includes funding made possible by State of California Proposition 68. This funding cycle caps the grant funding at 50% of eligible project costs. The resolution specifically authorized the Public Works Director to submit project applications on the City's behalf and negotiate and execute all documents relating to funded projects. The two projects identified in the resolution are 1) Mannel Park Site Improvements; and 2) Rodriguez Park Site Improvements.
LWCF applications were ultimately submitted to the State, resulting in one grant award for the Mannel Park Site Improvements. The highlights of this project are a new shade structure, replacing and updating the park irrigation system, and constructing a dog park. A funding agreement valued at $457,500, with State participation capped at $228,750, was executed in early 2022, allowing the City to program the project into the Capital Improvement Program for Fiscal Year 2022-2023.
Late last year, the Public Works Director requested a project work scope reduction from State grant officials, specifically eliminating the dog park. This request was made in response to 1) concerns expressed by residents living near the park about increased traffic and congestion; and 2) the loss of open space in the park for community events, such as the annual Cinco de Mayo Festival and Holiday Festival. The State responded, determining that eliminating the dog park would likely result in a forfeiture of the grant because it played a significant role in the grant award to the City. A loss of the LWCF grant impacts funding for all planned park improvements, including a new shade structure that has already been awarded for construction and the new irrigation system.

ANALYSIS
Residents that reside around Mannel Park have expressed their concerns of the construction of a dog park at the park. While a dog park within the Core City, similar to what was developed in Gossamer Grove community, may add to the city's amenities, it begs the question if Mannel Park is the best location for it. While there is a potential for dog parks at existing and future park sites, residents have consistently expressed concerns about adding too many features and amenities at Mannel Park. Development of effective community engagement is to not only listen to citizens' concerns, but if feasible, also address their concerns. To this end, staff has determined that current and future considerations for a dog park should exclude Mannel Park.
Fulfilling the planned park features listed in the LWCF grant requires alternative funding if the grant is forfeited. Regarding the shade structure project that has already been awarded for construction, reallocation of $75,000 of American Rescue Plan Act (ARPA) funds will replace the LWCF grant share of an equal amount of $75,000.
FISCAL IMPACT
ARPA funds in the amount of $75,000 for the budget amendment. The project is currently listed as Project No. PK 00004 in the City Capital Improvement Program.
CEQA ANALYSIS
The proposed activity is not subject to the California Environmental Quality Act (CEQA) because it is not defined as a "Project" pursuant to Section 15378(b)(5) of the CEQA guidelines. The action is for administrative purposes only.
APPROVED BY THE CITY ATTORNEY

ALTERNATIVES
The Council can reject the recommendation and direct staff to fulfill all elements of the LWCF grant project for Mannel Park, including the dog park. Siting and designing a dog park should include public outreach and community workshops to address concerns raised about impacts on future park use and surrounding neighborhoods. STAFF DOES NOT RECOMMEND THIS OPTION
NEXT STEPS
If the Council approves the staff recommendation, the shade structure project can proceed with ARPA funding.
