ANALYSIS
Based on committee review and scoring of the submitted proposals, Spohn Ranch is the highest-ranked. Among their proposal's strong points is a well-thought-out design process, plus a commitment to public outreach and input to ensure the project meets the community's needs. This outreach includes a presentation at a future City Council meeting. They provided a preliminary conceptual equipment layout to serve as a starting point once the design process is ready to commence. While they can include steel-framed equipment in the design, their proposal advocates concrete equipment primarily because of its durability, enhanced safety, and reduced maintenance.

Projects funded through the current Clean California grant funding cycle must be completed by June, 2024. An award to Spohn Ranch should be authorized at tonight's meeting to meet this deadline.

FISCAL IMPACT
Capital Improvement Program Project #PK00009 has $770,000 in Clean California and local matching funds to complete the skatepark improvements. The equipment upgrades will be capped at $500,000, with the balance of funding for other site amenities to be bid on and constructed later. No budget action is required.

AWARD SKATEPARK EQUIPMENT UPGRADES PROJECT TO SPOHN RANCH FOR AN AMOUNT NOT TO EXCEED $500,000.
- 3 -

CEQA ANALYSIS
The requested action is exempt from the California Environmental Quality Act per Section 15302. The project consists of replacing and reconstructing structures within an existing recreation site that will have the same purpose and capacity.

APPROVED BY THE CITY ATTORNEY
No

ALTERNATIVES
While other qualified vendors can potentially submit competing proposals for consideration, the project completion deadline with Clean California grant funds can only accommodate one RFP process. An award can be issued to American Ramp Company, which submitted the second-ranked proposal. However, that would likely result in a design process and a finished project less desirable than what Spohn Ranch offers. Therefore, no alternative action is recommended.

NEXT STEPS
Upon Council approval, staff will issue a formal contract award to Spohn Ranch. The project's design development phase, including public outreach, should take place over the next two months.

CITY OF SHAFTER, CALIFORNIA SKATEPARK EQUIPMENT UPGRADES FRIDAY, JUNE 9, 2023
RE: REQUEST FOR PROPOSALS - SKATEPARK EQUIPMENT UPGRADES Dear Mr. James,
Thank you for the opportunity to present Spohn Ranch’s proposal for the professional design-build services that will transform Shafter’s existing facility into a state-of-the-art concrete skatepark.

We consider Southern California to be our backyard and always go above and beyond to make the projects where we live, work and skate truly special. We care about our community and because our kids, our friends and ourselves will personally be using these facilities, we feel an extra sense of duty to not just do a mediocre job and walk away.

We’ve followed this project closely over the past year and have developed an unparalleled understanding of the project’s goals, as well as potential constraints. Intimate background knowledge, including a recent site inspection, uniquely enables our team to hit the ground running, without having to play catch-up.

We are hopeful Shafter will join the long list of municipalities who’ve discovered the Spohn Ranch difference. • Unparalleled experience. You don’t survive the ups and downs of three decades on accident. While other builders have come and gone, our passion, professionalism and hard work have sustained our success over the long haul. • Process. We’ve spent 30+ years refining and improving our design-build process. From first information checklist to final concrete pour, our process is dialed - guaranteeing a smooth experience, free from surprises. • Well-balanced. Our skateparks accommodate the full spectrum of experience levels and feature a ratio of street to transition-style terrain shaped by community input. Not too advanced. Not too much transition. Just right. • Art and aesthetics. Spohn Ranch is known for architectural finesse and sculptural elements that transform a skatepark into a modern work of art the entire community can take pride in. • High-quality construction. When a community is entrusting us with its most valued assets - its kids and its real estate - we don’t take the responsibility lightly. We sweat the small stuff and when other builders would say “good enough” - we take the extra steps to make sure it’s done right.

Our comprehensive design-build process, dedicated team members and legacy of success are detailed in the following pages. We understand the services to be performed, are available to begin work immediately and are committed to successfully executing this project. Please don’t hesitate to reach out with any questions.

Sincerely,
Aaron Spohn, Founder & President

Our corporate clients and the athletes they host demand perfection when the skatepark is the stage for a live television event. SHOULD BE AN EXAMPLE FOR

OTHER COMMUNITIES TO FOLLOW
“It’s an excellent street-plaza design, with just enough transitions to make it well-rounded.

It has something for all skill levels, and is exactly the type of project, area, and advocacy that we want to get involved with. It should be an example for other communities to follow.” • Tony Hawk, Professional Skateboarder

ONE OF THE BEST PIECES OF

SKATEABLE TERRAIN EVER BUILT
“In addition to being a pro skater for over 20 years, I am the creative director for the Dew Tour.

The Dew Tour needed a professional class competition bowl that would showcase the best of modern vert and transition skateboarding.

The team at Spohn Ranch was able to take my ideas and deliver a finished product that was not only the world’s first portable bowl, but one of the best pieces of skateable terrain ever built.” • Chris Miller, Professional Skateboarder

KNOWLEDGE AND EXPERIENCE IN

THE DESIGN AND CONSTRUCTION OF

SKATEPARKS IS BEYOND WORDS
“From the initial group meeting with the local skaters, through conceptual/final design and construction, Spohn Ranch brought their “A” game.

Spohn Ranch’s knowledge and experience in the design and construction of skateparks is beyond words. I do not hesitate in recommending Spohn Ranch to design and construct your skatepark. Spohn Ranch’s attitude and passion in skateparks is so contagious that it makes everyone love the sport of skateboarding.”

cannot imagine having a better
partner than spohn ranch
“When you are replacing a wood ramp skatepark built in the late 90’s over top of a Cold War era Nike Ajax Missile Magazine on a limited budget, I cannot imagine having a better partner than Spohn Ranch. Your team at Spohn were the ultimate professionals – easy to work with, committed to delivering an excellent product, patient and extremely responsive.

We selected Spohn Ranch for our project after hearing from our group of children and adult skaters that all of their favorite skateparks were designed and built by Spohn. Staff and riders were not disappointed. Thank you for transforming our old wood ramp park into a skating mecca for our area.”

A STAPLE IN THE PARK & RECREATION

FIELD FOR QUITE SOME TIME
“We recently completed the construction of our skatepark and the quality of work displayed by your company was outstanding. You showed a high degree of integrity, responsibility, professionalism and ambition. Your judgment resulted in a design that is not only logical and practical, but so unique that has left our “kids” speechless.

Spohn Ranch has been a staple in the Park and Recreation field for quite some time, you continue to exceed expectations and your products/services would be an asset to any organization so I am pleased to give you my wholehearted endorsement.” • Sue Swithin, Director of Parks and Recreation

WITH GREAT PRIDE, I GET TO RESPOND
“SPOHN RANCH BUILT OUR PARK!”
“I want to say a BIG “THANK-YOU” to you and all at Spohn Ranch, Inc. who helped to build the Lathrop Skatepark. We have been open for over a week now and everyone, skaters, parents, neighbors, City Council members, community members and recreation staff from other cities say we have one of the “sickest” parks in the Central Valley! The craftsmanship is excellent and almost everyone asks’ “who built this park?” Luckily, and with great pride, I get to respond, “Spohn Ranch built our park!” Skaters give me knowing nods of appreciation whenever I say that, rolling away from me knowing that the premiere skatepark building company on Planet Earth built the Lathrop Skatepark.” • Gabriel Goulart, Recreation Supervisor

THIS PARK IS A SUCCESS BECAUSE WE

STARTED WITH THE RIGHT COMPANY
“It is with much enthusiasm that I recommend Spohn Ranch Skateparks for both design and build to anyone considering such a project. The Thomas J. Evans Foundation partnered with the City of Newark, Ohio, to bring a skatepark to our community. Our skatepark officially opened in August and we couldn’t be more proud to have partnered with Spohn Ranch.

We are confident when we say that this park is a success because we started with the right design and build company! We are truly grateful to Spohn Ranch for their knowledge, professionalism, passion and expertise in skateparks.”
• Jennifer Roberts, Administrative Director

EVERETT PARK SKATEPARK - NEWARK, OH

IMPRESSED THAT THE ON-SITE CREW

MEMBERS WERE ALSO SKATEBOARDERS
“The entire team - from the designers to the on-site builders, were great to work with from start to finish. The on-site crew was professional, courteous to other staff members and informative to the public during the process. I was also impressed that the on-site crew members were also skateboarders, so they had a personal interest in the fine details.

The proof of a great product is the user’s ability to enjoy it for long periods of time, which exceeded expectations. Great company, great results and I would recommend Spohn Ranch to other communities interested in a quality skatepark, using the design-build process.” • Dianne Hoover, Recreation and Parks Director

AARON
SPOHN

FOUNDER & PRESIDENT
Aaron is the embodiment of the entrepreneurial spirit. When he used a carpentry background to start Spohn Ranch in the early ‘90’s, he had no back-up plan – he put everything he had behind his passion for wheel sports. That passion culminated in a backyard half-pipe that not only gave birth to a community, but eventually an award-winning skatepark design-build firm.

After Aaron helped launch skateparks into the mainstream when he partnered with ESPN to develop the X-Games, Spohn Ranch’s backyard roots spread globally in the form of hundreds of cutting-edge creations.

From permanent skateable landscapes to innovative installations for high-profile events, Aaron and Spohn Ranch have played an invaluable role in the exponential development of wheel sports. Hailed by insiders as a pioneer of the modern municipal skatepark, Aaron has also spent considerable effort promoting the industry as a whole and sharing his extensive knowledge – leading the ASTM committee that created safety standards for public skateparks and lecturing at parks and recreation conferences across the country.

KIRSTEN
DERMER

CEO & CFO
Kirsten is Los Angeles born and raised. While attending Venice High in the early ‘90s she and her brother Mark befriended their new neighbor Aaron Spohn, joining him in his relentless pursuit of skating and building ramps at his house. It wasn’t long before that house transformed into a community dubbed “Spohn Ranch”. And with innate ambition and drive, it wasn’t long before Kirsten transformed from one of Aaron’s first employees into the CEO that would help Spohn Ranch evolve from a small family business into an award-winning, nationwide design-build firm. A counterweight to Aaron’s free-spirit, Kirsten steered the ship through good times and bad, always keeping the company on course for success. Kirsten is truly the glue that holds the company together.

Intimately involved in the wheel sports industry for 20+ years, the breadth of Kirsten’s experience is vast. In addition to earning a bachelor’s degree in environmental science from UCLA, she has developed expertise in every facet of skatepark design, construction and operations – with a focus on executing all financial, legal and administrative matters. This ensures our designers and builders are freed up to do what they do best.

CITY OF SHAFTER, CALIFORNIA SKATEPARK EQUIPMENT UPGRADES Spohn Ranch projects are managed by seasoned experts with decades of experience navigating complex projects, leading interdisciplinary teams and using critical-thinking skills to address unique challenges.

As shown in our organization chart, a clear chain of command and division of responsibilities sets the stage for success and provides a safety net that guarantees information never slips through the cracks. At the start of the project we’ll launch an online portal for the project accessible by project team members and City staff. The portal will provide a server for all project files and include a project schedule that tracks progress and identifies key milestones.

Through the lens of three decades of skatepark construction experience, we engage in an exhaustive upfront planning process that ensures responsible design work and helps us avoid surprises down the road that cost both time and money.

Then, prior to the construction phase, Spohn Ranch will submit our standard QC Master Plan for material testing. We’ll cross reference it with the client’s standards and refine it as necessary. • project checklist

PROJECT APPROACH CONCEPT DESIGN
• ALL SKILL LEVELS
• ALL WHEEL TYPES
• WELL-BALANCED TERRAIN
• THOUGHTFUL FLOW
• CONCRETE DURABILITY
• MODERN AESTHETIC
We’ve prepared a preliminary concept to
illustrate one potential design approach and to
serve as a discussion tool for the future public
engagement process. While we’re excited about
this design direction, we still need to engage
in a thorough information gathering process
(including topographic survey and geotechnical
study) before we can prepare highly-accurate
designs. We look forward to collaborating with
the public to refine the vision and create a
design that is embraced by all stakeholders.

We remain open to a design-build utilizing steel
ramps, but feel confident the public will prefer
modern concrete terrain.

COVER LETTER
Project Team,
With more than 25 years of experience in the action sports industry, American Ramp Company (ARC) understands the importance of designing facilities that foster a safe environment, are engineered to stand the test of time, and include features that all users and all skill levels can enjoy. It is our goal with your project to give your user group a space to progress in their skill and commune with their fellow athletes. It is also our goal, for the city’s sake, to ensure we do this diligently, consider grant requirements and deadlines, as well as establish a finished product that is easy to maintain.

As outlined below, the City can be confident ARC will design a quality skatepark your community can enjoy for years to come.

Established Industry Experts. Since 1998, ARC has partnered with communities around the world to complete thousands of skatepark designs and builds. As skaters and bikers ourselves, we understand the importance of community input and detailed craftsmanship throughout every step of the design process. We are also the only company in the industry that offers both modular and cast on site skateparks allowing us to provide you with an unbiased opinion and approach towards your design engagement process.

Experience in Grant Funded Projects. ARC has worked on hundreds of projects with large and small grants included in the process. With a working backward approach, our team establishes deadlines for all required tasks, required forms, and milestones to ensure these grant requirements are met within the timeframe we have been given.

Construction Driven Approach. As a full-service design and build company, ARC designs skateparks with construction in mind. With this firsthand construction knowledge, we have a unique understanding of how the skatepark should be developed. Additionally, this knowledge gives us a true understanding of project costs, resulting in an accurate estimate.

Multi Wheel and Ability Focus. To create all-inclusive, multi wheel skateparks, ARC incorporates features all users (skateboards, scooters, bikes, roller blades, wheelchairs, etc.) can enjoy. We focus on designing street and transition style parks with features that progress in difficulty and cater to various riding styles.

Innovative Designs. As the action sports industry leader, we are constantly looking for ways to innovate and push the industry forward. We were the first action sports company to combine skateparks with pump tracks, have worked with adaptive use riders to design adaptive skate and bike features, and our team has a full steel fabrication shop allowing us to design and create truly unique features that pay homage to the city.

In this proposal, you will find a description of our firm’s qualifications, project approach, and references all showcasing our ability to design a custom skatepark which reflects your design priorities. Thank you for considering our team as the designer and builder of this facility. We hope to partner with you to provide a world-class skatepark for the City of Shafter.

If you have any additional questions, please do not hesitate to reach out.

Respectfully,
Blake Robinson

PARK SKATEPARK

PERRIS, CA
The Enchanted Hills Park Project is a 22-
acre oasis residing on the west end of the city
amongst a lower income community. This park
was devoted to using the native landscape and
natural stone outcroppings as a backdrop for the
community to gather and recreate. Included in
this project was a reworking of the existing bike
park area and addition of a skate park, both of
which were constructed by ARC. The park project
also included basketball courts, a splash pad, play
structures, and a network of walking paths, art,
and stone murals. This projects was funded in

FRANKLIN D ROOSEVELT

PARK SKATEPARK

LOS ANGELES, CA
We had the opportunity to work with LA County on
the Franklin D. Roosevelt Park and provide a great
skatepark. With a concrete pad already in place,
it was an easy decision to move forward with an
above-ground setup and revitalize the existing
space. This park has a perfect blend of transition
and plaza, catering to all skill levels and has both
concrete and steel ramps to offer up a variety of
preferences.

It is exciting to see a space, in the heart of the
Florence-Graham community, for skaters to really
develop their skills, interact with other users, and
commune together. We are glad we got to be a part
of it!

PROJECT TEAM
Cody McEntire comes to the skateboard world by way of Texas. His breakout role was in the Digital Skateboarding video Smoke and Mirrors where he skated to the musical stylings of Lynard Skynard. He won Tampa Am back in 2006 and reached pro status in 2010. But for McEntire the “pro” title has never mattered much to him—he does it for the fun of it. That said, McEntire’s presence at Tampa Pro and Street League Skateboarding (SLS) events shows that he means business.

Chuck Dodge has an unrivaled ability to create skatepark designs that are aesthetically pleasing and functionally sound. Over the past decade, Chuck has toured throughout the U.S. giving him the opportunity to visit many skateparks of every style and flavor. Having this hands-on experience has fine tuned his ability to recognize what defines a well designed skatepark. His passion for BMXing and skateboarding nurtures his drive to create skatepark environments that are coherent to their surroundings and distinguishes them as one-of-a-kind skatepark destinations.

in our final report. Upon completion of the site
reviews, our team will prepare a report for the City
with our recommendations.

COMMUNITY INVOLVEMENT
With over 25 years of experience designing and
building municipal skateparks, we fully understand
the importance of including the community in the
design process. American Ramp Company looks
forward to collaborating with project stakeholders
and local athletes to design a skatepark that meets
the high expectations of the community.

IN-PERSON FORUM
The ARC design team has developed a
comprehensive series of workshops which focus
not only on the skatepark elements but, also
the perimeter uses and functions as well. As
skateboarders ourselves, we can easily identify
and speak the language of the skatepark users and
advisory group participants. We provide all meeting
materials, hardware, illustrations, etc. needed to
facilitate the public meetings. The city only needs
to provide a meeting room, tables, chairs, electricity, and your ideas. By inviting discussions regarding
locations and preferences of spectator viewing,
separation of beginner areas, and incorporation
of park amenities, we have had great success in
achieving a sense of ownership by the general
public as well as the skate community. In facilitating
public workshops with the kids, we have found the
younger skaters can sometimes be intimidated by
the more vocal older crowd. We have designed a
portion of our workshop to include an anonymous
questionnaire where users can express their ideas
without influence from the older participants. These
meetings really are a lot of fun!

SKATE SESSION WITH CODY MCENTIRE AND JULIA

BRUECKLER
What better way to get the community excited about
giving input than bringing some of their favorite
pros out to host a skate session. Cody and Julia
are awesome with the kids, and truly care about
designing the best possible park for your community.

They make sure to spend time with each person who
attends. We’ve found this method to yield the best
possible feedback because it’s an informal setting
that the skate community is comfortable in.

ONLINE SURVEY
The final piece of the community involvement puzzle.

We typically run two online surveys throughout
the process. One at the very beginning to gather
general information like demographics and skatepark

Page 7 of 121 ends

PROJECT BACKGROUND
A public skatepark, located at 460 East Ash Avenue, was developed several years ago with equipment intended to be temporary. Equipment upgrades have been delayed due to a lack of funding. Fortunately, the State of California awarded the City grant funds through the Clean California program to complete the Historic Core Recreation Rehabilitation and Enhancement Project. The total value of the project is approximately $5.3 million. The grant will reimburse the City for its project costs at a reimbursement rate of

87.5% up to approximately $4.6 million. The project includes improvements to several public and recreational facilities.

The Clean California grant allocation for the skatepark enhancements is approximately $670,000, the maximum funding available, to fund the: 1) equipment replacement covered in this RFP; and 2) additional site amenities, including lighting, a shade structure, and landscape improvements. To ensure the City can fund all planned improvements, the desired final cost for the skatepark equipment replacements design and construction is $500,000. After the submittal deadline for the proposals, the City anticipates that a final scope of work and cost will be negotiated with the firm submitting the highest-ranked proposal.

FIGURE 1–VICINTY MAP
preferences, and then another after the first concept
design has been created – requesting feedback. The
online portion of community engagement is essential
because a lot of the younger crowd will not be able to
make the scheduled meetings. When constructing a
skatepark that will last for decades, it’s important to hear what the future generation would like to see in
the park.

LOCAL INFLUENCE AND SKATEPARK IDENTITY
Our design team specializes in the integration of
local identity into all our action sports park projects.

We look forward to collaborating with the city and
local athletes to identify ways to incorporate local
culture to make the action sports park visually
unique and create a sense of ownership throughout
the community.

OVERVIEW
Our desire is to create action sports facilities that
welcome and encourage all rider types and people
of all ages and skill level. To create a signature
skatepark for the City, ARC will collaborate with City
staff and the local skate community to gain input on
the design. Through a series of public workshops,
we will use the community’s ideas to formulate a
conceptual design. The proposed skatepark design
will incorporate current street and plaza style skating elements along with transition and bowl areas.

In addition to the skatepark, ARC can provide
consultation for the integration of spectator viewing
areas, entry signage, covered structure, landscaping,
and trash receptacles. The final skatepark design will
appeal to all skill levels and host a variety of ages
and abilities.

SITE REVIEW
One of our team members will walk the potential
skatepark sites with the City to review the
opportunities and constraints at each location.

During the site reviews, we will use a drone to
capture photos and videos that will be used to assist

PROJECT APPROACH

Page 423 of 457 ends

Skatepark design, manufacturing, and construction should be innovative and highly functional with consideration to sustainability and environmental preservation.

1. LOCATION SELECTION. Seek to redevelop neglected sites or brownfields to lessen the environmental damage of further urban sprawl.

2. SITE DEVELOPMENT. Skatepark sites should incorporate native vegetation with a goal of at least 20% vegetated open space per project site area to protect and restore the surrounding habitat. The site and installed equipment as a whole should have a minimal heat island effect. Skatepark design and construction should be sensitive to stormwater runoff to eliminate contaminants entering natural water flows.

3. PARTNERS AND SUPPLIERS. Team with vendors and business partners that are taking their own steps to protect our environment and natural resources. Search for vendors and suppliers that are operationally proximal to avoid trucking raw materials over long distances.

4. RESPONSIBLE BUILD METHODS. Manufacturers, installers, and builders of skatepark equipment should identify areas of waste and excess and maximize efficiency and accuracy of work force, energy, and materials. Manufacturing, construction, land clearing, or demolition waste involved with skatepark development should be managed responsibly by salvaging or recycling as much as possible.

5. SUSTAINABLE PRODUCTS. Skatepark equipment should be resilient and long-lasting, composed of recyclable and/or recycled materials, and feature low-emitting finishes.

When lighting is necessary, install high-efficiency or solar powered lighting. This will optimize the lifespan of a skatepark and decrease maintenance costs all while reducing environmental impact.

ARC SUSTAINABLE PRACTICES
At ARC/Pivot we take pride in our commitment to
providing the highest quality skateparks possible.

As the leader in the skatepark industry, we recognize
that it is our responsibility to set an example as an
environmentally conscientious company.

We have invested considerable time and resources
identifying aspects of our business that we can alter
in order to maximize our customer satisfaction while
minimizing our environmental impact. We hold firm
to the belief that focusing on building the highest
quality, longest lasting skateparks will insure the
least environmental impact. By building skateparks
right the first time, we help ensure that resources
won’t needlessly be used to replace or repair in years
to come.

Green Skate is an initiative set forth to create baseline standards for sustainability in the production and
maintenance of skateparks. As one of the founding
members of Green Skate, we have adopted a policy of
evaluating the environmental impact of every decision
we make.

TRIMBLE SITEVISION TECHNOLOGY
Imagine walking around the existing skatepark
with key stakeholders and city staff to review the
latest concept design via an augmented reality
device. You’ll be able to walk through the design,
visualizing and understanding 1:1 scale and spacing
of each element in the skatepark. High-accuracy
GNSS and remote distance measurement provides
unrivaled precision during the design process,
translating in more accurate concept designs and
construction documents.

CONSTRUCTION DRAWINGS & SERVICES
Our team of engineers have over a decade of
experience in creating workable construction
drawings and specifications.

Action sports park construction requires very
detailed plans outlining how every inch of the
park is to be built and are the blueprints to ensure
your projects success. We engineer and depict
the size, length, radius, material, and dimension of
every element in the park. All surface area slope
calculations are provided along with drawings
detailing every connection in the park. We will work
alongside City staff to ensure all documents needed
for permitting are provided in a timely manner.

GUARANTEED MAXIMUM PRICE
Being a national designer and builder of action
sports parks, our database of project costs is
constantly being reviewed and updated. This
translates into realistic cost estimates and cost
saving solutions that no other action sports
park company can provide. When the City sets a
guaranteed maximum price, our team will ensure
that it is met during the design and through the
construction of the park. We also have existing
national contracts with pricing that can be utilized
and reviewed by the City to ensure you get the best
price possible for your given design.

SOURCEWELL CONTRACT
In the action sports category, American Ramp
Company is the highest rated design and
construction firm and is longest standing firm on the
Sourcewell Contract. We set the industry standard
for build quality and competitive pricing.

MODULAR CONSTRUCTION APPROACH CONCRETE CONSTRUCTION APPROACH

PRE-CONSTRUCTION MEETING
Upon permitting and notice to proceed with construction, ARC will meet with the City’s Project Team on site to review the scope of work, project sequencing, introduce ARC’s
Construction Superintendent, and discuss site preparation, disturbance, staging area(s), and construction entrance(s).

SITE PREPARATION
Preparing the site for the construction phase to begin is the next priority. Following details from the preconstruction meeting, ARC will establish a safe and organized job site.

This will likely include temporary security fencing if needed, temporary BMP & erosion/sediment control measures,
temporary jobsite restroom, temporary jobsite dumpster, stabilized construction entrance, temporary water & power hook-up, utility locates, and site staking & layout.

METALS
Once construction permits are issued and notice to proceed given, all steel coping, edging, and grind rails, will be fabricated and hot dip galvanized to project specification for materials and color plan.

DRAINAGE & EARTHMOVING
ARC will perform all needed site work to prepare for forming and metals installation. Our team will clear and grub the site, perform needed demo, and haul off, rough and fine grade, set and cap utilities and drainage, and import/export select fill material as needed. For your project, however, we plan to try and utilize as much of your existing pad as possible which will allow us to maximize your space and stretch that budget.

FORMING, REBAR & STEEL INSTALL
At this juncture, ARC will install all forming and prepare grind rails, coping, and edging for specialty shotcrete placement to features and skate terrain.

PRE-CONSTRUCTION MEETING
Upon permitting and notice to proceed, ARC will meet with the City’s Project Team to review the scope of work, project sequencing, introduce ARC’s Construction Superintendent, and discuss site preparation, disturbance, staging area(s), and construction entrance(s).

SITE PREPARATION
Preparing the site is the next priority. Following details from the preconstruction meeting, ARC will establish a
safe and organized job site. Our team will check the pad for damage and potential issues. We will remove a 10ft section of fencing unless a gate already exists so that we can bring manufactured materials into the space. Our team will then mark feature locations on the pad.

MODULAR INSTALLATION
ARC’s Installation crew will work diligently to install features, piece by piece until completion. This should move fairly quickly. Our team will inspect each component to ensure it is sitting on the pad properly and that all pieces are undamaged.

DETAIL WORK, PUNCH LIST & CLEAN-UP
ARC will perform a walkthrough with key member(s) of the City’s Project Team identifying punch list items. Our team will touch up ramps, clean, and demobilize after punch list items are addressed.

PLACE CONCRETE/SHOTCRETE
ARC’s veteran skatepark shotcrete construction crew will place our specialty concrete mix according to project plans and specifications. After specialty features are placed, concrete decks and flatwork are poured, where it doesn’t already exist, and finished according to design and color plan.

DETAIL WORK, PUNCH LIST & CLEAN-UP
Landscaping, caulking, and cleaning will be completed after concrete has cured. ARC will perform a walkthrough with key member(s) of the City’s Project Team identifying punch list items. Our team will clean and demobilize after punch list items are addressed.

PROJECT CLOSE-OUT
ARC will submit project close out deliverables and project sign-off.

MAINTENANCE SCHEDULE
Weekly
• Placement – Inspect the positioning of the obstacles within your skatepark. They have been designed to give your park optimum safety and enjoyment (If obstacles have been anchored to the pad, this should not be necessary). • Riding Surface – Inspect the riding surface of all obstacles for any and all foreign objects and remove to avoid possible skating injuries.
• Pad Surface – Inspect and clean the pad surface of all foreign objects. (i.e., rocks, glass, trash, etc.) • Graffiti - Check the skatepark for graffiti and remove promptly. Graffiti removers and/or repainting sections of ramps are both viable solutions.

Monthly
• Hardware – Inspect all hardware to ensure that the nuts and bolts are secure. Tighten as needed. • Riding Surface - Inspect for scratches. Any scratches should be lightly sanded and painted to maintain aesthetics.

Maintenance Products and Skatepark Additions
• Max-Grip Wet Paint – Though you will not have replace the riding surface it will need a periodic coat of paint. ARC offers a two-part paint that matches the original factory color and texture of your skatepark equipment. Typical time to recoat your ramps will range somewhere between one and three years. Application is easy and can be rolled-on by volunteers or maintenance personnel. We can help you determine how many gallons you will need when you are ready to recoat the surface
• Enclosures – If you did not purchase enclosure panels with your skatepark these can be added at any point in the future. Enclosures will help debris from accumulating under your ramps, limit access to the underside, as well as give the ramps an aesthetically pleasing look.
• Sound Dampening – If sound becomes an issue we offer a sound dampening material that can be applied to the underside of the ramps and it helps reduce the noise generated by the equipment. Enclosures are strongly recommended to prevent vandalism of the sound dampening material. • Additional Obstacles – Your Pro Series equipment has been specially designed to accommodate future ramp additions in a seamless fashion. When you are ready to add equipment to your skatepark just contact us and we will work with you to determine what ramps the next phase of your skatepark should include. 1 YEAR LIMITED ON ALL CONCRETE & SHOTCRETE SURFACES
Begins on the date of final project delivery or when the on-site work is complete, under the condition that the skatepark has no defect in material and/or workmanship. Warranty items covered include:
• Spalling attributed to improper floating, finishing, water content or curing methods.
• Compression strength less than required by the specifications. • Surface cracking greater than the width of two quarters.

Should purchaser believe American Ramp Company has failed to meet the terms of this warranty, they shall notify American Ramp Company, and American Ramp Company shall, at its sole discretion, repair or provide replacement parts. ROUTINE MAINTENANCE AND INSPECTION OUTLINE

OVERVIEW
It will be the responsibility of Parks and Recreation Maintenance Staff to perform daily, weekly and monthly inspections and any needed maintenance for the skatepark. Routine Maintenance and inspections should take place preferably in the mornings before opening the park to the public at dawn.

GENERAL INSPECTION-SURFACES
*Check all surfaces inside the park and remove debris, trash, rocks, dirt build-up and any foreign objects. A power blower is ideal for removing smaller debris.
*Check surfaces for possible slick or sticky surfaces. i.e., spilled drinks, irrigation over-spray, graffiti, etc. Should surfaces need cleaned, refer to the repair and maintenance product list. *Check all sealants for vertical separation from joints. Refer to the repair and maintenance product list for replacement type.

GENERAL INSPECTION-JOINTING
*Saw-Cut Joints- Inspect all saw cut joints for debris that might have become trapped within the joint creating sharp object imbedded in the finish work. Look for chips that might occur on either side of the joint greater than 1/16” wide by1/4” deep. Should large chips of concrete be discovered, refer to the repair and maintenance product list for appropriate joint filler. *Cold Joints- Inspect tooled surfaces for possible separation greater than 1/16” which would then require joint filler. Check tooled edge for large chips greater than 1/16” wide by 1/4” deep. Should large chips of concrete be discovered, refer to the repair and maintenance product list for appropriate joint filler.
*Expansion Joints- Inspect all expansion joints for loose mastic sealant that can stop the wheels of a skateboard and the possible lifting of the expansion felt material causing the wheels to stop upon contact. Should loose or missing mastic be discovered, refer to the repair and maintenance product list for appropriate sealant.

GENERAL INSPECTION-METAL FABRICATIONS
Steel Edging-Inspect all mitered corners for possible break in original weld. Re-weld and grind smooth if cracking greater than 1/8” is present. Check all corners and edges for lifting from concrete surface causing a gap greater than 1/8”. File any burrs or irregularities in the finish work to avoid a potential cutting edge.

Square & Round coping and rails-Inspect all pipe surfaces for any burrs or irregularities in the finish work to avoid a potential cutting edge. Inspect all welded end caps for cracking and separation from main pipe body. Re-weld any cracks present and grind smoothly and touch-up any rusting that might have occurred from rain with primer and match paint.

GENERAL INSPECTION-DRAINS
Inspect all drain lids for vertical separation form drainage collar/ body. Make sure all drain lids are fastened securely with no loose screws. Should screws become loose apply “lock-tight” to screws to avoid any future loosening by wheel vibration. Inspect drains routinely for excessive debris in the strainers causing backup of water during monsoon season.

GENERAL INSPECTION-FENCING
If applicable, inspect any fencing for possible bending of the pickets that might have occurred as a means of unauthorized access and/or park users. Touch-up any rusting that might have occurred from irrigation water and/or rain with primer and match paint.

MANAGEMENT REPORT

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: July 18, 2023
FROM: Gabriel A. Gonzalez, City Manager
PREPARED BY: Steve Esselman, Planning Director
SUBJECT: AUTHORIZE RELEASE OF REQUEST FOR QUALIFICATIONS

FOR PROFESSIONAL SERVICES TO PREPARE GENERAL PLAN

UPDATE, DEVELOPMENT REGULATION UPDATES, AND

PROGRAMMATIC ENVIRONMENTAL IMPACT REPORT

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(5) of the CEQA Guidelines; authorize the City Manager to issue a request for qualifications for professional services to prepare general plan update, development regulation updates, and programmatic environmental impact report.

BACKGROUND
A general plan is each local government’s blueprint for meeting the community’s longterm vision for the future; the City’s General Plan can be found on the City's website.

Per Government Code (GC) 65300 through 65303.4, the mandatory elements for all general plans are:
• land use
• circulation
• housing
• conservation
• open space
• noise
• safety
Additionally, cities and counties in the San Joaquin Valley Air Pollution Control District (SJVAPCD) must also address air quality in their general plans. Cities and counties that have identified disadvantaged communities must also address environmental justice in their general plans, including air quality. Per SB 617, the City has been designated a disadvantaged community. Therefore, the City is also mandated to prepare policies and/or new elements to address:
• air quality

Page 446 of 457 ends

PROGRAMMATIC ENVIRONMENTAL IMPACT REPORT
- 2 -
• environmental justice
Per SB 1000, an environmental justice element must be adopted or revised upon adoption or next revision of two or more elements concurrently on or after January 1, 2018. In 2018, the Council approved Resolution No. 2606, which approved General Plan Amendment (GPA) No. 18-33. This GPA made changes to two or more general plan elements after January 1, 2018 and therefore, triggered the requirement to prepare an environmental justice (EJ) element.

Additionally, GC Section 65302(g) requires that, if a local hazard mitigation plan has not been adopted by a local jurisdiction on or before January 1, 2022, then the safety element shall be reviewed and updated as necessary to address climate adaptation and resiliency strategies applicable to the city. The City currently does not have a local hazard mitigation plan in compliance with State law.

ANALYSIS
Due to the amount of long-range planning efforts that will be required soon, it is time to consider a general plan update that includes all the mandatory elements listed above.

The current Shafter General Plan is over 17 years old (certified in 2005).

As required by law, a city’s zoning ordinance must be consistent with its general plan.

Additionally, revisions to a city’s subdivision ordinance and any other affected development regulations in response to any changes made to the general plan update (GPU) may be warranted. Therefore, as part of the request for qualifications (RFQ), the City is including development regulation updates.

Both the EJ element and future GPU will require a PEIR. Therefore, it would be most cost effective to environmentally clear by including an EJ element within the greater GPU rather than preparing two separate PEIRs.

These factors warrant preparation of: (1) GPU to direct growth for the next 20 to 30 years, (2) development regulation updates, and (3) a new comprehensive environmental analysis that identifies the specific impacts of the new growth and appropriate methods to address and mitigate those impacts.

Once a consultant has been chosen based on this RFQ process, the City will request a detailed proposal where the chosen consultant will outline a detailed workplan and cost to provide professional services for the preparation of the GPU, development regulation updates, and PEIR.

Approval of the workplan and cost for professional services will be brought to the Council at a future date for discussion and approval.

FISCAL IMPACT
There is no fiscal impact because of the proposed action.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(5) of the CEQA Guidelines because the action is authorization to release a RFQ and therefore, it is organizational and administrative activity that will not result in direct or indirect physical changes to the environment and not subject to CEQA.

APPROVED BY THE CITY ATTORNEY
Not Applicable

ALTERNATIVES
The Council can 1) not authorize the release of the RFQ or 2) direct staff to revise the RFQ based on directions provided and bring the revised RFQ back to the Council for future consideration.

NEXT STEPS
If authorized to release the RFQ, staff will finalize and send it to various consultants for their consideration.

CITY OF SHAFTER

REQUEST FOR QUALIFICATIONS
General Plan Update, Development Regulation
Updates, and Programmatic Environmental Impact
Report
Introduction
The City of Shafter (City) requests written responses to a Request for Qualifications (RFQ) for selection of a planning firm to provide professional services related to an update of the City’s general plan, development regulation updates, and programmatic environmental impact reports.

Background
In accordance with California Government Code (GC) Section 65300, the City adopted the Shafter General Plan (SGP) and certified the associated programmatic environmental impact report (PEIR) in 2005 to plan for the long-term future development of the Shafter area.

The SGP contains six elements (referred to as Programs in the SGP), including land use, transportation, public services and facilities, housing, environmental management, and environmental hazards. The SGP can be found on the City’s website (https://www.shafter.com/DocumentCenter/View/5042/Shafter-General-Plan).

A draft of the Environmental Health and Justice Program (EJ element) was prepared November 2020 and considered by the City Council in May 2021. Preparation of the EJ element including meetings with the EJ groups, health care providers, and faith-based organizations. The draft EJ element also addresses air quality issues as required by State law. Based on public feedback, the Council referred the EJ element to staff. Staff has determined that EJ element implementation could result in significant and unavoidable environmental effects and therefore, a PEIR is warranted. Subsequently, staff determined that it would be more appropriate to incorporate the EJ Element into a new general plan update (GPU) and then prepare a new PEIR for a GPU that contains an EJ element.

Cities and counties in the San Joaquin Air Pollution Control District (SJVAPCD) must also address air quality in their general plans. Cities and counties that have identified disadvantaged communities must also address environmental justice in their general plans, including air quality.

Per Assembly Bill (AB) 617, the City has been designated a disadvantaged community and therefore, inclusion of an air quality analysis in the GPU will be required.

Page 450 of 457 ends

These factors warrant preparation of: (1) GPU to direct growth for the next 20 to 30 years, (2) development regulation updates, and (3) a new comprehensive environmental analysis that identifies the specific impacts of the new growth and appropriate methods to address and mitigate those impacts.

Various maps of the City can be found on the City’s website (https://www.shafter.com/363/Geographic-Information-Systems-GIS-Offic). In accordance with state planning law, a general plan must cover all territory within the boundaries of the adopting city. The plan should also consider any area outside which, in the planning agency's judgment, "bears relation to its planning" (Government Code Section 65300). It also allows adoption of area plans or general plans in part. Thereby, the City can designate the area covered by this general plan update for study and adoption.

Scope of Work
The consultant's role will be to provide professional planning services resulting in a GPU, development regulation updates revision, and related CEQA analysis no later than a tentative deadline of January 2026.

Public Outreach
The update will include a wide‐reaching, inclusive, and informative outreach campaign that empowers community members. Outreach shall include:
• Establishing a Community Advisory Committee made to advise the City Council throughout the process.
• Branding with consistent design templates and graphics. • Developing a digital presence and use of community surveys. • Facilitating community workshops to provide participants with an opportunity to give input on what they feel are the City’s most important assets and opportunities for the future and what critical issues and topics should be addressed.
• Facilitating pop‐up exhibits at local events or destinations in target neighborhoods.

Element Updates
The comprehensive update should include the following:
• A fresh new look and format with integrated graphics, including an electronic version for use on the City’s website.
• A new, updated vision and guiding principles for the community established through meaningful outreach to all community stakeholders.
• The updating of all mandatory element elements to comply with state legislation, regional, and local policies.
• The inclusion of select optional elements to address topics that are of great importance to the future of the City and the values of its citizens, such as economic development and/or community design.
• Review and potentially updating land use designations, with some designations likely deleted and others created. The land use map would be revised.

Page 451 of 457 ends

• Performance of all technical analyses, with subsequent incorporation of data into the associated element(s).

Development Regulation Updates
The selected consultant will be responsible for drafting updates to the City’s zoning ordinance, subdivision ordinance, and any other affected development regulations in response to any changes made in the GPU.

CEQA Analysis
Preparation of a PEIR to satisfy California Environmental Quality Act (CEQA) requirements and allow for streamlining development projects consistent with the general plan. Creates an opportunity to integrate the PEIR and GPU whereby any required CEQA mitigation is developed as a general plan update policy to be self-mitigating to further streamline development.

General Project Management
The selected firm will be responsible for ensuring that the project is effectively managed, ensuring completion of the project on time and on budget. At a minimum the City will expect the consultant to successfully provide the following project management services:
• Identification of critical path tasks and key benchmarks. • Development of associated timeline to ensure project completion by City’s tentative deadline of January 2026.
• Direction on best practices for execution of each critical path task. • Development of strategy for ensuring tasks are timely completed. • Consistently achieve agreed-upon timeline(s), ensuring project is delivered on-time and on budget.
• Effectively and proactively communicate with City staff should issues arise, should modifications need to be made to the project scope, budget, or schedule, and at key decision points.

Selection Process
Based on the responses received, City staff may choose to interview consultants or solicit specific proposals. Consultants that work with the City are required to enter into a standard professional services agreement.

Evaluation Procedure
In reviewing a firm’s statement of qualifications (SOQ) submitted to the City in response to this RFQ, staff will be considering the following criteria:
• Firm Experience: Demonstration that the firm can successfully provide services for projects of a similar nature and complexity as those described herein (see experience details below). • Staff Qualifications: Demonstration that principals, project manager, and project team members are qualified to undertake the project.

Page 452 of 457 ends

• Approach to Organization and Project Management: Demonstration that the firm understands and can execute the critical path tasks that are necessary to successfully complete the scope of the project on time and on budget.
• Quality Control and Assurance: Demonstration that the firm has processes in place to ensure the quality of their work product and is committed to assuring client satisfaction. • Positive Professional References: Confirmation that the firm has successfully undertaken projects of a similar nature and complexity via confirmation from positive professional references.

Experience
The successful SOQ will provide an overview of the firm’s experience in the following areas:
• Developing and managing successful general plan update processes. • Positive community consultation and stakeholder coordination:
• Conducting meaningful community outreach, including experience in effectively and clearly presenting technical material to non-technical audiences. • Collecting and sincerely considering community input and adjusting work product based on community feedback.
• Managing/mitigating conflict to achieve informed consent. • Experience with community consultation in person and in a virtual setting. • Developing visually appealing maps and graphics.
• Conducting CEQA analysis and drafting appropriate CEQA documents. • Drafting updates to development regulations.

MANAGEMENT REPORT

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: July 18, 2023
FROM: Gabriel A. Gonzalez, City Manager
PREPARED BY: David Franz, Education Partnership Director SUBJECT: APPOINT TWO COUNCILMEMBERS TO AD HOC MURAL

SUBCOMMITTEE FOR THE PROPOSED MURAL AT THE

SHAFTER LIBRARY AND LEARNING CENTER

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(5) of the CEQA Guidelines; create and appoint two Council Members to the Murals AdHoc Committee.

BACKGROUND
The Shafter Municipal Code Chapter 15.51 (Murals) requires Council approval of mural designs following the review of a committee. At the regular meeting of the Shafter City Council on March 17, 2020, for example, Council created an Ad Hoc committee to advise the City Manager regarding a proposed mural on a concrete block wall at La Hacienda Market (315 James Street). A design for a mural on the exterior north wall (facing the Richland bus barn) of the "GAF Room" at the Shafter Library & Learning Center has been submitted by the Friends of the Shafter Library, which proposes to fund the creation of the mural. Because the mural is proposed on City property, no maintenance agreement is required.

ANALYSIS
Ad Hoc committees are created for the sole purpose of being advisory to the City Manager without requiring action by the entire City Council. As deemed appropriate at the mutual discretion of the City Manager and the City Council, two (2) City Council members may be appointed to an Ad Hoc committee. Ad Hoc committees generally meet with a defined purpose and time frame to accomplish that purpose.

The purpose is with a narrow focus on a specific problem or task (non-generalizable).

Ad Hoc committees do not have continuing subject matter jurisdiction nor do they handle an issue or issues on a continual basis, and ends when it has completed its work on a specific task or problem, or when it is no longer under consideration. Ad Hoc committees cannot implement a project, pass city laws, etc. Ad Hoc committees have not been delegated any decision-making power, and rarely issue formal recommendations or reports that are made public at open board meetings. Ad Hoc committees are not intended to be able to be adapted to other purposes to cover areas

Page 456 of 457 ends

- 2 -
that are truly public matters that should be fully debated publicly before being voted on by the Council. While an earlier Ad Hoc committee did work on mural design, that committee was specific to that project and a new committee is required.

FISCAL IMPACT
None.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(5) of the CEQA Guidelines because the action is the appointment of council members to an ad hoc committee and therefore, it is organizational and administrative activity that will not result in direct or indirect physical changes to the environment and not subject to CEQA.

APPROVED BY THE CITY ATTORNEY
Not Applicable

ALTERNATIVES
Council could choose not to create an Ad Hoc committee to evaluate the mural design and postpone consideration of the mural proposal.

NEXT STEPS
If the Ad Hoc committee is created, the design would be shared with the committee and a meeting with the artist and organizers would be arranged to provide any feedback.

The design would then be brought to Council for approval.
