CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: October 3, 2023
FROM: Gabriel A. Gonzalez, City Manager
PREPARED BY: Rogelio Sanchez, Finance Director
SUBJECT: ACCEPT TREASURER’S REPORTS – AUGUST 2023

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines; and accept the Treasurer’s Report for August 2023.

BACKGROUND
California government code section 41004 requires that the City Treasurer submit to the City Clerk and the legislative body a written report and accounting of all receipts, disbursements, and fund balances. The accompanying report for July meets this Government Code requirement, as well as the requirements of other sections of the Government Code and the City’s Investment Policy.

ANALYSIS
None.

FISCAL IMPACT
There is no fiscal impact resulting from the acceptance of the monthly Treasurer’s Report.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is the acceptance of a treasurer's report and therefore, it is governmental fiscal activity that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.

APPROVED BY THE CITY ATTORNEY
No

ALTERNATIVES
None.

NEXT STEPS
Cash balances are subject to year-end bank reconciliations and audit review.

Council find the action is not defined as a “project” per Section 15378(b)(5) of the CEQA Guidelines; accept the public improvements constructed for Tract 7346 Phase 2; authorize the City Engineer to file a Notice of Completion and Acceptance of Work for the tract; and authorize the release of performance bond securities to 25% of their original value to act as a warranty bond for a minimum of one year.

BACKGROUND
Lennar Homes of California (Lennar) continues to develop Gossamer Grove and has recently completed construction of all public improvements required for Tract 7346 Phase 2. The improvements include earthwork, water, sewer, storm drain facilities, curbs and gutters, medians, perimeter walls, street paving, street lighting, sidewalks, landscaping, and miscellaneous underground utilities, including City fiber optic conduits. The domestic and irrigation water systems were approved and accepted by Oildale Mutual Water Company. All other improvements have been completed per the approved plans and inspected by Public Works.

ANALYSIS
Lennar previously filed a performance bond with the City to cover 100% of the proposed construction costs for Tract 7346 Phase 2 per a Subdivision Improvement Agreement with the City. The bond ensures their faithful performance in constructing the required public improvements. Upon recommendation of the City Engineer, the bond amount can be reduced to 25% of the proposed construction costs once the Council accepts the improvements. Even if the bond amount is reduced, Lennar will make any repairs to the improvements deemed necessary by the City during a oneyear warranty period. At the end of the warranty period, the improvements are then the responsibility of the City.

FISCAL IMPACT
No budget action is required. Lennar will perform any repairs to the improvements within the warranty period. Future City operating and maintenance budgets will be adjusted to ensure adequate funding once it assumes responsibility for improvements.

APPROVE NOTICE OF COMPLETION AND ACCEPTANCE OF WORK FOR TRACT 7346 PHASE 2 - 2 -

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(5) of the CEQA Guidelines because the action is approval of a notice of completion and acceptance of work and therefore, it is organizational and administrative activity that will not result in direct or indirect physical changes to the environment and not subject to CEQA.

APPROVED BY THE CITY ATTORNEY
Not Applicable

ALTERNATIVES
There are no alternatives to the recommended action. With the project complete and constructed per the approved plans, public improvements should be accepted by the Council.

NEXT STEPS
Upon Council authorization, the City Engineer will execute and file a Notice of Completion and Acceptance of Work for recordation, plus authorize a reduction in the performance bond amount to cover warranty work for Tract 7346 Phase 2.

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: October 3, 2023
FROM: Gabriel A. Gonzalez, City Manager
PREPARED BY: Marcos Torres, Deputy Public Works Director SUBJECT: ADOPTION OF RESOLUTION APPROVING PARTICIPATION IN

THE SAN JOAQUIN VALLEY AIR POLLUTION CONTROL

DISTRICT ZERO EMISSION LANDSCAPING EQUIPMENT

VOUCHER PROGRAM

RECOMMENDATION
Council find action is not defined as a "project" per Section 15378(b)(4) of the CEQA Guidelines; and adopt Resolution 2944, a Resolution of the City Council of the City of Shafter approving the participation in the San Joaquin Valley Air Pollution Control District Zero Emission Landscaping Equipment Voucher Program.

BACKGROUND
The landscaping industry in California is a significant contributor to air pollution and greenhouse emissions due to the widespread use of gas and diesel-powered equipment such as lawnmowers, leaf blowers, and chainsaws. The San Joaquin Valley Air Pollution Control District (District) has developed the Zero-Emission Landscaping Equipment (ZELE) Voucher Program to address this issue and align with California's ambitious climate goals. This program incentivizes replacing existing gas or dieselpowered landscape maintenance equipment with new electric versions for city operations.

ANALYSIS
Vouchers issued through the ZELE program will be issued upon the District approving an application. Once the applicant purchases an authorized piece of equipment and the diesel-powered equipment replaced is properly destroyed, the applicant can be reimbursed up to the voucher amount. The Council must adopt a resolution approving participation in the program in order for an application submitted by the City to be considered for funding.

The program has the potential to address critical environmental and public health concerns related to the landscaping industry's contribution to air pollution and greenhouse gas emissions. The Public Works Department could benefit from reduced fuel and maintenance costs. Secondly, the vouchers allow the equipment to be purchased at significantly reduced prices.

FISCAL IMPACT

Page 202 of 241 ends

ADOPTION OF RESOLUTION APPROVING PARTICIPATION IN THE SAN JOAQUIN VALLEY AIR

POLLUTION CONTROL DISTRICT ZERO EMISSION LANDSCAPING EQUIPMENT VOUCHER

PROGRAM
- 2 -
Budget action is not required at this time. However, should program funding be awarded, budget action may be required to cover any expenses above current operational budgets.

CEQA ANALYSIS
The action is exempt from the California Environmental Quality Act (CEQA) because it is not defined as a "project" per Section 15378(b)(4) of the CEQA Guidelines. The action is a government fiscal activity that does not involve any commitment to any specific project that may result in a potentially significant impact on the environment.

APPROVED BY THE CITY ATTORNEY
No

ALTERNATIVES
The Council can reject the recommended resolution if it does not wish for the City to participate in the Zero-Emission Landscaping Equipment Voucher Program. However, submitting a funding application does not obligate the City to purchase the authorized electric-powered equipment. The likelihood of a purchase would depend on the type and net price of the equipment available. Public Works would still maintain dieselpowered backups to the electric equipment, meaning the diesel-powered equipment replaced would be what has not been in use for an extended period. If successful, this voucher program could reduce pollution and operational costs. Therefore, alternative action is not recommended.

NEXT STEPS
Upon the Council adopting the recommended resolution, Public Works plans to complete and submit Zero Emission Landscaping Voucher Program applications.

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: October 3, 2023
FROM: Gabriel A. Gonzalez, City Manager
PREPARED BY: Randy Milligan, Captain
SUBJECT: APPROVAL OF THE PURCHASE OF TWO 2023 FORD POLICE

UTILITY VEHICLES WITH NECESSARY OUTFITTINGS IN
AMOUNT OF $150,000

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines; and approve the purchase of two 2023 Ford Police Utility vehicles with necessary outfitting for each vehicle for a total cost not to exceed $150,000.

BACKGROUND
The Shafter Police Department has historically replaced patrol vehicles that have exceeded 80,000 miles due to high maintenance costs and outdated emergency equipment, as emergency electronic components wear out over time and may not operate as expected. Currently, the police department’s fleet inventory has two vehicles (2016 & 2013) that have over 100,000 miles. Both vehicles are in need of paint, emergency graphics, and emergency lighting equipment. Both vehicles have accrued a maintenance cost of over $22,000 since 2018.

Staff received a quote from Jim Burke Ford, who is the only known dealer that has two vehicles ready for purchase. The police department currently contracts with American Emergency Products (A.E.P), who have supplied the outfitting of emergency equipment and outfitting maintenance to the department’s fleet since 2003. The police department has previously retained Finish Line Signs to apply the needed emergency graphics to the police vehicles. The required design fees for the department’s graphics have already been paid and it would not be cost-effective to seek other quotes as new design fees would be accrued. The mobile radios required to be outfitted in the patrol vehicles have to be purchased through Motorola Solutions as they are the only entity that is able to provide public safety radios. The department is required to outfit new patrol vehicles with AES encryption to be in compliance with DOJ/CJIS encryption protocols. Currently, the department does not have spare radios or radios that can be transferred that have AES encryption.

Historically, the department would outfit two new patrol vehicles each year and salvage two of the older fleet vehicles due to the excessive mileage and projected maintenance costs. It is essential to replace two patrol vehicles in the Shafter Police Department's current fleet inventory to provide patrol personnel with newer patrol vehicles that are

Page 208 of 241 ends

- 2 -
more reliable and outfitted with newer, more efficient emergency equipment that is less likely to fail in the field.

ANALYSIS
Quotes were produced by Jim Burke Ford, A.E.P, Motorola Solutions, Shafter Auto Body, and Finish Line Signs. Jim Burke Ford has historically been the lowest price for police vehicles. Jim Burke Ford is currently the only known dealer that has two (2) patrol vehicles available for purchase as another agency just canceled their order of two vehicles. Ford Motor Company is currently not taking orders for the 2023 or 2024 models and is not expected to take orders for the 2025 model until Spring of 2024. • Jim Burke Ford (2023 Ford Police Utility) each $49,647.31 • A.E.P (Outfitting for one patrol vehicle) $26,485.55
• A.E.P (Outfitting for one unmarked vehicle) $16,275.81 • Motorola Mobile Radio each $2,913.18
• Shafter Auto Body (Painted doors for patrol
vehicle
$1,082.10
• Finish Line Signs (Graphics for patrol vehicle) $879.38

FISCAL IMPACT
The purchase of these two vehicles is included in the 2023-2024 Operating Budget under account 0100-60-200-14-00-570100. No budget action is required.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is the replacement of police vehicles and therefore, it is a governmental fiscal activity that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: October 3, 2023
FROM: Gabriel A. Gonzalez, City Manager
PREPARED BY: Michael James, Public Works Director
SUBJECT: ADOPTION OF RESOLUTION AUTHORIZING CITY MANAGER

TO EXECUTE AGREEMENT FOR FUNDING THE NORTH

SHAFTER TRANSPORTATION IMPROVEMENTS AND

SUSTAINABILITY PLAN

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines; adopt Resolution 2945, a Resolution of the City Council of the City of Shafter authorizing the City Manager to Execute Agreements with the California Department of Transportation for the North Shafter Transportation Improvements and Sustainability Plan.

BACKGROUND
North Shafter and North Park communities were initially developed before being annexed into the City. Upon being annexed in the early 1990s, the City led initiatives to extend municipal water and sewer service to the residents there. However, they can still benefit from other amenities like sidewalks, crosswalks, signage, bicycle lanes, and lighting.

Earlier this year, an application was submitted to propose funding through the State of California Sustainable Transportation Planning Grant Program for completing the North Shafter Transportation Improvements and Sustainability Plan. The plan's estimated cost is $205,000, comprised of $181,486 in grant funds and a minimum local match of $23,514. One key plan component is engaging with the local community and stakeholders. After receiving public feedback, the plan can be developed to list and prioritize specific projects. Once the Council adopts a plan, prioritized transportation amenities should become more competitive for construction grants.

Public Works recently received a conditional award of the requested grant funds. Among the conditions of an award is a resolution adopted by the City Council authorizing a City official to execute a grant funding agreement for the project.

ANALYSIS
The requested grant funding agreement resolution has been developed by staff and is ready for Council adoption. Consistent with similar resolutions for other State grant

- 2 -
funding projects, the City Manager or designee is listed as the authorized signature for the agreement and potential amendments.

Per State officials, work on the project can start as early as January 2024 and must be completed by April 2026. The project's first phase would be procuring a consultant to prepare the desired plan. Public Works plans to prepare and release a Request for Proposals (RFP) that consolidates the scope of work covered by the Sustainable Transportation Planning Grant Program and consultant services for designing bike and pedestrian improvements at Highway 43 immediately adjacent to North Shafter and North Park funded by a separate grant administered by the San Joaquin Valley Air Pollution Control District (District).

FISCAL IMPACT
The Sustainable Transportation Planning Grant Program grant for completing the North Shafter Transportation Improvements and Sustainability Plan is valued at $205,000, with $181,486 in grant funds and a minimum local match of $23,514.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is approving an agreement to prepare a transportation plan and therefore, it is governmental fiscal activity that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.

APPROVED BY THE CITY ATTORNEY
Yes

ALTERNATIVES
There are no alternatives to the recommended action. To develop the North Shafter Transportation Improvements and Sustainability Plan with funding through the Sustainable Transportation Planning Grant Program, the Council must adopt a resolution authorizing a City official to execute a funding agreement.

NEXT STEPS
Upon adoption of the resolution, the Sustainable Transportation Planning Grant Program will be executed. Afterward, a Request for Proposals will be released to procure a consultant to prepare the North Shafter Transportation Improvements and Sustainability Plan. The award of a professional services contract to this consultant will be on a future Council meeting agenda.

REPLACEMENT TRANSIT VEHICLES

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines; and adopt Resolution 2946, a Resolution of the City Council of the City of Shafter Approving Participation in the San Joaquin Valley Air Pollution Control District AB 617 Emission Reduction Program applications G-155895, G-155896, G-182801, and G-182802 and authorize City Manager to implement award agreements and purchase replacement of transit vehicles.

BACKGROUND
The San Joaquin Valley Air Pollution Control District (“District”) is currently accepting and reviewing grant applications for its Community Emission Reduction Program. This program prioritizes funding for public agencies that the California Air Resources Board (CARB) and District identify for transit vehicle replacement (for Dial-A-Ride) The District received and adopted Shafter Community Emission Reduction Programs (CERP) and assigned the following application numbers G-155895, G-155896, G-182801, and G182802. The proposed funding amount up to $400,000 would cover up to 100% of the cost of replacing polluting transit vehicles with new electric or plug-in hybrid vehicles with a minimum passenger capacity of six .

ANALYSIS
The Public Transit Department has four gas vehicles that would be eligible for the District's Community Emission Reduction Program. The Transit Department would benefit from replacement of the gas vehicles as they are past their useful life and in need of replacement. The District has assigned the following grant applications for the four replacement gas vehicles; G-155895, G-155896, G-182801, and G-182802. Contract agreements will be issued through the Community Emissions Reduction Program Grant upon the District approving the applications. Once the applicant purchases the authorized replacement transit, electric and hybrid plugin vehicles and the gas transit vehicles are replaced and disposed of

by an authorized dismantling facility. The City can submit for reimbursement.

Gas Vehicles for Replacement
Electric and Plug-in Vehicles to be purchased
The Council must adopt a resolution approving participation in the program in order for the applications G-155895, G-155896, G-182801, and G-182802 to be submitted by the City to be considered for funding and authorize the City Manager to implement award agreements and purchase replacement of transit vehicles.

The participation in the program would cover the replacement at 100% and would address critical environmental and public health concerns related to air pollution and greenhouse gas emissions.

FISCAL IMPACT
No budget action is required. Upon approval and related reimbursements, the grant is expected to cover 100% of three Electric Vans and one Hybrid Van.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is adopting a resolution to participate in a grant program and sign agreements related to replacement transit vehicles and therefore, it is governmental fiscal activity that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.

ALTERNATIVES
The Council can reject the recommended resolution if it does not wish for the City to participate in the San Joaquin Valley Air Pollution Control District, Community Emission Reduction Program. However, the City would still need the funding to replace capital assets and that might take longer to secure due to allocation limitations designated for capital replacement. Due to the gas transit vehicles being beyond useful life, it increases the need for maintenance to keep them in operation. Therefore, alternative action is not recommended.

NEXT STEPS
Upon the Council adopting the recommended resolution, staff will complete and submit the resolution and applications G-155895, G-155896, G-182801, and G-182802. to the District for approval. Upon approval by the District, issued contract agreements will be implemented and will proceed with the purchase of transit electric and hybrid plug-in vehicles and disposal of the gas transit vehicles.

PROJECT IDENTIFICATION
SHAFTER CERP HD.5: INCENTIVE PROGRAM FOR TRANSIT VEHICLE REPLACEMENT (FOR DIAL-A-RIDE)
This is a Community Identified Project included and prioritized in the California Air Resources Board (CARB) and District adopted Shafter Community Emission Reduction Programs (CERP).

The goal of this strategy is to provide up to $400,000 for the purchase of electric or plug-in hybrid transit vehicles to be utilized in dial-a-ride service within and surrounding the City of Shafter. The proposed funding amount of $400,000 would cover up to 100% of the cost of replacing polluting transit vehicles with electric or plug-in hybrid vehicles.

The City of Shafter currently has in place an existing Dial-A-Ride service utilized as a supplement to the existing fixed route transit services provided. Dial-A-Ride services are an innovative transit that provides door-to-door, transportation service within Shafter city limits and extending to outercity areas. This is a low cost transportation option for Shafter residents and visitors, including the elderly and those with limited mobility. Conversations with the transit agency staff have confirmed, all existing vehicles in service are gasoline-fueled. Dial-A-Ride vehicles can be either light-duty or heavy-duty vehicles, depending on the specific needs of the individuals within the community being served. Replacing gasoline powered transit vehicles is important to reduce the public’s exposure to pollutants that negatively impact human health, especially for sensitive populations such as children and the elderly. Disadvantaged communities often lack the infrastructure to support zero-emission vehicles and the transportation needs of the community.

Zero-Emission (ZE) and/or Transitional Zero-Emission (TZE) transit vehicles would enable residents to continue using dial-a-ride services while also reducing emissions.

COMMUNITY SUPPORT
This measure received support from Shafter Community Steering Committees and was included in each of the respective adopted Community Emission Reduction Programs. This project plan was presented to the public at the District’s August 18, 2022 Governing Board meeting and received unanimous approval. Information about the Steering Committees is included below:

Page 230 of 241 ends
Page 4 of 7 ends

FUNDING AMOUNTS
The approved CERP for Transit Vehicle Replacement includes $400,000 for the Shafter AB 617 community for the implementation of this measure. The Grantee must replace an old dial-a-ride vehicle with a new eligible transit vehicle. The Grantee must replace and purchase at a minimum two transit vehicles. There are no minimum match requirements for participation in the program.

The following costs are eligible for funding as part of this CERP strategy:
• New vehicles
• Extended warranty for new vehicles
• Vehicle wraps, designs, stickers, etc. for Dial-a-Ride services • Freight, sales tax, registration fees
• Up to 100% of funds may be used for eligible costs
The follow items are ineligible for funding as part of this CERP strategy:
• Used or Refurbished Vehicles
• A chassis that has been modified with aftermarket parts or equipment to create a zeroemission vehicle.

INSPECTION AND DISMANTLING REQUIREMENTS AS PER MOYER GUIDELINES The program requires the old transit vehicle to be permanently destroyed by a participating dismantler. Destruction of the old vehicle’s chassis and engine permanently removes the old, high-emitting vehicle from operation. This requirement has been established to ensure that emission reductions are real. It prevents the old vehicle from being moved into another locale to continue emitting high levels of pollutants. A list of participating dismantlers can be found at https://ww2.valleyair.org/media/00vpkvu2/replacement-certified-dismantlers.pdf.

PROJECT SELECTION AND REPORTING
The District has identified an individual project in accordance with the criteria presented in the CERP project plan. The selected project is the City of Shafter, who was approved at our Governing Board meeting in August 2022. The City of Shafter provides dial-a-ride services to the Shafter AB 617 community.

The District will report program information in accordance with Community Air Protection program guidelines found at:
https://ww3.arb.ca.gov/msprog/cap/docs/cap_incentives_2019_guidelines.pdf.

Page 231 of 241 ends
Page 5 of 7 ends

The District and Grantee that receives funding under this program must comply with the requirements described in Chapter 3, Section H of the CAP Incentives 2019 Guidelines.1This will involve the preparation of Semi-Annual and Yearly reports, which the District will prepare based on information collected from the Grantee and program participants

EMISSION REDUCTION TARGETS AND BENEFITS
The goal of this measure is to support the emission reductions associated with electric vehicle deployment. The District will report emission reduction information utilizing CARB-approved methodology for Clean Mobility Options under the Innovative Transit service type and Vehicle Replacement project type as defined in Section B. Methods in the Clean Mobility Options Quantification Methodology at https://ww2.arb.ca.gov/sites/default/files/auctionproceeds/carb_cmo_qm_final_090120.pdf and calculator https://ww2.arb.ca.gov/sites/default/files/auction-proceeds/carb_cmo_tool_final_090120.xlsx).

The emissions reductions will utilize current dial-a-ride vehicle inputs from the applicant and shall be calculated using Equations 11, 12, and 13 as applicable from Section C. Emissions Reductions from Vehicle Replacement.

Equation 11 calculates the annual emissions associated with the baseline and new vehicles.

Equation 12 calculates the emissions associated with the baseline and new vehicles. Equation 13 estimates both the GHG and air pollutant emission reductions from Vehicle Replacement as the difference between the emissions associated with the baseline vehicle and emissions associated with the new vehicle.

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: October 3, 2023
FROM: Gabriel A. Gonzalez, City Manager
PREPARED BY: Michael James, Public Works Director
SUBJECT: AWARD PROFESSIONAL SERVICES AGREEMENT IN THE
AMOUNT OF $35,000 TO SWANSON ENGINEERING, INC. FOR

CORE CITY SEWER DESIGN AND ENGINEERING

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines; approve one (1) proposal submitted by Swanson Engineering, Inc., for performing a sewer capacity analysis at Los Angeles Avenue valued at $15,000; approve one (1) proposal submitted by Swanson Engineering, Inc., for designing a City sewer main extension from East Ash Avenue to City-owned lots off Lerdo Highway valued at $17,500; authorize the City Manager to execute professional services agreements for each of the two (2) proposals; add one (1) new sewer project to the Capital Improvement Program; and authorize a General Fund appropriation of $35,000 to said project.

BACKGROUND
Planned and prospective developments at the eastern edge of the Core City currently need a plan for sewer service. Some of these developments are immediately off Lerdo Highway between Beech Avenue and Golds Avenue, with residential lot considerations for private development on the north and City-owned commercial lots on the south side.

Additionally, vacant land off of Los Angeles east of Santa Fe Way zoned for industrial land use has also been considered for development. In addition to designing the extension of new sewer service pipelines to these prospective developments, the impact of new sewer connections on existing pipelines must be assessed to ensure adequate flow capacity. In the case of this particular service area, a specific pipeline at Los Angeles Avenue west of Beech Avenue should be the focus of the flow capacity study because it would be expected to convey sewer for virtually everything east of Beech Avenue.

Public Works requested proposals from Swanson Engineering, the lead civil engineer for the Shafter Recreation and Park District site project, to assist with the necessary sewer design and studies. They propose $17,500 to lead the Lerdo Highway sewer extension design to construction drawings and $15,000 to conduct the sewer capacity assessment.

ANALYSIS

Page 237 of 241 ends

AWARD PROFESSIONAL SERVICES AGREEMENT IN THE AMOUNT OF $35,000 TO SWANSON ENGINEERING, INC. FOR CORE CITY SEWER DESIGN AND ENGINEERING - 2 -
Swanson Engineering has proven experience providing engineering services of similar scopes, plus the fees for these services covered in both of their proposals are reasonable. They should also be able to complete the work promptly, given that they are working on the Shafter Recreation and Park District site project.

The $17,500 for the sewer extension design will need to be fully funded by the City because there are no confirmed project beneficiaries other than the City-owned lots off Lerdo Highway. However, the sewer capacity analysis will benefit other lots considered for development, which are the industrial-zoned parcels off Los Angeles Avenue and a parcel on the north side of Lerdo Highway being considered for new single-family homes. While a written cost-sharing agreement has yet to be developed, prospective developers for each area have expressed an interest in participating in the $15,000 cost for the capacity analysis, which could reduce the City's net cost to $10,000.

FISCAL IMPACT
The proposed work will be paid for with the current budget.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is the approval of a professional services agreement for sewer design and engineering to accommodate existing land uses that have been already environmentally cleared and therefore, it is the creation of a governmental funding mechanism or other fiscal activity that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.

ALTERNATIVES
The Council can direct staff to award one of the proposals submitted by Swanson Engineering based on which scope of services is the most important to pursue or reject both proposals in favor of staff either seeking additional proposals or not investing any City funds on sewer improvements in this particular service area. At a minimum, the sewer main extension to the vacant City-owned lots off Lerdo Highway should be pursued because developing those will ultimately require sewer service. Further, the sewer capacity analysis provides valuable information on how much future development the Core City can sustain before constructing new infrastructure. Having Swason Engineering complete the sewer extension main extension design and capacity analysis allows Public Works to manage both project phases more efficiently.

Therefore, alternative action is not recommended.

NEXT STEPS
Upon Council authorization, staff will issue separate professional services contracts to Swanson Engineering for the sewer capacity analysis and sewer main extension design work.

Re: Shafter Lost Angeles Sewer Trunk Line
Dear Michael,
Swanson Engineering is please to provide this proposal for engineering services to perform a sewer analysis on the Lost Angeles trunk line. The analysis will use information being procured by the City on the existing flows in the sewer main. The aim of the study is to determine what additional flow capacity is available in the sewer trunk line for future development using existing land zoning and proposed/anticipated land uses. Our fee for this analysis is estimated at $15,000 and will be billed monthly at our current time and material rates. Not included in our proposal are any special studies by outside firms, public entity fees, or surveying services. If this proposal is acceptable, please review and sign the attached agreement.

Sincerely,
Bob Swanson
