AGENDA ITEM
City Council Meeting
TO: Mayor and City Council Members
FROM: James Takehara, Electric Utility Director
DATE: August 10, 2022
SUBJECT: Approval to Issue a “California Climate Credit” to all Electric Customers FILE NO: E-090-643-148
RECOMMENDATION:
Staff recommends the City Council adopt a resolution authorizing the City Manager to distribute a “California Climate Credit” of $75.00 on City electric customers’ utility bills issued for August 2022 and December 2022, with funding from the California Cap-and-Trade Program.
BACKGROUND:
In 2006, California adopted AB32, the “Global Warming Solutions Act of 2006,” which established aggressive mandates to reduce statewide emissions of greenhouse gases (GHG) through 2020.
In 2016, California adopted SB32, which extended these policy mandates through 2030. Under these laws, the California Air Resources Board (CARB) established a Cap-and-Trade emissions market and comprehensive regulations that affect nearly every sector of the California economy.
Under this rule structure, the City of Shasta Lake electric utility has incurred substantial costs to comply with this State mandate, as the electric utility must buy GHG Allowances (permits to pollute) from the Cap-and-Trade market for its operational activities. These costs are included in the electric department budget and operating costs and are rate impacting. In recognition that the Cap-and-Trade Program could adversely affect California electric ratepayers, CARB reserved a substantial portion of the GHG auction proceeds to benefit California’s electric ratepayers through 2030.
The City of Shasta Lake is responsible for the administration of its allocated share of auction proceeds. The City must use the proceeds to promote the State’s policy objectives under AB32, and primarily benefit its electric ratepayers. In the past, the City distributed its auction proceeds to its electric customers in proportion to the electricity they purchased from the City. This was intended to protect electric ratepayers from rate shock caused by the sudden and substantial new 10 costs caused by the Cap-and-Trade program. However, CARB changed the Cap-and-Trade regulations in October 2017 expressly prohibit this practice. Rebates are now only permissible if issued as a fixed dollar amount. The City is not required to issue rebates to all customer classes.
The City continues to incur Cap-and-Trade compliance costs, and this impacts all customers’ electric rates. In 2022, the City’s compliance cost is expected to be average around $140.00 per customer.
The attached resolution would authorize the City Manager to issue two $75 rebates to each City electric customer, for a total up to $150, to be issued in FY 2023 to continue to help reduce the impact State policy has on the City’s electric ratepayers. This proposal was supported by the Electric Committee, which met on August 10, 2022.
FISCAL IMPACTS:
The bill-credit of $75.00 per electric account would be issued around September 2022 and January 2023, to City electric customers who have electric billing activity in the month prior. This would provide City electric customers a total up to $150.00 in bill credits. Issuing these credits would cost approximately $700,000. Staff requests supplemental appropriations from the City Council to draw these funds from the GHG auction proceeds. The City is required to expend its auction proceeds for authorized uses, such as direct rebates. Staff will prepare other uses of funds at a later date.

11 RESOLUTION NO. CC-2022-xx
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SHASTA LAKE
AUTHORIZING THE CITY MANAGER TO ISSUE A CALIFORNIA CLIMATE CREDIT
TO CITY OF SHASTA LAKE ELECTRIC CUSTOMERS
WHEREAS, in 2006, the State of California adopted AB 32, “The Global Warming Solutions Act of 2006,” which requires statewide emissions of greenhouse gases (GHG) be reduced to 1990 levels by 2020, and was amended in 2016 by SB 32 to further reduce GHG emission to 40% below 1990 levels by 2030; and
WHEREAS, the California Air Resources Board (CARB) has published regulations to implement AB32 and SB32, including the Cap-and-Trade Program Regulations (CA Cap-andTrade Program); and WHEREAS, the City is subject to the rules and conditions established under the CA Cap-andTrade Program, incurs compliance costs associated with its electric utility operations, and receives a number of GHG pollution permits, or “Allowances,” from the State at no cost to help protect its electric ratepayers from the cost impacts of the CA Cap-and-Trade Program; and WHEREAS, the City is required under the CA Cap-and-Trade Program to consign all allocated Allowances to the Cap-and-Trade auctions, and to use the auction proceeds to advance the policy objectives under AB32 and to benefit its electric ratepayers; and WHEREAS, one such approved use of Allowance value is to provide a direct rebate to electric ratepayers in a non-volumetric manner; and
WHEREAS, the City desires to issue a credit to all electric rate payers to help keep the community cost-neutral to the effects of AB32 and to provide additional benefit as originally envisioned under State law; and
WHEREAS, the City desires to issue a bill-credit of $75 to each City electric customer with an active electric account associated with monthly billing statements issued for August 2022 and December 2022.
NOW, THEREFORE, BE IT RESOLVED that the City of Shasta Lake City Council authorizes the City Manager to issue a “California Climate Credit” of $75.00, on City utility bills issued for August 2022 and December 2022, for all electric accounts active in the month immediately preceding bill publication, for all rate classes, as described herein.

SUBJECT: On-call Professional Services List
Increase Contract Limit from $75,000 to $125,000
FILE NO.: E-600-200-587
RECOMMENDATION:
Staff requests that the City Council modify amount authorized by Resolution CC 18-20 and increase the limit for professional services contracts issued utilizing the On-Call List from $75,000 to $125,000.
BACKGROUND:
Since 2009, the City has maintained an On-call Engineering, Surveying, and Architectural-related Professional Services List (List) established via Resolution CC 09-41. The intended use of the List is to provide professional services as needed to augment current staff capabilities and to expedite the delivery of projects.
City Council Resolution CC 09-41 was amended in 2015 via CC 15-15, which extended the life of each List from two to three years in an effort to cut staff costs related to the List renewal process. Subsequently, City Council Resolution CC 09-41 was further modified in 2018 via CC 18-20 to increase the on-call professional services contract limits from $50,000 to $75,000. The List has been renewed five times since the procedure was established (2011, 2013, 2015, 2018 and 2021), and the next scheduled renewal will be in 2024. All three previous resolutions are attached.
For comparison, the City of Redding raised its On-call Professional Services List limit from $125,000 to $200,000 in 2020. In the last several years, staff has seen consulting costs increase due to inflation and increased salaries due to competitive salary demands, to the point where the $75,000 limit is sometimes not sufficient to allow for the completion of some minor projects through the List.
Therefore, Staff recommends increasing the List contract limit from $75,000 to $125,000. This change would be effective with the 2021 List renewal that will expire in 2024. Professional services contracts anticipated to exceed $125,000 will still be awarded via Request for Qualifications/Proposal. 37 FISCAL IMPACTS:

SUBJECT: Execute and Submit CWSRF Construction Application for Force Main Replacement Project
FILE NO.: New
SUMMARY:
Staff recommends that City Council consider authorizing the City Manager to execute and submit construction grant and loan applications and related documents to the State Water Resources Control Board Clean Water State Revolving Fund (CWSRF) for the construction of the Force Main Replacement Project.
BACKGROUND:
On April 4, 2017, City Council authorized the City Manager to execute and submit grant and loan applications and related documents to the State Water Resources Control Board Clean Water State Revolving Fund for the Force Main Route Analysis and Replacement Project. Staff applied for and received a CWSRF Planning Financial Assistance grant. This grant funding was used to perform a route analysis and complete design for a new sewer force main and associated Lift Station (LS) improvements.
A contract was executed with PACE Engineering to provide engineering services to provide route analysis and design. OF AFFORDABLE HOUSING
FILE NO.: New
SUMMARY:
Staff recommends that the City Council adopt a Resolution determining certain parcels of land located in Downtown and owned by the City of Shasta Lake as exempt surplus land pursuant to Government Code Sections 25539.4 and 54221(f)(1)(A).
The following parcels (also described as the “Property”) are recommended to be declared exempt surplus property for the purposes of affordable housing, and are further described in the Resolution:
• 4605 SHASTA DAM BLVD (005-250-059-000)
• 4659 SHASTA DAM BLVD (005-250-063-000)
• VACANT LAND (007-010-096)
BACKGROUND:
In January 2022, the City of Shasta Lake was notified by the California Strategic Growth Council (SGC) Program of an award of over $16.5 million toward the construction of a $36.5 million mixeduse development along the north and south sides of Shasta Dam Boulevard. This 52,918SF project includes 49 units of affordable housing and 7,500SF of commercial space (hereinafter referred to as the “Shasta Lake Downtown Housing Project” or “Project”). Funding will go directly toward transit, pedestrian, and bike improvements throughout downtown, connecting to the future Win-River Hotel Company commercial center project.
50 The purpose of the Affordable Housing And Sustainable Communities (AHSC) program is to reduce greenhouse gas (GHG) emissions through projects that implement land-use, housing, transportation, and agricultural land preservation practices to support infill and compact development. This is the second time the development team has submitted an application for the funds. The Shasta Lake Downtown Revitalization project was awarded under the RIPA (Rural Innovation Project Area) and was the only Federally Recognized Native American Tribal Project in the State of California.
In January 27, 2020, the City of Shasta Lake executed a “Letter of Intent” to sell three city-owned parcels at fair market value to ADK Properties for the purposes of the construction of the affordable housing project. On June 2, 2021, the City, the Project managing partner and ADK signed a Conditional Commitment letter outlining the terms under which the City would transfer Property to the Project developers. While the agreements are still binding, the State Legislature under AB 1486 expanded requirements under the Surplus Land Act , requiring local agencies to follow a process (outlined below) effective for any transactions on or after January 1, 2021.
Surplus Land Act
Recent changes to the Surplus Land Act (Gov’t Code § 54220, et seq.) reaffirmed the State’s commitment to further the availability of affordable housing by requiring that surplus government land be first made available for housing projects. As a result, the California Department of Housing and Community Development (HCD) adopted guidelines to increase compliance with the Surplus Land Act that clarify and strengthen reporting and enforcement provisions of the Act. In general, prior to the disposition of surplus land, agencies must first hold a public meeting to declare the property as surplus land. After the meeting, agencies must send a written notice of availability to local public entities and certain housing sponsors of the availability of surplus land. Entities have sixty (60) days to respond. If a notice of interest is received by a proper entity, the agency and the entity will enter a 90-day negotiation period. Once the negotiation period has ended, the agency may dispose of the surplus land. Should an agency dispose of the surplus land in violation of the Act, the agency shall be subject to penalties set forth in Government Code Section 54230.5.
An agency may be exempt from the provisions noted above if the property is determined to be “exempt surplus land”. To do so, the agency shall do the following:
1. Adopt a resolution declaring the property as exempt surplus land during a regularly held public meeting.
2. Prior to adoption, notify HCD to clarify whether land should be declared “surplus land” or “exempt surplus land.”
3. If concurrence is received, proceed with the resolution process.
4. Once adopted, a copy of the resolution shall be provided to HCD a minimum of thirty (30) days prior to the disposition of the land.
Staff recommends adoption of the Resolution attached declaring the Property “exempt surplus land” within the meaning of Government Code Section 37364.
Government Code Section 37364
Government Code Section 37364 provides in part “whenever the legislative body of a city determines that any real property or interest therein owned or to be purchased by the city can be used to provide housing affordable to persons and families of low or moderate income, as defined by Section 50093 of the Health and Safety Code or as defined by the United States Department of Housing and Urban Development or its successors, and that this use is in the city’s best interests, the city may sell, lease, exchange, quitclaim, convey, or otherwise dispose of the real property or interest therein at less than fair market value, or purchase an interest in the real 51 property, to provide that affordable housing under whatever terms and conditions the city deems best suited to the provision of such housing.”
To qualify for “exempt surplus land” status, the use of the property must meet three conditions:
1. Not less than 80 percent of the area of any parcel of property disposed of pursuant to this section shall be used for development of housing.
2. Not less than 40 percent of the total number of those housing units developed on any parcel pursuant to this section shall be affordable to households whose incomes are equal to, or less than, 75 percent of the maximum income of lower income households, and at least half of which shall be affordable to very low income households.
3. Dwelling units produced for persons and families of low or moderate income under this section shall be restricted by regulatory agreement to remain continually affordable to those persons and families for the longest feasible time, but not less than 30 years, pursuant to a method prescribed by the city. The regulatory agreement shall contain a provision making the covenants and conditions of the agreement binding upon successors in interest of the housing sponsor. The regulatory agreement shall be recorded in the office of the county recorder of the county in which the housing development is located. The regulatory agreement shall be recorded in the grantorgrantee index to the name of the property owner as grantor and to the name of the city as grantee.
The Project meets all three of these conditions and provides the City with a unique opportunity to participate in a development that will provide much needed affordable housing for years to come.
ENVIRONMENTAL (CEQA) REVIEW:
Staff has determined that the proposed project, which includes the transfer of land and subsequent construction and operation of affordable housing, is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15194, Affordable Housing Exemption, which applies to projects that provide housing for low-income households, on a site that is less than five acres and located in an urbanized area. Staff has also determined that the project is categorically exempt from CEQA pursuant to Class 32 (In-Fill Development Projects); per Section 15332 of the CEQA (CCR Title 14, Chapter 3, Article 19).
FISCAL IMPACTS:
Sale of the property at fair market value (to be determined by appraisal) will be positive revenue for the general fund.
