SUMMARY
Staff is recommending the Council approve the proposed ordinance amendment. The Council should open the Public Hearing, consider any comments received, and close the Public Hearing before action on the attached Ordinance. Staff recommends that the City Council offer the ordinance for first reading by title only and direct that the City Clerk post a summary of the proposed ordinance.
BACKGROUND
The City of Shasta Lake Municipal Code establishes the City’s purchasing system and provides that the City Council shall approve policies and procedures necessary to implement such system, including dollar limits associated with purchase of goods, supplies and services, professional agreements and public works projects. The current Municipal Code Section 2.32 “Purchasing System” was initially adopted in 1997 via ORD-97-84, since then there were four amendments to the chapter. ORD-00-127 & ORD-04-160 “Motor Vehicles”; ORD-02-140; ORD-15-242 (Cooperative Purchasing Agreements); and most recently ORD-21-287 (exemptions and increase thresholds) & ORD-21-291 (surplus supplies/equipment).
When staff submitted revisions to Chapter 2.32 in April 2021, fuel reduction exempt projects were included without a cap. The City was successful in receiving several large Department of Forestry CalFIRE grants, and as such the scope of work for these projects would require a competitive bidding process. The City wants to be sure to proceed in an expedited manner for smaller projects and procure for the larger projects. Staff feels placing a threshold on exempt fuel reduction projects would be more transparent in procurement expectations.
Staff Recommends the following action:
1. Chapter 2.32 “Purchasing System” revise section 2.32.080 – “Exceptions to competitive bidding requirements.” Specifically, fuel reduction work at or below the “threshold 2” purchasing limit, or $75,000 as proposed in this staff report, would be exempt from normal competitive bidding. The City Council will receive public input and discuss 13 whether to adopt the recommended amendments to Title 2 “Administration and Personnel” Chapter 32 “Purchasing System” of the City of Shasta Lake Municipal Code (SLMC).
2. Approve Resolution 2022-XX increasing the purchasing limits for small, open market, and competitive purchases.

In January of 2022, the City, and coapplicants were notified that the Project was selected to receive funding through the AHSC. The partnership for the Project are the City, ADK Properties, LLC, Community Revitalization and Development Corporation and WRHC.
A portion of the Project surrounds and encompasses a portion of the Commercial Center property owned by WRHC. The anticipated work around the Commercial Center is anticipated to be a Complete Streets, Safe Routes to School, Green Stormwater Infrastructure public improvements project. It includes improvements to numerous existing roadways (Shasta Way, Grand Avenue and Cascade Boulevard), construction of a new roadway (Wonderland Boulevard), and a two-acre open space area adjacent to Moody Creek that will integrate green space, native landscaping, improved walking trails, and green sustainable stormwater infrastructure.
The anticipated improvements are expected to be located completely within existing road right of way (R/W) and/or property owned by the City and WRHC or its affiliates, subsidiaries, or assignees.
18 The City and WRHC are collaborating on a memorandum of understanding (MOU) to define the project, roles & responsibility, R/W dedications, post-construction maintenance, etc., for the Commercial Center portion of the Project.
Staff is seeking approval from Council authorizing the City Manager to execute all documents including, but not limited to the MOU and R/W dedications.
