AGENDA ITEM
City Council
TO: Mayor and City Council Members
FROM: Jessaca Lugo, City Manager
DATE: August 15, 2023
SUBJECT: FIRST READING OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SHASTA LAKE AMENDING SLMC CHAPTER 2.04, SECTION

2.04.020 COMPENSATION AND BENEFITS FOR CITY COUNCIL

MEMBERS
FILE NO.: A-050-60-003
RECOMMENDATION:

Introduce an Ordinance amending Chapter 2.04, Section 2.04.020: Compensation and Benefits for City Council Members.

BACKGROUND
At the request of the City Council, staff has prepared a summary of options to consider under Sen. Bill Dodd Senate Bill 329, passed in June 2023 allowing general law cities to enact an ordinance to provide each member of the city council a salary based upon the population of the city, as specified. Existing law authorizes that amount to be increased by the city council by an amount that does not exceed 5% for each calendar year from the operative date of the last adjustment of the salary that is in effect when the increase is enacted; or an amount equal to inflation since January 1, 2024, based upon the California Consumer Price Index, which shall not exceed 10% for each calendar year.

Currently, city councils in general law cities may vote to receive a limited salary, not to exceed caps based on population size provided in state law. In previous decades, the Legislature updated these numbers for inflation. However, these amounts have not been adjusted since 1984 despite significant increases in the cost of living.

As a result, council members in most cities including the City of Shasta Lake are currently capped at $300 per month. SB 329 would allow general law cities to adjust council member 7 salaries from their 1984 (1993) numbers to today’s numbers. This would essentially triple what is in current law, bringing it roughly in line with inflation.

League of California Cities (League) sponsored the bill in hopes to lessen barriers for those interested in governing at the local level. Government officials, policy experts, and activists often cite low compensation as a barrier to elected office. In theory, anyone can run for elected office however, lengthy time commitments and limited pay discourage many, especially lowincome residents, single parents, people of color, and young people, from running. For many, being a council member is a full-time commitment with part-time pay.

City staff presented options for City Council to consider on August 1, 2023. As a result, City Council requested staff to draft an ordinance with the following option(s):
• “Revise” section 2.04.020 (C) to increase Council compensation from $300.00 to $950.00 per month.
• SALARY BASED ON POPULATION SIZE
In cities up to and including 35,000 in population, up to and including nine hundred fifty dollars ($950) per month.
• “Eliminate” section 2.04.020 (B) The city shall pay on behalf of each member the federal social security payments.
• “Revise” section 2.04.020 to include language from Resolution CC-16-96 policy language for City Councilmember Health Benefits:

A City Council member may choose to become a part of the City’s health care plan. The City will pay 100% of the premium that it pays for management employees including dental and vision premiums for the City Council members only.

If a Council member chooses to cover a spouse or family member they may do so, however the Council member will reimburse the City for any additional costs of any selection in excess of self-coverage only as indicated above. Premiums paid by Council Members are automatically pre-taxed.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SHASTA LAKE APPROVING MUNICIPAL CODE AMENDMENTS TO TITLE 2.04.020 COMPENSATION AND BENEFITS

FOR CITY COUNCIL MEMBERS
WHEREAS, the City of Shasta Lake is a general law City with a population of approximately 10,217; and
WHEREAS, Senate Bill 329 approved by the Governor June 29, 2023 would amend Section 36516 of the government code to allow increases the maximum amount of salary; and WHEREAS, SB 329 amends Government Code section 36516 (a) (1) 36516. allowing City Councils to enact an ordinance providing that each member of the city council shall receive a salary based on the population of the city; and
WHEREAS, SB 329 bill would authorizes the salary of council members to be increased beyond the specified maximums to an amount not exceeding the greater of either 5% for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance or amendment is enacted, or an amount equal to inflation since January 1, 2024, based upon the California Consumer Price Index, which shall not exceed 10% for each calendar year. The bill would require the city council to consider the adoption of an ordinance to increase council member compensation in open session during at least 2 regular meetings of the city council; and WHEREAS, City Council compensation has not been adjusted since the City incorporated in 1993; and
WHEREAS, the State of California recognizes allowing cities to adjust their compensation for inflation since 1984 may help city councils become more diverse because increased compensation can help individuals from across different income levels receive sufficient income from their service to help ensure that they can continue to serve the public and support their families; and
WHEREAS, by increasing the monthly salary of City Council can help ensure our elected officials are reflective of the residents who live, work, and play in their communities; and WHEREAS, funding for this amendment is currently not allocated in the 2022-2024 Two-Year Budget and upon passage will require a supplemental appropriation; and WHEREAS, the City Council conducted a public hearing on August 1, 2023 and considered the entirety of the record and all public testimony that was provided regarding the proposed ordinance amendment.

NOW THEREFORE, the City Council of the City of Shasta Lake does ordain as following:

SECTION 1.

The foregoing recitals are adopted as findings of fact in support of this ordinance. 9 SECTION 2.

2.04.020 Compensation and benefits for city council members. Each member of the city council shall be entitled to a stipend (salary) and benefits as follows:

A. Each member shall receive a salary of $950.00 hundred dollars per month; B. Each city council member shall be eligible to participate in the health, welfare and retirement programs of the city.

1. A City Council member may choose to become a part of the City’s health care plan.

SECTION 3.

In accordance with Government Code section 36516.5 a change in compensation does not apply to a council member during the council member’s term of office. This prohibition shall not prevent the adjustment of the compensation of all members of a council serving staggered terms whenever one or more members of the city council becomes eligible for a salary increase by virtue of the council member beginning a new term of office.

SECTION 4.

Under the provisions of the California Environmental Quality Act (CEQA) Guidelines Section 15061 (b) (3), this ordinance is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, such as the adoption of the regulations contained herein, the activity is not subject to CEQA.
