SUBJECT: ORDINANCE REPEALING CHAPTER 13.12, ARTICLE V CROSSCONNECTIONS AND BACKFLOW PREVENTION FILE NO.:

RECOMMENDATION
Staff recommends that the City Council authorize an ordinance repealing Chapter 13.12, Article V, Cross-Connections and Backflow Prevention.

BACKGROUND
On December 19, 2023, the State Water Board adopted the Cross-Connection Control Policy Handbook (CCCPH), which will take effect on July 1, 2024. The CCCPH will replace the existing cross-connection control and backflow prevention regulations currently found in Article V, Chapter 13.12. While the CCCPH carries the same authority as a standard regulation, it is designed to provide more technical details and explanatory language.

The implementation of the CCCPH requires the development of a Cross-Connection Control Plan, due by July 1, 2025. The CCCPH does not eliminate any elements from existing cross-connection control programs. Therefore, while public water systems (PWS) work toward compliance with the CCCPH, they must continue to operate their crossconnection control programs effectively according to Title 17 of the California Code of Regulations, which mandates at least annual testing of backflow prevention assemblies.

These regulations and the CCCPH apply, or will apply, to all California public water systems, including community, non-transient non-community, and transient noncommunity systems. 15 The City currently has 181 backflow devices in its distribution system. Approximately

99.5% of these devices consist of either Reduce Pressure Principle Assemblies (RPPA) or Double Check Valve Assemblies (DCVA), with only one known Pressure Vacuum Breaker (PVB). The City owns around 25% of these units, while the remaining 75% are privately owned by water customers. All backflow devices are tested annually by City Water Treatment Plant (WTP) staff.

The primary objective of the CCCPH is to protect public health by establishing standards that ensure a PWS drinking water distribution system is safeguarded against backflow.

Additionally, by offering basic educational information on backflow prevention, the State Water Board aims to raise awareness within the regulated community about the importance of backflow protection and cross-connection control. This, in turn, is expected to lead to the implementation of robust cross-connection control programs for each PWS.

On September 3, 2024, the City conducted a first hearing to repeal Article V, Chapter

13.12 of the municipal code and will be replaced with the City of Shasta Lake CrossConnection Control and Backflow Program, which was adopted separately by Resolution CC-2024-66 and will take effect upon the repeal of Article V (this action).

SUBJECT: RESOLUTION AMENDING THE PROCESSING FEE SCHEDULE

FOR SPECIFIED BUILDING PERMIT APPLICATIONS
FILE NO.:

RECOMMENDATION
Staff requests the City Council consider the attached resolution revising current development application processing fees as indicated in the attached resolution. These modifications reflect currently adopted permitting processes.

BACKGROUND
California Government Code §§66000 et seq. (Mitigation Fee Act) allows public agencies to impose fees for government services when:

1. The individuals’ decision to use the service is voluntary; and

2. The fees charged to an individual user are reasonably related to the level of service rendered to the cost of providing that service.

Fees in California are required to conform to the statutory requirements of the California Constitution, the Mitigation Fee Act, and the California Code of Regulations. Fees may not exceed the reasonable cost of providing the services for which they are collected unless the excess fee is approved by a two-thirds vote of the electorate.

The City’s original fee schedule for planning and building-related permits was adopted from Shasta County upon incorporation in 1993. In February 2006, Muni-Financial prepared a comprehensive application processing fee study for the City. The study established the full cost to the public of providing building and planning services in the 19 review of private development applications. The recommendations of the study including some modifications recommended by the City’s Finance Committee, was adopted in December 2006. The fee study provided the basis for relating the processing fees to the cost of services rendered as required by law.

The City of Shasta Lake application processing fees have been adopted with the following goals:

1. Recover up to 100% of the actual cost of providing the service; and

2. Maintain reasonably competitive fees with neighboring agencies providing similar services to a user.

Under current adopted City Council policy, a deposit is collected from applicants to cover application processing for multiple application projects (ex. – combined General Plan Amendment, rezone and subdivision applications). The fees are regularly updated and/or modified as necessary to reflect current permitting processes, and in January of each year an “inflation escalator” is applied to the fee amounts. The annual inflation factor allows the City Council to increase or decrease the fees annually based on the Employee Cost Index (ECI) for State and Local Government Employees, as released by the U.S.

Department of Labor’s Bureau of Labor Statistics. The ECI measures changes in wages, salaries and benefits for civilian workers (private industry, state and local government).

RECOMMENDED CHANGES:

Staff is recommending the following modifications to the current fee schedule.

Attachment A to this report provides additional information on these recommended changes. The recommendations include no new fees. The changes will simply provide administrative clarity when new applications are submitted. Recommended changes are as follows:
1) Building Division Fees: Establish a Miscellaneous Permit Fee for smaller framing projects including window replacement, siding repair, and minor framing repair that does not require a plan check or engineering.

FISCAL IMPACTS:

The recommended modifications will recover a new building permit application fee and processing costs incurred by the City’s general fund, consistent with past Council policy.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SHASTA LAKE

ESTABLISHING APPLICATION PROCESSING FEES FOR SPECIFIED BUILDING

PERMIT APPLICATIONS
WHEREAS, the City of Shasta Lake Municipal Code requires that applications for development permits be accompanied by fees to cover the cost of services necessary to review plans and application materials; and
WHEREAS, the City of Shasta Lake has prepared a comprehensive application processing fee study to determine the full cost to the public of providing building and planning user-requested services for private development applications (Muni-Financial Report); and
WHEREAS, the City Council has determined that City departments must review development applications to ensure that new development of land and use of property is consistent with the adopted General Plan; and

NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Shasta Lake hereby approves the application processing fees as set forth in this resolution, subject to the following findings and direction:

A. The City Council finds and determines the above recitals are true and correct and have served as the basis, for the actions set forth herein; and B. The City Council finds that the following fees do not exceed the reasonable cost of providing services necessary to process the applications as specified below; and C. 27 Amendment GPA11-01, Rezone Z11-02, Tentative Subdivision Map SD11-01, the project development agreement, and certification of the project environmental impact report (EIR) for the Mountain Gate at Shasta Area Plan. On December 15, 2015, the City Council adopted Resolution CC 15-101, certifying the EIR; Resolution 15-102, approving the general plan amendment; and Resolution 15-103, approving the tentative map.

On January 5th, 2016, the City Council adopted Ordinance CC 16-246, approving a development agreement between the City and the Developer. The Agreement includes the following requirement(s):

ARTICLE 9 ANNUAL REVIEW

9.1 Review Date. The annual review date of this agreement (“the Review Date”), as required by the Development Agreement Law, shall be approximately (12) months from the effective date and every twelve months thereafter.

9.1 Procedures. The procedures for annual review shall be set forth in the Development Agreement Law.

Development agreement law requires local agencies to include at least an annual review of the project proponent’s compliance with the delineated responsibilities. The review must require the proponent to demonstrate good faith compliance with the terms of the agreement. If a local agency finds, based on substantial evidence, that such compliance has not occurred, the agency may modify or terminate the agreement.

The City Manager has determined that the Developer has complied in good faith with the terms and conditions of the Development Agreement. The Agreement does not include a timeline requiring completion of the project or specific milestones that must be met by certain dates.

Additionally, the Agreement specifically states that non-construction of the project is not grounds for making a finding of non-compliance. The Development Agreement is set to expire on May 26, 2041, 25 years from the effective date.

Current Status
In 2019, the developer submitted a large lot final map (FM) and requested a consistent finding from the city with the approved tentative map (TM). City staff coordinated with the developer until the proposed FM was consistent with the TM and encouraged them to record it. The developer took no action regarding the FM. See Attachment 2 for more information regarding the large lot maps.

In 2021 and 2022, the developer applied for two grading permits to effectuate the requirements of US Army Corp of Engineers and California Fish and Wildlife permits. Staff issued the permits, and related work was completed. See Attachment 3 for more information regarding the grading projects.

The city is currently working on constructing the southern portion of Wonderland Boulevard, between Cascade Boulevard and Grand Avenue, as part of the Cascade Village project. This work is being funded through the Affordable Housing and Sustainable Communities grant and will support the Mountain Gate at Shasta project by building approximately four million dollars worth of necessary infrastructure. For more information about the improvements to Wonderland Boulevard, please refer to Attachment 4.
28 The next steps for the project include recording the large lot final map and subsequent small lot maps.
