SUBJECT: A RESOLUTION OF THE CITY OF SHASTA LAKE CITY COUNCIL TO DECLARE APS ENVIRONMENTAL, INC. THE LOWEST

RESPONSIVE, RESPONSIBLE BIDDER, AWARD A

CONSTRUCTION CONTRACT FOR THE WASTEWATER
COLLECTION SYSTEM CLEANING & CCTV PHASE 2 PROJECT
(BID NO. 2025-01)
FILE NO.: (New)

RECOMMENDATION
Staff requests that the City Council consider awarding the Wastewater Collection System Cleaning and CCTV Phase 2 project to APS Environmental, Inc. of North Highlands, CA in the amount of $401,306.80 and approve a total of $450,000.00 to allow for a contract contingency.

BACKGROUND
Since 2009, the City of Shasta Lake has operated and maintained the wastewater collection system under the guidance of the approved Sewer System Management Plan (SSMP), which was mandated by the California State Water Resources Control Board, to assist in the proper operation, maintenance, and funding of the system to ensure the prevention of sanitary sewer overflows.

The system contains approximately 58 miles of sanitary sewer gravity mains and force mains. With an overriding goal of inspecting, cleaning and televising the entire system every 10-year period starting in 2014, the SSMP contains performance indicators for both items.
13 The City Public Works Department handles general maintenance for the streets, water, wastewater, storm water, and parks divisions, the Department was and had been unable to meet the minimum goal for cleaning and televising the collection system per the SSMP.

This project is Phase 2 of 2 and includes the inspecting, cleaning and televising of approximately 26.1 miles of sanitary sewer main, as well as inspection of approximately 445 sanitary sewer manholes. The project represents approximately 45% of the entire system. Phase 1 was completed in the fall of 2024, by APS.

Three (3) bids were received on June 26, 2025. All bids were deemed to be responsive.

The bids ranged from a low responsive bid of $401,306.80 to a high responsive bid of $1,146,150.00 The lowest responsive bid was about 20% lower than the Engineer’s Estimate of $503,646.13 and the highest responsive bid was about 225% higher than the Engineer’s Estimate. A Bid Summary is attached.

FISCAL IMPACTS:

This project is funded through currently budgeted Wastewater utility funds (530-340).

City Council
TO: Mayor and City Council Members
FROM: Jessaca Lugo, City Manager
DATE: July 15, 2025
SUBJECT: TEMPORARY PAUSE ON CANNABIS RETAIL APPLICATIONS;

FORMATION OF CANNABIS AD HOC COMMITTEE AND REVIEW

OF EXISTING REGULATIONS
FILE NO.:

RECOMMENDATION
Staff recommends that the City Council adopt the attached Resolution to: (1) pause the acceptance of new cannabis retail applications; (2) initiate a comprehensive review of existing cannabis retail regulations under Shasta Lake Municipal Code Chapter 5.05; and (3) establish a City Council Ad Hoc Committee to assist in the review process and develop potential regulatory updates.

BACKGROUND:

The City of Shasta Lake currently regulates commercial cannabis activities under Chapter

5.05 of the Shasta Lake Municipal Code. Section 5.05.010 outlines the purpose and intent of these regulations to align with state law, protect public health and safety, and mitigate adverse community impacts associated with cannabis businesses.

The City’s cannabis regulations were initially adopted on May 2, 2017, following an extensive public outreach process led by a Cannabis Ad Hoc Committee. This committee, comprised of representatives from education, non-profits, cannabis businesses, the Chamber of Commerce, SCI Consulting Group, and members of the public—met regularly throughout 2016 and 2017 to help draft the regulatory framework. The resulting recommendations were reviewed by the Planning Commission and adopted by the City Council. The City has not amended these regulations since 2019.

Over the past three years, the City has experienced a decline in cannabis business inquiries. Existing cannabis businesses have also reported revenue decreases due to 25 broader challenges within the industry statewide. Notably, High Times, once operating more than 40 retail locations across California, recently shuttered all of its retail operations, including the one in Shasta Lake.

Although the City has not received a significant number of new cannabis retail applications, staff recommends temporarily pausing acceptance of new retail applications to allow for a comprehensive review of the existing regulatory framework. This review would evaluate the effectiveness of current policies and consider potential updates in response to emerging issues, including:
• Clustering of cannabis retail locations
• Compatibility with surrounding land uses
• Adequacy of separation requirements and zoning standards • Maximum number of retail businesses permitted
• Alignment with evolving state laws and industry best practices To facilitate this effort, staff recommends adoption of a temporary pause on new cannabis retail applications. During this pause, staff further recommends convening a Cannabis Ad Hoc Committee comprised of two City Council Members, with participation from staff and community stakeholders. The Committee would be tasked with:
• Reviewing the City’s existing cannabis regulations
• Gathering input from the public and local businesses
• Identifying areas for regulatory improvement
• Presenting policy recommendations to the City Council Staff is not requesting the Ad Hoc committee to look at restructuring Chapter 3.17 Cannabis Business Tax. The Cannabis Ad Hoc Committee, through staff, would provide an initial report within 90 days of the resolution’s adoption, unless the City Council approves an extension.

TEMPORARILY PAUSING THE ACCEPTANCE OF NEW APPLICATIONS FOR

CANNABIS RETAIL BUSINESSES, INITIATING A REVIEW OF EXISTING REGULATIONS UNDER MUNICIPAL CODE CHAPTER 5.05, AND ESTABLISHING A

CITY COUNCIL CANNABIS AD HOC COMMITTEE
WHEREAS, the City of Shasta Lake regulates commercial cannabis activities pursuant to Chapter 5.05 of the Shasta Lake Municipal Code; and
WHEREAS, the cannabis regulations adopted in 2017 were the result of significant public engagement and stakeholder input through a Cannabis Ad Hoc Committee that included community members, non-profit organizations, the business community, SCI Consulting Group, and others; and
WHEREAS, the City has not amended its cannabis regulations since 2019, and recent industry trends, including a statewide decline in cannabis business activity, warrant a comprehensive review of local cannabis policy; and
WHEREAS, a temporary pause will allow time for staff and a City Council Ad Hoc Committee to evaluate potential policy improvements related to cannabis retail zoning, land use compatibility, separation distances, and alignment with evolving state law and best practices
.

RESOLUTION FOR THE ALIGNMENT OF TWO PLANNING

COMMISSION SEATS FOR TERM EXPIRATION
FILE NO.: New

RECOMMENDATION
Staff recommends that the City Council consider and approve a resolution to align the terms of two Planning Commission seats so that all appointments follow a consistent schedule. This will improve efficiency in the appointment process and ensure continuity in commission operations.

BACKGROUND:

The Planning Commission was established as a seven-member body, with terms set with three staggered expirations. Three seats were to expire in February, two seats were to expire in August, and two seats were to expire in December of alternating years.

Because the Commission struggled to fill vacancies, it was unanimously approved by the Planning Commission to request a reduction of its membership to a five-seat body. At that time, there was a vacancy for the seat with a term expiring in December and a seat with a term expiring in August.

On October 15, 2019, the City Council approved a revision to Municipal Code Title 2 – Administration and Personnel, Chapter 2.16, Relating to Planning Commission, changing the number of members from seven to five. With this change, the commission was left with three seats to expire in February, one seat to expire in August, and one seat to expire in December of alternating years.
31 During Commissioner Palmer's December 17, 2024, reappointment, the Council requested staff bring back the discussion and possible action of the term alignment at or near the August term vacancy.

In reviewing the current appointment schedule, staff identified opportunities to streamline term lengths and expiration dates, providing a more predictable and manageable structure for both commissioners and the appointing body.

Staff recommend that the City Council consider the following actions:

1. Extend the appointment of Commissioner Palmer's term to expire in August of 2029, with the upcoming Planning Commission seat.

2. Adjust the upcoming August seat vacancy term to align with Commissioner Palmer's appointment, with a term expiring in December 2028.

3. Adjust Commissioner Palmer's appointment to expire in August 2025 with the upcoming Planning Commission term expiration and advertise both planning commission vacancies for terms expiring in August 2029.

4. Take no action.
