RESOLUTION NO. 2022-02-6662
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, APPROVING AN ENCROACHMENT AGREEMENT PROGRAM AND POLICY WHEREAS, the City’s Public Works Department has encountered situations where routine private improvements are proposed by residents or businesses on public right-of-way; and WHEREAS, in response to these requests, the City proposes adoption of the Encroachment Agreement Policy, which would establish requirements and conditions for permitting, operation, and maintenance of routine private improvements within the City of Signal Hill right-of-way; and WHEREAS, the Encroachment Agreement Policy would allow for a binding agreement recorded against the adjacent parcel stipulating the conditions of approval such that the City retains maximum amount of local control for any improvement requests made by private individuals or companies, including procedures to remove said private improvements should the City require the right-of-way for purposes of a public project or should the private improvements pose a hazard to public safety; and WHEREAS, the City Council hereby delegates authority to change or amend the Encroachment Agreement Policy to the Public Works Director as necessary in order to comply with any applicable state or federal requirements or regulations and/or to improve the City’s processing requirements for Encroachment Agreements and ensure compliance with the Signal Hill Municipal Code regulations for same, in accordance with state and federal law.
NOW, THEREFORE, the City Council of the City of Signal Hill, California, does hereby resolve that the Encroachment Agreement Policy attached hereto as Exhibit A is hereby approved.
