AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, AMENDING A PORTION OF CHAPTER 10.40 OF THE SIGNAL HILL MUNICIPAL CODE RELATING TO THE SPEED LIMIT ON SEVERAL STREET SEGMENTS WHEREAS, the California Vehicle Code (CVC) requires local authorities to conduct a review of its posted speed limits through an “engineering and traffic survey” every five years. This study must be conducted in accordance with specific State guidelines; and WHEREAS, CVC Section 22357(a) provides that whenever an engineering and traffic survey supports a determination that a speed greater than twenty-five miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon any street other than a highway, a local authority may by ordinance determine and declare a prima facie speed limit between thirty (30) and sixty-five (65) miles per hour, whichever is most appropriate to facilitate orderly movement of traffic and is reasonable and safe; and WHEREAS, posted speed limits must be in conformance with the study’s findings; and WHEREAS, once a prima facie speed limit has been established pursuant to CVC Section 22357(a), it shall not thereafter be revised except upon the basis of an engineering and traffic survey; and WHEREAS, the study is also required by the CVC to enable the Police Department to enforce the posted speed limits through the use of speed detection devices such as radar; and WHEREAS, the City conducted an engineering and traffic survey in 2021 in order to comply with the CVC (the “2021 Engineering and Traffic Survey”).
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Pursuant to CVC Section 22357(a), on the basis of the 2021 Engineering and Traffic Survey, the City Council of the City of Signal Hill finds and determines that a speed greater than twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe on certain streets within the jurisdiction, excluding any state highway otherwise subject to alternate speed limits.
Section 2. Pursuant to CVC Section 22358.8(a), on the basis of the 2021 Engineering and Traffic Survey and the fact that a registered engineer has evaluated that certain section of highway eastbound on Spring Street between Orange Avenue and Walnut Avenue, and has determined that no additional general purpose lanes have been added to the roadway since completion of the immediately prior engineering and traffic survey, the City Council of the City of Signal Hill finds and determines that the current speed limit on one or more streets is still more than is reasonable or safe.
Section 3. Section 10.40.010 of the Signal Hill Municipal Code relating to the speed limits on several street segments is hereby amended to repeal Section 10.40.010 and replace it with the following Section 10.40.010 Speed Limits Designated on Certain Streets to read in full as follows:
10.40.010 Speed Limits Designated on Certain Streets. It is determined upon the basis of an engineering and traffic investigation that the speed permitted upon the following streets is necessary for safe operation of vehicles thereon and it is declared that the prima facie speed limit shall be as set forth in this section on those streets or parts of streets designated when signs are erected giving notice thereof:

40 Section 4. This ordinance is adopted for the preservation of the public peace, health, and safety. The City Council must establish this speed limit based on a current Speed Zone Study in conformance with the CVC to allow complete enforcement of speed limits within Signal Hill. The adoption of this ordinance will allow police enforcement of the speed limit utilizing radar or other electronic devices and thereby reduce the threat to persons and properties that now exist due to vehicles exceeding posted speed limits.
Section 5. The Public Works Director shall post appropriate signage to implement the provisions of this ordinance.
Section 6. Certification and Effective Date. The City Clerk shall certify to the passage and adoption of this ordinance by the City Council of the City of Signal Hill and shall cause a summary of this ordinance to be published in accordance with Government Code Section 36933, in a newspaper of general circulation which is hereby designated for that purpose, and this ordinance shall take effect thirty (30) days after its passage.
