Background:

In recent years, Signal Hill has seen an increase in the discharge of illegal fireworks during the summer months, especially during the week of the 4th of July holiday. Illegal fireworks threaten neighboring properties, increase 911 response times for all emergencies, and create an increased risk of fire-related property damage and personal injury. In response to resident concerns, the City Council has expressed its interest in strengthening the City’s fireworks enforcement capacity.

Analysis:

To strengthen the City’s enforcement capacity, in consultation with the City Attorney’s Office, staff is recommending the following amendments to the Signal Hill Municipal Code.

Increased Fines for Fireworks Violations
The State Fire Marshall has adopted a model fireworks ordinance for cities. The fines imposed by the model ordinance are as follows:

Social Host Liability
Currently, State law generally requires that a law enforcement officer personally observe the actual person discharging illegal fireworks prior to issuing a citation. One of the many challenges of fireworks enforcement is that illegal fireworks are often ignited from locations that are not visible from the public right-of-way. Host liability shifts and broadens the focus of enforcement to include the person providing the location.

A ”host” or “social host” means a person who permits or allows a gathering or person at their place of residence or other private property or any place under their control. A host is generally:

1. The person in charge of private property, including but not limited to, an owner, tenant, landlord, or property manager of the property; or

2. The person who organizes, supervises, officiates, conducts, controls, or is otherwise in charge of the activity on the property.

Providing for social host liability will allow law enforcement and code enforcement personnel to hold the “host” responsible for the discharge of illegal fireworks, improving enforcement capabilities in several ways.

Currently, State law generally requires that a law enforcement officer personally observe the actual person discharging illegal fireworks prior to issuing a citation. Typically, it is not difficult for enforcement officers to identify the specific location an aerial firework originates. The challenge lies in identifying the specific individual user or possessor of the firework. The “Social Host Liability” provision will allow an officer to focus on a particular person (or persons) responsible for the property or event.
