AGENDA ITEM
TO:

HONORABLE MAYOR

AND MEMBERS OF THE CITY COUNCIL
FROM:

THOMAS BEKELE

PUBLIC WORKS DIRECTOR
SUBJECT:

PUBLIC HEARING - ORDINANCE ADDING CHAPTER 8.14 TO TITLE 8 OF THE

SIGNAL HILL MUNICIPAL CODE RELATING TO SINGLE-USE FOODWARE

ACCESSORIES AND STANDARD CONDIMENTS
Summary:

Form of Notice: Notice was published in the Signal Tribune newspaper per Government Code Section 65091 (a)(4) on June 17, 2022; and notice was posted in accordance with Signal Hill Municipal Code Section 1.08.010 on June 17, 2022.

On October 5, 2021, Assembly Bill 1276 (Chapter 505, Statutes of 2021) (AB 1276) was signed into law, regulating the distribution of single-use foodware accessories and condiments to consumers.

Included in the provisions of AB 1276 is the requirement that the City authorize an enforcement agency by June 1, 2022. To comply, staff is proposing the addition of Chapter 8.14 to the Signal Hill Municipal Code.

Recommendation:

Introduce an ordinance, entitled:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, ADDING CHAPTER 8.14 TO TITLE 8 OF THE SIGNAL HILL MUNICIPAL CODE RELATING TO SINGLE-USE

FOODWARE ACCESSORIES AND STANDARD CONDIMENTS
Fiscal Impact:

Sufficient funds are available within the Public Works Environmental Program (Account No. 100-93- 5633) for educational and notification expenses. Annual inspections will be performed by Public Works Department staff.

Strategic Plan Objective:

Goal No. 5: Ensure an enhanced quality of life for the residents.

Background and Analysis:

The State has recognized that littered plastic products cause environmental harm requiring significant cleanup costs.

In response, in September 2018 the State passed Assembly Bill 1884 (Chapter 576, Statutes of 2018) (AB 1884), prohibiting full-service restaurants from distributing single-use straws to consumers without first being requested by the consumer.

Expanding upon AB 1884, in October 2021, the Governor approved AB 1276 which prohibits all food facilities from providing any single-use foodware accessory or standard condiment unless requested by the consumer.

AB 1276 defines single-use foodware accessories as follows: utensils, chopsticks, condiment cups and packets, straws, stirrers, splash sticks, and cocktail sticks. Standard condiments are defined as follows: relishes, spices, sauces, confections, or seasonings such as ketchup, mustard, mayonnaise, soy sauce, hot sauce, salsa, salt, pepper, sugar and sugar substitutes.

AB 1276 requires food facilities that use third-party food delivery platforms to list single-use foodware accessories and standard condiments on their menu and only provide such items when requested.

The law excludes correctional institutions, health care facilities, residential care facilities, and public and private school cafeterias.

To comply with AB 1276, staff recommends adopting an ordinance to add Chapter 8.14 to Title 8 of the Signal Hill Municipal Code establishing standards related to single-use foodware accessories and standard condiments and authorizing the City to act as the enforcement agency.

There are currently approximately 35 food facilities that would need to comply with AB 1276. The City’s enforcement program will include annual inspections and mailed bi-annual reminder notifications. Staff will also utilize the City’s current service request portal to receive citizen concerns of violations and conduct site visits accordingly.

Upon introduction of the Ordinance, the City Clerk’s office will cause to be posted a summary of the Ordinance pursuant to Signal Hill Municipal Code Section 1.08.010 at City Hall, Discover Well Park, Reservoir Park, and the Signal Hill Library on or before July 1, 2022. A summary of the Ordinance will also be published in the Signal Tribune newspaper per Government Code §65091(a)(4) on July 1, 2022. Second reading of the Ordinance will be agendized for the July 12, 2022 City Council meeting.
