AGENDA ITEM
TO:
HONORABLE MAYOR
AND MEMBERS OF THE CITY COUNCIL
FROM:
THOMAS BEKELE
PUBLIC WORKS DIRECTOR
SUBJECT:
AGREEMENT FOR DESIGN SERVICES WITH MOFFATT & NICHOL (M&N) FOR STRUCTURAL ENGINEERING SERVICES FOR THE CITY’S FUEL STATION
CANOPY REPLACEMENT AND AUTHORIZATION FOR STANDARD
CONTINGENCIES
Summary:
The City Council will consider entering into an Agreement for Design Services with M&N to prepare final structural engineering design and construction documents for the replacement of the fuel station canopy at the Public Works yard located at 2175 28th Street.
Recommendations:
1. Authorize the Interim City Manager to enter into an Agreement for Design Services with M&N to prepare final structural engineering design and construction documents for the replacement of the City’s fuel station canopy, in a form approved by the City Attorney. The term of the Agreement shall be from December 19, 2022 to May 8, 2023 with a not-to-exceed contract amount of $58,863.
2. Authorize standard contingencies of 10% ($5,886) and up to a 180-day term extension pursuant to the City’s Purchasing and Contracting Guidelines, to be utilized if approved by the Public Works Director.
Fiscal Impact:
The total cost of services to be provided by M&N is a not-to-exceed amount of $58,863. The City’s Purchasing and Contracting Guidelines allow for an additional 10% compensation contingency. For this Agreement, the contingency amount is $5,886, for a total contract authority of $64,749. There are sufficient funds budgeted in the Fiscal Year (FY) 2022-23 Fleet Fund for this Capital Improvement Program (Project No. 90.17015).

Strategic Plan Objective:
Goal No. 4: Maintain and improve the public infrastructure.
Background and Analysis:
In 2018, City staff initiated preliminary engineering to design and replace the canopy over the City’s fuel station at the Public Works yard located at 2175 28th Street. The existing fuel station canopy was originally constructed in 1982 and has deteriorated to a state of disrepair. State water quality codes require fueling stations to be covered to prevent accidental discharge of fuel and automotive fluids into the stormwater runoff. City staff tasked AndersonPenna Partners, Inc and their structural engineering subconsultant, McLean & Schultz, to prepare preliminary plans and cost estimates for the replacement under their City Engineering Services contract. Upon completion of design documents, a new Engineer’s Estimate for construction will be provided and is likely to be higher than the original construction budget mainly due to price escalation. Staff will present the construction contract in early 2023 for Council review and approval.
With the Council approval of the FY 2022-23 Capital Improvement Program, there are sufficient funds in the amount of $229,696.42 available to complete the design phase of the fuel canopy replacement project. The structural design consultant firm that prepared the preliminary design, McLean & Schultz, has been dissolved and the key engineering staff are now employed by M&N. Staff recommends that a sole source structural engineering design contract be awarded to M&N to complete the final design and prepare construction documents. Continuing work with the original engineering consulting staff will have lower costs and effort required to complete the project as compared to starting over with new engineering design personnel, as new engineering staff will need to spend more time and effort on research and preliminary design elements. City staff has reviewed the attached proposal by M&N (Attachment A) and has determined the scope and hourly rates to be appropriate and consistent with current market prices.
After award of the Agreement for Design Services and issuance of Notice to Proceed to M&N, completion of 100% design plans and construction documents is anticipated in February 2023.
Subsequently, staff will solicit bids from contractors for construction of the project, scheduled to start in May 2023 after Council’s approval of the construction contract.
