A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, ACCEPTING CERTAIN SIDEWALK EASEMENT TO THE CITY OF SIGNAL HILL ON CERTAIN REAL PROPERTY AT ASSESSOR PARCELS 7212-008-104 AND 7212-008-105 WHEREAS, the City of Long Beach, adopted a resolution certifying an Environmental Impact Report for a development Project (hereinafter, the “Project”) consisting of three building totaling 160,673 square feet on a 7.5 acre site located at 2851 Orange Avenue on APN 7212-009-021; and WHEREAS, Technical Advisory Committee that consisted of planning and public works staff from City of Long Beach and Signal Hill was formed to finalize the off-site improvements for the Project and required off-site improvements including the Sidewalk Easement at adjacent parcels APN 7212-008-104 and APN 7212-008-105; and WHEREAS, certain Sidewalk Easements described in Exhibit “A” and depicted in Exhibit “B” attached hereto and incorporated by reference (hereinafter, the “Sidewalk Easement”) have been presented to the City of Signal Hill; and WHEREAS, APN 7212-009-021 is opposite to APN 7212-008-104, for which Signal Hill West LTD Partnership is the property owner; and WHEREAS, Signal Hill West LTD Partnership has agreed to convey certain property interests set forth in Exhibit “A” and Exhibit “B” to the City of Signal Hill; and WHEREAS, the City Council of the City of Signal Hill does here by find and determine that it is in the best interest of the City of Signal Hill to accept the Sidewalk Easement; and WHEREAS, the property owner is offering for acceptance, an easement to be used for public sidewalk purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Signal Hill that the Sidewalk Easements described in Exhibit “A” and depicted in Exhibit “B” be, and they hereby are accepted for public sidewalk purposes in accordance with California Street and Highway Code Section 1806(b), and said property is located in the City of Signal Hill in the County of Los Angeles, State of California BE IT FURTHER RESOLVED that the City Clerk in the City of Signal Hill be instructed to record a certified copy of this Resolution and that the property owner be instructed to record an executed easement deed of property legally described in Exhibit “A” and depicted in Exhibit “B” in the Los Angeles County Registrar-Recorder/County Clerk’s office and to provide a certified copy of the recording to the Public Works department.
