TO:
HONORABLE MAYOR
AND MEMBERS OF THE CITY COUNCIL
FROM:
YVETTE E. AGUILAR
COMMUNITY SERVICES DIRECTOR
SUBJECT:
REQUEST TO WAIVE FEES FOR USE OF CITY FACILITY AND WAIVE THE
PROHIBITION OF ALCOHOL AT CITY FACILITIES
Summary:
The Signal Hill Community Foundation (SHCF) is proposing to host a fundraising event on Friday, May 12, 2023, benefitting the City of Signal Hill community. SHCF is requesting a waiver of the fees for the use of the Signal Point Terrace, with the option to utilize the Community Room as a backup in the event of inclement weather, and permission to provide alcoholic beverages at the event.
Recommendation:
Approve waiver of the fees for use of the Signal Point Terrace and the use of the Community Room (as a backup in the event of inclement weather); City staff costs; use of equipment; and waiver of the prohibition of alcohol at City facilities.
Fiscal Impact:
The fee waiver amount totals $1,790.

Should the Community Room be utilized in lieu of the Signal Point Terrace, the total fees waived would be less than $1,790, as the Community Room hourly rate is $50 less than the hourly rate for the Signal Point Terrace.
Strategic Plan Objective:
Goal No. 6: Promote a transparent and open government.
Background:
In anticipation of this event, SHCF has requested a fee waiver for Friday, May 12, 2023, from 12:00 p.m. to 9:00 p.m. for the use of the Signal Point Terrace, with the Community Room as a backup location in the event of inclement weather (Attachment A).
Analysis:
SHCF is planning to host a fundraising event and seeks approval from the City Council to waive the fees and the prohibition of alcohol on City property per City policies for the proposed fundraising event scheduled for May 12, 2023 at the Signal Point Terrace and/or Library Community Room.
The City has three policies pertaining to the requested waivers:
1. City of Signal Hill Policy 4.9A Facility Use Permits - Indoor - prohibits the use of amplified/live music & noise levels for the Signal Point Terrace (Attachment B).
2. City of Signal Hill Policy 4.15 Prohibiting Alcohol Use at City Property Except Under Certain Circumstances - provides for a waiver process regarding alcohol use at public facilities (Attachment C).
The policy requires the City Council to make the following findings to grant approval for alcohol use:

3. City of Signal Hill Policy 4.16 Waiver of Fees for City Facilities - provides for a waiver process regarding facility fees (Attachment D).
The policy authorizes the City Council to waive fees based on the following criteria:

b) The individual or organization must have nonprofit status with the Internal Revenue Service. Proof of nonprofit status by the I.R.S. must be furnished to City staff; and c) The organization’s primary focus must be serving the residents of Signal Hill. The Board submitted a letter of support detailing the event and benefits to the community (Attachment E).
The request to waive facility fees is appropriate for the event and SHCF meets the criteria as outlined in City of Signal Hill Policy 4.9A
The ability to serve alcohol is an appropriate feature for the event. The SHCF meets criteria as outlined in City of Signal Hill Policy 4.15 and has provided support for programs and activities provided by the City. In response to criteria (f), the Chief of Police determined the event hosts will be required to provide private security and ensure one Board Member will complete LEAD (Licensee Education on Alcohol and Drugs) training prior to the event; the hosts have agreed to these conditions. The event must comply with all requirements of the California Department of Alcoholic Beverage Control office and the SHCF must also obtain a certificate of insurance that will cover the event. If any of the above conditions are not met, the event will be cancelled.
