City shall provide Contractor with a copy of the prevailing rates of per diem wages in effect at the commencement of this Agreement. Contractor shall make copies of the prevailing rates of per diem wages for each craft, classification or type of worker needed to execute the Services available to interested parties upon request, and shall post copies at the Contractor’s principal place of business and at the project site. Contractor shall defend, indemnify and hold the City, its elected officials, officers, employees and agents free and harmless from any claim or liability arising out of any failure or alleged failure to comply with the Prevailing Wage Laws.

It shall be Contractor’s sole responsibility to comply with all applicable registration and labor compliance requirements, including the submission of payroll records directly to the DIR. Notwithstanding the foregoing, the contractor registration requirements mandated by Labor Code Sections 1725.5 and 1771.1 shall not apply to work performed on a public works project that is exempt pursuant to the small project exemption specified in Labor Code Sections 1725.5 and 1771.1.

In the event the surety or Contractor intends to reduce or cancel any required bond, at least thirty (30) days prior written notice shall be given to the City, and Contractor shall post acceptable replacement bonds at least ten (10) days prior to expiration of the original bonds. No further payments shall be deemed due or will be made under this Agreement until any replacement bonds required by this Section are accepted by the City. To the extent, if any, that the total compensation is increased in accordance with the Agreement, the Contractor shall, upon request of the City, cause the amount of the bonds to be increased accordingly and shall promptly deliver satisfactory evidence of such increase to the City. To the extent available, the bonds shall further provide that no change or alteration of the Agreement (including, without limitation, an increase in the total compensation, as referred to above), extensions of time, or modifications of the time, terms, or conditions of payment to the Contractor, will release the surety. If the Contractor fails to furnish any required bond, the City may terminate this Agreement for cause.

3.2.12.4 Surety Qualifications. Only bonds executed by an admitted surety insurer, as defined in Code of Civil Procedure Section 995.120, shall be accepted. The surety must be a California-admitted surety and satisfactory to the City. If a California-admitted surety insurer issuing bonds does not meet these requirements, the insurer will be considered qualified if it is in conformance with Section 995.660 of the California Code of Civil Procedure, and proof of such is provided to the City.

3.2.13 Water Quality Management and Compliance.

3.2.13.1 Storm Water Management. Storm, surface, ground, nuisance, or other waters may be encountered at various times during the Services. 3. Special event and emergency cleaning, as needed.

Street Sweeping Services
The primary objective of street sweeping is to pick all debris to ensure free flow of water in the gutter and to maintain the streets in a state of cleanliness. Sweeping shall normally consist of a single pass over an area, although additional passes shall be made as necessary when conditions warrant special attention. Debris collection may require more than one pass in order to sufficiently clean the street. Extra effort will be required when sweeping equipment leaves a dirt/silt smear in its swept pathway. Extra effort will be strictly enforced during and after windy conditions and storm weather. This service shall be included in the unit curb-mile price at no additional cost to the City.

Debris shall consider to be all litter, rubbish, leaves, sand, dirt, garbage and other foreign material removable from a paved street with a street sweeper. Items of 55728.00300\33359534.1
Exhibit “A”-2 CITYWIDE STREET SWEEPING SERVICES
excessive size, such as cardboard, palm, fronds, large rocks, etc. shall be physically picked up and placed in the sweeper by the contractor. The selected contractor shall be responsible for providing all labor and equipment necessary to perform street sweeping services on a weekly basis including the sweeping of all arterials, collectors, industrial, residential and commercial streets, cul-de-sacs, high traffic intersections, median island curbs and catch basin inlets. All city facility/parks parking lots will be swept once a week per the posted timeframes and schedules.

Hours
Street sweeping is performed on Monday, Tuesday, Wednesday, and Friday each week. Street sweeping hours are 8:00 a.m. to 12 noon in residential areas and 4:00 a.m. to 8:00 a.m. in the business and commercial/industrial districts of the City. A map of the City’s street sweeping schedule is provided as Exhibit A-1. Some areas may be posted with different hours than noted above. It is the Contractor’s responsibility to familiarize themselves with these areas and adjust their sweeping schedule accordingly.

Holidays
The Contractor is not required to sweep streets on Sundays nor on any of the following holidays or any additional holidays set forth in any collective bargaining agreement which may be entered into between the Contractor and its employees, a copy of which is to be provided to the City.
a. New Year’s Day
b. Memorial Day
c. Independence Day (July 4th)
d. Labor Day (first Monday in September)
e. Thanksgiving Day
f. Christmas Day
During the week of a holiday, the Contractor shall adjust the weekly schedule to as to return to the normal weekly schedule the following week. Sweeping scheduled for a holiday shall be completed within seven (7) days following the holiday. Holiday sweeping schedules must be submitted to the Contract Officer thirty (30) days prior to the holiday. No modification of this holiday schedule shall be effective unless authorized in writing by the Contract Officer.

Weather Conditions
The Director of Public Works or designee reserves the right to be the sole judge if the weather is too inclement to sweep the streets. When adverse weather interrupts sweeping, the Contractor shall adjust the work schedule so as to return to the normal weekly schedule the following week. The City reserves the right to direct schedule changes made necessary due to inclement weather. In the event of a rainy day, the Service Provider shall obtain approval from the City’s Public Works Director or his designated Public Works representative for the day’s sweeping. 55728.00300\33359534.1
Exhibit “A”-3 CITYWIDE STREET SWEEPING SERVICES
Sweeping Practices and Standards of Performances
 All work shall be performed in accordance with the highest maintenance standard. Standards, schedules, and frequencies may be modified from time to time as deemed necessary by the City for the proper maintenance of the sites.
 Areas of street shall include curb lines along both sides of the roadway or to the edge of pavement where no curb exists, along all curbs on raised medians, over all portions of painted median, painted left and right turn pockets, and all intersection cross-gutters.
 While Contractor is normally responsible for the 8 foot wide strip (sweeper width), curb to curb sweeping, an additional width of street may need to be swept at some locations due to unforeseen circumstances and shall be included within the curb mile price.
 Each street shall be swept clean to the adjacent property line. Swept clean means minimal debris residual or tailings. Any sweeper used must not blow debris onto private property nor drain water onto the street from the rear hopper. Sweeper shall travel with the direction of traffic at all times.  Debris shall not be swept onto residential and arterial driveway aprons, sidewalks, and access ramps. Contractor will be responsible for the manual clean-up of any debris. Clean- up will be completed at time of occurrence at Contractor’s expense.
 Contractor shall remove all loose debris obstructions and material normally picked up and removable by a fully operational street sweeper. This includes, but is not limited to: sand, gravel, glass, nails, bottles, cans, leaves, silt, mud, and litter.
 Noses or ends of curbed medians and arterial intersection turn pockets and arterial intersection center areas and dead spots are to be maintained on the same frequency as the median or intersection for which they are associated and included in the curb mile price.
 Curb returns (radii) at intersections of arterial and residential streets will be swept along their entire length and free of debris on scheduled arterial sweeping days.
 Bulb outs, islands, and City parking spaces need to be cleaned by appropriately sized and style sweeper, in addition hand or blower should be included as part of the regular duties in the sweeping schedule.  Areas to be swept that may cause damage to the Contractor’s equipment used, or any City property equipment used are to be sweep by hand or blower.
 The Contractor shall transport and dispose of all sweepings in accordance with all county, state, and federal requirements. Sweepings are NOT to be unloaded at permanent or temporary storage sites on City, state or federal property within the City boundaries. Contractor shall deliver collected street sweepings to a facility to process waste. The Contractor shall be solely 55728.00300\33359534.1
Exhibit “A”-4 CITYWIDE STREET SWEEPING SERVICES
responsible for all fees involved in the recycling/disposal of sweepings collected in the City. The Contractor shall be solely responsible for all labor, materials, equipment, fees, and expenses to haul debris away. The City will not allow for sweepings to be dumped directly on the ground at the City Yard or stored overnight.
 Water shall be used during all sweeping operations to minimize dust except when otherwise requested by City staff. Water shall be provided by the City at designated hydrant locations. An approved backflow device must be installed on all sweeping trucks to be used in the City. City staff shall train the sweeper operators on the proper operation of the hydrants.  Sweeper shall operate at designated speeds based on recommendations by the equipment manufacturer for optimum sweeping performance (typically 6- 8 mph or less). Due to different street widths throughout the City, street sweeping may require slower travel speed and/or multiple passes by the sweeper, in many cases, to ensure curb-to-curb coverage of the street.

Streets with raised medians (commercial and residential) shall have their curbgutter perimeter swept, including turnouts. Street-grade striped medians shall be swept in their entirety. All deposits within intersections shall be removed as part of the sweeping operations.
 Speeds in excess of designated speed for sweeping will result in a verbal warning for the first violation. A written warning will be given for the second violation, and a “Failure to Perform” notice will be issued upon the third violation. Contractor’s street sweeper drivers shall maintain good safety and driving records, valid operator’s licenses and use extreme caution during all street sweeping operations.
 A significant number of City streets are posted no parking for street sweeping during designated hours on various days of the week. It is imperative that the Contractor maintain a firm schedule for sweeping posted streets, as the Contractor is required to coordinate sweeping operations with City Public Works Department.
 The Contractor is required to correct deficiencies within the time specified by the City. Re-sweeps of the deficient area will not be billed to the City. If noted deficient work has not been completed, payment for subject deficiency shall be withheld for current billing period and shall continue to be withheld until deficiency is corrected, without right to retroactive payments.  No City lot space is available for storage of any Contractor equipment.

Obstructions
Non-swept or items that cannot be picked up by the sweeper such as small tree limbs, palm fronds, rocks, silt, mud, trash and debris shall be removed from the sweeping path by the sweeping operator rather than going around it. Larger obstructions such as impaired vertical and/or horizontal clearance by tree limbs, construction or landscape Contractor debris, etc. shall be immediately reported to City when the location cannot be swept and should be included in the monthly activity report to the City. Contractor 55728.00300\33359534.1
Exhibit “A”-5 CITYWIDE STREET SWEEPING SERVICES
may go around homeowner landscaping debris, and landscape or construction debris only when all of the following conditions are met:
 Source of debris is obvious and not natural accumulation. Debris should be bagged and/or disposed of by party responsible.  Contractor is not responsible for areas missed because of parked vehicles and other personal property such as toys, bicycles and skateboard ramps.

The contractor must notify the Public Works Director or designee, by the end of the workday, if any area was missed due to the conditions listed above.

All sweeping equipment used by Contractor for City shall be compensated at the same curb mile cost.  Equipment shall be no older than five (5) years at any time during the Agreement. When new vehicles are added to the fleet, they shall be models of the latest design and construction and shall not be prototype models. Any changes in the Contractor’s sweeping equipment from the initial equipment must have prior approval from the City. Minimum Sweeping Width Required:

Equipment must be capable of sweeping a minimum eight (8) foot width as measured with all brooms in the sweeping position. Equipment unable to do this is unacceptable.
 Equipment shall be maintained both visually and operationally. Paint and body of street sweeper shall be maintained in good condition with no visible rust or body damage.
 Contractor shall keep accurate records of maintenance and repairs on equipment used in this contract, which shall be available at any time for the City to request. City shall have the right to perform periodic inspections of the 55728.00300\33359534.1

Additionally, a rotating 360 degree safety beacon or comparable traffic safety light is required to be placed on roof of truck cab or atop hopper.

Sweeper equipment operators shall wear personal protective clothing and equipment, including a certified federal and state compliant retro-reflective orange safety vest at all times.
 A rear-mounted left/right arrow stick shall be required for arterial and bike lane sweepers.
 Contractor will comply with all County and local sound control and noise level rules, regulations, and ordinance, which apply to any work performed pursuant to the Contract, and will make every effort to control any undue noise resulting from its operation.
 All equipment used in performance of this contract shall be in compliance with AQMD Rule 1186/1186.1 for less polluting sweepers. Information on the sweepers to be used in the City shall be included with the Contractor’s submitted Proposal response, along with proof of AQMD rule 1186/1186.1 compliance. All equipment shall conform to AQMD PM 10 Standards and include the required dust control components.
 Please note the City does not own a CNG fuel station.  Equipment shall control and remove dust from the surface being swept, and control airborne particles to the maximum extent practicable in compliance with existing AQMD Standards and the Clean Air Act. Policies shall contain or be endorsed to contain such provisions.

1.1.5 Waiver of Subrogation. 1.1.7 Evidence of Insurance. The Contractor, concurrently with the execution of the Agreement, and as a condition precedent to the effectiveness thereof, shall deliver either certified copies of the required policies, or original certificates on forms approved by the City, together with all endorsements affecting each policy. 1.1.8 Failure to Maintain Coverage. In the event any policy of insurance required under this Contract does not comply with these specifications or is canceled and not replaced immediately so as to avoid a lapse in the required coverage, City has the right but not the duty to obtain the insurance it deems necessary and any premium paid by City will be promptly reimbursed by Contractor or City will withhold amounts sufficient to pay premium from Contractor payments. In the alternative, City may cancel this Agreement.

1.1.9 Acceptability of Insurers. Each such policy shall be from a company or companies with a current A.M. Best's rating of no less than A:VII and authorized to transact business of insurance in the State of California, or otherwise allowed to place insurance through surplus line brokers under applicable provisions of the California Insurance Code or any federal law.

1.1.10 Enforcement of Contract Provisions (non estoppel). Contractor acknowledges and agrees that actual or alleged failure on the part of the City to inform Contractor of non-compliance with any requirement imposed no additional obligation on the City nor does it waive any rights hereunder.
