RESOLUTION NO. 2023-07-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, APPROVING THE 2022 MILITARY EQUIPMENT ANNUAL REPORT AND RENEWING ORDINANCE NO. 2022-06-1535, IN ACCORDANCE WITH ASSEMBLY BILL 481 WHEREAS, the City of Signal Hill, California (“City”) is a charter city, duly organized under the California Constitution and laws of the State of California; and WHEREAS, on September 30, 2021, Governor Newsom signed into law Assembly Bill 481 (“AB 481”) to address the funding, acquisition, and use of military equipment, as that term is defined by Government Code § 7070(c), by law enforcement agencies; and WHEREAS, AB 481 seeks to provide transparency, oversight, and an opportunity for public input on decisions regarding whether and how military equipment is funded, acquired, or used; and WHEREAS, Ordinance No. 2022-06-1535 shall be reviewed by the City Council at least annually, and based on an Military Equipment Annual Report that will be submitted to the City Council pursuant to AB 481, the City Council shall determine whether each type of military equipment identified in the report has complied with the standards for continued approval; WHEREAS, in accordance with AB 481, an Military Equipment Annual Report was made available on the Police Department website at least thirty (30) days prior to the City Council meeting; and WHEREAS, in accordance with AB 481, the Military Equipment Annual Report is on the agenda as an open session item at a regular meeting of the City Council, and public comment on the item will be allowed in accordance with the Brown Act.
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. Approve the 2022 Military Equipment Annual Report.
Section 2. Renew Ordinance No. 2022-06-1535 thereby approving the Police Department’s military funding, acquisition, and use policy.
