A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, DECLARING THE CITY MANAGER'S AUTHORITY TO EXECUTE PAYMENT FOR EMERGENCY WATER LINE REPAIR WORK CONDUCTED AT MULTIPLE LOCATIONS WITHIN THE CITY ON JULY 20 AND JULY 21, 2023, IN ACCORDANCE WITH THE PROVISIONS OF SIGNAL HILL MUNICIPAL CODE SECTION 3.20.120 AND ACCEPTING COMPLETION OF THE EMERGENCY WORK WHEREAS, Section 3.20.120(C)(1) of the Signal Hill Municipal Code (“Municipal Code”) defines an “emergency” as “a sudden, unexpected occurrence that poses a clear and imminent danger, requiring immediate action to prevent or mitigate the loss or impairment of life, health, property, or essential public services”; WHEREAS, a series of major water leaks occurred on July 20 and July 21, 2023, leading to significant disruptions and potential risks to residents and businesses; and WHEREAS, the emergency water leak repairs occurred at various locations, including the intersection of Junipero Avenue and E. 28th Street, 2031 Raymond Avenue, 3259 Walnut Avenue, and 2603 E Pacific Coast Hwy; and WHEREAS, despite efforts by City crews and staff, the extent and urgency of the repairs required collaborative efforts with prime contractors and subcontractors to ensure prompt and effective resolution of the emergencies; and WHEREAS, the repairs were completed through the combined efforts of RP Vititow Construction, WA Rasic Construction, Doty Bros, and several subcontractors; and WHEREAS, the emergency water repairs were successfully completed by July 22, 2023, effectively restoring water supply and mitigating potential harm to the community; and WHEREAS, pursuant to Section 3.20.120(C)(2) of the Municipal Code, the City Manager has the authority to make an emergency determination and immediately procure contractors without following the procurement procedures in Chapter 3.20 of the Municipal Code to perform the emergency work and execute payment for the emergency repair work performed by the aforementioned contractors and subcontractors, up to $100,000; and WHEREAS, pursuant to Section 3.20.120(C)(2) of the Municipal Code, the City Council has the authority execute payment for the emergency repair work performed by the aforementioned contractors and subcontractors, in excess $100,000; and WHEREAS, the funds for the emergency repair work are available within the Water Department Repair and Maintenance Services Account No. 500-40-5560.
NOW, THEREFORE, the City Council of the City of Signal Hill, California, does hereby resolve as follows:
Section 1. That the City Manager is authorized to execute payment for the emergency water repair work performed by RP Vititow Construction, WA Rasic Construction, Doty Bros, and their subcontractors, for a total not-to-exceed amount of $250,000.
Section 2. That the funds for the payment shall be drawn from the Water Department Repair and Maintenance Services Account No. 500-40-5560.
Section 3. It is further ordered that the City Manager shall ensure proper documentation and accountability for the payment of emergency repair work.
