RESOLUTION NO. 2024-08-XXXX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, ACCEPTING CERTAIN EASEMENT TO THE CITY OF SIGNAL HILL FOR THE PURPOSES OF CONSTRUCTING AND MAINTAINING A BLOCK WALL ACROSS CERTAIN REAL PROPERTY AT ASSESSOR PARCEL 7211-021-001 WHEREAS, in 2020, the Signal Hill Police Department identified ongoing issues concerning unauthorized access of pedestrian traffic through a City public alley located south of Burnett Street between California Avenue and Lewis Avenue into an adjacent private property in the City of Long Beach; and WHEREAS, this unauthorized access has resulted in numerous incidents of trespassing, public nuisances, and theft, causing significant concern for the City of Signal Hill, the City of Long Beach, neighboring residents, and business owners; and WHEREAS, in 2023, the Public Works Department of the City of Signal Hill, after coordination with Kreuzer Engineering, prepared engineered drawings and specifications for the construction of a masonry block wall at the southern end of the City alley to effectively address and mitigate these issues; and WHEREAS, it was determined during the plan design process that, due to the alignment of the public alley, a portion of the wall would need to be constructed on private property on a portion of Assessor Parcel Number 7211-021-001 (hereinafter referred to as the "Property"); and WHEREAS, the property owner has agreed to grant an easement to the City of Signal Hill to facilitate the construction and maintenance of the block wall on the aforementioned property as set forth in the grant of easement deed; and WHEREAS, the City Council of the City of Signal Hill does here by find and determine that it is in the best interest of the City of Signal Hill to accept the easement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Signal Hill that the Easements described in Exhibit “A” and depicted in Exhibit “B”, are hereby accepted for public easement purposes in accordance with California Street and Highway Code Section 1806(b), and said property is located in the City of Signal Hill in the County of Los Angeles, State of California.
BE IT FURTHER RESOLVED that the City Clerk in the City of Signal Hill be instructed to record a certified copy of this Resolution and that the Public Works Department be instructed to coordinate with the property owner to record an executed easement deed on the property in a form approved by the City attorney in the Los Angeles County Registrar-Recorder/County Clerk’s office and to provide a certified copy of the recording to the City.
