ORDINANCE NO. 1344
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SIMI VALLEY AMENDING SECTION 6 -3.16 OF THE SIMI
VALLEY MUNICIPAL CODE INCREASING THE
FRANCHISE FEE FOR WASTE DISCARDS COLLECTION
WHEREAS, the City Council considered an Amended and Restated Franchise Agreement (Agreement) with G.I. Industries for the collection waste discards ; and
WHEREAS, the current franchise fee for discards collection in the Simi Valley Municipal Code (SVMC) provides for a fee of not more than eight percent (8%) ; and
WHEREAS, the Agreement approved by the City Council provides for a franchise fee of ten percent (10%); and
WHEREAS, the City Council desires to amend the SVMC to reflect the new franchise fee.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SIMI VALLEY DOES ORDAIN AS FOLLOWS:
SECTION 1
. The City Council has approved an Agreement with G.I.
Industries for the collection of discards that includes a franchise fee of ten percent (10%) of gross revenues.
SECTION 2 . Sections 6- 3.16(a)(2), 6 -3.16(b)(2), and 6 -3.16(c)(2) are hereby amended to allow for a franchise fee of not more than ten percent (10%) of gross revenues.
SECTION 3. The City Clerk shall cause this ordinance or a summary hereof to be published in a newspaper of general circulation, published in the County of Ventura and circulated in the City, and if applicable, to be posted, in accordance with Section 36933 of the California Government Code; shall certify to the adoption of this ordinance and shall cause a certified copy of this ordinance, together with proof of publication, to be filed in the Office of the Clerk of this City.

SECTION 4. This ordinance shall go into effect and be in full force and effect at 12:01 a.m. on the thirty-first (31st) day after its passage.
