STAFF RECOMMENDATION
It
is recommended the City Council authorize the procurement of education, outreach, and enforcement activities utilizing the Department of Resources Recycling and Recovery (CalRecycle) SB 1383 Local Assistance Grant funds received in FY 2021- 2022, and approve a supplemental budget request in the amount of $176,441, in the General Fund (Fund 100), to establish expenditure authority.

BACKGROUND AND OVERVIEW
In
2017, the California State Legislature adopted SB 1383, establishing target reductions in organi c disposal of 50% by 2020 and 75% by 2025. Additionally, SB 1383 requires a minimum of 20% of edible food products be recovered from specific generators as food for humans. On January 4, 2022 , CalRecycle made funding available to assist in the implementation of SB 1383 State mandated organic waste recycling requirements. The City of Simi Valley received a one-time award amount of $176,441, the maximum amount eligible.

FINDINGS AND ALTERNATIVES
The S
tate’s organic waste recycling mandates on local jurisdictions include increased education and outreach, inspections, reporting, as well as potential equipment costs and upgrades. The CalRecycle SB 1383 Local Assistance Grant program is a non-competitive grant that provides funding to local jurisdictions to assist with the implementation of the following requirements:

• Enforcement and Inspection
• Program Evaluation/Gap Analysis
• Procurement Requirements
• Record Keeping
Under Resolution No. 2016-05 (Attachment A, page 4), City Council authorized staff to apply for CalRecycle grants to assist with various S tate program implementation. The SB 1383 Local Assistance grant has a two-year period in which the monies must be spent.

Staff will use the funding to promote recycling activities as well as community awareness and education initiatives related to organics recycling, utilizing the City’s social media platforms, local news resources, and community outreach. Staff will also develop material that will educate businesses, schools, and multi-family complexes about compliance with SB 1383 Organic Waste Recycling requirements.

During the application process, staff tentatively identified how the funds would be expended (Attachment B, page 6). The primary aim of SB 1383 is to divert 75% organic material fr om landfills by 2025. With a portion of these grant funds, s taff plans to implement a residential compost bin purchasing program. The goal of this program is to divert organic material at the source, resulting in a reduction of greenhouse gasses.

Additionally, staff will implement a new and enhanced public outreach campaign specific to organic waste recycling, consisting of digital media, newspaper articles, social media, as well as mailings. The grant funds can additionally be used to offset the increase of staff time, new software purchases, edible food recovery efforts, and equipment needs.

The following alternatives are available to the City Council:

1. Authorize the procurement of education, outreach, and enforcement activities utilizing the Department of Resources Recycling and Recovery (CalRecycle) SB 1383 Local Assistance Grant funds received in FY 2021-2022;

2. Approve a Supplemental Budget Request in the amount of $176,441, in the General Fund (Fund 100), to establish expenditure authority;

3. Provide other direction to staff.

Staff recommends Alternative No. 1 and 2.
