CITY OF SIMI VALLEY

MEMORANDUM
M
ay 1, 2023
TO
: City Council
Board of Directors, Ventura County Waterworks District No. 8 F
ROM: Department of Public Works
S
UBJECT: SECOND AMENDMENT(S) TO CONTRACTS FOR THE PURCHASE OF ONE (1) 2022 INTERNATIONAL CHIPPER TRUCK, ONE (1) 2022

INTERNATIONAL TRUCK CHASSIS FOR THE LANDSCAPE DIVISION, ONE (1) 2022 INTERNATIONAL DUMP TRUCK, AND ONE (1)

INTERNATIONAL TRUCK CHASSIS FOR THE WATERWORKS DIVISION

UTILIZING THE SOURCEWELL COOPERATIVE AGREEMENT

STAFF RECOMMENDATION
I
t is recommended that the City Council/Board of Directors approve the attached second amendments to the contracts with Gibbs International Truck Center (Gibbs) for the replacement of four (4) Public Works vehicles.

BACKGROUND AND OVERVIEW
O
n April 5 , 2021, the City Council /Board of Directors awarded Gibbs four (4) contracts to purchase Public Works replacement vehicles ; o ne (1) International Chipper Truck, one (1) International Truck Chassis for the Landscape Division, one (1) International Dump Truck , and one (1) International Truck Chassis for the Waterworks Division. The four (4) replacement vehicle contracts utilized a Sourcewell Cooperative Agreement. However, similar to many vendors, Gibbs has experienced significant cost increases related to materials, freight, and new emissions regulations. Due to nationwide vehicle supply shortages, Gibbs could not provide the replacement veh icles within the original contract term, and the contracts expired. On January 23, 2023 , the four contracts were reinstated and amended which included increasing the not-to-exceed amount to a total of $514,867.15 and extending the term to June 30, 2023. Due to the continued nationwide vehicle shortage, Gibbs is again unable to furnish the four replacement vehicles during the contracts' first amended term. However, the parties desire to continue their contractual relationship and further extend the contract term so that the City/District m ay complete the anticipated vehicle purchases. Gibbs expects delivery of the four vehicles during FY 2023-24.

AGENDA ITEM NO.

Consent (7)
In summary, staff requests that the term for all four contracts be extended to June 30, 2024, and that Contract No. 3 for the International Dump Truck be increased by $4,000.

FINDINGS AND ALTERNATIVES
Sourcewell Contract No. 060920-NVS with Navistar Inc. (Navistar) is valid through August 1, 2024. Navistar does not sell directly to municipalities, and purchases are made through local distributor Gibbs, located in Oxnard, C alifornia, and is the contracted International Truck dealer for Ventura County under this contract.

The City’s Purchasing Ordinance 2-9.201(f), authorizes using the cooperative purchasing method such as Sourcewell, recognizing the efficiency in staff time and the very competitive pricing usually available.

The original negotiations with Gibbs allowed for a $7,500 trade allowance to purchase (1) new International Dump Truck. On January 26, 2023, staff was informed of an engine failure on Waterworks dump t ruck vehicle No. 452. Gibbs has agreed to take trade allowance on the Waterworks dump truck at a reduced rate of $3,500, for a total increase of $4,000.

As a r esult o f t he pending expirati on o f the F irst contract amendments, t he f ollowing summarizes the second contract amendments for each vehicle:

Contract No. 1 (page 5): Purchase of one 2022 International Chipper Truck; Landscape vehicle No. 499 replacement. Extend the term of the contract to June 30, 2024.

Contract No. 2 (page 7): Purchase of one 2022 International Truck chas sis with transfer of existing equipment; Landscape vehicle No. 486 replacement. Extend the term of the contract to June 30, 2024.

Contract No. 3 (page 9): Purchase of one 2022 International Dump Truck; Waterwor ks vehicle No. 452 replacement. The first contract amendment not-to-exceed amount was $131,554.52. The price increased by $ 4,000, for a total not -to-exceed amount of $135,554.52. Extend the term of the contract to June 30, 2024.

Contract No. 4 (page 11): Purchase of one 2022 International Truck chassis with transfer of existing equipment; Water works vehicle No. 512 replacem ent. Extend the term of the contract to June 30, 2024.

The amount of first amendment s to the four contracts combined does not exceed $514,867.15; these contracts are attached for the City Council’s reference. The total price increase for the engine failure on Waterworks vehicle No. 452 is $4,000 and the amended contracts total is $518,867.15. The Waterworks Division has sufficient funding to cover the cost increase. Consequently, the not to exceed amount of contract No. 3 needs to be adjusted accordingly.

SUMMARY
O
n April 5, 2021, the City Council awarded four (4) contracts to Gibbs for the purchase of Public Works replacement vehicles. Two (2) International Trucks for the Landscape Division and two (2) International Trucks for the Waterworks Division. The replac ement vehicle contracts utilized a Sourcewell Cooperative Agreement. However, similar to many vendors, Gibbs have had significant cost increases related to materials, freight, and new emissions regulations. Due to nationwide vehicle supply shortages, Gibbs was not able to provide the replacement vehicles within the amended contract term, and the contracts will expire on June 30, 2023. Staff is requesting the City Council approve the second contract amendments with Gibbs in the amount of $ 4,000 and extend the term to June 30, 2024.
