ECT: REINSTATE AND AMEND SIX PROFESSIONAL SERVICES
CONTRACTS FOR ON-CALL ENGINEERING DESIGN SERVICES, RFQ
PW 21-04
STAFF RECOMMENDATION
It is recommended that the City Council reinstate and approve amendments to contracts with Bengal Engineering, Inc., Huit t-Zollars, Inc., and Kimley -Horn and Associates , extending the term of the contracts retroactively effective from February 14, 2023, to February 14, 2024, for professional on-call engineering design services.
BACKGROUND AND OVERVIEW
On February 14, 2022, the City Council awarded three consultants professional service con tracts for on- call engineering design services for the Public Works Department. Each consultant was awarded two contracts, one for federally funded projects and one for non- federally funded projects. The Department does not maintain staff for certain specialized engineering services due to the fluctuating workload of projects and fund availability. To streamline the consultant selection process, on-call contracts for professional services have been utilized.
The Department contracts with multiple firms in the event one consultant becomes unavailable due to workload, a conflict of interest, or the need for third- party peer review. Although each contract allows for contract amendment s t o extend the contracts for up to two additional one-year terms, the contracts expired before their terms could be extended for another year. The parties desire to continue their contractual relationship by reinstating the original agreements and extending their term so that the City may complete t he anticipated work in the upcoming year.
FINDINGS AND ALTERNATIVES
Staff recommends that the contracts with Bengal Engineering, Inc., Huitt-Z ollars, Inc., and Kimley-Horn and Associates be reinstated and amended extending the term of the contracts retroactively effec tive from February 14, 2023, to February 14, 2024. These are professional s ervices contracts for on-call engineering design services. Each entity has two (2) contracts at issue; one for federally funded projects and for non-f ederally funded projects . All three consultants have revis ed their Schedule of Fees which hav e been added in the attached amendments. Lastly, Kimley-

Loaded Hourly Billing Rates
3. The billing rates shown in this cost proposal for field staff entitled for PW rates are calculated with estimated fringe benefits of the staff. The actual billing rates to be used in the invoices will be calculated by using the actual PW fringe benefits of the individual staff in accordance with the certified benefits statement submitted with each invoice.
For Managers: On weekdays up to a maximum of 8 hours will be charged for work time, travel time or any combination of travel and work time. Billing Rate = Loaded Rate Formula "C" above.
For Exempt staff: During regular work day, actual travel time not to exceed 8 hours in any one day or one way travel will be billed as follow:
Billing rate for travel time = Loaded Rate Formula "C" above.
All travel time, outside of the regular work day, will be billed without the application of overhead rate as follow: Billing Rate = (Actual Hourly Rate) (1+ Fee) + (Delta Base + Delta Fringe)
4. The employees' actual hourly rates shown in this cost proposal are the rates that were effective on xx/xx/xx. Caltrans Contract Manager's pre-approval is required for addition of staff not previously listed on the cost proposal. The billing rates for these employees, including those that fall under general classifications, will be calculated and reimbursed based on their actual hourly rates on xx/xx/xx. Hourly rates for new employees hired after the date of this cost proposal will not exceed (or shall be in line with) the rates of similar personnel listed on this cost proposal having similar experience.
