STAFF RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 2023-37 (page 5) to accept a $220,380 grant award from the FY 2023-24 State of California, California Highway Patrol (“CHP”) Cannabis Tax Grant P rogram, au thorize all expenditur es referenced in the grant agreement (page 8), including purchase of a new Traffic Bureau fleet vehicle, and approval to increase the Police Department fleet size by one (1) additional vehicle, au thorize the City Manager, or designee, to sign all grant related documents, and approve a Supplemental Budget Request in the amount of $220,380 for Fund 287, Law Enforcement Grants Fund, with an inter-f und transfer to the General Fund (100) for Salary Reimbursements of all personnel instructor/ training and backfill costs.
BACKGROUND AND OVERVIEW
In January 2023, staff applied for the State of California CHP Cannabis Tax Grant to cover the cost of officers/instructors to teach Standard Field Sobriety Test (“SFST”), Advanced Roadside Impaired Driving Enforcement (“ARIDE”), Drug Recognition Expert (“DRE”) recertification/field certification and DRE Instructor Training. Additionally, the grant will fund attendance at t he Governors Highway Safety Conference and annual California Narcotic’s Officers Association Conference, which are both resources for current trends in drugged/DUI driving and best ways to combat those problems on the roadways. The grant will also provide funds to cover backfill costs when officers attend DUI alcohol/DUI drug related trainings and to purchase and outfit a new patrol enforcement vehicle
AGENDA ITEM NO.
Consent (8)
used for DUI related activities. In June of 2 023, the City was notified that it was successful in its application with CHP and was awarded $220,380.
FINDINGS AND ALTERNATIVES
Current prosecutorial procedures require a Drug Recognition Expert (DRE) to perform an evaluation of all subjects suspected of driving under the influence of drugs (“DUI”).
The Simi Valley Police Department currently has 8 of its allotted 123 officers trained as a DRE. The Simi Valley Police Department is in need of additional DRE trained officers to efficiently fulfill the prosecutorial procedures. Additionally, it is imperative to keep up to date on traffic related trends to better serve t he community and prevent impaired driving.
It was determined that the CHP Cannabis Tax Grant provides l aw enforcement grants to allied agencies for the education, prevention, and enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis. The intent of the program is to educate the public regarding the dangers of impaired driving, enforce impaired driving laws on the roadway, improve the agency’s effectiveness t hrough training, and aid in the development of new strategies.
This grant provides for reimbursement of salary and benefits of instructors’ time to teach SFST, ARIDE, and provide DRE certification/recertification to the Department’s officers.
Having the capabi lity to teach this program in-house is imperative. Reimbursement of backfill costs will also be available through the grant when the City sends officers to DUI alcohol/drug related training. This grant will also provide funding to attend the annual Governors Highway Safety Confer ence and the California Narcotic’s Officers Association Conference, which discusses current drug/alcohol trends related to driving and provides ways to combat the issue on the roadways. The grant will also provide funding to purchase and outfit a new police enforcement vehicle, which will be used specifically for enforcement related to driving under the influence of drugs and/or alcohol.
The Simi Valley Police Department's goal is to continue to train officers in the area of DUIs to protect Simi Valley re sidents from impaired drivers. T he City is currently experiencing more collisions involving intoxicants aside from alcohol. Grant funds will be utilize d to reimburse the City’s General Fund for costs associated with this training/certification, education in traffic trends associated with impaired driving, and a new patrol/enforcement vehicle to be used for DUI alcohol/drug enforcement. No City match is required and all funds are planned for expenditure by the deadline of June 30, 2024.
To proceed, the City Council must approve Resolution No. 2023-37 accepting the grant award from CHP’s Cannabis Tax Fund Law Enforcement Grant Program; authorize the City Manager to execute all grant related documents; and approve a Supplemental Budget Request of $220,380 for Fund 287 with a transfer to the General Fund (100) for Salary Reimbursements of all personnel Instructor costs. 2 Th

Project Description
The Simi Valley Police Department has seen an increase in the number of DUI related collisions over the past years. As these numbers have risen and the population of the city has grown, the department resources have remained the same. In order to combat this increase in DUI related collisions, the Simi Valley Police Department is requesting funds from the Cannabis Grant Unit to assist with providing DUI related training to our Simi Valley Police Department Officers, provide SFST, ARIDE and DRE Instructors to assist with trainings throughout Ventura County, host DUI related trainings at the Simi Valley Police Department open to all California Law Enforcement agencies, conduct DUI Saturation patrols and conduct DUI/DL Checkpoints.
Funds would also be used to pay overtime to officers who have to backfill the vacancies created when officers attend DUI related trainings and/or conferences. The Simi Valley Police Department would also use funds from this grant to send two Simi Valley Police Department traffic Officers to the annual GHSA Conference being held in New York August 13-17, 2023, and three Simi Valley Police Department traffic officers/DRE Officers to the annual CNOA Conference being held in Reno, Nevada November 17- 21, 2023. Both conferences offer numerous classes specifically related to impaired driving trends, resources, and ways to detect impaired drivers. These trainings are crucial for officers whose primary job is to conduct traffic enforcement activities specifically related to DUI detection and investigation. Funds from this grant would also be used to purchase one (1) Simi Valley Police Department marked police vehicle which would be used primarily by Simi Valley Police Department traffic officers while they are conducting DUI related activities.
These vehicles would be used for all grant funded DUI Saturation patrols, DUI/DL Checkpoints, travel to and from DUI related trainings, and would be marked with a "DUI Enforcement Vehicle" decal. With this funding, we will have the ability to train more Simi Valley Police Department officers, provide instructors to assist with DUI related training throughout the County of Ventura, provide DUI related training to other Law Enforcement agencies, conduct DUI specific enforcement activities, and have vehicles dedicated to these DUI enforcement activities. These activities will help identify DUI offenders and remove them from the roads making the City of Simi Valley safer for all its residents and anyone who drives on the city streets.
Problem Statement & Proposed Solution
Problem Statement
The Simi Valley Police Department along with other law enforcement agencies, have seen a noticeable increase in the number of DUI related collisions and the number of DUI drivers being contacted on the roadways. Since 2020, the Simi Valley Police department has averaged approximately 70 DUI Collisions per year. An average of 20 of those collisions per year have caused injuries or death to individuals involved. From January 1, 2021 through December 31, 2022, officers with the Simi Valley Police Department have made approximately 320 DUI related arrests. Even with the high number of DUI related arrests, we are still seeing the number of DUI related crashes increase. Based on information obtained through UC Berkley's Transportation Injury Mapping System (TIMS) database, from 2016 through 2020, Ventura County is one of the Top 20 (#18) counties in California for DUI Drug Involved collisions, one of the Top 10 (#6) counties in California for Drug Involved Fatalities, and one of the Top 5 (#4) counties in California for Alcohol Involved Fatalities. As it relates to the City of Simi Valley specifically, the TIMS database shows the City of Simi Valley has had an increase in the number of DUI-Alcohol related crashes and DUI Drug related crashes from 2020 to 2021. The TIMS Database also indicates our percentage of DUI Alcohol and Drug Related crashes is consistent with or higher than the State of California average.
Proposed Solution
These documented increases indicate the need for Simi Valley Police Department officers to focus on DUI enforcement. To accomplish this goal, more officers in our agency need to be trained in SFST, ARIDE, and DRE. Out of 125 sworn officers, we currently only have 64 trained in SFST, 39 trained in ARIDE, and 10 15 Schedule A
trained in DRE. The money received from this grant would help us send officers to SFST, ARIDE, DRE, and DRE Re-certification training as well as provide funds to cover the costs of backfill for the officers who are going to training. These funds would also be used to cover the overtime costs incurred by our SFST, ARIDE, and DRE instructors who help conduct DUI related training classes at other law enforcement agencies throughout the County of Ventura. Funds would also be used to pay overtime to officers who have to backfill the vacancies created when officers attend DUI related trainings and/or conferences. Along with the increased training, the Simi Valley Police Department would use funds to conduct two (2) DUI/DL Checkpoints and conduct ten (10) DUI Saturation Patrols. The DUI Saturation patrols along with the DUI/DL Checkpoints would allow for extra officers to conduct DUI related enforcement without having to handle regular calls for service. Due to current budget cuts within the Police Department, along w ith an unexpected increase in the number of police vehicles which have been damaged beyond repair, the Simi Valley Police Department would also use these funds to purchase two police/patrol vehicles which would be used primarily for DUI enforcement activities, DUI/DL Checkpoints, and transportation to and from DUI related training. The purchase of these vehicles would ensure officers working grant funded DUI related enforcement details would have a police vehicle to use. Currently, if all police/patrol vehicles are being used by patrol officers during their normal patrol shifts, we are not able to conduct DUI related enforcement activities.
Performance Measures/Scope of Work
PERFORMANCE MEASURES/SCOPE OF WORK
Training
If funding is provided to the Simi Valley Police Department the funds will be used to send Simi Valley Police Department officers to DUI related training classes (SFST/ARIDE/DRE /DRE-Recertification/ DRE Instructor).
Officers would attend these classes as soon as the classes are available during the grant period. It would be our goal to have at least two officers attend one of the above listed DUI related trainings every quarter. We will be able to measure the effectiveness of this performance measure by increasing the number of SFST/ARIDE/DRE/ certified officers in our agency.
Funding would be used to host DUI related trainings at the Simi Valley Police Department which would be open to Simi Valley Police Department officers and officers from other Law Enforcement agencies. It would be our goal to host at least one DUI related training class each quarter. We will be able to measure the effectiveness of this performance measure by documenting the number of law enforcement officers who attend and successfully complete the training.
Funding for the GHSA conference would be used during the first quarter to send two traffic officers and/or traffic sergeants/commanders to the annual conference to learn about current DUI related trends and ways to combat the DUI problem. The two officers attending this conference would be able to bring the information back to all other officers at the agency and find a way to share this information in the training classes presented at our agency. The effectiveness of this performance would be measured by completing training bulletins to be distributed to officers at our agency and officers who attend trainings at our agency.
Funding for the CNOA conference would be used during the second quarter to send three traffic officers/sergeants to the annual conference to learn about current alcohol and drug trends which effect driving and how best to detect these violators. The three officers attending this conference would be able to bring the information back to all other officers at the agency and find a way to share this information in the training classes presented at our agency. This effectiveness of this performance would be measured by completing training bulletins to be distributed to officers at our agency and officers who attend trainings at our agency.
Funding received to cover the backfill costs will be used to pay overtime to officers who are covering vacancies created when officers are attending DUI related training, instructing DUI related classes and attending the GHSA and CNOA conferences. This performance would begin in the first quarter of the grant and continue throughout the grant period. This performance would be measured by the number of overtime vacancies created when officers attend training or assist with instructing DUI related training.
DUI Related Enforcement Activities
Funding received for DUI/DL checkpoints would be used during the second and third quarters of the grant period. The goal would be to conduct one DUI/DL checkpoint during the second quarter and one DUI/DL checkpoint during the third quarter. While conducting these checkpoints, the Simi Valley Police Department would keep count of all vehicles which came through the checkpoint and all drivers contacted. Information 16 Schedule A
regarding the number of DUI arrests and other violations would also be documented and reported. These DUI/DL checkpoints would allow us to contact a large number of drivers and educate them regarding the dangers of driving under the influence of alcohol and/or drugs. These checkpoints would also allow officers to locate drivers who are driving under the influence of alcohol and/or drugs. The effectiveness of this performance will be measured by the number of DUI related collisions and the number of DUI drivers arrested during this grant period compared to the number of DUI drivers arrested during the same time from one year prior.
Funding received for DUI Saturation patrols would be used during all quarters of the grant period. It would be the goal of our agency to conduct at least one DUI Saturation patrol per month (three per quarter). The funding would allow for officers to be specifically assigned to DUI enforcement activities without being tasked to respond to any other calls for service during their shift. This would ensure these officers are concentrating enforcement activities on locating individuals driving under the influence of alcohol and/or drugs. These DUI Saturation patrols would be conducted during days and times when the likelihood of DUI driving is increased.
The officers conducting these patrols will keep a log of all contacts, citations, and arrests. The effectiveness of this performance will be measured by the number of DUI related collisions and the number of DUI drivers arrested during this grant period compared to the number of DUI drivers arrested during the same time from one year prior. It is the hope of the Simi Valley Police Department to reduce the number of DUI related arrests and collisions by a minimum of 10% during this grant period compared to last year (July 2022- June 2023).
Equipment
Funding received for one new police vehicle would be used to purchase and equip one marked black and white police vehicle to be used primarily for DUI enforcement activities, DUI/DL Checkpoints, and transportation to and from DUI related trainings. When this vehicle is not used for these specific activities, it will be used by members of the Simi Valley Police Department's Traffic Bureau whose main function is to conduct traffic enforcement activities, identify and arrest drivers driving under the influence of alcohol and/or cannabis, as well as investigate collisions. When not actively investigating collisions, the officers in the traffic bureau are constantly looking for DUI drivers and taking appropriate enforcement action when they locate a driver who may be under the influence of alcohol and/or cannabis. This vehicle will be marked with a "DUI Enforcement Vehicle" decal to indicate the primary use of the vehicle. As with many other police agencies throughout the State of California, the Simi Valley Police Department has seen a decrease in funding which has made it difficult to purchase new enforcement vehicles and maintain the enforcement vehicle we currently have. This vehicle would be solely used by officers in the traffic bureau whose primary function is the identification of impaired drivers and removing them from the roads. From the date of grant approval by the City of Simi Valley City Council, the vehicle could be purchased, outfitted and ready for use within approximately three to five months dependent on supply availability. This goal will be easily measured by the Simi Valley Police Department obtaining the vehicle and putting it on the road to be used.
Project Performance Evaluation
Throughout the period of the grant, the Simi Valley Police Department will use press releases, social media, and community outreach events to promote the project and educate the community regarding the project.
Some examples of ways to communicate with internal and external stakeholders regarding the project would be to issue press releases or use social media to inform the community about when officers will be conducting extra enforcement activities related to the grant. After the enforcement activities, the Simi Valley Police Department could use the same communication methods to talk about the outcome of the extra enforcement activities. The Simi Valley Police Department will also communicate with the community members while conducting DUI/DL Checkpoints by talking with drivers and providing all drivers with fliers, which provide some education regarding the dangers of driving under the influence of drugs and/or alcohol. At the conclusion of the grant cycle, the Simi Valley Police Department will have statistics available regarding all grant related activities and the enforcement/violations, which were documented. A comparison of the number of DUI arrests/collisions compared to the same time as the year prior will indicated the successfulness of the grant activities.
Program Sustainability
Should grant funding be drastically reduced or rescinded, the Police Department's only option would be to request additional funding during the yearly budget process. Depending on the state of the economy (Local, State, National) funding may or may not be granted.
17 Schedule A
The most important part of this grant is the ability to train as many of our police officers as possible. The funding received from this grant would allow us to provide DUI related training to a large percentage of our agency during a time when funding is scarce. After training our officers, they will then be equipped with the knowledge and abilities to go and enforce the DUI related laws. The ability for more officers to be confident in identifying possible DUI drivers, and then having the confidence to conduct a DUI investigation could have a significant impact in reducing the number of DUI drivers on our city streets and the number of DUI related crashes.
Attending the GHSA Conference and the CNOA Conference would allow officers to understand "Vision Zero" more effectively and learn about the different ways other agencies and states are attempting to reduce traffic collisions and DUI's.
The ability to fund DUI specific patrols would also have a significant impact on the DUI crashes in our community. Right now, officers are only looking for DUI drivers when they are not having to handle other calls for service or completing paperwork associated with those calls. Officers specifically assigned to DUI enforcement would allow more DUI drivers to be identified prior to being involved in a collision.
Administrative Support
The Simi Valley Police Department is currently receiving grant funds from the Office of Traffic Safety (OTS) and from the Cannabis Tax Fund Grant Program (CTFGP). We have been receiving funds from t he OTS grant for more than five years and from the CTFGP grant for two years. The Traffic Bureau Supervisor and the Police Department's Administrative Officer maintain both grants. Both grants have been working seamlessly together and have helped the agency significantly. Out fiscal services unit handles all financial documentation and expenditures as well as budget reporting. The Traffic Bureau supervisor handles the daily operation of the grants as well as organizing and reporting on all grant activities. The City of Simi Valley City Council and executive staff support the grant and appreciate the grant funding. 18 Schedule B
