BACKGROUND AND OVERVIEW

The California Department of Resources Recycling and Recovery (CalRecycle) offers the Rubberized Asphalt Concrete Pavement Grant Program pursuant to Section 42870, et seq. of the Public Resources Code. The purpose of the grant program is to promote markets for rubberized pavement products derived from 100% recycled California -generated waste tires. On October 14, 20 19, the City Council adopted Resolution No. 2019-38, authorizing the City Manager to execute applications and related agreements with CalRecycle for the Rubberized Asphalt Concrete Pavement Grant Program. The City submitted a grant application for the FY 2019-20 CalRecycle grant program for $154,932.50 and the City received two payments totaling $154,932.50 ($36,466.02 and $118,466.48). In FY 2021 -22, the CalRecycle grant application was $250,000. The City received two payments totaling $250,000 ($201,975.61 and $ 48,024.39). The total grant funds received for FY 2019-20 and FY 2021-22 is $404,932.50. On December 5, 2022, the City Council accepted prior year’s grant awards that totaled $379,349.87; therefore, an

additional request to accept grant funds and a supplementa l budget request of $25,582.63 is needed in the Major Streets Rehabilitation Program.

FINDINGS AND ALTERNATIVES

In May of 2021, the initial $36,466.02 grant funds received from CalRecycle were placed in the General Fund (Fund 100) and subsequently moved into the General Fund balance.

To utilize these funds, staff recommends the appropriation of $36,466.02 into the General Fund (Fund 100) and an inter-fund transfer of the same amount from the General Fund (Fund 100) to the Streets and Roads Fund ( Fund 600). In accordance with CalRecyc le grant guidelines, cities are not allowed to apply for funds in consecutive years. Staff recommends using these funds for this year’s Major Streets Rehabilitation Program.

The following alternatives are available to the City Council:

1. Accept Rubberized Asphalt Concrete Pavement G rant funds of $25,582.63 from the California Department of Resources and Recovery (CalRecycle);

2. Approve a supplemental budget request to adjust the Streets and Roads Fund (Fund 600), add $25,582.63 to the Major Streets Rehabilitation Program Expense Budget, and approve an appropriation of $36,466.02 into the General Fund (Fund 100) and an inter-fund transfer of $36,466.02 from General Fund (Fund 100) to the Streets and Roads Fund (Fund 600).

3. Provide staff with other direction.

Staff recommends Alternative Nos. 1 and 2.
