TRANSPORTATION DEVELOPMENT ACT CLAIM FOR LOCAL
TRANSPORTATION FUND ARTICLE 4 , STATE TRANSIT ASSISTANCE

FUNDS, AND STATE OF GOOD REPAIR FUNDS WITH THE VENTURA

COUNTY TRANSPORTATION COMMISSION AND AUTHORIZE THE

CITY MANAGER TO APPROVE FUTURE BUDGET AMENDMENTS

RELATED TO THE RECEIPT OF FUNDS

STAFF RECOMMENDATION
It is recommended the C ity Council adopt attached R esolution No. 202 3-50 (page 4 ) authorizing the City Manager to execute and file the FY 20 23-24 Transportation Development Act (TDA) C laim for Local Transportation Fund (LTF) (A rticle 4 ), State Transit Assistance (STA) funds, and State of Good Repair (SGR) funds with the Ventura County Transportation Commission (VCTC), and authorize the City Manager to approve future budget amendments related to the receipt of the funds.

BACKGROUND AND OVERVIEW
The California State Legislature enacted the TDA (Public Utilities Code Section 99200, et seq.) in 1971, which created an LTF for each County in the State. As a result of California Senate Bills 716 and 203, LTF funds received by the City as of July 2014 are to be allocated solely for the operation of public transportation systems. Annually, Simi Valley Transit prepares a claim and submits it to VCTC t
o receive the new funds (Attachment A page 6) for the FY 23-24 claim.

FINDINGS AND ALTERNATIVES
TDA funds are comprised of two separate revenues: Local Transportation Fund (LTF) and State Transit Assistance (STA). LTF funds a wide variety of transportation programs, including planning and program activities, community transit services, public transportation, and bus and rail projects. However, STA funds can only be used for transportation planning and mass transportation purposes.

TRAN2348.SR.TDA.JK
With respect to TDA/LTF, the S tate collects a ¼ cent sales taxes in every county. The funds are then returned to the county of origin, and within the county, are distributed to the cities and the unincorporated county based on population. If there is a transit district, it receives all the funds attributable to the cities within the district. In Ventura County, VCTC is the transit district and has the oversight of the funds distribution. VCTC also maintains a reserve amount of funds to prepare for any downturns in the economy. The funds apportioned to Simi Valley must be used for transit, but are flexible and can be used for operating and capital expenses. Additionally, t he funds can be used to provide the required local match for federal transit grants. Attachment B (page 10) shows the final FY 2023-24 LTF apportionments of A rticle 4 provided by VCTC to unincorporated Ventura County and its ten cities. The amount allocated for Simi Valley is $6,236,663.

State Transit Assistance (STA) funds are allocated by formula to each “Transportation Planning Agency” (TPA), including the allocations to each transit operator. The TPA, in Simi Valley’s case, VCTC, distributes the funds like TDA. The STA funds can be used in a m
anner similar to TDA funds, and can be used for transit capital infrastructure and operational costs. The FY 2023-24 State allocation of STA funds for Simi Valley is $ 98,720.

State of Good Repair (SGR) funds are distributed to transit agencies based on their share of the state tra nsit fares collected. Before receiving an apportionment of SGR program funds in a fiscal year, an agency must submit a list of proposed projects to the California Department of Transportation (Caltrans). Caltrans reports to the State Controller’s Office the eligible agencies which will receive a quarterly allocation under Public Utilities Code Sections 99313 and 99314. As noted in the Caltrans report, Simi Valley Transit’s share of the funds is $12,872. SGR funds are available for capital projects that maintain the public transit system in good repair. Examples include replacement or rehabilitation of rolling stock, passenger bus stops, safety and security , maintenance of facilities and equipment, and preventative maintenance.

Attachment C (page 16), provided by the California State Controller’s Office (SCO), indicates the es
timated FY 2023-24 allocation is $98,720 and $12,872 for STA and SGR, respectively. However, the FY 2023-24 TDA Claim amounts for STA and SGR are $114,449.36 and $13,231.49, slightly higher than the State estimates of $98,720 and $12,872 due to the carryover balances from FY 2022-23.

By a dopting attached Resolution No. 2023 -50, the City Council authorizes the City Manager to execute and file the FY 2023-24 TDA Claim with VCTC and allows the City Manager to amend the claim if needed to reallocate funds between the operational and capital needs of Simi Valley Transit.

The following alternatives are available to the City Council:

1. Adopt attached Resolution No. 2023-50 authorizing the City Manager to execute and file the FY 2023-24 Transportation Development Act Claim (Attachment A) for Local Transportation Funds (Article 4), State Transit Assistance funds, and State of Good Repair funds with the Ventura County Transportation Commission and authorize the City Manager to approve future budget amendments related to the receipt of those funds;
2 TRAN2348.SR.TDA.JK

2. Provide other directions to staff.

Staff recommends Alternative No. 1.

SUGGESTED CITY COUNCIL MOTION

I move to adopt Resolution No. 2023-50 authorizing the City Manager to execute and file the FY 2023-24 Transportation Development Act Claim , including Local Transportation funds Article 4, State Transit Assistance funds and State of Good Repair funds with the Ventura County Transportation Commission and authorize the City Manager to approve future budget amendments associated with the receipt of the funds.

SUMMARY

The City’s FY 202 3-24 TDA Claim include s the LTF apportionment of Article 4 of $6,236,663, STA allocation of $ 114,449.36 and S tate of Good Repair allocation of $13,231.49 which are slightly higher than the state estimates due to carryover balances from FY2022- 23. These funds are to be used solely for public transportation system activities. It is recommend ed that the City Council adopt R esolution No. 2023-50 authorizing the City Manager to execute and file the FY 2023-24 Transportation Development Act Claim with t he Ventura County Transportation Commission and authorize the City Manager to approve future budget amendments associated with the receipt of funds.

SUBJECT: TRANSPORTATION DEVELOPMENT ACT (TDA)

LOCAL TRANSPORTATION FUND (LTF)
FINAL APPORTIONMENT FOR FISCAL YEAR 2023/2024
RECOMMENDATION:
• Approve the Local Transportation Fund Final Apportionment for Fiscal Year 2023/2024, apportioning $53.55 million as shown in Attachment A.

BACKGROUND:

Each year the Ventura County Transportation Commission (VCTC) is responsible for apportioning the quarter cent statewide sales tax funds that accrue to Ventura County under the State Transportation Development Act (TDA) Local Transportation Fund (LTF). Current eligible uses of LTF revenues include funds for VCTC administration (amount determined by the Commission), County administration fees, VCTC planning activities (capped at 2% of revenues), bicycle and pedestrian projects (capped at 2% after administrative and planning costs are deducted), rail passenger service operations/capital improvements with the remainder going to fund transit and if all transit needs are met, to street and road projects in cities with populations under 100,000 if eligible. The City of Thousand Oaks is exempt from the 100,000-population rule and is eligible to spend funds on Article 4 or 8 per Senate Bill (SB) 848 June 2018.

The County Auditor-Controller works with staff to determine the projected LTF sales tax revenue for the upcoming fiscal year. In developing the LTF apportionment, the current year is also evaluated to determine if the LTF revenue projection needs to be adjusted, and if so, either up or down depending on the direction of sales tax receipts. VCTC staff reviews the information to decide whether to revise the current apportionment or whether to incorporate the adjustment into the upcoming fiscal year. The beginning fund balance is estimated at this time based on projections. Then the apportionment is prepared according to LTF regulations and submitted to the Commission for approval. A draft apportionment is submitted to the Commission in February and a final apportionment is submitted in June for the upcoming fiscal year. The apportionment is allocated throughout the fiscal year after the local agency files a claim and sales tax receipts are received.

In recognition of the volatility of sales tax revenue, the VCTC adopted two policies to help smooth out the year-to-year flow of funds to LTF recipients. In 2011, the VCTC adopted a policy to maintain a reserve of approximately 10% of funds apportioned for Articles 4 (public

ATTACHMENT B
10 transportation) and 8 (other allocations, currently transit and local streets and roads) . Should LTF revenues received be lower than estimated, VCTC would be able to draw from the contingency reserve to keep local jurisdictions whole for the fiscal year and to smooth out sales tax fluctuations. The second policy, adopted by VCTC in 2013, established a funding policy to support Rail Passenger Service/Commuter Rail (Metrolink). The policy requires that each time there is an increase in estimated LTF sales tax receipts, the increase will be allocated one-third to Rail Passenger Service/Commuter Rail and two-thirds to bus transit.

DISCUSSION:

This year while working through the LTF projection process with the County Auditor-Controller, it was found that the revenues for the current fiscal year were exceeding the initial projections. The County is now projecting that the current fiscal year’s LTF revenue will increase by $3.7 million to $46.0 million. The County Auditor-Controller also estimates that Fiscal Year 2023/2024 Local Transportation Fund sales tax receipts will remain flat at $46.0 million (see attachment B). In the County Auditor-Controller’s projection, the Auditor-Controller cautioned that “Projections are very uncertain given the current economic climate.

The beginning balance for Fiscal Year 2023/2024 is estimated to be $11.7 million comprised of $3.7 million estimated additional receipts and $0.4 interest for the current fiscal year (2022/2023), an additional $3.6 million in actual receipts from Fiscal Year 2021/2022, and the unused budgeted contingency reserve of $4.0 million in the current fiscal year’s apportionment. The LTF revenues projection for Fiscal Year 2023/2024 of $46.0 million, plus the $11.7 million beginning fund balance less the $4.15 million contingency reserve results in a LTF apportionment for Fiscal Year 2023/2024 at $53.55 million, $1.38 million higher than the previous apportionment for Fiscal Year 2022/2023. The Fiscal Year 2023/2024 apportionment shown in Attachment A follows LTF guidelines and past practices and includes the following:

• Article 3 funds in the amount of $11,056,395 for VCTC activities as follows:

o Metrolink commuter rail funds in the amount of $8,047,116 which is $1,233,210 higher than last fiscal year. The increase follows the Commission’s policy which designates that one-third of the change in estimated LTF sales tax receipts is allocated to passenger rail.

o Planning funds (2% formula) in the amount of $1,071,000 which is $27,600 higher than last fiscal year. These funds are for planning activities which include Regional Transportation Planning, Regional Transit Planning, and Transportation Programming.

o Administrative funds in the amount of $1,938,279 which is $118,055 lower than last fiscal year. These activities include ADA and Senior projects, Regional Transit Technology, Grant Administration, Regional Transit Information Center, TDA Administration, Transportation Programming as well as supporting the VCTC’s administrative and management functions.

• Article 3 Administrative funds in the amount of $14,500 which is the same as last fiscal year. These funds pay for the County Auditor-Controller’s administrative costs.

• Article 3 Bicycle and Pedestrian funds (2% formula) in the amount of $1,010,524 which is $49,400 higher than last fiscal year. These funds are for local agency’s bicycle and pedestrian projects.

• Articles 4 and 8 funds in the amount of $41,467,581 which is $1,186,836 higher than last fiscal year. These funds are for local agencies as allowed by TDA regulations. The funds 11 are apportioned to each local agency based on population estimates for the cities and county from the Department of Finance that were released in May 2023.

Staff’s recommendation is to approve the Final Local Transportation Fund Apportionment for Fiscal Year 2023/2024, apportioning a total of $53.55 million as shown in Attachment A. 12 Final Final Change vs. FY Draft
