CITY OF SIMI VALLEY

MEMORANDUM

April 22, 2024

TO: City Council

FROM: Department of Environmental Services

SUBJECT: A PUBLIC HEARING TO CONSIDER A GENERAL PLAN AMENDMENT PRE-SCREENING REVIEW OF GPPS- 2024-0001 (ALLIED REALTY

PARTNERS, LLC), A REQUEST TO CHANGE THE GENERAL PLAN

LAND USE DESIGNATIONS FROM MODERATE DENSITY

RESIDENTIAL TO INDUSTRIAL FOR THREE RESIDENTIAL ZONED

PARCELS NORTH OF SMITH ROAD AND EAST OF KUEHNER DRIVE

STAFF RECOMMENDATION

It is recommended that the City Council authorize GPPS-2024-0001 for further processing as a formal General Plan Amendment to change the General Plan land use designation from Moderate Density Residential to Industrial with concurrent filing of applicable entitlement applications.

BACKGROUND AND OVERVIEW

The Applicant, Allied Realty Partners, LLC, has submitted a General Plan Pre- screening application (GPPS -2024-0001), requesting the City Council’s authorization to move forward with a formal application to change the General Plan land use designation from Moderate Density Residential to Industrial, for three residential zoned lots located north of Smith Road and east of Kuehner Drive. The parcels together make up 2.55-acres. The western-most parcel is developed with a residence; and the remaining two parcels are vacant (Figure 1). Additionally, the two southern parcels are separated from the northern parcel by a Ventura County Watershed Protection District water body, which is not part of this project.

The subject lots are part of a future development for a 12- acre movie studio ‘campus’ (Figure 2), in which Allied Studios is proposing to expand its operations with the 243,000 gross square foot mixed- use project on its studio campus. The project will include eight (8) new 20,000-square-foot sound stages, supported by an 80,000-square-foot multi-level building, for a millshop, storage areas and general production offices. The project will also include an additional 3,000 square feet of restrooms, utility and service areas. The rezoning of the three subject parcels to the north side of Smith Road will be for parking.

AGENDA ITEM NO.

5B

GPPS20240001AlliedRealtyCCmtg4-22-24(klk)
Figure 1 – Project Site Aerial and Vicinity Map

The site is surrounded by a residence to the southeast and the Corriganville Park and Trail to the northeast, a vacant Commercial Recreation parcel to the southwest, and industrial development to the northwest. The southern parcel is a 9.11- acre vacant industrial lot, and the future site of the sound stages and offices for the movie studio campus. In 2016, this vacant industrial parcel was approved for the development and expansion of a movie studio and backlot under PD-S-1039; construction plans have not yet been submitted. The parcel east of the 9.11-acre lot is currently developed as a movie studio backlot as well.

If authorized by the City Council, the current request would require the applicant to apply for:
• The requested General Plan Amendment (GPA);
• Zone Change to change the zoning of the three subject parcels from Residential Low Density with an Animal Overlay and Conditional Zoning, requiring a minimum lot size of 0.5-acres [RL(A)CZ] to Light Industrial (LI); • Potential development of a Specific Plan for the subject parcels and associated LI zoned parcels to the south to create a movie studio campus; • Possible amendments to the Hillside Performance Standards development requirements (Simi Valley Municipal Code 9- 32), to allow development on slopes greater than 10 percent and expand height allowances; and • Planned Development Permit (PD) to allow for the development of a movie studio campus.

The City Council established certain procedures for evaluating potential changes to the City’s General Plan. In 1994, City Council Resolution No. 94- 10 (Exhibit 3, page 16) provided requirements for the processing of General Plan Amendment (GPA) requests, which includes a requirement to pre- screen these requests at quarterly public hearings before the City Council. This pre- screening review process allows the City Council t o consider whether to authorize an application for a GPA to move forward. 2 GPPS20240001AlliedRealtyCCmtg4-22-24(klk)

Figure 2- Conceptual Site Plan

Current General Plan Land Use and Zoning

The current land use designation for the subject parcels is Moderate Density Residential (5.1 to 10.0 units per acre). This designation is intended to encourage residential areas composed primarily of detached, single-family dwelling units on small lots. The Moderate Density designation is intended for use mainly on the central portion of the valley floor with limited use in outlying canyon areas.

4 GPPS20240001AlliedRealtyCCmtg4-22-24(klk)
The subject properties are zoned Residential Low Density with an Animal Overlay and Conditional Zoning. This Zoning is intended to provide for a suburban single- family residential environment with a range of parcel sizes, but with generally l ow density and some clustering of parcels. The residential density in this zoning district may range from

2.1 to 3.5 dwelling units per acre, with the maximum density of one dwelling per lot. The Animal Overlay District is intended for areas within the City where farm animals may be raised and maintained, as where development is oriented towards rural -like settings or common equestrian themes. The current Zoning and General Plan designation for the subject parcel are not consistent as Moderate Density Residential is compatible with Residential Moderate (RMod) or Residential Medium (RM) Zoning per Table LU-1 of the General Plan’s Chapter 3.

Proposed General Plan Land Use Map

Proposed Amendment to the General Plan and Zone Change

The intent of the proposed General Plan land use designation of Industrial is to create an opportunity for the development of currently underutilized parcels, encourage new business, enhance the local economy, and create jobs for the City. The Industrial l and use designation, specifically Light Industrial is intended to provide areas for a variety of light manufacturing, service, technical research, and related business office uses, operating under performance standards, which will result in very few outside impacts.

The proposed land use designation on the site would match that of the properties located immediately to the south.

The following criteria are included in Resolution No. 94- 10 regarding General Plan Pre- screening requests, with analysis for the City Council’s consideration:

1. The proposed amendment is of a configuration and land use that has a reasonable potential for being compatible with other existing and proposed land uses in the area, in that amending the General Plan land use designation over the 2.55-acre site would allow for a development that is compatible with the surrounding land 6 GPPS20240001AlliedRealtyCCmtg4-22-24(klk)
uses. The subject parcels would serve the proposed movie studio as parking. The proposed movie studio is a potential expansion of the existing Allied Movie Studio lot south of Smith Road.

2. The proposed amendment has a reasonable potential for being compatible with the goals and policies of the General Plan, in that the following General Plan Policies are provided to demonstrate that the Industrial Land Use can be found to be appropriate for this location:

LU-20.3: Location. Locate industrial and business park areas near major transportation routes such as freeways, railways, or arterials to reduce traffic on residential streets while providing efficient transportation of supplies and workers.

The proposed change in General Plan land use designation to Industrial would allow the movie studio campus development in a location near the eastern edge of the City by the 118 Highway and Santa Susana Pass, near Los Angeles County.

This strategic location has the potential to attract the entertainment industry and employers to the City and foster economic development via job creation and local spending as it falls within the Los Angeles 30-Mile Studio Zone. This zone makes the region financially competitive for entertainment production, when other cities outside of California have become more affordable entertainment hubs. The studio zone is a 30- mile radius from the southeast corner of Beverly and La Cienega in Los Angeles, used by union film projects to determine per diem rates and driving distances for crew members, and ensure fair compensation and benefits to cast and crew members. By being within the radius, cast and crew members get paid by the unions and not the proposed studio.

The location is also conducive for the growth of the entertainment industry, being situated adjacent to an existing movie studio. However, while this pre-screen application considers changing the land use designation from residential to industrial, other residential uses exist to the east of the subject properties. Given the proximity to a growing industrial corridor along Smith Road, these existing residential zones have the potential of becoming non-conforming and mitigations will be necessary. To demonstrate compatibility between industrial and residential uses, at the time of formal application submittal, the Applicant shall provide to the City analyses of how the proposed studio will support both residential and industrial uses via Specific Plan development, traffic management, noise and time limit considerations.

LU-20.1: Diversity of Uses. Provide for a variety of office, industrial, and research and development uses that offer job opportunities for Simi Valley’s residents. The proposed General Plan land use designation to Industrial has the potential to create film production jobs, employment opportunities in support services (i.e. administrative staff, accounting, legal services, and marketing). The development has the potential to also create industrial and technical jobs as studios require technical staff for production.

ED-1.2: Facilitate Expansion of Existing Businesses. Promote the expansion of existing businesses to increase their employment and sales capacity and extend efforts at business retention. The proposed General Plan land use designation to 7 GPPS20240001AlliedRealtyCCmtg4-22-24(klk)
Industrial for a movie studio development has the potential to promote the expansion of existing businesses, increase employment and sales, and extend efforts at business retention via:

• The creation of jobs and business opportunities for local suppliers. Movie studios require various services and support industries, such as caterers, equipment rental and transportation companies , and construction companies, where such e xisting businesses in the City have the potential to benefit from the increased demand.

• Tourism and promotion. A successful movie studio has the potential to attract tourists and film enthusiasts to the area, boosting local tourism and creating opportunities for existing hospitality and restaurant businesses. This has the potential to further stimulate the local economy.

ED-3.3: Proactive Industry Strategies. Create proactive industry growth strategies with a focus on industries that provide a range of higher skilled professional and technical jobs to match the City’s highly educated workforce. The proposed land use change has the potential to provide employment opportunities in a range of disciplines from the City including: director s, photographers, producers, sound engineers, actors, makeup artists, choreographers, storyboard artists, and costume designers, to name a few. It has the potential to also draw in local food vendors and caterers to service employees on site.

3. The proposed amendment is unlike other amendment requests located in the same general area, which have been previously considered and denied by the City Council within the last 12 months, in that there have been no other amendment requests located in the same general area that were considered and denied by the City Council in the last 12 months. Therefore, the proposal is compatible with this finding.

4. The proposed amendment is not located within an area where a newly adopted land use study or policy has been in effect for less than 12 months or within an area where the City Council has directed the preparation of a land use study, in that the site is not located within an area where the City Council has directed the preparation of a land use study in the last 12 months.

Therefore, the proposed change to Industrial has a reasonable potential to be compatible with the goals and policies of the General Plan.

A General Plan Amendment would change the land use designation for 2.55- acres of residentially zoned properties from Moderate Density Residential to Industrial to accommodate the eventual development of a movie studio campus. If allowed to proceed (with a minimum of three (3) affirmative votes), the applicant would be authorized to file a formal General Plan Amendment and process concurrently the required applications at any time during a one-year period following the City Council’s action.

8 GPPS20240001AlliedRealtyCCmtg4-22-24(klk)
It is important to note that the City Council’s authorization to process a request for a formal General Plan Amendment does not constitute approval of the General Plan Amendment. The City council will retain the discretion to ultimately approve or deny the General Plan Amendment request.

The following alternatives are available to the City Council:

1. Authorize GPPS- 2024-0001 for further processing as a formal General Plan Amendment, a request to change the General Plan Designation of three residential zoned parcels north of Smith Road and east of Kuehner Drive from Moderate Density Residential to Industrial with direction to include concurrent filing of required applications for future development;

2. Do not authorize GPPS -2024-0001 for further processing as a General Plan Amendment; or

3. Provide alternative direction to the Pre-screening review request.

Staff recommends Alternative No. 1.

SUGGESTED CITY COUNCIL MOTION

I move to authorize GPPS -2024-0001 for further processing as a formal General Plan Amendment.

SUMMARY

Allied Realty Partners, LLC submitted a General Plan Amendment (GPA) Pre- screening application GPPS -2024-0001 for the City Council’s conceptual review to change the General Plan land use designation from Moderate Density Residential to Industrial for three parcels totaling 2.55- acres north of Smith Road and east of Kuehner Drive. The change is proposed to facilitate the development of a movie studio campus, along with the 9.11-acre industrial parcel to the south of the subject parcels. The proposed General Plan Amendment has the potential to be compatible with the existing and proposed commercial and industrial developments. Staff has made findings for the criteria required in Resolution No. 94-10, regarding the General Plan Pre-screening requests. Therefore, staff recommends approval to authorize GPPS -2024-0001 for further processing as a formal General Plan Amendment.
