DEPARTMENT OF HIGHWAY PATROL (CHP) CANNABIS TAX GRANT
PROGRAMS; AUTHORIZE THE CITY MANAGER OR DESIGNEE TO
SIGN ALL GRANT -RELATED DOCUMENTS; AND APPROVE A
SUPPLEMENTAL BUDGET REQUEST OF $225,924 IN FUND 287

STAFF RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 202 4-34 (page 5) to accept a $225,924 grant award from the FY 2024-25 State of California, California Highway Patrol (CHP) Cannabis Tax Grant Program; authorize the City Manager to sign grant -related documents; and approve a Supplemental Budget Request of $225,924 in Fund 287, with a transfer to the General Fund (100) for Salary Reimbursements of all personnel instructor costs.

BACKGROUND AND OVERVIEW
In January 2024, staff applied for the State of California CHP Cannabis Tax Grant to cover the cost of officer s/instructors to teach Standard Field Sobriety Test (SFST), Advanced Roadside Impaired Driving Enforcement ( ARIDE), Drug Recognition Expert (DRE) recertification/field certification , and DRE Instructor Training. Additionally, the grant will fund attendance a t the International Association of Chiefs of Police Impaired Driving Conference and the annual California Narcotic Officers’ Association Conference, which are both resources for current trends in drugged/DUI driving and the best ways to combat those problems on the roadways. The grant will also provide funds to cover backfill costs when officers attend DUI alcohol/DUI drug- related trainings, as well as to purchase one TruNarc Handheld Narcotics Analyzer and two So toxa Mobile Oral Fluid Handheld Screening devices. In June 2024, the City was notified that it was successful in its application with CHP and was awarded $225,924.

FINDINGS AND ALTERNATIVES
Current prosecutorial procedures require a Drug Recognition Expert (DRE) to perform an evaluation of all subjects suspected of driving under the influence of drugs (DUI). The AGENDA

ITEM NO.

Consent (9)
2 Simi Valley Police Department (SVPD) currently has six of its allotted 125 officers trained as a DRE . SVPD needs additional DRE-trained officers to efficiently fulfill the required prosecutorial procedures. Additionally, it is imperative to keep up to date on traffic-related trends to better serve the community and prevent impaired driving.

It was determined that the CHP Cannabis Tax Grant provides law enforcement grants to allied agencies for the education, prevention, and enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis. The intent of the program is to educate the public regarding the dangers of impaired driving, enforce impaired driving laws on the roadway, improve the agency’s effectiveness t hrough training, and aid in the development of new strategies.

This grant provides reimbursement of salary and benefits of instructors ’ time to teach SFST and ARIDE and provide DRE certification/recertification to the Department’s officers. Having the capability to teach these programs in-house is invaluable.

Reimbursement of backfill costs will also be available through the grant when officers are sent to DUI alcohol/drug-related training. This grant will also provide funding to attend the annual International Association of Chiefs of Police Impaired Driving Conference and the California Narcotics Officers Association Conference which discuss current drug/alcohol trends related to driving and provide ways to combat the issue on the roadways. The grant will also provide funding to purchase one TruNarc Handheld Narcotics Analyzer and two Sotoxa Mobile Oral Fluid Handheld Screening devices.

The Simi Valley Police Department's goal is to continue training officers in DUIs to protect Simi Valley residents from impaired drivers . In 2023, approximately 6% of Simi Valley documented collisions were caused by one party being DUI; of those DUI-related collisions, 33% of them resulted in one or more parties being injured. In 2022, approximately 10% of documented collisions in Simi Valley were caused by one party being DUI; of those DUI-related collisions, 27% of them resulted in one or more parties being injured. Additionally, the Department made 170 DUI arrests in 2023 and 114 DUI arrests in 2022, and DUI drug arrests decreas ed from 12 in 2022 to 7 in 2023 . The Department believes that the decrease in arrests of DUI drivers is due to officers not being trained effectively in the area of DUI drug arrests as well as decreased enforcement.

Current studies being conducted by UC Berkley indicate over half of all DUI a lcohol arrests also include the individual having some other intoxicating substance in their body.

Simi Valley is currently experiencing more collisions involving intoxicants aside from alcohol. Grant funds will be utilized to reimburse the City’s General Fund for costs associated with this training/certification, education in traffic trends associated with impaired driving, and new equipment which will be used during DUI investigations that can give o fficers the confidence t o make a DUI drug arrest. No City match is required , and all funds are planned for expenditure by the deadline of June 30, 2025.

To proceed, the City Council must approve Resolution No. 2024-34 accepting the grant award from the CHP Cannabis Tax Fund Law Enforcement Grant Program; authorize the City Manager to execute all grant -related documents; and approve a Supplemental Budget Request of $225,924 for Fund 287 with a transfer to the General Fund (100) for Salary Reimbursements of all personnel Instructor costs.

3 The following alternatives are available to the City Council:

1. Adopt Resolution No. 2024-34 accepting a $225,924 grant from the FY 2024-25 State of California, CHP Cannabis Tax Grant Program; authorize the City Manager to execute all grant -related documents; and approve a Supplemental Budget Request of $225,924 to Fund 287, with a transfer to the General Fund (100) for Salary Reimbursements of all personnel instructor costs;

2. Do not approve the acceptance of the FY 2024-25 State of California, CHP Cannabis Tax Grant Program grant award;

3. Provide staff with other direction.

Staff recommends Alternative No. 1.

Proiect Description
The Simi Valley Police Department has continued to see an increase in the number of DUI arrests and DUI related collisions over the past year. As these numbers have risen and the population of the city has grown, the department resources have remained the same. ln order to combat this increase in DUI related collisions, the Simi Valley Police Department is requesting funds from the Cannabis Grant Unit to assist with providing DUI related training to our Simi Valley Police Department Officers, provide SFST, ARIDE and DRE lnstructors to assist with trainings throughout Ventura County, host DUI related trainings at the Simi Valley Police Department open to all California Law Enforcement agencies, conduct DUI Saturation patrols and conduct DUI/DL Checkpoints. Funds would also be used to pay overtime to officers who have to backfillthe vacancies created when officers attend DUI related trainings and/or conferences. The Simi Valley Police Department would also use funds from this grant to send two Simi Valley Police Department traffic Officers and two certified DRE Officers to the annual lnternational Association of Chiefs of Police (IACP) lmpaired Driving and Traffic Safety Conference (formerly known as the DRE Conference) being held in Washington, D.C., August 16-18, 2024 and four Simi Valley Police Department traffic officers/DRE Officers to the annual CNOA Conference being held in lndian Wells, California November 21-26,2024. Both of these conferences offer numerous classes specifically related to impaired driving trends, resources, and ways to detect impaired drivers. These trainings are crucial for officers whose primary job is to conduct traffic enforcement activities specifically related to DUI detection and investigation. Funds from this grant would also be used to purchase two (2) SoToxa Oral Fluid Roadside testing systems which would be used primarily by Simi Valley Police Department traffic officers while they are conducting DUI related activities. These devices would be used during all grant funded DUI Saturation patrols, and DUI/DL Checkpoints. These devices will also be made available to all Simi Valley Police Department officers for use during any DUI related enforcement activity. Funds would also be used to purchase a TruNarc Handheld Narcotics Analyzer which would be used primarily by Simi Valley Police Department traffic officers while they are conducting DUI related activities.

These devices would be used during all grant funded DUI Saturation patrols, and DUI/DL Checkpoints. These devices will also be made available to all Simi Valley Police Department qfftcers for use during any DUI related enforcement activity. With this funding, we will have the ability to tidin mpre SimiValley Police Department officers, provide instructors to assist with DUI related training thro0ghout the County of Ventura, provide DUI related training to other Law Enforcement agencies, and conduct DUI specific enforcement activities. These activities will help identify DUI offenders and remove them from the roads making the City of Simi Valley safer for all its residents and anyone who drives on the city streets.

Problem Statement & Proposed Solution
Problem Statement
The Simi Valley Police Department along with other law enforcement agencies, have seen a noticeable increase in the number of DUI related collisions and the number of DUI drivers being contacted on the roadways. Since 2020, the SimiValley Police department has averaged approximately 70 DUI Collisions per year. An average of 20 of those collisions per year have caused injuries or death to individuals involved. From January 1,2022, through December 31,2023, officers with the SimiValley Police Department have made approximately 320 DUI related arrests. Even with the high number of DUI related arrests, we are still seeing the number of DUI related crashes increase. Based on information obtained through UC Berkley's Transportation lnjury Mapping System (TIMS) database, from 2020 through 2022,Ventura County is one of the Top 20 (#16) counties in California for fatal and serious injury collisions, one of the Top 20 (#12) counties in California for DUI Drug lnvolved fatal and serious injury collisions, and one of the Top 20 (#16) counties in California for Alcohol lnvolved fatal and serious injury collisions. As it relates to the City of Simi Valley specifically, the TIMS database shows the City of Simi Valley has had an'irlcrease in the number of DUI- Alcohol related crashes and DUI Drug related crashes lrom 20201o 2021. The TIMS Database also indicates our percentage of DUI Alcohol and Drug Related crashes is consistent with or higher than the State of California average.
15 Schedule A
Proposed Solution
These documented statistics indicate the need for Simi Valley Police Department officers to continue to focus on DUI enforcement. ln order to accomplish this goal, more officers in our agency need to be trained in SFST, ARIDE, and DRE. Out of 125 sworn officers, we currently only have 70 trained in SFST, 44 trained in ARIDE, and 7 trained in DRE. The money received from this grant would help us continue to offer in-house training for our officers and other Law Enforcement Officers in SFST, ARIDE, DRE, and DRE Re-certification as well as provide funds to cover the costs of backfill for the officers who are going to training. These funds would also be used to cover the overtime costs incurred by our SFST, ARIDE, and DRE instructors who help conduct DUI related training classes at our agency and at other law enforcement agencies throughout the County of Ventura. Funds would also be used to pay overtime to officers who are used to backfill the vacancies created when officers attend DUI related trainings and/or conferences. Along with the increased training, the Simi Valley Police Department would use funds to conduct two (2) DUI/DL Checkpoipts and conduct ten (10) DUI Satuiation Patrois. The DUI Saturation patrols along with the DUI/DL Checkpoints would allow for extra officers to conduct DUI related enforcement without having to handle regular calls for service. With the legalization of marijuana in California, the Simi Valley Police Department has seen an increase in the number of drivers being contacted who appear to be under the influence of marijuana. The Simi Valley Police Department cuirently only uses the Standardized Field Sobriety Exercises to determine impairment. The Simi Vaitey Police Department would like to purchase two (2) SoToxa Oral Fluid screening devices to assist officels with determining whether or not a driver is under the influence of marijuana. These devices will be used by members of the Simi Valley Police Department's Traffic Bureau whose job function is to detect impaired drivers. The devices will also be used during all CTFGP funded DUI Saturation Patrols and DUI/DL Checkpoints. The devices will also be available to any officer who is conducting a DUI investigation. During a DUI investigation, it is common for officers to locate narcotics. Some of the narcotics are not easily identifiable and with the increased presence of fentanyl, can be dangerous to test using common methods. The Simi Valley Police Department would use funds from this grant to purchase one (1) TruNarc Handheld Narcotics Analyzer which can be used on the roadside to scan directly through plastic or glass to quickly and safely ideniify up to 530 of the highest priority illicit and abused narcotics in a single drug test. This device would be used by the Simi Valley Police Department Traffic Officers and during all CTFGP funded DUI Saturation Patrols and DUI/DL Checkpoints. The device would also be made available to all officers who need to test narcotics during a DUI investigation or drug investigation Performance Measures/Scope of Work " :;
Training
lf funding is provided to the Simi Valley Police Department the funds will be used to send Simi Valley Police Departm-ent officers to DUI related training classes (SFST/ARIDE/DRE /DRE-Recertification/ DRE lnstructor).

Officers would attend these classes as soon as the classes are available during the grant period. lt would be our goal to have at least eight officers attend the SFST class (Q1 = 2, Q2 = 2, Q3 = 2, Q4 = 2), at least eight officers attend ARIDE (Ql = !, Q2 = 2, Q3 = 2, Q4 = 2), and at least two officers attend DRE training (Q2 = I, Q3 = 1). The Simi Valley Police Department will provide at least 4 Officers to assist with instructing SFST trainings in each quarter and provide one instructor to assist with ARIDE training and DRE trainings. The instructor for the ARIDE trainings and DRE trainings will assist with training during Q1, Q2, Q3, and Q4. We will be able to measure the effectiveness of this performance measure by increasing the number of SFST/ARIDE/DRE/ certified officers in our agency.

Funding would be used to host DUI related trainings at the Simi Valley Police Department which would be open to Simi Valley Police Department officers and officers from other Law Enforcement agencies. lt would be our goal to host at least one DUI related training class each quarter. We will be able to measure the effeCtiveness of this performance measure by documenting the number of law enforcement officers who attend and successfully complete the training.

Funding for the IACP lmpaired Driving and Traffic Safety Conference would be'used during the first quarter to send two traffic officers and/or traffic sergeants/commanders and two DRE Officers to the annual conference to learn about current DUI related trends and ways to combat the DUI problem. The officers attending this conference would be able to bring the information back to all other officers at the agency and find a way to share this information in the training classes presented at our agency. The effectiveness of this performance would be measured by completing training bulletins to be distributed to officers at our agency and officers who attend trainings at our agencY.

Funding for the CNOA conference would be used during the second quarter to send four traffic 16 Schedule A
officers/sergeants to the annual conference to learn about current alcohol and drug trends which effect driving and how best to detect these violators. The officers attending this conference would be able to bring the information back to all other officers at the agency and find a way to share this information in the training classes presented at our agency. This effectiveness of this performance would be measured by completing training bulletins to be distributed to officers at our agency and officers who.attend trainings at our agency.

Funding received to cover the backfill costs will be used to pay overtime to officers who are covering vacancies created when officers are attending DUI related training, instructing DUI related classes and attending the IACP and CNOA conferences. This performance would begin in the first quarter of the grant and continue throughout the grant period. This performance would be measured by the number of overtime vacancies created when officers attend training or assist with instructing DUI related training.

DUI Related Enforcement Activities
Funding received for DUI/DL checkpoints would be used during the second and third quarters of the grant period. The goal would be to conduct one DUI/DL checkpoint during the second quarter and one DUI/DL checkpoint during the third quarter. While conducting these checkpoints, the SimiValley Police Department would keep count of all vehicles which came through the checkpoint and all drivers contacted. lnformation regarding the number of DUI arrests and other violations would also be documented and reported, These DUI/DL checkpoints would allow us to contact a large number of drivers and educate them regarding the dangers of driving under the influence of alcohol and/or drugs. These checkpoints would also allow officers to locate drivers who are driving under the influence of alcohol and/or drugs. The effectiveness of this performance will be measured by the number of DUI related collisions and the number of DUI drivers arrested during this grant period compared to the number of DUI drivers arrested during the same time from one year prior.

Funding received for DUI Saturation patrols would be used during all quarters of the grant period. lt would be the goal of our agency to conduct at least one DUI Saturation patrol per month (three per quarter). The funding would allow for officers to be specifically assigned to DUI enforcement activities without being tasked to respond to any other calls for service during their shift. This would ensure these officers are concentrating enforcement activities on locating individuals driving under the influence of alcohol and/or drugs. These DUI Saturation patrols would be conducted during days and times when the likelihood of DUI driving is increased.

The officers conducting these patrols will keep a log of all contacts, citations, and arrests. The effectiveness of this performance will be measured by the number of DUI related collisions and the number of DUI drivers arrested during this grant period compared to the number of DUI drivers arrested during the same time from one year prior. lt is the hope of the Simi Valley Police Department to reduce the number of DUI related arrests and collisions by a minimum of 10% during this grant period compared to last year (July 2022-June 2023).

Equipment
Two (2) SoToxa Mobile Oral Fluid Screening device Q1- Purchase, Q2 - Receive Q2-Q4- Use device at all CTFGP funded DUI Saturation Patrols and DUI/DL Checkpoints and use during all DUI and DUI/D investigations. Use of this device will help officers determine whether or not a driver is under the influence of marijuana. Aim to increase DUI/D (marijuana) arrests by 10% which would help reduce the number of DUI/D (marij uana) impaired drivers.

One (1)TruNarc Handheld Narcotics Analyzer - Q1-Purchase, Q2-Receive, Q2-,Q4 - Use device to help officers quickly, easily, and safely identify up to 530 of the highest priority illicit iind abused narcotics which they may recover during a DUI or DUI/D investigation.

Proiect Performance Evaluation
Throughout the period of the grant, the Simi Valley Police Department will use press releases, social media, and community outreach events to promote the project and educate the community regarding the project.

Some examples of ways to communicate with internal and external stakeholders regarding the project would be to issue press releases or use social media to inform the community about when officers will be conducting extra enforcement activities related to the grant. After the enforcement activities, the Simi Valley Police Department could use the same communication methods to talk about the outcome of the extra enforcement activities. The Simi Valley Police Department will also communicate with the community members while conducting DUI/DL Checkpoints by talking with drivers and providing all drivers with fliers, which provide some education regarding the dangers of driving under the influence of drugs and/or alcohol. At the conclusion of the grant cycle, the Simi Valley Police Department will have statistics available regarding all 17 Schedule A
grant related activities and the enforcemenUviolations, which were documented. A comparison of the number of OUt arrests/collisions compared to the same time as the year prior will indicated the successfulness of the grant activities.

Proqram Sustainabilitv
@drasticallyreducedorrescinded,thePoliceDepartment'sonlyoptionwouldbeto requestLdditionalfunding during the yearly budget process. Depending on the state of the economy (Local, State, National) funding may or may not be granted.

The most important part of this grant is the ability to train as many of our police officers as possible. The funding received from this grant would allow us to provide DUI related training to a large percentage of our agency during a time when funding is scarce. After training our officers, they will then be equipped with the fnowledge anO abitities to go and enforce the DUI related laws. The ability for more officers to be confident in identifying possible DUI drivers, and then having the confidence to conduct a DUI investigation could have a signifiianl impact in reducing the number of DUI drivers on our city streets and the number of DUI related crashes.

Attending the IACP Conference and the CNOA Conference would allow officers to understand "Vision Zero" more effectively and learn about the different ways other agencies and states are attempting to reduce traffic crashes and DUI's. The conferences would also allow officers to stay up to dqte on the current drug trends and ways officers can more easi[ detect when an individual is driving under th€ influence.

The ability to fund DUI specific patrols would also have a significant impact on the DUI crashes in our communiiy. Right now, officers are only looking for DUI drivers when they are not having to handle other calls for service or completing papenruork associated with those calls. Officers specifically assigned to DUI enforcement would allow more DUI drivers to be identified prior to being involved in a collision.
