CITY OF SIMI VALLEY

MEMORANDUM

August 19, 2024

TO: City Council

FROM: Police Department

SUBJECT: APPROVE THE USE OF FOUR (4) ADDITIONAL 40MM LESS LETHAL

LAUNCHERS FROM INDEPENDENT STUDIO SERVICES ( ISS) AND
APPROVE THE USE OF TWO (2) ADDITIONAL PEPPERBALL LESS

LETHAL LAUNCHER SYSTEMS FROM ADAMSON POLICE PRODUCTS
AS REQUIRED BY ASSEMBLY BILL 481

STAFF RECOMMENDATION

It is recommended that the City Council authorize the Police Department to use four (4) additional 40mm less lethal launchers from Independent Studio Services (ISS) and use two (2) additional PepperBall less lethal launcher systems from Adamson Police Products as required by Assembly Bill 481.

BACKGROUND AND OVERVIEW

In recent years, political events and public demonstrations have led to increased tensions, and in some cases, interactions between law enforcement and the public.

To ensure safety for both the community and law enforcement officers alike, it is important that the Police Department is adequately equipped with the proper tools and resources to effectively and safely manage these situations. One of the tools that the Police Department utilizes are less lethal launchers, which are weapons that fire non -lethal ammuniti on to de -escalate conflict. The Police Department currently has eleven (11) previously approved 37mm less-lethal launchers and two (2) 40mm less-lethal launchers. The Police Department also has five (5) previously approved PepperBall less-lethal launchers. The 37mm less lethal launcher systems are becoming obsolete across the law enforcement industry . As such, maintenance and repairs for the Police Department’s current inventory is becoming increasingly difficult and costly. As a result, the Police Department has begun the transition to the 40mm less lethal launcher system. During the transition, the 37mm less lethal launchers are being removed from field use.

FINDINGS AND ALTERNATIVES

The B&T GL06 Launcher with Aimpoint Micro TL is one of the most lightweight systems in the industry and has an ambidextrous design making it functional for almost any officer, regardless of physical size or stature. It also comes equipped with a quick detachable vertical foregrip for increased support and accuracy when deployed. This system uses rubber-tipped baton projectiles, propelled by kinetic energy that are designed to cause minimal injury. They are critical pieces of de- escalation equipment that offer effective crowd control and can provide individualized, focused suspect management.

AGENDA ITEM NO.

9A

2 The PepperBall less lethal launcher system also offers effective crowd control management options, particularly when dealing with numerous individuals at the same time. The VKS Pro PepperBall system stands is the only product certified by the National Institute of Justice (NIJ) for its accuracy, ensuring its reliable performance in critical situations. It is lightweight, versatile, and extremely easy to use. This system deploys small, crushable projectiles that contain a chemical irritant (similar to pepper spray) that causes temporary discomfort on its intended target.

In accordance with section 2-9.201(b) of the municipal code, staff conducted outreach to three distinct vendors regarding the procurement of both 40mm less-lethal launchers and PepperBall less-lethal launcher systems. After a thorough evaluation, it was determined that the proposals submitted by ISS and Adamson Police Products represent the best combination of quality, cost-effectiveness, and suitability to meet the City's needs.

The Police Department’s Forfeited Assets fund has the necessary budget to cover this purchase, as permitted by the updated "Guide to Equitable Sharing for State, Local, and Tribal Law Enforcement Agencies" released in March 2024. Due to time constraints related to purchasing, ordering, and delivery of goods in a timely manner , the Police Department has already begun the purchasing process of these items.

Due to the requirements of AB 481, and the City’s Military Equipment Use Policy (Attachment C, page 13) staff requests City Council approval for the use of four (4) additional 40mm less lethal launchers from ISS and use two (2) additional PepperBall less lethal launcher systems from Adamson Police Products.

The following alternatives are available to the City Council:

1. Authorize the Police Department t o use four (4) additional 40mm less lethal launchers from ISS and use two (2) additional PepperBall less lethal launcher systems from Adamson Police Products;

2. Do not authorize the Police Department to use four (4) additional 40mm less lethal launchers from ISS and use two (2) additional PepperBall less lethal launcher systems from Adamson Police Products;

3. Provide staff with further direction.

Staff recommends the City Council approve alternative No. 1.

SUGGESTED CITY COUNCIL MOTION

I move that the City Council authorize the Police Department to use four (4) additional 40mm less lethal launchers from Independent Studio Services (ISS) and use two (2) additional PepperBall less lethal launcher systems from Adamson Police Products.

SUMMARY

To effectively address and manage potential interactions between the public and law enforcement at political events and public demonstrations , it is essential that the Police Department is equipped with the appropriate tools and resources. The Police Department 3 recently researched and began the purchasing process for four (4) additional 40mm less lethal launchers from ISS for the purchase price of $6,864.00 and two (2) additi onal PepperBall less lethal launcher systems from Adamson Police Products for the purchase price of $11,707.65. These new additions are aimed at enhancing the Police Department’s capacity to handle such situations safely and effectively. ___
