UBJECT: APPROVAL OF FIFTH AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF SIMI VALLEY AND SAFETY VISION, LLC. FOR

PROFESSIONAL SERVICES TO REPLACE AND INSTALL TRANSIT
ON-BOARD VIDEO SURVEILLANCE SYSTEM, CP75000009, RFP
NO. PW 20-23R

STAFF RECOMMENDATION
I
t is recommended that the City Council:

1. A
pprove the attached fifth contract amendment (page 4 ) with Safety Vision for professional services to replace and install transit on-board video surveillance system, amending to include the transfer of the surveillance system to twelve (12) new dial-a-ride vans, the relocation of the system from retired buses to the two (2) fixed-route buses, and acquisition of one (1) new surveillance system for a fixed-route bus, and increasing the contract amount by $54,860.97 , for a total not -to-exceed amount of $220,618.36; and

2. A
uthorize the City Manager or her designee to approve any subsequent contract amendments and incorporate future budgeted funds into the contract amount.

BACKGROUND AND OVERVIEW
O
n March 11, 2021, the City issued a Notice Inviting Bids to replace and install Transit On-Board Video Surveillance System, but the bids received were considered non- responsive. The City then issued a Request for Proposal on June 9, 2021, and on August 3, 2021, the City Manager awarded a contract to Safety Vision for a total not-to-exceed contract amount of $156,187.51.

O
n March 13, 2021, the Public Works Director approved via a Change Order (the First Contract Amendment) the replacement of antennas compatible with the City’s Wi-Fi, for $1,104.95, increasing the total not-to-exceed contract amount to $157,292.46.

O
n December 9, 2021, the Public Works Director approved via a Change Order (the Second Contract Amendment) the acquisition of three (3) spare hard drives, for $3,716.92, increasing the total not -to-exceed contract amount to $161,009.38.

Subsequently, a Change Order (the Third Contract Amendment) was made to resolve a AGENDA ITEM NO.

Consent (9)

technical issue with the City’s Enterprise Resource Planning (ERP) System, adjusting the total not-to-exceed contract amount to $161,053.39.

On September 3, 2024, the City Manager approved a Change Order (the Fourth Contract Amendment) to cover the labor and travel costs for replacing a defective sur veillance system part not under warranty, for $4,704, increasing the total not -to-exceed contract amount to $165,757.39. According to the City’s Purchasing Ordinance Section 2- 9.110 (c), the City Manager is authorized to approve change orders and amendments up to 10% or $100,000 of the original contract amount, whichever is less, and may also extend the contract term , provided the work remains reasonably related to the original contract’s scope.

Following the recent acquisition of transit vehicles, the City plans to transfer the existing surveillance system to the twelve (12) new dial -a-ride vans , relocate the surveillance system from the disposed buses to two (2) fixed- route buses, and acquire one (1) new on-board video surveillance system for a fixed-route bus.

FINDINGS AND ALTERNATIVES

Since Safety Vision originally installed the City’s onboard video surveillance system and is familiar with the specifications required for removing and installing the existing system, and given that the City already has an active contract with Safety Vision, staff determined that amending the contract is the most efficient option. This amendment would involve transferring the existing onboard video surveillance system to twelve (12) new dial-a-ride vans, relocating the system from the retired buses to the two (2) fixed- route buses, and acquiring one (1) new onboard video surveillance system for a fixed-route bus that currently has a legacy surveillance system. This approach will save the City both time and cost.

Federal Transit Administration (FTA) Circular 4220.1F, Chapter VI, Section 3.h. (1)(b), “If a recipient’s requirement can only be met by one source, the recipient may make a non- competitive award. This applies in the case of a follow -on contract for the continued development or production of highly specialized equipment or major components, where awarding the contract to another contractor would likely result in significant duplication of costs that would not be recovered through competition.”

Sufficient funding is currently available in Transit Capital Project account (CP75000009).

The following alternatives are available to the City Council:

1. Approve the fifth contract amendment with Safety Vision for professional services to replace and install transit on-board video surveillance system, to include the transfer of the surveillance system to twelve (12) new dial -a-ride vans, the relocation of the system from retired buses to the two (2) fixed-route buses, and acquisition of one (1) new surveillance system for a fixed-route bus, and increasing the contract amount by $54,860.97, for a total not-to-exceed amount of $220,618.36.

2 2. Authorize the City Manager or her designee to approve any subsequent contract amendments and incorporate future budgeted funds into the contract amount.

3. Provide staff with other direction.

Staff recommends Alternative Nos. 1 and 2.

SUGGESTED CITY COUNCIL MOTION

I move to approve the attached fifth contract amendment with Safety Vision for professional services to replace and install transit on-board video surveillance system, to include the transfer of the surveillance system to twelve (12) new dial -a-ride vans, the relocation of the system from retired buses to the two (2) fixed- route buses, and acquisition of one (1) new surveillance system for a fixed- route bus, and increasing the contract amount by $ 54,860.97, for a total not -to-exceed amount of $220,618.36; and further authorize the City Manager or her designee to approve any subsequent contract amendments and incorporate future budgeted funds into the contract amount.

SUMMARY

The City plans to transfer its existing surveillance system to twelve (12) new dial -a-ride vans, relocate the system from retired buses to two (2) fixed- route buses, and acquire one (1) new on- board surveillance system for a fixed- route bus. Since Safety V ision originally installed the system and is familiar with the required specifications, staff recommends amending the existing contract with Safety Vision to cover these tasks. The amendment will increase the contract by $ 54,860.97, bringing the total not -to-exceed amount to $220,618.36, and will save both time and cost for the City.

MOBTLE VIDEO SURVflIIATCE SOLWrOatS
The NVR features a built-in GPS receiver module for recording and displaying date/time, vehicle position, direction and speed, synchronized with video. The NVR contains an integrated 3-Axis accelerometer, capable of being configured to automatically trigger an alarm/event when the vehicle exceeds a pre- determined G-force setting.

All vehicle metadata is synchronized with video. The NVR allows the following selectable metadata to appear as on-screen display (OSD) on recorded video: Date/Time, Speed, Vehicle Number, GPS coordinates, Channel Name, and Device lD. The position of the metadata is adjustable to satisfy user preference.

The Observer 4816 NVR operates on 8-36 volt DC power and includes a protective filtering device to protect from voltage spikes, power surges, and reverse polarity. The system does not interfere electrically with the operation of the vehicle or with its onboard electronic equipment. The NVR does not require vehicle operator interface to prepare the system for operation, initiate shutdown, or maintain the system.

Startup and shutdown are powered by the vehicle's ignition, Different parameters for system startup and shutdown can be configured. Users can selectto powerthe NVR on and offwith the ignition only, setup timer settings to power the NVR on and off at set specific times, or power the NVR on during both conditions.

Users may enter a Shutdown Delay time up to 24 hours, where the NVR will wait to shut down after the vehicle's ignition has been turned off. Users may also enter a Shutdown Record time up to 24 hours, where the NVR will continue to record after the vehicle's ignition has been turned off.

Built-in software performs full and continuous system diagnostics and reports failures to the sub-system component level. Located on the front panel of the NVR are Status LEDs, which illuminate to display the current health status of the NVR. The panic button, which allows the vehicle operator to create an alarm/event, also contains the Status LEDs.

The NVR features a built-in clock calendar. The NVR clock operates independently of the main power supply and contains a minimum five (5) year operational lifetime before battery change is required. Clock drift is less than five (5) minutes per six (6) months. Dates are programmed to the year 2050 and takes into account all leap years and daylight savings time changes automatically without external intervention.

The NVR can be configured to record in the following modes: Power Up (continuous recording begins when NVR is powered on); Timer (NVR records during a configured time schedule); or Alarm (records only when an alarm/event is triggered). Pre-event recording times can be configured up to 60 minutes and post-event recording times can be configured up to 30 minutes.

Video, audio and vehicle data is fully synchronized, compressed, encrypted and stored in a secure, proprietary file format to detect and prevent attempted alteration or tampering, and restrict access.

Compressed encrypted data is stored to the removable hard drive(s) and requires proprietary software Safety Vision LLC

PROJ ECT I M PLEM ENTATION
Upon receipt of PO and notice to proceed, Safety Vision would check inventory to make sure the components necessary to complete the job are in house and begin compiling hardware based on the contract requirements for the City of Simi Valley. Orders will be immediately placed to ensure proper inventory is available for the project. Once inventory for the City of Simi Valley has been confirmed in- house, Safety Vision will ship the product to the designated installation location. Once the product is shipped in full to the City of Simi Valley, Safety Vision will deliver the completed, tested and fully functional system within the required time of executing the contract.

Safety Vision will work with the designated Project Team at the City of Simi Valley to outline an implementation schedule that is best suited to the City's daily operations.

Once the implementation schedule has been defined and approved, Safety Vision will allocate the required number of technicians to get the installations completed in the proposed timeframe. A recommended installation schedule is included in the bid. The objective is to categorize the same make and models of vehicles to start with. For efficiency purposes, alike makes and models are grouped and assigned for reasons of repetition.

Part of the Lead Technician's responsibilities is to handle the QA/QC process, These are accomplished by several key steps in the process. This process includes Pre/Post signoff sheets for the installs, configuration spread sheet (in .xml format) and signoff sheet. The signoff sheet includes configurations, model and serial numbers, lP/MAC addresses and snapshot of each camera installed to ensure proper views. The purpose of this procedure is to document deficiencies that are found during inspection prior to the installation of Safety Vision mobile equipment. lt will also serve to document any deficiencies that are found during Post installation inspection of the vehicle for the same criteria.

Time will be allocated to provide a golden sample for each type of vehicle. The involvement of the City will be crucial to this section. lnstallation training if needed, and guides will be documented at this point and copies of it will be distributed to the City of Simi Valley personnel for future reference. lnstallation will be accommodated, so there is minimal disturbance of revenue generating vehicles. An indoors bay for install is requested (maybe required if weather is not optimal). Also required are power outlets so technicians can charge drill batteries and other electric tools. There is some involvement from the City of Simi Valley personnel (for pre/post inspections sheets). Vehicles will be completed prior to morning rollout time. Software and hardware training sessions for both the operations and maintenance will be accommodated for different shifts and reps.

Safety Vision tracks all events and milestones from the date of Notice to Proceed, to the point of System Acceptance through a web-based project delivery tracker. All assignments are assigned to Safety Vision internal personnel or End User's responsibility. The assigned Project Manager edits the tasks, assignments, duration, dates and status of completion on a weekly basis.

Safety Vision will remove all existing systems currently installed in vehicles. All removed equipment will be returned to the City of Simi Valley.

Safety Vision will install a first article prototype in order to establish mounting locations, camera views and DVR configurations. All equipment and components, including wiring and cabling, will be installed I

according to the specifications described in the bid document. We will work closely with the City of Simi Valley to determine the installation parameters and provide installation training if needed. After the prototype is approved, Safety Vision will begin the installation of the remaining vehicles all configured in the same manner as the prototype(s).

As vehicles are completed, Safety Vision's on-site Project Manager will provide the City of Simi Valley with a sign-off sheet including images of each camera, serial numbers and a summary of work performed. This would be compared to the previously determined installation parameters and check to verify all is correct.

We would suggest a walkthrough of each vehicle for final approval with a City of Simi Valley Supervisor.

As systems are completed, Safety Vision will compile and submit a weekly list of completed installations to the City of Simi Valley.

Once an installation is complete, the below procedures/steps must be performed:

L. The first installation will be the template for all remaining installations moving forward

2. The customer or a representative authorized to provide approval is required to review and inspect all aspects of the first installation and note any corrections required. lf requirements are within the scope, notification must be communicated back to the project manager who will review the requirement and notify the customer and technicians of the findings.

3. lf customer agrees with the first installation, the technician must provide a completed "lnstallation Acceptance Form". The customer and technician must both sign the document.

4. All remaining installations will match the initial installation and must have its own completed "lnstallation Acceptance Form" completed and signed by both the customer and technician.

At the conclusion of the installations, Safety Vision will conduct training classes for any/all City of Simi Valley employees. USB storage devices including all Safety Vision user manuals will be distributed to every attendee. Safety Vision could also provide these training sessions earlier in the process if the City of Simi Valley intends to utilize the systems before allwork is completed. Documentation will be provided in hard copy and/or electronic media.

Once the installations are complete, all material, tools etc. will be removed from the premises. The warranty period will begin once the vehicle installation is approved.

We first had Safety Vision product installed on Baltimore MTA's fleet as far back as 2006 as a retro-fit, and 2011 as OEM installs from New Flyer. We have a mixed fleet that consists of two NVR vendors, and 6 different models between them. Over the years, Safety Vision has proven to be far more reliable, robust, and truly suited for a mobile/transit environment. Our operating environment is something to be noted, we are the first property that has cracked NOVA Bus's frames when route testing, to where they had to add two additionalframe supports to be considered for our recent 5yr Bus Purchase Contract with them. We currently have 583 of our 780 Fixed Route Vehicle Fleet fitted with Safety Vision and growing We believe this system has saved Baltimore MTA Millions in accident, workplace injury, and other claims made against the agency. lt has also helped to reduce criminal activity while making our patrons feel safe. Safety Vision's various teams have always been very responsive and accommodating, whether it be training, warranty, OEM design and approvals, and any other support.

BACKUP & DISASTER RECOVERY STRATEGY
Backup Plan:

L. Daily image snapshot of the server begins at 07:00 UTC. a. This includes the application's database and all stored video.

2. Snapshots are duplicated across multiple datacenters in different regions within the United States.

3. Snapshots are periodically launched and tested to verify the integrity of the process.

Recoverv Plan:

1. Check the Cloud provider's service health dashboard to determine if the issue is on their end. a. Their response time is < t hour.

2. lf during normal business hours, notify Service Depaftment about the nature of the disaster and that the recovery process will begin.

3. Notify affected customers about the nature of the outage using the current email listing.

4. Launch a new server using the most recent snapshot available.

5. While the new server initiates, perform basic troubleshooting on the problematic server to determine if a root cause can be found.

6. When the new server finishes initiating:
a. Verify that all server health checks pass.
b. Verify that the database has recent data.
c. Verify that the application functions normally.
i. Able to live stream video.
ii. Able to playback stored video.

7. Transfer networking information over to the new server to restore services to customers.

Post-Event Plan:

1. Notify affected customers about the resolution of the outage using the current email listing.

2. Monitor services for next 24 hours to ensure stability.

3. Have Service Department relay any phone calls to the Cloud team regarding any issues with the problematic server.

4. lf the root cause for the server has yet to be discovered, at this point it must be.

5. Complete necessary steps to avoid the problem again, or to mitigate the effect that it can have.

RPO = the delta of time passed since 07:00 UTC. This can be anywhere from 0-24 hours. Video lost on the cloud will be able to be redownloaded from the local recorder.

RTO < 30 minutes. Alarms are in place for Safety Vision to be notified of any detrimental problem to the Cloud service within 5 minutes of it occurring.

B. All steel and iron manufacturing processes must take place in the United States, except m etallurg ical processes involvin g refinement of steel add itives, C. These requirements do not apply to steel or iron used as components or subcomponents of other manufactured products or rolling stock, or to bimetallic power rail incorporating steel or iron components.

RE: Buy America Waivers; Codified as 49 C.F.R. $ 661.7, Appendix A Safety Vision, LLC offers a product line of Hybrid Video Recorders (HVR) devices, and Network Video Recording (NVR) devices. The following devices are included in that anay: Observer@ 4000, observer@ 4l 12, observer@ 4 I I 6, observer@ 48 I 6, observer@ 4120, RoadRecorder@800O, RoadRecorder@84O0 and RoadRecorder@9000-NvR.

According to Federal Transportation Law 49 U.S.C. Chapter 53, Section 5323(OQ)(C), the Federal Transportation Agency (FTA) is permitted to waive its Buy America requirements if applying them would be inconsistent with the public interest. Accordingly, under the FTA's codification of Buy America statues, Appendix A, 49 C.F.R. $ 661.7, a general public interest waiver exists under provisions $661.7 (b) and (c) and "applies to microprocessors, computers, microcomputers, or software, or other such devices, which are used solely for the pu{pose of processing or storing data." Furthermore, all components and subcomponents covered by the waiver may be considered of domestic origin for the purposes of calculating the cost of all components and subcomponents for the purposes of $661 .1 I .

It can be stated with the utmost certainty that the line of Safety Vision HVRs and NVRs mentioned above are used solely for the purpose of processin g and/or storing digital data, with the end result being video formed from that data. Thus, these HVRs and NVRs do fall within the general public interest waiver and are considered of domestic origin, rendering them compliant with Buy America statutes.

Furthermore, the general public interest waiver does "not extend to a product or device which merely contains a microprocessor or microcomputer and is not used solely for the purpose of processing or storing data." The aforementioned Safety Vision HVRs and NVRs are meant solely for the purpose of processing and storing data, with any other use being inconsistent with the scope of its intended purpose.

If you have any further questions or need additional clarification, please do not hesitate to contact Michael Ondruch at7l3-929-1002 or via email at [email protected].

Mr. Don Erickson
Chief Executive Officer
Security Indushy Association
8405 Colewille Road, Suite 500
Silver Spring, Maryland 20910
Dear Mr. Ericlson:

I am writing in response to yow letter dated September 26,2016, asking whether internet protocol (IP) security cameras would be covered under the Federal Transit Administation's €TA) general public interest waiver for microprocessors and microcomputers in Appendix A to section 661.7 of Part 661 of Title 49 ofthe Code of Federal Regulations.

You believe that IP camoras should be included under FTA's microprocessorwaiver, which applies to:
mictoprocessors, computers, microcomputers, or software, or other such devioes, which are used solely for the pu{pose of processing or storing data" This general waiver does not extend to a product or device which merely contains a microprocessor or microcomputer and is not used solely for the purpose of processing or storing data.
49 CFR 661,.7, Appendix A, para. ft).

According to your letter, an IP camer4 also known as a network camera, is a tlpe of digital video cameta that sends and receives data over a computer network using standard network protocols. Citing FTA's April 14, 2008 letter to Dedicated Microso lnc., in which FTA detemrined tliat a digtal video recorder (DVR) was eligible for the microprocessor waiver, you described an IP camera as a o'D\lR with a lens," and "a computer wittr its own IP address, connected directly to a network, and [which] may be placed wherever there is a network connection, including wireless access." You stated that an IP camera is primarily a computer, performing data storage and processing as an integral part of a network, and data storage and processing that allows onboard video analytics to reduce the load on the rest of the computing network. You noted that an IP camera's computing functions are identifiable separate and apart from the other purposes for which they are optimized, and that IP carneras are capable of being employed without using the lens and image se,nsor, utilizing their primary computing function of data storage and processing.
63 63
I
1 2
Noting that FTA's microprocessor waiver does not extend to products or devices that are not used solely for processing or sbring data, you distinguished the IP qamera from a fraditional "closed circuit television" (CCW) security oamera. You note that a CCTV security camera simply captures an analog video signal and tansmits that data over courial cable to a receiver such as a monitor, recorder or other device, which zubsequeirtly processes and stores that data.

You also distinguished an IP camera from a web camera, which can operate only over anetwork when it is connected via a port to a computer with the necessary software installed, where the attached cornputer processes and stores the data.

Based on the foregoing, I agree that IP cameras are eligible for the microprocessor waiver in Appendix A to 49 CFR 661.7. Accordingly, IP cameras may be considered as a Buy Amsrica- compliant component of security and surveillance systems procured with FTA financial assistance. Note, howevet that this waiver does not exteid to the entire secr.uity and surveillance system - other corqponents of the systern that do not meet the definition of a 'omicrocomputer" or'tnictoprocessoro'must still comply with the Buy America requirements as outlined at 49 CFR 661.5(d) in order for a bidder to certiff compliance with the requircments.

Sincerely yours,
Partridge
