provision allows a contractor to request an adjustment to the contract price if unforeseeable new tariffs or tariff increases imposed after bid submission directly raise material or equipment costs. However, the contractor must demonstrate that the cost increases were unforeseeable, unavoidable, and not mitigable, and any adjustment is limited to actual cost increases without added profit or overhead. Consequently, staff recommends rejecting the bids, revising the bid specificatio ns, and re -bidding the contract.

The following alternatives are available to the City Council:

1. Reject all bids received, and authorize staff to revise the bid specification and re- bid for Annual Street Light Maintenance Services, Specification No. SV 25 -32, pursuant to the City’s Purchasing Ordinance Section 2-9.205 Informal and Formal Bidding Procedures: Section (h)(2) Rejection of Bids;

2. Provide other direction to staff.

Staff recommends Alternative No. 1.
