City of Simi Valley
Staff Report
June 22, 2026
To: City Council
From: Public Works Department
Ron Fuchiwaki, Public Works Director
Subject: A public hearing to consider the proposed fiscal year 2026-27 assessments for Simi Valley Landscape District No. 1 and adoption of a resolution approving the assessments
Staff Recommendation
It is recommended that the City Council (1) open the public hearing (Attachment A); (2) receive verbal and documented testimony; and (3) after receiving the evidence from the public hearing, adopt Resolution No. 2026-31 (Attachment B) approving the FY 2026-27 assessments for Simi Valley Landscape District No. 1 pursuant to Streets and Highways Code § 22624.

Background
Simi Valley Landscape District No. 1 operates under the authority of the California Landscaping and Lighting Act of 1972. There are a total of 99 landscape zones in the District, including 48 active zones (one of which encompasses all City-controlled areas), and 51 contingency fallback zones (Attachment C). Active zones are maintained by the City and partially funded through assessments paid by property owners within each active zone, and the City’s General Fund. Fallback zones are maintained by Homeowners Associations or the property owners.

On May 4, 2026 , the City Council initiated the Landscape District No. 1 (District) assessment review process. The purpose of this public hearing is for the City Council to consider the proposed FY 202 6-27 assessments for Simi Valley Landscape District No.

1. It is recommended that the City Council approve the FY 2026-27 assessments, which will remain unchanged at their current levels.

Discussion
The staff report (without attachments) from May 4, 202 6, is included for reference (Attachment D). In sum, the City continues to subsidize the District with General Fund monies totaling $947,190 for FY 2026-27.

If the Council were interested in increasing assessments, the City would be required to follow the Proposition 218 (Prop 218) process. Under Prop 218, an “assessment” constitutes “a levy or charge upon real property … for a special benefit conferred upon the real property.” A “special benefit” is “a particular and distinct benefit over and above Agenda Item No.
5D
general benefits conferred on real property located in the district or to the public at large.” The assessment must be supported by a detailed engineer’s report prepared by a registered professional engineer certified by the State of California.

Assessments already existing on the effective date of Prop 218 were generally required to comply with Prop 218 by July 1, 1997. However, assessments such as those imposed by the District since its inception in 1973 were exempt from this deadline. The existing District assessment predates Prop 218. If the City seeks to increase the assessments, the entire amount of each assessment, not just the difference between the existing and the proposed (higher) assessment , must be calculated and justified in accordance with Prop 218.

As noted above, pursuing an adjustment to the assessments would require an investment by the City to complete the engineer’s report, provide public education, and conduct an election in which property owners would be required to vote. Unless directed otherwise, staff will continue to use the existing assessments while seeking cost-saving measures to reduce the financial burden on the City’s General Fund.

Resolution No. 2026-31, which establishes the FY 2026-27 assessments for Simi Valley Landscape District No. 1 , is included and features a map of the landscape zones . The Engineer’s Report (Attachment E), approved by the City Council on May 4, 2026, for purposes of initiating the FY 2026 -27 assessment process, shows the proposed assessments for each zone, the projected costs, including the recommended essential improvements, the estimated beginning balances, and the projected ending balances.

Also attached is a summary of the proposed assessments by zone (Attachment F).

If the proposed assessments are not approved, Landscape District No. 1 will not receive approximately $790,267 in assessment revenue for FY 2026-27. As a result, maintaining current maintenance levels may require additional General Fund support (up to $790,267), reductions in maintenance services within the assessment zones , or a combination of both.

Financial Impact

The FY 2025 -26 assessments were $790,267. There is no change to the current assessments proposed for FY 2026-27.

City Council Priority

This item supports the Thriving Community Pillar of Excellence as outlined in the City Council goals.

Suggested Motion

I move to adopt Resolution No. 202 6-31 approving the FY 202 6-27 assessments for Simi Valley Landscape District No. 1 pursuant to Streets and Highways Code § 22624.

Subject: Adoption of a resolution initiating the Fiscal Year 2026 -27 assessment process for Landscape District No. 1
Staff Recommendation
It is recommended that the City Council consider initiating the Landscape District No. 1 assessment process for Fiscal Year (FY) 202 6-27 by adopting Resolution No. 202 6-11 (Attachment A) declaring the City Council’s intent to levy and collect assessments for FY 2026-27 in Simi Valley Landscape District No. 1 pursuant to Streets and Highways Code § 22624 and set a public hearing for June 22, 2026.

Background
In 1973, the City Council formed Landscape District No. 1 (District)947190 to provide for the continued maintenance of enriched landscaping along arterial streets and other prominent areas, which is a goal of the City’s General Plan. The District is operated under the authority of the Landscaping and Lighting Act of 1972. Since the formation of Landscape District No. 1, a total of 99 zones were placed into the District. There are 48 active zones (one of which encompasses all City -controlled areas, Zone 39) and 51 contingency fallback zones.

Active zones are maintained by the City, funded through assessments to the property owners within each active zone, and supplemented by other City funds. Fallback zones are generally maintained by homeowners’ associations and/or the property owners. The City has the authority to convert the fallback zones to active status in the event they are not maintained to City standards. Thus far, it has not been necessary for the City to assume maintenance responsibilities for any fallback zones. However, if the City were to convert a fallback zone to active status, the initiation of assessments to pay for the maintenance costs would be subject to the property owner voting requirements of Proposition 218.

Discussion
Since 1973, the cost to maintain the landscape district has exceeded the revenue received from assessments. In FY 1999-00, the City Council approved the establishment of a Landscape Zones Augmentation Fund to offset the deficit. These funds were needed to augment balances in existing zones to ensure that funds cover the landscaping costs Agenda Item No.

Consent (6)
Attachment D
9 for all zones at the end of each fiscal year. With rising maintenance and utility costs and the need to repair and replace aging irrigation equipment and backflow devices in the landscape zones, the augmentation amount for FY 2026-27 is $947,190.

Staff continues to take steps and explore opportunities to reduce costs. The landscape maintenance contracts were modified to include new maintenance requirements and specifications for landscape maintenance services, reducing the frequency of certain tasks and applications required under the contract while still maintaining the aesthetics of the City’s landscaping. Additionally, the City secured turf replacement rebates from the Metropolitan Water District for turf removal projects in several zones. Beginn ing in FY 2023-24, the City removed approximately 179,044 square feet of turf and received $608,602 in rebates from the Metropolitan Water District to date. The rebate funds will be reinvested in additional turf reduction projects within Landscape District zones. In FY 2025-26, the City participated in the Turnkey Turf Transformation Participation Program, a no-cost opportunity for the City to renovate the existing non-functional turf landscaping at the Simi Valley Civic Center. A total of 110,006 square feet of non-functional turf areas of the Civic Center area were replaced with California-friendly landscapes and efficient irrigation.

Water restrictions previously adopted by the City Council had reduced the “Utilities” costs in the assessment zones. In zones where turf is present and irrigation was reduced, water usage and costs have decreased. With the lifting of water restrictions in FY 22-23 and the return of normal levels of landscape irrigation, followed by dry conditions and increased water commodity costs, utility expenditures have increased. Utility costs are anticipated to exceed the adopted FY 2025-26 budget of $550,200. The projected total utility cost for FY 2026-27 is estimated at $689,401, with t he majority of the increase attributable to water usage and nearly 73% of the augmentation amount.

Initiation of FY 2025-26 Assessment Process

The Engineer’s Report (Attachment B) was prepared for the purpose of initiating the assessment process. This report shows the proposed assessment of each zone, the projected cost, including the recommended essential improvements, the estimated beginning balances, and the projected ending balances. A vicinity map of the various landscape zones is also attached (Attachment C).

It is customary for the public hearing to consider the proposed assessments to be held annually in May or June. Adoption of the attached Resolution will provide evidence of the City Council’s intent to levy assessments, approve the Engineer’s Report, and set the date of the required public hearing. It is recommended that the public h earing be set for June 22, 2026. This will allow sufficient time to meet the Ventura County Tax Assessor’s deadline for the first week of July, ensuring the collection of assessments on the County property tax roll.

The FY 202 5-26 assessments were $790,267. There is no change to the current assessments proposed for FY 202 6-27. It is recommended that the City Council initiate the Landscape District No. 1 assessment process for FY 2026-27. 10 Financial Impact
