City of Simi Valley
Staff Report

June 22, 2026

To: City Council

From: Department of Environmental Services
Stratis Perros, Environmental Services Director

Subject: Award and execute three separate contracts to Amy Milanes, Fortis Construction Services, Inc., and m6 Consulting, Inc. for building plan review services, Request for Proposals (RFP) No. ES 26-01

Staff Recommendation

It is recommended that the City Council:

1. Award contracts to Amy Milanes (Attachment A), Fortis Construction Services, Inc. (Attachment B) and m6 Consulting, Inc. (Attachment C) for building plan review services in individual not -to-exceed amounts of $25,000 for a cumulative total of $75,000 for a period of one year, with an option to extend for one additional one- year term; and

2. Authorize the City Manager to approve and execute contract amendments and incorporate future budgeted and appropriated funds, as necessary.

Background

The City of Simi Valley (City) has historically contracted with skilled consultants to provide building plan review (also called plan check) services on an on- call, as-needed basis.

They supplement the work of City-staffed Plan Check Engineers by ensuring that building plans submitted through the permitting process comply with the California Code of Regulations Title 24, California Building Standards Codes , as adopted and amended by City Ordinance. The consultants are engaged during periods of increased workload to ensure that the Building and Safety Division meets its turnaround goals and maintains a high level of customer service for building permit applicants.

On May 1, 2026, Request for Proposals ES 26- 01 was electronically transmitted to four firms on a Bidders List and posted on the City’s website. By May 11, 2026, eight (8) proposals were received from Amy Milanes, Bureau Veritas North America, Inc., Fortis Construction Services, Inc., JAS Pacific, m6 Consulting, Inc., Shums Coda Associates, Transtech Engineers, Inc., and True North Compliance.

Discussion

Staff evaluated the eight (8) proposals and scored each using a rubric with criteria in the following categories:

Agenda Item No.

Consent (6)

• Proposer’s understanding of the Statement of Work (25%) • Proposer’s approach to performing the tasks defined in the Statement of Work (25%)
• Capability of Proposer and key project personnel to handle the work in terms of workload, experience, and efficient utilization (25%)
• Cost proposal (25%)

The evaluators ranked the consultants’ proposals as summarized below:

Consultant Rank
Amy Milanes 1
Fortis Construction Services, Inc. 2
m6 Consulting, Inc. 3
JAS Pacific 4
True North Compliance 5
Shums Coda Associates 6
Bureau Veritas North America, Inc. 7
Transtech Engineers, Inc. 8

Amy Milanes, Fortis Construction Services, Inc. and m6 Consulting, Inc. ranked the highest and were found to be responsive, met the qualification requirements, and have competitive rates.

Amy Milanes and Fortis Construction Services, Inc., currently have contracts with the City that will expire on June 30, 2026. They have provided excellent service to the satisfaction of staff for four years. The ranking committee staff was impressed with m6 Consulting, Inc.’s approach to quality control and supervision, and that it has local building and safety experience, being located in Moorpark.

Contracting with three consultants ensures availability should one become unavailable for various reasons. It also allows the Building and Safety Division to take advantage of the consultants’ diverse specialties in specific disciplines.

Financial Impact

The amount of each contract is $25,000 for a cumulative total of $75,000. The funds for this service are included in the operating budget for the Department of Environmental Services in the FY 2026-27 Budget. Most expenses will be recovered through revenues from Plan Check Services Fees paid by applicant developers.

City Council Priority

This item supports the Excellent City Government Pillar of Excellence by ensuring timely building plan review by qualified engineers.

CONSULTANT will retain such financial and program service records for at least four (4) years after termination or final payment under this Agreement.

21. INSURANCE.

A. Before commencing performance under this Agreement, and at all other times this Agreement is effective, CONSULTANT must procure and maintain the following types of insurance with coverage limits complying, at a minimum, with the limits set forth below:

Agreement No. 3260170
Amy Milanes

Page 8 of 18 ends

The minimum insurance requirements and limits of these requirements does not in any way represent or imply that the minimum insurance coverage required is sufficient to cover the CONSULTANT’s obligations under this Agreement. The indemnity obligations in this Agreement are not in any way limited by the minimum insurance requirements contained in this Agreement. The defense and indemnity obligations shall survive the termination or completion of this Agreement and are independent of and not in any way limited by the insurance requirements of this Agreement.

B. Commercial general liability insurance will meet or exceed the requirements of the most recent ISO-CGL Form. The amount of insurance set forth above will be a combined single limit per occurrence for products and completed operations, bodily injury, personal and advertising injury, and property damage for the policy coverage. Liability policies will be endorsed to name City of Simi Valley , its boards, officials, agents, and employees as “additional insureds” under said insurance coverage and to state that s uch insurance will be deemed “primary and non -contributory” such that any other insurance that may be carried by City will be excess thereto. Such insurance will be on an “occurrence,” not a “claims made,” basis and will not be cancelable or subject to reduction except upon thirty (30) days prior written notice to City.

C. Automobile coverage will be written on ISO Business Auto Coverage Form CA 00 01 06 92, including symbol 1 (Any Auto).

Such extended insurance will have the same coverage and limits as the policy that was in effect during the term of this Agreement, and will cover CONSULTAN T for all claims made by City arising out of any errors or omissions of CONSULTANT, or its officers, employees or agents during the time this Agreement was in effect.

E. CONSULTANT will furnish to City duly authenticated Certificates of Insurance evidencing maintenance of the insurance required under this Agreement, endorsements as required herein, and such other evidence of insurance or copies of policies as may be reasonably required by City from time to time. F. Should CONSULTANT, for any reason, fail to obtain and maintain the insurance required by this Agreement, City may obtain such coverage at CONSULTANT’s expense and deduct the cost of such insurance from payments due to CONSULTANT under this Agreement or terminate.

G. Self-Insured Retention/Deductibles. All policies required by this Agreement must allow CITY, as additional insured, to satisfy the self -insured retention (“SIR”) and deductible of the policy in lieu of CONSULTANT (as the named insured) should CONSULTANT fail to pay the SIR or deductible requirements. The amount of the SIR or deductible is subject to the approval of the City Attorney and the Finance Director. CONSULTANT understands and agrees that satisfaction of this requirement is an express condition precedent to the effectiveness of this Agreement. Failure by CONSULTANT as primary insured to pay its SIR or deductible constitutes a material breach of this Agreement. Should CITY pay the SIR or deductible on CITY’s behalf upon the CONSULTANT’S failure or refusal to do so in order to secure defense and indemnification as an additional insured under the policy, CITY may include such amounts as damages in any action against CONSULTANT for breach of this Agreement in addition to any other damages incurred by CITY due to the breach.

H. CONSULTANT hereby grants to C ITY a waiver of subrogation which any insurer may acquire against CITY , its officers, officials, employees, and volunteers, from CONSULTANT by virtue of the payment of any loss.

CONSULTANT agrees to obtain any endorsement that may be necessary to affect this waiver of subrogation, but this provision applies regardless of whether or not the CITY has received a waiver of subrogation endorsement from the insurer. The Workers’ Compensation policy shall be endorsed with a waiver of subrogation in favor of the C ITY for all work performed by the CONSULTANT, its employees, agents, and subcontractors.

I. The CONSULTANT may use Umbrella or Excess Policies to provide the liability limits as required in this agreement. This form of insurance will be acceptable provided that all of the Primary and Umbrella or Excess Policies shall provide all of the insurance coverages herein required, including, but not limited to, primary and non-contributory, additional insured, Self-Insured Retentions (SIRs), indemnity, and defense requirements. The Umbrella or Excess policies shall be provided on a true “following form” or broader coverage basis, with coverage at least as broad as provided on the underlying Commercial General Liability insurance. No insurance policies maintained by the Additional Insureds, whether primary or excess, and which also apply to a loss covered hereunder, shall be called upon to contribute to a loss until the CONSULTANT’s primary and excess liability policies are exhausted.

Accordingly, and notwithstanding any other provision of this Agreement as to ownership, CITY specifically rejects ownership of such Documents. CONSULTANT is required to indemnify and defend CITY to the fullest extent allowed by applicable law should it violate this Section.

Any provision in this Agreement that may appear to give CITY the right to direct CONSULTANT as to the details of doing the work or to exercise a measure of control over the work means that CONSULTANT will follow the direction of the CITY as to end results of the work only.

20. AUDIT OF RECORDS. CONSULTANT will maintain full and accurate records with respect to all services and matters covered under this Agreement. 21. INSURANCE.

A. Before commencing performance under this Agreement, and at all other times this Agreement is effective, CONSULTANT must procure and maintain the following types of insurance with coverage limits complying, at a minimum, with the limits set forth below:

Minimum Scope and Limit of Insurance
Coverage shall be at least as broad as:

Type of Insurance Limits (combined single)

Commercial general liability: $2,000,000
Professional Liability $2 ,000,000

D. Professional liability coverage will be on an “occurrence basis” if such coverage is available, or on a “claims made” basis if not available.

21. INSURANCE.

A. Before commencing performance under this Agreement, and at all other times this Agreement is effective, CONSULTANT must procure and maintain the following types of insurance with coverage limits complying, at a minimum, with the limits set forth below:

Page 8 of 20 ends

D. Professional liability coverage will be on an “occurrence basis” if such coverage is available, or on a “claims made” basis if not available.
