PW 25-02
Staff Recommendation
It is recommended that the City Council:
1. Approve the second contract amendment (Attachment A) to the Professional Services Agreement with Burns Engineering, Inc. (Burns Engineering) to include professional construction management support services for the Battery Electric Van Charging Infrastructure Project, in an amount of $86,163.34, increasing the total contract amount from $406,523.73 to $492,687.07; and
2. Authorize the City Manager to approve subsequent contract amendments to incorporate future budgeted funds into the contract amount.
Background
The City is undertaking two Battery Electric Vehicle charging infrastructure projects: one for six (6) battery electric buses (BEBs) and another for seven (7) battery electric vans (BEVs). For the six (6) BEBs charging infrastructure project, the City entered into a Professional Services Agreement with Burns Engineering on February 23, 2026, in an amount not to exceed $396,564.71 for professional architectural and engineering design and construction management services. The City also approved a $53,435.29 contingency fund to cover unforeseen costs and authorized the City Manager to approve amendments up to a total contract amount of $450,000. On July 6, 2026, the City executed the first contract amendment with Burns Engineering in the amount of $9,959.02 to include evaluation of an interim off-grid electric vehicle charging solution for the six (6) BEBs, increasing the contract amount to $406,523.73.
For the seven (7) BEVs charging infrastructure project, the City contracted with Siemens Industry, Inc., utilizing a Sourcewell Cooperative Contract, to coordinate with Southern California Edison (SCE) on the electrical infrastructure design. Siemens Industry, Inc. has primarily performed this work through its subcontractor, Linkture Corp. The City has completed the design for the seven (7) BEVs charging infrastructure, procured the Electric Agenda Item No.
Consent (2)
Vehicle Supply Equipment (EVSE), and is finalizing the bid documents for solicitation of a construction contractor.
To support the construction phase of the seven (7) BEVs charging infrastructure project, the City proposes to amend its existing Professional Services Agreement with Burns Engineering to include professional construction management support services for the BEV charging infrastructure project. The proposed second contract amendment, in the amount of $86,163.34, would increase the total contract amount from $406,523.73 to $492,687.07.
Discussion
As the seven (7) BEVs charging infrastructure project enters construction, professional construction management support services are required to oversee the installation of the electric vehicle charging equipment and coordinate with the construction contractor, SCE, EVSE supplier, and other project stakeholders.
The City's experience with the electric vehicle infrastructure projects has shown that coordination among multiple consultants, the utility provider, equipment suppliers, and rebate programs can be challenging and may result in delays. Burns Engineering has already completed the electrical infrastructure and electrical demand analysis for the City's electric vehicle charging buildout, performed the transit facility yard evaluation, and has been closely involved in coordination with SCE regarding the City's electrical service and transformer upgrades. Having Burns Engineering provide construction management support for the seven (7) BEVs charging infrastructure project will ensure continuity and establish a single point of technical coordination for the City's related electric vehicle infrastructure.
Staff therefore recommends adding the construction management support services for the seven (7) BEVs charging infrastructure to the City's existing Professional Services Agreement with Burns Engineering. This approach is expected to improve communication and coordination, reduce duplication of effort, and minimize potential delays during construction.
Burns Engineering has submitted a proposal in the amount of $86,163.34 for the additional construction management support services for the seven (7) BEVs charging infrastructure project. The proposed services include review of bid document specifications, a pre-construction and kick-off meeting, construction management support before and after contract award, review of Requests for Information, material and equipment submittals, design clarifications, construction compliance, contract issues, EVSE commissioning, charging management system integration, and related technical coordination.
The proposed second contract amendment will increase the Burns Engineering contract from $406,523.73 to $492,687.07. The proposed amendment represents approximately
21.7% of the initial contract amount. Burns Engineering’s initial agreement was for design 2 and construction management services for the six (6) BEBs charging infrastructure project.
In accordance with City Purchasing Ordinance Chapter 9, Article 1, Section 2-9.110(c), City Council approval is required for this amendment because it exceeds the City Manager’s authority to approve amendments up to 10% of the original contract amount or $100,000, whichever is less, when the additional work is reasonably related to the original scope of work. The proposed amendment adds construction management support services for the separate seven (7) BEVs charging infrastructure project.
Therefore, staff recommends that the City Council approve the second contract amendment in the amount of $86,163.34, increasing the total contract amount to $492,687.07.
Staff also recommends authorizing the City Manager to approve subsequent contract amendments to incorporate future budgeted funds into the contract amount.
Financial Impact
The cost of this action was included in the FY 2025-26 Adopted Budget under the Electric Vehicles Infrastructure Project, CP75000014, RFP No. PW 25-02. The project funding was carried forward to FY 2026-27 and is available for this action. The City will utilize Senate Bill 125 funding to support this action. No appropriation is required. This action has no impact on the City’s General Fund.
City Council Priority
This item supports the Reliable Infrastructure Pillar of Excellence.
Suggested Motion
I move to:
1. Approve the second contract amendment to the Professional Services Agreement with Burns Engineering to include professional construction management support services for the BEVs Charging Infrastructure Project, in an amount of $86,163.34, increasing the total contract amount from $406,523.73 to $492,687.07; and
2. Authorize the City Manager to approve subsequent contract amendments to incorporate future budgeted funds into the contract amount.

- There are no telecommunications additions to this scope. EVSE will be shipped with SIM Cards from manufacturer. Any communications construction scope (new telecommunications lines, fiber lines, ethernet, wireless, etc.) or procurement of new SIM cards are excluded.
- Burns is not responsible for delays caused by factors beyond its reasonable control, including but not limited to acts of God, force majeure events, adverse weather 21 conditions, labor disputes, shortages of labor or materials, governmental actions, utility interruptions, permit or agency review delays, contractor, subcontractor, supplier, vendor, utility, or other third-party delays, failed inspections, rework, retesting, commissioning delays, or delays resulting from the Client’s failure to provide timely information, approvals, access, or direction. Pricing is based on one (1) mobilization and the schedule assumptions stated herein. If the project duration, phasing, sequencing, working hours, mobilization requirements, or level of effort changes for reasons outside Burns’ control, Burns shall be entitled to an equitable adjustment in fee and schedule. - Proposal is a supplement to Project PW 25-02. Unless expressly modified herein, the work will be performed and invoiced under the applicable master contract terms, general project scope, and assumptions provided in Burns’ amended proposal dated January 09, 2026.
Sincerely,
