38 SUBJECT: Resolution No. 6326, A Resolution of the City Council of the City of Soledad Declaring Surplus Equipment and Authorizing the Sale, Donation or Disposal of Such Property
TO: Honorable Mayor Velazquez and City Council
FROM: Jessica Potts, Parks and Recreation Director
MEETING DATE: February 18, 2026

CITY OF SOLEDAD

STAFF REPORT
THROUGH: Megan Hunter, City Manager
AGENDA ITEM NO. 3.

Recommendation
It is recommended that the City Council of the City of Soledad adopt Resolution No.6326, “Declaring Surplus Equipment and Authorizing the Sale, Donation or Disposal of Such Property.” Executive Summary
City property may be deemed surplus due to factors such as age, high maintenance costs, obsolescence, or other relevant reasons. Disposal of this property cannot occur until the City Council officially declares it surplus. In past years, surplus property has included vehicles, office furniture and equipment, computers, tools, unclaimed recovered property, and various miscellaneous items.

Currently, the Parks and Recreation Department has one large piece of equipment that is no longer in use and is not suitable for continued operations at the Soledad Community Center. The item is a portable dance floor system originally purchased for special events. Due to its size, weight, safety risks, and limited practical benefit, staff have discontinued its use and are requesting authorization to declare the equipment surplus so it may be sold, donated, or disposed of in accordance with City policy.

Background
In previous years, the City Council has declared property not in use or obsolete, surplus property, and authorized the sale, donation, destruction, or disposal of said property. The surplus property consists of a 20’x20’modular dance floor, as detailed in “Exhibit A”.

The portable dance floor was purchased in 2021 in conjunction with the opening of the Soledad Community Center and the City’s Centennial Gala. The system consists of a 20’x20’ modular dance floor designed for temporary installation at events.
39 Review & Analysis
Staff have assessed the functionality of the portable dance floor during real-world use and concluded that it is not suitable for ongoing City events or rentals. The system is very heavy, making it difficult for staff to install and remove safely. During setup, the panels can scratch and damage the gym flooring in the facility, leading to additional maintenance issues and potential liability concerns.

Additionally, the dance floor does not adequately serve its intended purpose. Due to its relatively small size within the overall gym space, event guests often do not use the designated floor and instead continue dancing on the main gym floor. As a result, the equipment does not meaningfully protect the facility's flooring or improve event operations.

A review of the equipment confirms that the portable dance floor is no longer useful or appropriate for City operations and occupies substantial storage space that could be put to better use. Continued use presents the following issues:

Safety risks to staff due to the heavy lifting required for installation and removal Damage to the gym floor during setup and removal
Liability exposure related to improper installation or tripping hazards Inefficient use of storage space
Minimal benefit to event operations
Under Government State Code Section 37350 – 37351, the City has the ability to dispose of property for the common benefit of the City. Based on staff experience and operational assessment, this equipment meets the criteria for surplus property.

The original purchase cost of the dance floor is estimated to have been approximately $20,000. While the equipment may still have resale value, particularly to private event companies, it will be offered strictly “AS IS,” without warranty or guarantee. Any buyer will be responsible for transportation, installation, and compliance with all safety requirements.

City staff will make reasonable efforts to sell the equipment to an interested party. Because this is specialized equipment, staff will reach out to hotels in Monterey County or other similar event venues in an attempt to sell the floor. If no viable sale is achieved, staff will explore donating to a nonprofit organization or disposing of the property in accordance with City procedures.

Financial Considerations
The sale, donation, or disposal of the property will have minimal financial impact. Any proceeds from a sale will be recorded as revenue in the General Fund. This process will free up needed storage space at the Community Center and reduce ongoing liability and maintenance risks associated with retaining unused equipment. Attempting to sell the property sooner rather than later will help in maximizing the likely resale value, especially if the equipment further deteriorates in storage.

Strategic Plan Alignment
Removing the outdated dance floor will further Objective 4.1.3 – Expand and modernize the Community Center. This action will create additional storage for program needs and may lead to funding that can be reinvested in the Community Center.

Alternatives
Adopt the Resolution
40 Resolution No. 6326
Exhibit A - Dance Floor Surplus
Do not surplus the property. This is not recommended as the equipment is no longer in use and continued storage provides no benefit to the City.

Planning/CEQA
The approval and declaration of surplus property is not considered a project for purposes of CEQA since it has no potential for resulting in either a direct or indirect impact to the environment. (See CEQA Guidelines Section 15378.)
Public Notice Requirements
None required.

AGENDA ITEM NO. 4.

Recommendation
It is recommended that the City Council of the City of Soledad consider and adopt Resolution No.6327, “A Resolution of the City Council of the City of Soledad Approving a Contract Change Order for Construction Services with Monterey Peninsula Engineering (MPE) for the Amount of $33,302.30 for a Total Amount of $957,089.19 for the Soledad Fire Department Aerial Apparatus Bay (Phase 2) Sitework Project, and Approving the Respective Budget Amendments and Authorizing the City Manager to Execute said Contract Change Order on Behalf of the City of Soledad”.

It is recommended that the City Council of the City of Soledad consider and adopt Resolution No.6328, “A Resolution of the City Council of the City of Soledad Accepting the Soledad Fire Department Aerial Apparatus Bay (Phase 2) Sitework Project as Complete by Monterey Peninsula Engineering (MPE) and Authorizing the Release of Retention in the Amount of $47,854.46”.

Executive Summary
Contract Change Order No. 4: This change order is for the Aerial Apparatus Bay Project, Phase 2, 45 which includes the additional scope of work to have Monterey Peninsula Engineering (MPE) install an additional 20 linear feet of 4-inch PVC for the water service to establish a connection per the updated fire plans, and the installation of trench drains on the Monterey Street driveway approach to achieve the desired slope to provide enough clearance for the ladder truck and avoid sustaining damages from the underside of the vehicle.

This change order also includes various miscellaneous credits and time and materials (T&M) items that occurred during the life of this project. The credit items included the removal of the electrical conduits, concrete curb islands, paving near the existing container and gas fueling tank, striping, and special inspection testing. The T&M items resulted from various items that were required to be completed to accommodate the sitework plans and/or to ensure continued operation of the facility such as but not limited to: demolition of the sally port, installation of header board and reinstallation of the pavers, and the undergrounding of the overhead wires between the police and fire departments.

Therefore, Staff is recommending that the City Council consider and approve both the proposed contract change order No. 4 in the amount of $33,302.30 and the respective budget amendment in the amount of $12,912.19 for FY 25/26 from the Fire Impact Fund. This is the final change for this project.

Acceptance and Retention Release: MPE's work has been completed and inspected. Staff recommends the acceptance of the Soledad Fire Department Aerial Apparatus Bay (Phase 2) Sitework Project and the release of the retention payment to MPE.

Background
The City received funding through a State of California earmark from Senator Caballero for $2 million to purchase a new fire engine with a ladder attachment. Subsequently, on January 11, 2023, the Soledad City Council authorized the purchase of a 2023 Sparta/Smeal 105-foot Quint Aerial Apparatus (Ladder Truck). Unfortunately, the existing fire station bay is too small for this new apparatus, requiring the construction of a new apparatus bay to house and protect the ladder truck. As a result, City Council authorized Staff to initiate design work for the new apparatus bay.

Design of the Soledad Fire Department Aerial Apparatus Bay Project was completed in two phases 1 – the prefabricated building and foundation; and Phase 2 – site improvements and utility connections necessary for the siting of the new apparatus bay.

On May 15, 2024, Council approved a contract for construction services with MPE in the amount of $359,000 plus 5% Contingency for a total not to exceed $376,950 for Phase 1 of this project.

On August 21, 2024, the City Council approved a contract for construction services with MPE in the amount of $858,343 plus 10% Contingency ($85,834) for a total not to exceed $944,177 for the Soledad Fire Department (CALFIRE) Aerial Apparatus Bay Project Phase 2 of this project.

Review & Analysis
This contract change order (CCO) reflects the miscellaneous additional work items completed by the contractor throughout the life of the project that was tracked on time and materials (T&M) and other necessary work to complete the project. The breakdown of the change order is as follows:

Underground Fire Service: $5,100 - Due to the updated plans, the underground fire service for the fire sprinklers and wharf hydrant required an additional 20 LF of 4” PVC service lateral to establish the 46 connection. This modification was made based on the fire review from the permitting process.

Monterey Street Trench Drain: $3,795.96 - Fire Department Staff expressed concerns with the dip in the driveway approach from Monterey Street and the height clearance with the new ladder truck. To avoid future complications and potentially damaging the City’s newest investment, trench drains were installed to achieve the desired slope for the ingress/egress of the ladder truck.

Miscellaneous Credits: $19,523.90 (Deductive) –After consideration of the existing conditions and available space, items within the contract were not completed per the bid per the direction of the City.

These items included but were not limited to underground electrical conduits to the fire apparatus bay building (it was getting its own dedicated electrical service) from the existing fire station, concrete curb islands in the parking lot, paving near the existing container and gas fueling tank (it would have been costly to remove and reinstall the existing equipment), striping, and special inspection testing.

Miscellaneous Time and Materials (T&M): $43,930.24 – As part of this project, various unforeseen items during the life of this project that required to be completed to accommodate the sitework plans and/or to ensure continued operations of the facility on a T&M basis per staff’s direction. These items included the demolition of the sally port (to ensure adequate space for turning movements and creating more open space for the police department), installation of header boards and reinstallation of pavers during the paving operations at the parking lot, the undergrounding of the overhead wires between the police and fire departments (to avoid vertical clearance issues with the ladder truck and exercising the ladder as required to complete routine maintenance of the vehicle), the hauling of salvaged materials, and the reconstruction of the storm drain inlet for drainage in the parking lot.

This change order formally captures the outstanding work to date that was not covered by the original project base bid or any of the previous contract change orders. Therefore, Staff recommends that the City Council consider and approve this CCO so that Staff may formally close this project. A full description with supporting documentation is attached to this Staff Report as Exhibit A.

Acceptance and Retention Release: During the project's construction phase, some modifications were made to the agreement to reflect the needs and goals of the project in a total of four (4) CCOs. A breakdown of the individual CCOs can be found in the financial consideration section of this staff report below.

Public Works Staff have inspected and reported that the Soledad Fire Department Aerial Apparatus Bay (Phase 2) Sitework Project work has been completed according to the project documents, and all work performed by MPE is now complete. Therefore, Staff recommends that the City Council accept the project as complete and release the retention.

Financial Considerations
This contract change order and additional funding requests shall be funded by Fire Impact Fees. The breakdown of the costs so far is as follows:
$858,343 Original Construction Contract Amount
$85,834 Construction Contingency (10% of the Original Contract) $20,000 CCO 1: To cover the additional costs of having the paving crew perform half of the paving 47 to allow for the Police Department to continue daily operations on a paved parking lot. Approved administratively utilizing the construction contingency. $6,443.89 CCO 2: To cover the additional scope of work to have MPE reinstall the loop detectors on the Soledad Street gate and driveway and to install geotextile fabric to provide additional structural support of the road base to account for the increased use and loading of the ladder truck. Approved administratively utilizing the construction contingency. $39,000 CCO 3: The additional scope of work to perform a new driveway approach on Main Street to provide both police and fire department a secondary ingress/egress to the facility and ensure a smooth transition onto the street when addressing emergency calls in addition to installing a wharf hydrant and water spigot to enable the Fire Department the ability to fill and clean the ladder truck within a secured area. Approved administratively utilizing the construction contingency. $33,302.30 CCO 4: (This Change Order)
$957,089.19 – Final Construction Contract Amount
This project has a remaining contingency balance of $20,390.11 that shall help cover the cost of the $33,302.30 change order. Additionally, Phase 1 of the Fire Apparatus Bay Project had remaining funding from the trench drain allowance in the amount of $4,038.22 that can be used to also cover the change order amount. Staff is recommending increasing the project funding from the Fire Impact Fund in the amount of $12,912.19 for FY 25/26.

Strategic Plan Alignment
This project advances Objective 6.5.2 – Maintain and Upgrade Firefighting Infrastructure, Equipment, and Facilities.

Completing site work for the apparatus bay helps the City update and modernize its fire service infrastructure to address the community's growing needs and ensure safe, effective operations.

FROM: Beatriz Trujillo, Community and Economic Development Director and Ariana Mora, Senior Planner
MEETING DATE: February 18, 2026

CITY OF SOLEDAD

STAFF REPORT
THROUGH: Megan Hunter, City Manager
AGENDA ITEM NO. 1.

Recommendation
It is recommended that the City Council of the City of Soledad consider waiver of reading, adoption and reading by title only of Ordinance No. 774, an Ordinance of City Council of the City of Soledad Amending the Downtown Specific Plan Section 2.0- Zones of Chapter 5.0- Development Code and Chapter 10.0- Definitions, to Establish Separate Veterinary Services and Animal Boarding Uses and to Conditionally Allow Small Scale Veterinary Services in the Downtown Core District.

Executive Summary
The SPCA of Monterey County approached the City regarding the possibility of providing limited veterinary services in Downtown Soledad. However, the Downtown Specific Plan currently prohibits veterinary-related services, regardless of scale. At the time of the request, particularly following the closure of the City’s only veterinary clinic, staff sought City Council direction on whether an amendment to the Specific Plan would be supported.

On February 4, the City Council considered amendments to allow veterinary services within the Downtown area. During the meeting, the SPCA indicated they may pursue an alternative location.

Nevertheless, the underlying objective remains unchanged: to facilitate access to veterinary services in Soledad. Accordingly, it is recommended that the Council proceed with adoption of the amendment.

Even with the proposed change, veterinary services would remain subject to substantial oversight, including public notification and approval through a Minor Use Permit process. The proposed amendment is also consistent with the City’s recently adopted Strategic Plan. 97 Background
The Downtown Soledad Specific Plan (DSP) establishes zoning districts and land use regulations to guide development within Downtown Soledad. Land uses are categorized as permitted, permitted with a Minor Use Permit, permitted with a Conditional Use Permit, or prohibited. This framework is intended to ensure compatibility among uses while promoting a balanced and vibrant downtown environment.

In response to the SPCA's interest in locating in Soledad, staff sought direction from the City Council on October 15, 2025, regarding how veterinary uses are currently regulated under the DSP. The City Council directed staff to prepare amendments to clarify veterinary-related land use classifications and to allow small-scale, appointment-based veterinary services in the downtown area.

Pursuant to this direction, staff prepared Ordinance No. 774, which establishes separate land use categories for veterinary services and animal boarding and permits small-scale veterinary services in the Downtown Core District, subject to defined limitations. The Planning Commission reviewed the proposed ordinance on November 20, 2025, and recommended its adoption.

The ordinance received its first reading on December 17, 2025. At the direction of the City Council, additional clarifying language was incorporated, and the revised ordinance was reintroduced on January 14, 2026, and February 4, 2026, for consideration of adoption.

Following public comment from the SPCA, which is reconsidering locating to Soledad, the Council expressed concern about proceeding with adoption. Ultimately, the Council decided to continue the item to February 18 to fully consider the implications of adoption.

Review & Analysis
The proposed amendments to the Downtown Soledad Specific Plan (DSP) have been presented to the City Council three times, on December 17, 2025, January 14, 2026, and February 4, 2026. These discussions stem directly from prior Council direction to amend the DSP to address service gaps in the community, specifically the lack of access to veterinary services following the closure of Soledad’s only veterinary clinic.

The proposed ordinance focuses solely on veterinary services as a land use category. It does not approve or limit a specific business or operator and would apply equally to any qualifying veterinary service seeking to locate within the downtown area, subject to permit requirements. Currently, veterinary services are prohibited in the Downtown Core District, even though they are conditionally allowed in other DSP districts. Staff evaluated this restriction and determined that limited, small-scale, appointment-based veterinary services, without boarding, kennels, or overnight stays, can be compatible with the Downtown Core and help meet a clear community need as outlined in the Strategic Plan.

To address this gap, Ordinance No. 774 proposes amendments to:

Create separate land use categories for Veterinary Services and Animal Boarding/Day Care; Allow Small-Scale Veterinary Services in the Downtown Core District through a Minor Use Process; and
Maintain the prohibition on animal boarding and higher-intensity animal uses in the Downtown Core.
98 The ordinance has been reviewed by the Planning Commission, which recommended adoption, and has been revised in response to City Council direction to clarify definitions and standards.

Council Action
The City Council is asked to consider one of the following options:

1. Adopt the ordinance as proposed, allowing small-scale veterinary services in the Downtown Core District subject to a Minor Use Permit, which provides administrative review and ensures compliance with development standards.

2. Adopt the ordinance with a more restrictive approval process, requiring a Conditional Use Permit, which would require Planning Commission review and approval, ensuring compliance with development standards.

3. Deny the ordinance and return it to the Planning Commission with direction for further consideration and refinement.

4. Deny the ordinance in its entirety, leaving existing DSP regulations unchanged and continuing the prohibition of veterinary services in the Downtown Core District.

Staff is presenting Ordinance No. 774 and the associated options for Council consideration to provide clear policy direction on how veterinary services should be regulated in Downtown Soledad. This approach reflects the City Council’s prior direction in preparing the ordinance to address service gaps for veterinary care and aligns with the recently adopted Strategic Plan (Goal 6.3.1). The ordinance allows small-scale, appointment-based veterinary services while maintaining compatibility with surrounding uses.

At this time, staff recommends that the City Council adopt Ordinance No. 774 as proposed. The services that would be allowed are highly restricted and would still require a Minor Use Permit (MUP) process. The MUP process is very similar to a CUP and would require notification and include conditions. This will further ensure compatibility in the Downtown. Even if the SPCA chooses to locate elsewhere, another organization offering similar services could establish itself in Downtown, thereby benefiting the residents of Soledad.

Financial Considerations
At this time, all costs associated with processing this item have already been incurred. If the Council decides to modify the Ordinance, additional costs would be incurred for publication of the required notice.

Strategic Plan Alignment
The approval of Ordinance No. 774 aligns with the City Council’s 2025 Strategic Plan by supporting continued progress toward key goals and priorities. This proposed ordinance advances the Economy pillar by updating and implementing the Downtown Specific Plan to better reflect current community growth and needs, guiding future development, investment, and economic vitality through improvements to land use, design, and pedestrian access (Objective 1.3.4). In addition, Ordinance No. 774 supports the Safety pillar by improving local access to spay, neuter, and foster programs, helping expand affordable veterinary and sterilization services for the community (Objective 6.3.1). 99 Ordinance No. 774

Planning/CEQA
The proposed amendments to the Downtown Soledad Specific Plan, including revisions to Section 2.0 – Zones of Chapter 5.0 – Development Code and Chapter 10.0 – Definitions to establish separate veterinary services and animal boarding uses and to conditionally allow small scale veterinary services in the downtown core district, qualify for a categorical exemption under CEQA Guidelines §15303 (New Construction or Conversion of Small Structures) and §15061(b)(3) (No Significant Effect on the Environment). The amendments are limited to text changes that regulate allowable land uses and definitions within existing zones, do not authorize physical construction, and will not result in any significant environmental impacts. Any future development under these provisions will be subject to separate review under CEQA.

ORDINANCE NO. 774

AN ORDINANCE OF CITY COUNCIL OF THE CITY OF SOLEDAD AMENDING THE DOWNTOWN SPECIFIC PLAN SECTION 2.0- ZONES OF CHAPTER 5.0- DEVELOPMENT CODE AND CHAPTER 10.0- DEFINITIONS, TO ESTABLISH

SEPARATE VETERINARY SERVICES AND ANIMAL BOARDING USES AND TO

CONDITIONALLY ALLOW SMALL-SCALE VETERINARY SERVICES IN THE

DOWNTOWN CORE DISTRICT
WHEREAS, the Downtown Soledad Specific Plan (“DSP”) was adopted by the City in 2012 to guide land use, development standards, and design within the Downtown area; and WHEREAS, the DSP establishes five zoning districts and provides flexibility to accommodate a variety of compatible land uses while preserving the long-term vision for a vibrant, balanced, and economically healthy Downtown; and
WHEREAS, the type and extent of permitted uses in each zone are guided by their intended purpose and geographic context of the district, ensuring orderly development while maintaining the character and quality of life in Downtown Soledad; and WHEREAS, it is necessary to periodically review and update the DSP to ensure it continues to support essential services, meets emerging community needs, and enhances the overall vitality and livability of the Downtown area; and WHEREAS, veterinary services are currently prohibited in the Downtown Core (DC) District, while similar services are conditionally permitted in other DSP zones; and WHEREAS, population growth and increased pet ownership have created a need for access to veterinary and wellness services within the Downtown area, while maintaining compatibility with surrounding uses; and
WHEREAS, the proposed amendments to the Downtown Soledad Specific Plan, including revisions to Section 2.0 – Zones of Chapter 5.0 – Development Code and Chapter 10.0 – Definitions, are intended to establish separate veterinary services and animal boarding uses and to conditionally allow small-scale veterinary services in the Downtown Core District; and WHEREAS, allowing small-scale, outpatient veterinary services, including wellness checks and spay/neuter procedures, with limitations on higher-impact operations such as overnight boarding, will help address local service gaps, promote public health and safety, and maintain the character and goals of the Downtown Core District; and
WHEREAS, the proposed amendments will provide a framework to conditionally allow these uses through discretionary review, ensuring that new uses are compatible with existing Downtown land uses and continue to support the City’s vision for a vibrant and balanced Downtown; and
101
WHEREAS, the proposed amendments to the Downtown Soledad Specific Plan are consistent with 2005 the City of Soledad General Plan, including Policy L10, which directs the City to maintain a reasonable balance between employment-generating uses and communityserving land uses; Policy L22, which calls for ensuring adequate commercial land to meet the present and future needs of residents and to sustain economic vitality; and Policy E3, which encourages efforts to attract and retain commercial and office tenants in sectors that are currently undersupplied and for which local demand exists; and
WHEREAS, allowing small-scale veterinary services within the Downtown Core supports these policies by expanding access to essential neighborhood-serving commercial services, addressing an identified community need, enhancing opportunities for economic activity, and strengthening the overall vitality and functionality of the Downtown commercial district; and WHEREAS, the proposed amendments to the Downtown Soledad Specific Plan qualify for a categorical exemption under CEQA Guidelines §15303 and the common-sense exemption under §15061(b)(3), as they consist solely of text changes regulating allowable land uses and definitions, do not authorize any physical construction, and will not result in a significant environmental impact and any future development under these provisions will be subject to separate CEQA review.

SUBJECT: Resolution No. 6329, A Resolution of the City Council of the City of Soledad Considering Adoption of “A Resolution Submitting to the Voters at the General Municipal Election to Be Consolidated With the Statewide General Election Held on Tuesday, June 2, 2026, A Measure That Would Implement A Special Parcel Tax to be Levied on Properties Within the City Based on Land Use to Fund Fire and Emergency Medical Services to be Provided by the City of Soledad.” TO: Honorable Mayor Velazquez and City Council
FROM: Mike Rodriquez, City Attorney
MEETING DATE: February 18, 2026

CITY OF SOLEDAD

STAFF REPORT
THROUGH: Megan Hunter, City Manager
AGENDA ITEM NO. 1.

Recommendation
It is recommended that the City Council of the City of Soledad adopt and consider Resolution No.6329, “A Resolution Submitting to the Voters at the General Municipal Election to Be Consolidated With the Statewide General Election Held on Tuesday, June 2, 2026, A Measure That Would Implement A Special Parcel Tax to be Levied on Properties Within the City Based on Land Use to Fund Fire and Emergency Medical Services to be Provided by the City of Soledad.” Executive Summary
The City of Soledad has had a contract with the California Department of Forestry and Fire Protection (Cal Fire) to staff the Soledad Fire Department since January 2012. In 2025, after over a decade with Cal Fire, the City Council confirmed that contracting with Cal Fire was still the most economical means of providing effective fire and emergency medical services to the City. However, it is anticipated that rising costs for existing and future services, including but not limited to compliance with National Fire Protection Association-recommended staffing of 3 people per shift, creates an immediate need to find a reliable source of funding for the City’s service demands. The Council has identified a parcel tax as the best means of raising revenue to fund ongoing and enhanced (3 person staffing) service needs. As such, Staff has prepared a resolution and ordinance calling for a tax measure to be placed on the ballot of a consolidated election on June 2, 2026, that if approved by a two-thirds vote of individuals voting on the matter, will establish a new annual tax on residential and non-residential parcels of property in the City.

The tax revenues could only be used for fire and emergency medical services and all expenditures would be subject to annual audit and oversite by the Tax Citizen’s Oversight Committee. Adoption of Resolution No. 6329 will initiate a variety of actions that need to be carried out in order to have a measure properly placed before the voters.
116
Background
In the latter part of 2023, after more than a decade of contracting with Cal Fire for fire and emergency medical services, the City Council requested that staff provide a financial analysis of potentially bringing these services back in-house. On January 17, 2024, the City Council determined that even after factoring in significant service cost increases, including costs associated with meeting National Fire Protection Association recommendations for increasing staffing to 3 persons per shift, contracting with Cal Fire was still the most economical means of providing fire and emergency medical services to the City. Nonetheless, due to the uncertainty related to how the City would fund increasing costs, the City and Cal Fire have subsequently only entered into one-year contracts while the City has explored financing options.

Current statistics indicate that the Soledad Fire Department, through its contract with Cal Fire, is responding to over 2000 service calls per year, or 5.7 calls for emergency services every day, with only two people (2-0) on shift. There are many times when the crew must depend on mutual aid due to staffing. As was referenced above, the national industry standard is a three-person shift (3-0) staffing.

Inadequate staffing levels can lower patient survival rates in medical emergencies, put first responder safety at risk, and impede response times for subsequent or simultaneous emergency calls. The urgency of the need for increased staffing is only exacerbated by various housing and economic development projects in the pipeline and the need to properly operate the recently acquired ladder truck. Taking all of these matters into consideration, it is the City’s goal to move from 2-0 to 3-0 staffing.

After reviewing various funding options and engaging in a variety of forms of public outreach to gauge the perceptions and needs of Soledad residents, Staff and the City Council have focused on the concept of a parcel tax as the best means of raising additional revenue for fire and emergency medical services.

In embarking on this effort, the City has looked to the fairly recent adoption of a parcel tax for the same purpose in the neighboring city of Greenfield.

Although the Council recognizes that an additional tax may be difficult to accept in the current financial environment, it appears that the public understands that these services are essential and that existing revenues cannot sustain ongoing costs for fire protection and emergency medical services.

Review & Analysis
Based on the results of surveys and comments received from the public on related informational materials, Staff has now prepared Resolution No. 6329 calling for a local municipal election to be consolidated with the statewide general election on June 2, 2026, at which a ballot measure establishing a new parcel tax in the City of Soledad would be considered by the City’s voters.

Resolution No. 6329, prepared in accordance with relevant provisions of the California Constitution, Government Code and Elections Code, contains a copy of the proposed tax ordinance which would levy a new annual tax on parcels of property in the City at a rate of $233.00/single family unit, $174.00/multi-unit, and $99.00-$134.00 plus $.07 per square foot for non-residential parcels, all adjusted annually. It is estimated that the new parcel tax would provide approximately $1,000,000 in revenue per year. All tax revenues collected by application of the new parcel tax would be used exclusively for 911 emergency medical/fire response, subject to independent audit and City oversight.

The new tax would remain in place until ended by the voters.

In adopting Resolution No. 6329, the City Council would approve the content and form of the proposed parcel tax ordinance and its submission to the voters of the City at the June 2, 2026 consolidated 117
Statewide election. (In placing the ordinance on the ballot, the City does not follow the usual first and second reading process used for council ordinance adoption.) Because the parcel tax is for a single purpose, it is by law considered a special tax and would require the approval of a two-thirds majority of the voters voting on the measure at the election. All tax revenues collected by application of the new parcel tax would be used exclusively for 911 emergency medical/fire response, such as personnel costs incurred in moving from a 2 to 3-person shift schedule, subject to independent audit and City oversight.

The new parcel tax would remain in place until ended by the voters.

Resolution No. 6329 also approves, authorizes and/or directs compliance with a number of other matters related to the proposed election, such as the City Attorney’s preparation of an impartial analysis of the tax measure, identification of the parties authorized to prepare ballot arguments and rebuttals by specified dates and the process for acceptance of the same, and various noticing and publication requirements. Additionally, the resolution contains the language of the official question that will appear on the ballot, prepared in accordance with legal requirements, which reads as follows:

To ensure fire/emergency medical 911 response, including 24-hour staf ing, updated lifesaving equipment/training, and disaster preparedness, shall the City of Soledad's measure, levying an annual parcel tax of $233.00/single family unit, $174.00/multi-unit, $99-$134 plus $.07 per building square foot for non-residential parcels, adjusted annually, providing approximately $1,000,000 per year until ended by voters, with funds dedicated exclusively to reliable 911 emergency medical/fire response and requiring local control/oversight, be adopted?
If the tax measure is approved by thevoters, it would become operative in Fiscal Year 2026-2027 .

Financial Considerations
If the City’s tax measure is successful, the parcel tax could result in up to $1 million in revenue for fire services. Election costs for the measure will be minimized by consolidation with the state primary election in June.

Strategic Plan Alignment
Approval of Resolution No. 6329 aligns with the City Council’s 2025 Strategic Plan by initiating the process for consideration of a proposed parcel tax as a means of maintaining reliable fire and emergency medical services. The resolution will advance the Safety Pillar of the Plan by placing a parcel tax that will raise revenue exclusively for use for fire and emergency service staffing and equipment before the City’s voters at the June 2, 2026, consolidated election. As such, Resolution 6329 supports Safety Pillar Objectives 6.5.1 -Strengthen Fire Services, Staffing, and Emergency Medical Response and 6.6.3- Explore a Local Parcel Tax to Sustain and Strengthen Fire and Emergency Services.

Alternatives
Adopt a resolution calling for a consolidated municipal and state election on June 2, 2026, and placing a measure on the ballot that would implement a special parcel tax to be levied on properties in the City to fund fire and emergency medical services; or Do not adopt the resolution and provide other direction to staff.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SOLEDAD does hereby resolve, declare, determine and order as follows:

SECTION I. RECITALS AND FINDINGS.

1. All of the foregoing recitals are true and correct and are incorporated herein by reference.

2. The Soledad Fire Department (SFD) currently serves the City of Soledad and the Mission-Soledad Fire Protection District’s approximately 24,000 people as first responders for all 911 emergency calls, including fire and emergency medical calls.

3. SFD answers over 2000 calls for service annually, averaging 5.7 calls for emergency services every day. In the last 10 years, service-call volume has increased by 58%.

4. The City has been fortunate to retain a dedicated group of professional firefighters/ Emergency Medical Technicians (EMTs) to protect the community and respond to local 911 calls under urgent circumstances where minutes and seconds really matter, like heart attacks, 121
strokes and car accidents, especially considering the closest emergency room is a half-hour away in Salinas.

5. Despite the City’s prudent and fiscally responsible funding efforts, the SFD faces growing financial challenges that threaten SFD’s ability to continue to provide reliable, effective 911 responses to the community, including the need to meet appropriate staffing levels and provide firefighter/EMTs with safe, modern apparatuses and equipment.

6. Under current fiscal conditions, the City’s fire station and fire engines rely on bare minimum staffing of 2 firefighters, which falls below the national recommended standard of 3 firefighters on duty 24 hours a day. Inadequate staffing levels can lower patient survival rates in medical emergencies, put safety for first responders at risk, and impede response times for the next or simultaneous emergencies.

7. In addition to the aforesaid challenges, the City’s ability to provide timely and efficient fire and emergency medical services is exacerbated by the growing threat of wildfires, floods and other disasters in our region that have the potential to divert resources from local 911 calls.

8. In order to maintain the availability of rapid 911 responses when an emergency occurs, the City needs to establish a reliable source of local funding that will allow the City to achieve national staffing standards.

9. Without additional funding, the SFD won’t be able to improve service and will struggle to maintain its current level of response as costs continue to rise.

10. The City Council is proposing the collection of a parcel tax on properties within the City, levying a tax of $233.00 annually for single-family residential parcels; $174.00 per multifamily unit; and additional rates for commercial, industrial and agricultural parcels, adjusted for inflation. It is estimated that a special parcel tax with these rates would generate approximately $1,000,000 per year.

11. All funds raised by the local parcel tax could only be used for firefighter/EMT staffing, vehicles and equipment including:
 Increase fire department staffing from 2 to 3 personnel, 24 hours a day, to meet recommended national standards for rapid emergency medical and fire 911 response  Improve response times to medical emergencies, car accidents, wildfires, floods and other natural disasters
 Ensure the SFD has up-to-date working equipment and resources to assist in emergency medical situations and fight wildfires
 Replace old or outdated medical equipment, breathing apparatuses, protective clothing and other equipment used by firefighters/EMTs
 Ensure the City’s fire apparatuses are outfitted with important medical incident response equipment and supplies.
122

12. To guarantee that all parcel tax proceeds would be used responsibly, expenditure of such funds would be restricted to costs related to providing fire protection and emergency medical response, would be subject to independent audits and citizens’ committee oversight to confirm funds are spent in accordance with approved uses, and could not be taken by the State or used for any other purpose than fire and emergency services

13. Based on extensive surveying, the City has determined that collection of parcel tax funding for the purpose of maintaining fire and emergency services is considered by the public to be a beneficial and worthwhile endeavor.

SECTION II. CALL FOR ELECTION. PLACEMENT OF MEASURE ON THE BALLOT. Pursuant to California Constitution Article XIIIC, Section 2(d) and Article XIIID, Section 3(2); Government Code Sections 53724, 53970, and 50077(a); Elections Code Section 9222 and Sections 10400 et seq.; and the Soledad Municipal Code, the City Council of the City of Soledad hereby calls an election at which it shall submit to the qualified voters of the City, a question that, if approved, would adopt a parcel tax which would create funding to support ongoing fire and emergency services for the City’s residents. The entire text of the ordinance attached hereto as Exhibit A shall be printed in the voter information portion of the sample ballot. The ordinance specifies that the City will levy a new annual parcel tax of $233.00/single family unit, $174.00/multi-unit, and $99.00-$134.00 plus $.07 per building square foot for non-residential parcels, adjusted annually, providing approximately $1,000,000 per year. All tax revenues collected by application of the new parcel tax would be used exclusively for 911 emergency medical/fire response, subject to independent audit, and subject to the oversight of the City’s Tax Citizen’s Oversight Committee. The new parcel tax would remain in place until ended by the voters.

SECTION IV. BALLOT LANGUAGE. The official ballot to be used at said election shall conform to the laws of the State of California with relation thereto. The proposed parcel tax shall be submitted to the voters on the ballot at the General Municipal Election to be held and consolidated with the Statewide general election on Tuesday, June 2, 2026, in the form of the following question:

To ensure fire/emergency medical 911 response, including improved 24-hour staffing, lifesaving equipment/training, and disaster preparedness, shall the City of Soledad’s measure, levying an annual parcel tax of $233.00/single family unit, $174.00/multi-unit, $99.00-$134.00 plus $.07 per building square foot for non-residential parcels, adjusted annually, providing approximately $1,000,000 per year until ended by voters, with funds 123
dedicated exclusively to reliable 911 emergency medical/fire response and requiring local control/oversight, be adopted?
The words “Yes” and “No” shall be printed on the ballots so the qualified electors may express their choice.

This measure shall be designated by letter by the Monterey County Elections Department.

ARGUMENTS. The City Attorney is hereby authorized to prepare an impartial analysis of the proposed measure. The City Attorney’s impartial analysis of the ballot measure shall not exceed five hundred (500) words in length showing the effect of the measure on the existing law and the operation of the measure. The City Attorney shall transmit such impartial analysis to the City Clerk by the close of business on March 10, 2026. Written arguments in favor or opposed to the measure may be prepared by the City Council, any member or members of the City Council so authorized by Council action, or any individual voter who is eligible to vote on the measure, or any bona fide association of citizens, or any combination of voters and associations. No more than five signatures shall appear on any argument. If more than one argument is submitted for or against the measure, the City Clerk shall select the argument for printing and distribution in accordance with the provisions of Elections Code Section 9287.

Pursuant to Section 9285 of the California Elections Code, when the City Clerk has selected the arguments for and against the measure, which will be printed and distributed to the voters, the City Clerk shall send copies of the argument in favor of the measure to the authors of the argument against, and copies of the argument against to the authors of the argument in favor.

Rebuttal arguments may thereafter be prepared in a length not exceeding two hundred and fifty (250) words and shall be filed with the City Clerk by no later than 5:00 p.m. on March 18, 2026.

Rebuttal arguments shall be printed in the same manner as the direct arguments. Each rebuttal argument shall immediately follow the direct argument which it seeks to rebut.

SECTION VI. CEQA. The City Council finds that under CEQA Guidelines 15060(c) (2) and 15378, subdivisions (2) and (4) of subdivision (b), this tax does not constitute a project under CEQA because it creates a government funding mechanism that does not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment, and therefore, review under CEQA is not required.

SECTION VII. REQUEST TO CONSOLIDATE AND CANVAS RETURNS. The City requests and authorizes the Registrar of Voters to consolidate this election with the established election on June 2, 2026 for the ease and convenience of the registered voters and to take advantage of any cost savings possible by such consolidation. The election on the measure set forth in Section IV shall be held and conducted, the votes canvassed and the returns made, and the results ascertained and determined as provided for herein. The election shall be held in 124
accordance with the Elections Code of the State of California. The Board of Supervisors of the County of Monterey is authorized to canvas the returns of that election with respect to the votes cast in the City of Soledad and to certify the results to the City Council of the City of Soledad.

At the next regular meeting of the City Council occurring after the returns of the election have been canvassed and the certification of the results to the City Council, the City Council shall cause to be entered in its minutes a statement of the results of the election. The City Clerk may request the assistance of the County of Monterey Elections Department in regard to said Consolidated Statewide Primary Election, as the City Clerk deems necessary, and in recognition of the fact that additional costs will be incurred by the County in providing assistance, the City agrees that it shall pay the incurred cost of such assistance pursuant to a “Service Agreement for the Provisions of Election Services between the City of Soledad and the Monterey County Registrar of Voters,” in substantially the form attached hereto as Exhibit B. The City Manager is hereby authorized to enter into or modify any written agreement for such services with the County of Monterey Elections Department.
