The Place to Be Midweek returned for its second year as a Q1 promotion. As the Santa Ynez Valley continued to emerge from the pandemic, hotels, wineries, and restaurants were seeing larger numbers of visitors on weekends, while midweek visitation remained slow. Knowing that many in our target markets of Los Angeles and San Francisco were still working remotely, we expanded our Midweek Membership Club—a promotion that put a spotlight on the benefits of a midweek trip. For the second year of the promotion, we expanded the offering to include $100+ value in credits at participating restaurants, wineries, and activity partners.
Visitors simply had to book a minimum two-night stay, Sunday through Thursday during from January 5 – April 30, 22 to receive a digital passport that offered 5 digital vouchers during their stay. All promotion details, including a complete list of participating lodging properties, restaurants, and wineries, were featured on a branded landing page on the Visit the Santa Ynez Valley website: www.visitsyv.com/midweek/.
Digital channels did the heavy lifting as we promoted the campaign via paid Facebook, Instagram, and Facebook Audience Network. Leveraging the equity of the existing “Place To Be” brand campaign, we incorporated our midweek message as an overarching theme across the 15 13 | P a g e
creative elements. Retargeting ads, served to those who had clicked but not booked, introduced the exclusivity of the Midweek Membership Club.
Integrating public relations was a key element of this campaign as we asked our PR team to pitch the idea to media, as well.
See below for sample ads and stats from the campaign.

We retained 93% of membership for a total of 217 members. 31 THE "PLACE TO BE"
The "Place to Be" campaign was born. This campaign lends itself to exploring the active interests of the Santa Ynez Valley. Through visuals and copy, we craft a story that engages our audience and leads them to explore what makes the Santa Ynez Valley, “The Place To Be.” This campaign allows us to focus more on human connection, which we feel is more important than ever today. 32 A CONTENT-FORWARD APPROACH
Content-forward paid ads promote website content under the umbrella of our annual campaign, and provide a deeper look into the Santa Ynez Valley experience, acting as inspiration and education. The content pulls from existing stories on the website, as well as timely and seasonal articles and videos. This campaign also allows us to focus more deeply on the people that make the SYV so special. 33 Visit the Santa Ynez Valley's 2022 marketing strategy builds on the following strategic objectives:
• Transition from pandemic-centric messaging to forward looking messaging which casts a wider net
• Continue to focus on increasing occupancy, particularly Mon.-Thur. nights, year-round
• Continue to build awareness and positive perception of the region among highly qualified potential visitors
• Drive market focus:

With that in mind, the 2022 Visit the Santa Ynez Valley digital strategy consists of:

Over the course of 10+ years, the promotion has developed a strong following, with residents and drive market visitors treating the 2-week promotion as a major celebration . This year’s promotion featured 3 course menus for $30, $40 and $50 from 20 restaurants and two-for-one tastings and bottle discounts at 18 wineries. 38 CAMPAIGN
THE PLACE TO BE MIDWEEK - 2022
The Place to Be Midweek returned in 2022 as a Q1 promotion. As we continued to emerge from the pandemic, hotels, wineries, and restaurants were seeing larger numbers of visitors on weekends, while midweek visitation remained slow.
Knowing that many in our target markets of Los Angeles and San Francisco were still working remotely, we expanded our Midweek Membership Club —a promotion that put a spotlight on the benefits of a midweek trip.
The 2022 offering included $100+ value in credits at participating restaurants, wineries, and activity partners. "WE REALLY ENJOYED THE 2 DA

76 CITY COUNCIL STAFF REPORT
AGENDA ITEM 4.d
Meeting Date: May 8, 2023
SUBJECT: Approve Amendment 5 to the Agreement with Mintier Harnish LP to complete the General Plan Update process and include analysis of a conceptual development of the 5.5-acre property at the northwest corner of Alamo Pintado and Old Mission Drive known as Site C, for the additional amount not to exceed $164,102.49 and to extend the term to June 30, 2024, and Authorize the Mayor to execute on behalf of the City.
PREPARED BY: Rodger A. Olds – Public Works Director/City Engineer DISCUSSION:
The General Plan is a vision for how the City of Solvang will grow, reflecting community priorities and values while shaping the future – a long-term framework for future growth and development. The General Plan also contains the goals and policies upon which the City Council and Planning Commission will base their land use decisions. There are nine mandatory elements: Land Use, Circulation, Housing, Conservation, Open Space, Noise, Safety, Environmental Justice, and Air Quality.
Solvang has chosen to include two optional elements: Community Design and Economic Development.
Over the last two years, Mintier Harnish has been working with the City of Solvang to update all the elements of the City of Solvang General Plan. The original contract with Mintier Harnish was approved on November 16, 2020 in the amount of $598,602.00. Since then, there have been four amendments to the contract. These contract amendments have totaled an additional $120,995 to the original contract. These amendments are as follows:
ITEM DATE DECRIPTION AMOUNT
Original Contract Nov. 16, 2020 General Plan Update $ 598,602.00 Amendment 1 May, 24, 2021 Added scope to include GPAC and Spanish Translation $ 23,800.00
Amendment 2 July 12, 2021 Added Housing Element to Scope $ 74,960.00 Amendment 3 July 27, 2022 Time Extension to June 30, 2023 $ 0.00 Amendment 4 Nov. 16, 2022 Added scope to analyze “Old Lumber Yard Property” Development $ 22,235.00
Total Current Contract Amount $ 719,597.00
The Proposed Amendment 5 will extend the contract until June 30, 2024 and increase the contract by $164,102.49. This amount is broken down as follows, and discussed below:
CONTRACT ITEM AMOUNT
Held Charges $ 27,572.50
Policy Document Edits $ 8,500.00
Additional Environmental Requirements $ 35,865.00
Additional Housing Element Costs $ 58,380.00
Project Management & Expenses $ 23,600.00
Additional EIR Analysis – Site C $ 24,532.00
Contingency $ 10,000.00
Contract Cost Savings ($ 24,347.01)
Total Proposed Amendment 5 $ 164,102.49
77 Held Charges
There has been on-going work for the past year and a half that was either in excess of the original agreed upon work or was additional work requested by staff. Some examples of this work were the attendance of consultant staff at GPAC meetings, additional GPAC and public meetings,
Previous staff had agreed to track these charges and work these charges into a future change order to the contract. Mintier Harnish has provided a narrative description and breakdown of these additional charges. While the current project team is unable to absolutely confirm all of these additional work items, the documentation provided appears to be consistent with the work to date. Mintier Harnish has reduced some of “held charges” based on internal inefficiencies that were not caused by requested additional work by the City; however, they are requesting payment for the balance of the remainder charges in the amount of $27,572.50.
Policy Document Edits
Mintier Harnish is asking for an additional $8,500.00 to complete the most recent round of edits from City staff, GPAC, Planning Commission, and City Council. The original scope allowed for one round of edits based on City staff comments and one round of edits based on GPAC comments.
Additional Environmental Requirements
Due to City Staff limitations, the environmental sub-consultant Rincon who is working for Mintier Harnish has been asked to coordinate the tribal outreach as part of the EIR as required by SB18 and AB 52. Some larger organizations perform this task with city planning staff, which is why this item is out of the original scope. The requested amount for this additional work is $32,865.00. Staff feels that this proposed amount is conservative and if approved to be added into the contract, will be monitored closely in an effort to control costs. Staff has requested the environmental consultant to attend the GPAC meetings to address the draft review of the EIR and other concerns. The anticipated cost for this attendance is $3,000.00.
Additional Housing Element Costs
The effort to complete the Housing Element of the general plan was greater than anticipated. In additional to multiple changes to the development of the document mid-process by previous staff, and a full staff change to the project team during the final effort to this element, there was a robust public involvement which required a greater than anticipated effort to respond to the comments while simultaneously bringing the new project team and public commissions up to speed on the current status of the process and document. The Housing Element was submitted to HCD before February 15th as planned, however the current budget in the contract for the Housing Element has been exhausted. Staff asked Mintier Harnish to provide a conservative estimate to complete the Housing Element based on the level of scrutiny that has been seen recently from HCD by other jurisdictions as well as the anticipated effort to address local public comments and include the various City review committees. The proposed budget received by Mintier Harnish is $58,380.00. Similar to the additional environmental scope, staff feels that this is a worst-case number, and will work to control these costs as much as possible moving forward.
Project Management
Other additional costs proposed such as Project management for the next 12 months due to the project schedule being extended. The estimated rate of $1,500 per month for a total of $18,000 for the next 12 months is based on the past level of work on the General Plan Update. Mintier Harnish is also requesting an additional $5,600 to cover potential travel expenses in order to cover to cost to attend future meetings in person. These meetings could be the GPAC, Planning Commission, City Council, or other public workshop type meeting should they be necessary. Since the new project team has begun to manage the project, we have limited the consultant attendance to virtual attendance in an effort to reduce costs to the project. This is anticipated to continue however the inclusion of this additional budgetary amount will allow in-person meeting should they become necessary. 78 Additional EIR Analysis – Site C
The owner of Site C, the 5.5-acre property located at the northwest corner of Alamo Pintado Road and Old Mission Drive has contacted the City and ask for a preliminary site plan for the development o the property to be included in the EIR. Staff received a proposal for this additional work from Mintier Harnish in the amount of $24,532.00. The cost for this additional work will be borne by the owner of the property. Staff will issue a notice to proceed for this additional work once the funds to cover this additional work have been received by the City,
Contract Cost Savings.
There is available budget remaining in the contract that is anticipated to remain unutilized as the work scope item has been completed. This includes the estimated budget for the initial public outreach and plan development as well as the Spanish translation task, which was added as part of Amendment 1.
The total available contract cost savings amount to $24,347.01.
Contingency
Staff has requested to add a contingency to the approved contract total to allow for additional work or other unanticipated items while out of the project scope but would be necessary to compete the project.
Therefor a contingency of $10,000 has been added to the proposed contract amendment.
ALTERNATIVES:
Council could choose to not approve all or part of Contract Amendment 5. If the Council decides to not approve Contract Amendment 5, there would likely be a delay in completing the General Plan Update.
FISCAL IMPACT:
The fiscal impact would be the encumbrance of an additional $139,570.49 from the General fund for the General Plan Update Contract and allow for the expenditure in the amount of an additional $24,532.00 to be deposited with the City by a private developer.

81 CITY COUNCIL STAFF REPORT
AGENDA ITEM 6.b
Meeting Date: May 8, 2023
SUBJECT: Discussion and possible action to receive Planning Commissioner Rodriguez’s resignation and provide direction to Staff regarding Councilmember Brown’s appointment to the Planning Commission PREPARED BY: Sophia Checa, Planning Manager
DISCUSSION:
Planning Commissioner Justin Rodriguez resigned from his position on April 19, 2023. He was appointed by Councilmember Brown at the January 23, 2023 City Council meeting.
Pursuant to Section 2-1-2(C) of the Solvang Municipal Code, “Vacancies shall be filled in the same manner as set forth in subsection A of this section by appointment by the city council member making the original appointment for the unexpired portion of the term.” Subsection A states, “Each city council member shall appoint one planning commissioner, subject to the ratification of the city council.” Planning Commissioners serve two-year terms, ending December 31, pursuant to Section 2-1-2(A) of the Solvang Municipal Code. The term for this position ends December 31, 2024, meaning whoever fills the seat will serve through December 31, 2024. To serve on the Planning Commission, members must be legal residents within the city at the time of their appointment and during their tenure in office. pursuant to Section 2-1-2(B) of the Solvang Municipal Code City Council direction is needed regarding the process for filling the vacancy. The process can be (a) selecting the new Planning Commissioner from the people who applied to join the Planning Commission in January or (b) opening the application for additional applicants:
(a) Eight people applied to be appointed to the Planning Commission in January. Three were not appointed: Denise El Amin, Scott Gold, and Jennifer Dryden Hess. All three are interested in serving on the Planning Commission. Currently, Denise El Amin and Scott Gold do not fill a committee seat. Jennifer Dryden Hess serves on the Design Review Committee (DRC) and would vacate her seat should she be selected for the Planning Commission vacancy. (b) Staff would open the same process utilized for nominations in January. Applications would be open through Friday, June 9th. We’d do outreach such as posting on Facebook and the website and make announcements at the City Council, DRC, and Planning Commission Meetings.
Applications will be brought back to the City Council at their meeting on June 26th, which would allow the vacancy to be filled for the July 3rd Planning Commission Meeting. Staff recommends including the three applicants received from January rather than requiring them to fill out the application again. Applicants can choose to fill out the application again.

The City has retained Francisco & Associates to prepare the annual Engineer’s Report for the Solvang Mesa LLMD. The Engineer’s Report outlines the estimated LLMD operations and maintenance budget for the 169-lot single-family residential subdivision, establishes the boundaries of the District, determines the method for spreading the annual maintenance costs to each single-family residential parcel, and determines the maximum annual assessment that can be levied on each parcel.
The attached Resolution fulfills the first three steps in the annual assessment process.
1. It initiates the Engineer’s Report,
2. approves the Preliminary Engineer’s Report
3. sets the date for the public hearing on the levy of the proposed assessment.
The public hearing will be held on May 22, 2023. After the public hearing the assessments will be set, and the Final Assessor’s Roll will be prepared and filed with the Santa Barbara County Auditor’s Office to be included in the subsequent tax roll. The Final Assessor’s Roll will be included in the Fiscal Year 2023-24 tax roll.
Since the formation of the LLMD in 2004, there have been six years, including last year, in which the assessment remained unchanged, and one year in which the assessment was reduced slightly. During the other years the assessment was increased as necessary based on increases in the cost of services, and to maintain adequate reserves. Last year, staff recommended no increase in the assessed amount for FY 22-23 in light of continued and uncertain rising cost of living. A modest increase of 5-percent in the assessment is recommended for FY 23-24 in order to keep pace with increased costs for services and utilities while keeping the reserves in good financial standing. This increase will result in the annual assessment of $1,360.80 per parcel.
At the close of FY 2022-23 the total reserves for the LLMD are projected to be approximately $400,149.04 and this figure less administrative fees, was used to develop the Preliminary Engineer’s Report. It is estimated that $229,975.20 will be adequate to maintain the lighting, landscaping, and open space areas; however, it is not adequate to cover all potential costs to the LLMD if incidental costs are included. A small reduction in the accumulation of reserves for FY 23-24 is expected. In order to counteract this in future years it is anticipated that the assessment will need to be increased again next year.
The number of single family residential (SFR) parcels included in the Final Maps for Phases 1, 2, 3 and 4 are 38, 46, 39 and 46 respectively. Each of the 169 SFR parcels benefit equally from the landscaping and street lighting improvements, and a portion of the entryway and detention basin improvements.
Therefore, it is proposed that the $229,925.20 in assessment revenue needed to operate, maintain and 91 service the landscaping and lighting improvements be spread equally among the 169 SFR parcels, or $1,360.80 per parcel.
A nominal increase of 5-percent of the annual costs for the maintenance costs was assumed in the preparation of the engineer’s report. Assuming this increase is realized due to increased water rates and required maintenance, a small reduction in the accumulation of reserves for FY 23-24 is expected.
A proposed capital project to install two additional streetlights on Skytt Mesa Drive has been designed by PG&E and is anticipated to be under construction by the end of the summer.
ALTERNATIVES:
The City of Solvang could choose to not increase the assessment for FY 23-24 or increase the assessment for FY 23-24 by a greater amount to cover the full estimated maintenance cost and incidental costs in order to eliminate potential operational costs impacts to the reserve funds for the LLMD.
FISCAL IMPACT:
There is no fiscal impact to the City. The Solvang (Skytt) Mesa LLMD will fund the annual operation and maintenance of the landscaping and lighting improvements, which have now been fully constructed for the Development as outlined in the conditions of approval for the project. The assessment District will be funded through the levy of a special assessment, collected on the Santa Barbara County’s property tax rolls for the 169 lots of the subdivision as outlined in the required Engineer’s Report.

96 SOLVANG MESA LANDSCAPE & LIGHTING SECTION I
MAINTENANCE DISTRICT No. 2004-1 INTRODUCTION
1 SECTION I
INTRODUCTION
As required by the Landscape & Lighting Act of 1972, this Engineer’s Report describes the improvements which can be constructed, operated, maintained, and serviced by the District, provides an estimate of cost for Fiscal Year 2023-24, lists the maximum assessments that can be levied upon each assessable lot or parcel of land within the District and lists the Fiscal Year 2023-24 assessments that are to be levied upon each assessable lot or parcel of land within the District.
In addition to complying with the provisions of the Landscape & Lighting Act of 1972, the Solvang City Council complied with the provisions of Proposition 218 which was approved by the California voters on November 5, 1996. Proposition 218, entitled “Right to Vote on Taxes Act”, added Articles XIIIC and XIIID to the California Constitution. This Proposition established new procedural requirements for the formation and administration of assessment districts. In order to comply with these requirements, the City of Solvang implemented the following procedures:
1. Every property owner subject to the proposed assessment was mailed a ballot allowing the property owner to vote on whether to form and levy assessments within the District. The ballots were accompanied by a public notice describing the total assessment, the individual property owner’s assessment, the reason for the assessment, and the general basis upon which the assessment was calculated.
2. The Solvang City Council held a Public Hearing on November 8, 2004 to provide an opportunity for any interested person to be heard. After the close of the public input portion of the public hearing, the City Council directed City staff to tabulate the assessment ballots. All the ballots received were in favor of forming the assessment district. The City Council subsequently adopted a resolution forming the assessment district and authorizing the levy of assessments. 97 SOLVANG MESA LANDSCAPE & LIGHTING SECTION II

DISTRICT INFORMATION
Total No. of Proposed Assessable Single Family Parcels 169 Maximum Assessment per Proposed Single Family Parcel 2 $3,259.00 Fiscal Year 2023-24 Collection per Proposed Single Family Parcel $1,360.80 NOTES:
(1) Recommended minimum reserve amount is $332,992 (Operating and Capital). Operating reserves are needed for future fiscal years because the City does not receive assessment revenue from the County until January, therefore it's necessary to have an operating reserve fund to cover 6 months of cashflow from July 1 through December 31 each fiscal year. Therefore, for Fiscal Year 2023-24, $119,690 is needed for operating reserves [($222,180+$17,200) x 0.50 = $119,690].
In addition, Capital reserves are used to replace capital facilities in the event of failure, damage, vandalism or when they reach their useful life expectancy. The estimated cost to replace the capital facilities in Fiscal Year 2023-24 dollars is $853,207. Since it is unlikely that all capital facilities will need to be replaced in the same year it is estimated that at least 25% of the replacement cost, or at minimum $213,302 be budgeted and available for capital reserves. (2) The maximum assessment per parcel may increase 5% each fiscal year.

MAINTENANCE DISTRICT No. 2004-1 PART D
10 PART D
METHOD OF APPORTIONMENT OF ASSESSMENT
GENERAL
Part 2 of Division 15 of the Streets and Highways Code, the Landscaping and Lighting Act of 1972, permits the establishment of assessment districts by Agencies for the purpose of providing certain public improvements, which include the operation, maintenance and servicing of landscaping and lighting improvements.
Section 22573 of the Landscape and Lighting Act of 1972 requires that maintenance assessments must be levied according to special benefit, rather than according to assessed value. This Section states:
“The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefit to be received by each such lot or parcel from the improvements.
The determination of whether a lot or parcel will benefit from the improvements shall be made pursuant to the Improvement Act of 1911 (Division 7 (commencing with Section 50000)) [of the Streets and Highways Code, State of California].”
In addition, Article XIIID, Section 4(a) of the California Constitution limits the amount of any assessment to the proportional special benefit conferred on the property.
The Act permits the designation of zones of benefit within any individual assessment district if “by reasons or variations in the nature, location, and extent of the improvements, the various areas will receive different degrees of benefit from the improvement” (Sec. 22574). Thus, the 1972 Act requires the levy of a true “assessment” rather than a “special tax”.
Article XIIID provided that publicly owned properties must be assessed unless there is clear and convincing evidence that those properties receive no special benefit from the assessment. Exempted from the assessment would be the areas of public streets, public avenues, public lanes, public roads, public drives, public courts, public alleys, public easements and rights-of-ways, public greenbelts and public parkways, and that portion of public property that is not developed and used for business purposes similar to private commercial, industrial, and institutional activities. 106
SOLVANG MESA LANDSCAPE & LIGHTING SECTION II
MAINTENANCE DISTRICT No. 2004-1 PART D
11 LANDSCAPING/OPEN SPACE BENEFIT DETERMINATION
Trees, landscaping, hardscaping, open space, and appurtenant facilities, if well maintained, provide beautification, shade, and enhancement of the desirability of the properties within the boundaries of the District. In Parkways and Land Values, written by John Nolan and Henry V. Hubbard, it is stated:
"... there is no lack of opinion, based on general principles and experience and common sense, that parkways do in fact add value to property, even though the amount cannot be determined exactly. Indeed, in most cases where public money has been spent for parkways, the assumption has been definitely made that the proposed parkway will show a provable financial profit to the City. It has been believed that the establishment of parkways causes a rise in real estate values throughout the City, or in parts of the City,..."
It should be noted that the definition of "parkways" above may include the roadway as well as the landscaping alongside the roadway. One hundred percent of the benefits resulting from the landscape and open space improvements are a direct and special benefit to the properties within the District. Therefore, there are no general benefits and 100% of the annual cost to operate and maintain the landscape and open space improvements is assessed to the properties within the boundaries of the District.
STREET LIGHTING BENEFIT DETERMINATION
The proper functioning of street lighting is imperative for the welfare and safety of the property owners throughout the District. The annual operation, maintenance and servicing of the District’s street lighting system benefits the properties within the District by providing increased illumination for ingress and egress, safe traveling at night, improved security, and protection of property. One hundred percent of the benefits resulting from the street lighting improvements are a direct and special benefit to the properties within the District. Therefore, there are no general benefits and 100% of the annual cost to operate and maintain the street lighting improvements is assessed to the properties within the boundaries of the District.
GENERAL & SPECIAL BENEFIT
There are no General Benefits associated with street lighting, landscaping, and open space improvements within the Solvang Mesa Landscape & Lighting District. All the street lighting, landscaping and open space improvements directly benefit and are a special benefit to the properties within the Solvang Mesa Landscape & Lighting District. 107
SOLVANG MESA LANDSCAPE & LIGHTING SECTION II
MAINTENANCE DISTRICT No. 2004-1 PART D
12 ASSESSMENT METHODOLOGY
Each single-family residential parcel will benefit equally from the construction, operation, maintenance and servicing of the landscaping and street lighting improvements.
Therefore, the total assessment revenue needed to construct, operate, maintain and service the landscaping and street lighting improvements will be spread equally to each proposed single family residential parcel.
Phase I through IV landscaping and street lighting improvements and the entire development’s (Phase I through IV) entryway and detention basin improvements have been completed and turned over to the City for annual maintenance. Each of the 169 single-family residential parcels located in Phases I thru IV will benefit from the landscaping and street lighting improvements and their pro-rata share of the entryway and detention basin improvements. Therefore, it is proposed that $229,975.20 in assessment revenue is needed from the 169 single-family residential parcels located in the District, or $1,360.80 per parcel to cover these costs. 108
